>> this is america. this morning. >> good wednesday morning, everyone. i'm andrew dymburt. >> happy wednesday. i'm rhiannon ally. we want to begin with former president trump speaking overnight after getting a so-called target letter from special counsel jack smith. >> the letter is a strong indication that he'll be indicted again. this time on charges related to efforts to overturn the 2020 election. in former president trump is now responding to a potential third indictment, telling a crowd in iowa last night that he's becoming an expert in subpoenas. i have no choice because we have to. sources say special counsel jack smith notified trump late sunday that he's a target of the investigation into events surrounding the january sixth attack on the capitol. sources say the target letter mentions three federal statutes conspiracy to commit offense or to defraud the united states. deprivation of rights under color of law and tampering with a witness victim or informant. in a statement, trump acknowledged a target letter is a clear indication an indictment

is likely to come soon, possibly within days, he responded. during a town hall on fox news. i bothers me. >> i don't think they've ever sent a letter on sunday night and they're in a rush because they want to interfere. it's interference with the election. it's election interference. never been done like this in the history of our country, and it's a disgrace. >> trump said prosecutors gave him until tomorrow to testify before the grand jury. sources say he's unlikely to accept the offer, adding the letter came as a shock to trump's team. >> trump's top advisers, including his lawyers, had told him that they expected that jack smith, that the special counsel would issue a final report and not an indictment in fact, when this target letter came in late sunday, they didn't even have a legal team, a full legal team in place. florida governor ron desantis, trump's closest rival in the republican primary, says another indictment of trump would not be good for the country. >> i want to focus on looking forward. i don't want to look back. i do not want to see him. i hope he doesn't get charged. >> smith's investigation is also looking into trump and his

allies alleged efforts to overturn election results in several states, including georgia, arizona, wisconsin, nevada and michigan. the michigan attorney general charged 16 people yesterday, accusing them of acting as fake electors, submitting false certificates after the 2020 election, claiming trump had won the state. the district attorney in fulton county, georgia, is also leading an investigation, a decision in that case is expected next month. >> we are learning more about the american soldier detained in north korea after dashing across the border. the pentagon says 23 year old travis king willfully entered north korea. officials say he was supposed to fly back to the us after being held on assault charges in south korea, but he left the airport and joined a tour of the border region. king was reportedly accused last year of attacking someone at a club and vandalizing a police car. abc's ian pannell tells us efforts to secure his release are now underway. >> well, king level communication has already begun with key allies like sweden and

south korea. but clearly it's going to be complex with tensions so high. meanwhile, abc news just speaking with travis king's mother, who says simply she just wants her son home. >> those heightened tensions include north korea launching more missiles and the us recently deploying a nuclear armed submarine to the region. travis king's mother told us she is shocked that her son would do something like this. she says he had no history of mental illness . his 75 million americans are under heat alerts again today. >> phenix, phenix is expecting its 20th consecutive day with temperatures topping 110 degrees. that's a record. one e.r. doctor says his hospital is seeing a pandemic level number of patients due to the heat. in las vegas. delta is investigating why one of its planes sat on the runway in triple digit heat with no air conditioning. our affiliate reports the plane was on the runway for four hours and some passengers had to be given oxygen. some passed out before being wheeled off the plane. the flight to atlanta was canceled nearly 900 wildfires are now

burning all across canada. >> british columbia has lost a record amount of land to the flames and there are still months to go in fire season. historically dry and hot conditions are also plaguing parts of europe caused by the so-called heat domes that you see. large areas of high pressure, signs of a changing climate back in this country. >> new allegations of inhumane treatment along the southern border. a state trooper in texas claims officers were ordered to push migrant children back into the rio grande and even deny migrants water in the extreme heat. abc's em nguyen has more on the accusations and the fallout. good morning. >> good morning, andrew. yeah, that texas state trooper who's also a medic, is blowing the whistle on tactics used at the southern border. and now state authorities are responding this morning. abc news has obtained emails sent from a texas state trooper to his superior, describing, quote, inhumane policies on the border, saying troopers were told to deny migrants water and were even

told to push children back into the river. the troopers saying we decided this was not the correct thing to do with the very real potential of exhausted people drowning. >> it's hard for me to imagine in a texas law enforcement member thinking that those things were okay. but if it was true and if it did happen, then heads need to roll. that's inhumane. >> in response, the texas department of public safety issued a statement saying the troopers are the ones who perform rescues while trying to stop migrants from placing themselves in harm's way. the trooper also raised concern about the risk posed by newly installed razor wire, providing pictures of serious injuries suffered by migrants and describing a pregnant woman who got stuck in the wire and experienced a miscarriage. texas governor greg abbott's office responding, saying texas is deploying every tool and strategy to deter and repel illegal crossings between ports of entry. critics question if that strategy is going too far. >> we know hear from this email

that we have a medic within the department of public safety that had a crisis of conscience that said, we are treating these people in a in a horrible, inhumane way. >> meanwhile, the latest data from homeland security shows a 30% decrease in migrant encounters at the southern border compared to this time last year. >> andrew and thank you. >> police in new york carted away more boxes from the home of the suspected gilgo beach serial killer rex herman. he is now charged with murdering three women. police are also searching for clues in south carolina, where herman owns land. they seized a truck that's linked to the case. he also owns a condo in las vegas. so police there are reviewing unsolved cases as. >> now to a big decision in the state of illinois being closely watched across the country. the state is making history by eliminating cash bail. some police officers call it a slap in the face of law enforcement. here's abc's andrea fujii this morning. >> illinois is set to become the

first state to eliminate cash bail after the state's highest court ruled the controversial move is constitutional. it is a very meaningful change in the way that our courts assess whether to release a defendant or not. opponents, including many in law enforcement, argue it will put more criminals back onto the streets before the state can try them. supporters argue it will create a more equitable court system. >> the reality of this is simple is that people who are charged with violent offenses should not be able to pay their way out of jail. and people who are charged with nonviolent offenses who aren't a threat to the public, shouldn't be criminalized for being poor under the new system , people charged with a crime will not be required to put up money in exchange for being released from jail before trial . >> it's still the judge's discretion who is detained, but only in cases of murder. battery burglar and carjacking, or if the state can show the defendant poses a threat or is a flight risk. opponents say that's not enough. we want a judge to have that opportunity on each and

every felony offense and many misdemeanors. critics have blamed other bail reform measures in the us for a spike in crime. the illinois fraternal order of police calls cashless bail a slap in the face, saying the court ignored the pleas of nearly every prosecutor in the state. lavette mays represents the other side of the debate. she spent 14 months in jail after an altercation with her mother in law because she could not afford the $25,000 in bail money. >> there are so many women that i met in jail because they could not afford to pay a bail. >> advocates say more than 60% of defendants in us jails are kept in custody before trial because they can't afford bail. most are held on low level offenses, and most are people of color. opponents of cashless bail are asking for a special session of the illinois legislature to address their concerns before the new system takes effect in september. rhiannon andrew andrea, thank you. >> it is time now for a look at

feel feeling something good morning, america. >> new details overnight about a new search warrant in the tupac shakur murder investigation. a swat team executed the warrant at a home in las vegas in a las vegas suburb monday, 27 years after the rapper was shot and killed on the vegas strip. police have not commented. the investigation gained momentum in 2018 after a netflix documentary . the evidence being sought included computers and articles about the rapper. the evidence will be presented to a grand jury. the scene monday was described as loud, with police using bullhorns. no word on who may live at that address. >> country singer jason aldean is coming under fire. critics say one of his latest songs is racist and they claim the video is pro lynching. here's abc's lionel moise this morning. >> country music star jason aldean is defending his controversial music video after

♪ ♪ . >> we are back now with an incredible story of survival at sea. one sailor is opening up about his months long ordeal. he may look like tom hanks in castaway, but for australian sailor timothy shaddock and his dog bella, being adrift at sea for months was a real and harrowing experience. where are you from? >> i'm from australia. >> shaddock stepped back onto dry land yesterday for the first time in three months. oh i'm feeling all right. >> i am feeling a lot better than i was, i can tell you. >> back in april, he and his dog set sail from the mexican city of la paz, hoping to reach french polynesia. but weeks into the journey, shaddock says bad weather crippled his boat, knocking out the electronics and his ability to cook. he and bella had to survive on raw fish. >> the health was was pretty bad for a while. i was pretty hungry
