abc news in new york. >> this is america for this morning. >> a very good friday morning, everyone. i'm lionel moise. >> good morning to you. i'm morgan norwood. rhiannon and andrew are off. we begin with today's travel rush before july 4th. the tsa says more than 17 million people are expected to fly between now and the middle of the week. today, the busiest of them all. >> but severe weather is adding to the headaches. this storm flooding streets in denver and dropping heavy amounts of hail. >> meanwhile, the extreme heat has become even more deadly in texas. but we begin with that holiday travel rush getting underway with the scare for passengers in california. the holiday travel rush starting with a scare in southern california, came in for landing, struck a bird, leaving behind a big dent in the nose cone of this aircraft. >> it also you could see some carnage on the windshield there

as well. >> the southwest jet colliding with the bird before landing in burbank from las vegas. no one was hurt, but the airline was forced to pull the plane out of service. it's just the latest hiccup during a stressful week for travelers with more than 600 flights canceled thursday alone and more than 7000 canceled since saturday. passengers are on edge with bags piling up at airports. some people stranded for days. and the tsa says today will be its busiest of the holiday weekend. >> we're staffed and prepared while airlines are mostly back to normal after storms and staffing issues led to cancellations earlier this week . >> united airlines is not the airline canceling more than 400 flights thursday, far more than any other airline. earlier this week, united's ceo blaming the faa for staffing issues it says caused the delays. the transportation secretary tells abc news it's not that simple. >> united airlines seems to have some issues that are specific to their airline. and i want to emphasize that staffing issues at air traffic control are not

the main driver of delays and cancellations in our system. >> as for united, the company says more cancellation actions could be on the way as it closely watches the weather in chicago and denver, where storm covered the area in grill delaying the start of the rockies dodgers game. and while this rockies player may have enjoyed it, the storm system flooded streets and created dangerous driving conditions. parts of the midwest have also been battered by severe storms that brought winds of more than 80 miles an hour to illinois, leveling trees. more than 150,000 people were without power there overnight and another 200,000 in indiana. those storms blowing away, that harmful smoke from the canada wildfires, the eastern part of the country, not as lucky. these were the skylines in new york and philadelphia, where air quality alerts are in effect today. detroit and washington, d.c. also are blanketed with haze. the two cities at one point having the worst air quality in the world. the air quality index much higher. the smoke also delayed a baseball

game in pittsburgh. pirates player andrew mccutchen wore a mask for part of the game. he and other players questioning whether the game should have been played at all. and there is also suffering in the south, where a heat wave has gripped more than a dozen states. in texas, at least 13 deaths have been blamed on the scorching weather so far. and with the heat index expected to reach above 110 degrees in certain areas throughout the weekend, officials warning people to stay cool and stay hydrated. meanwhile severe storms could impact the ohio and tennessee valleys today. we'll take a closer look at the forecast coming up in minutes. >> the other big story we're following this morning, the expected impact of the supreme court's affirmative action ruling beyond higher education. let's get right over to abc's justin finch, joining us with those details. justin good morning. >> lionel good morning. president biden had strong words for that decision saying this is not a normal court. the landmark ruling by the supreme court effectively ending affirmative action could have consequences

far beyond higher education. president biden last night saying the court went too far right, adding the court has become not just conservative, but it's like a throwback. earlier a reporter asked biden if the supreme court is a rogue court. is this a rogue court? >> this is not a normal court in a 6 to 3 decision, the court's conservative justices declared the admissions policies at the two schools at the center of the case, harvard and the university of north carolina, violate the constitution's guarantee of equal protection of the laws. >> just as clarence thomas, who acknowledges benefiting from affirmative action himself, writing while i am painfully aware of the social and economic ravages which have befallen my race and all who suffer discrimination, i hold out enduring hope that this country will live up to its principles that all men are created equal, are equal citizens, and must be

treated equally under the law. just as ketanji brown jackson firing back, riding with let them eat cake obliviousness today the majority pulls the rip cord and announces colorblindness for all by legal fiat. but deeming race irrelevant in law does not make it so in life. nine states already prohibit any considered version of race in admissions to their public colleges and universities by the end of affirmative action in higher education in california, michigan, washington state and elsewhere led to a steep drop in minority enrollment at leading public universities. now how the decision could send a ripple effect for hiring practices at corporations. the executive director of a right wing advocacy group saying the decision will put the wind in the sails of the groups like ours who want to get the woke racially based hiring and promotion schemes out of corporate america. >> its reasoning is a roadmap for challenges to diversity

equity and inclusion initiatives at so many corporations and conservative activists, they are already targeting the hiring programs internship programs and promotions at major employers like morgan stanley, mcdonald's and starbucks. >> meanwhile, the front runner for the republican presidential nomination, donald trump, saying the decision marked a great day for america as presidents of many colleges issue statements affirming their commitment to diverse city. regardless of the court's decision. and president biden is instructing the education department to quickly help colleges and universities to find new ways to build diverse student bodies without using race as a factor. lionel >> all right, justin, thank you. well the suspect named in a january sixth related lawsuit has been arrested near the washington, dc, home of former president barack obama. >> sources say taylor toronto, had guns and ammunition in his car, but never got past any checkpoints. he's named in a

civil lawsuit brought by the widow of a d.c. officer who died by suicide after january 6th. in court filings, toronto admitted to being inside the capitol, but denied any wrongdoing. >> fires, arrests and overall chaos marking the third night of rioting in france following a deadly police shooting there. cars were set on fire as protesters clashed with officers 40,000 are set to be deployed. the protests were sparked by the police shooting of a 17 year old during a traffic stop. >> we turn now to the emotional day in court in florida, where a former deputy was acquitted on all charges. he was accused of failing to act during the 2018 shooting at marjory stoneman douglas high school. abc's jacqueline lee has reaction from family members who are frustrated by the verdict. >> we the jury find as follows. as to the defendant in this case , the defendant is not guilty. the verdict is in. >> scott peterson, the former sheriff's deputy and school resource officer charged for allegedly failing to confront the parkland school shooter in

february 2018, was found not guilty on all counts. >> defendant is not guilty. >> peterson, sobbing, hugging his defense team as the verdict was read, some of the family members of the victims looking on in the fort lauderdale courtroom, shaking their heads. >> i got my life back. we got our life. we got our life back. that's a four and a half years. and being able to put the truth out of what happened. >> peterson was charged with 11 counts, including felony child neglect and culpable negligence. if found guilty, he was facing up to 95 years in prison. the mother of 35 year old teacher scott biegel, killed during the shooting and had this reaction to the verdict. >> and i do believe he did nothing. and i think that was wrong. you know, he may not have been found legally responsible, but he is morally responsible for my son's death. okay. had he done something, anything that murderer would have never gotten to the third floor at and i would be able to be speaking to

my son. okay. not visiting him at the crypt. >> 60 year old peterson was fired from his job and criminally charged after an internal investigation found that he retreated while students were under attack. 14 students and three staff members were killed. peterson says he hopes he can talk to victims families if they need to really know the truth of what occurred and not only my actions, but what occurred, i'm there for them. >> i have nothing to say to him whatsoever. i am not going to speak to him and absolve him of his moral guilt. no way. >> peterson is the first law enforcement officer ever to be charged for failing to act during a school shooting. peterson's defense, arguing he didn't hear the gunshots. jacqueline lee, abc news, new york. >> all right, jacqueline, thank you. time now for a look at your morning weather. >> good morning. the heat is on once again in the south. the core of the heat into this weekend shift shifting a bit to

the east. we'll have heat related illness possibilities. so be careful there. meantime, today and tonight, another round of severe weather from the plains all the way to the midwest and ohio valley. gusty winds could get up to 90 miles an hour. areas of smoke and haze still likely through today across the northeast. that will improve this weekend. and the weather won't, though. lots of storms this weekend in the east. i'm accuweather meteorologist kevin corcoran. >> coming up the major change for overstock. >> also ahead the historic report on reparations. everything from apologies to cash payments for descendants of slaves. we'll tell you what that panel recommends. >> and a grand jury explains why rapper travis scott will not be charged over the deadly crowd

hometown rapper travis scott will not face charges in 2021. >> deadly incident at a houston concert. a houston grand jury opted not to indict scott and five other people in the tragedy that left ten people dead. scott and the other defendants face state and federal probes over safety measures at the astroworld concert. one investigator emphasized that the incident was not a stampede. >> now to california, where the first in nation reparations task force released its final report. and the task force says it's time for california to pay its, quote, crime bill. abc's andrea fujii has the details. >> what do we want? win >> on the same day the us supreme court struck down affirmative action, california has finalized its report on reparations for black residents. >> why aren't our accomplishments as black america as recognized and american history? >> the nearly 1100 page report two years in the making. the

study details what it describes as ongoing and compounding harms experienced by african americans as a result of slavery and its lingering effects on american society today. the report lists over 100 recommendations on how black californians can be made whole, including the state formally apologizing, returned property unjustly seized from black residents and over policing and mass incarceration and wellness centers. in historically black neighborhoods. though the report recommends the legislature determine a dollar amount, the task force experts estimate each eligible black californian could receive up to $1.2 million, cost the state 800 billion, nearly three times its yearly budget. >> it's not a handout. it is not charity. it is what was promised , what was owed and what is long overdue. >> this is not a done deal. the recommendations must be approved by the california legislature and signed by governor gavin newsom. some task force members
