in san francisco, amanda del castillo io, abc 7 news. karina: we have more on to bennett's life and legacy on our website. go to abc7news.com and you can find it on the main page. dion: developing news out of antioch, a court adjourned in the case involving police officers linked to the racist texting scandal. they will determine if the antioch officers violated the racial justice act by treating the texts. our reporter was at court and joins us live. this saga continues. >> that is right. court let out a short while ago. and what happened. this is not a trial. there will not be a verdict. this is looking at the california racial justice act. that is a state law that allows defendants to challenge racism in the criminal justice system. the case centers around antioch police officers who may have engaged in racially biased

policing. and four black men who were charged in a gang-related shooting two years ago. they attempted to antioch police chief, ford. you need his testimony to determine how many of those linked to the scandal are still working at about department protocol but the judge does not have to -- the judge says he does not have to testify. they say it is not relevant because it's not determine motive and chief ford was not here when it all started a few years ago. representatives of the naacp who were in court today agreed with the judge. >> i am glad the trivial lists of asking him to testify was over. i don't feel he was part of it, that he knew anything about it. he came in here later. >> officers who were subpoenaed to testify tried to prevent them from having to take the stand. the judge will allow them to testify but says officers can

have their attorneys present during questioning. the antioch police officer was in court and the others were available if called to testify. we did reach out to prosecutors and they declined to be interviewed. dion: before you go, we know it is friday ad court is over for the day. you know what happens next and how long these hearings will go for? dion: august 25 because of a scheduling issue. i spoke to the contra costa county chief public defender office and she says after the hearing the judge may administer nobody's at that point. i also want to point out that the contra costa county alternative defender's office say that this case could be historic and precedent-setting because they are looking at institutional racism within a police department. abc 7 news. dion: a story we will continue
