after a car sails over the steps. this is also a crime scene. announcer: building a better bay area, moving forward, finding solutions, this is abc 7 news. kristen: this week marks one year since police officers took down a gardener who had been enjoying a beer with friends after work on the street. he suffered serious injuries. dan: today, that gardener filed a civil rights lawsuit against the officers, the police department, and the city. good evening. thank you for joining us. >> ou break this story last year and has the latest. dan: the lawsuit against san rafael, the police department and its own former officers was file it in federal court. why is this a federal case? >> julio's rights were violated in a violent way.

going back to the founding of our country, we have the right against excessive force and reasonable search and seizure. dan: this lawyer rep julio lopez. he had wrapped up gardening when he stopped for a beer with two relatives. the officers arrived, asked for his id, and when he they take him down. >> sit down. sit down. >> i understand. hey! [sounds of a scuffle] dan: medical records show he suffered a concussion and a shoulder injury that required surgery. >> you know, i -- i fel was going to die. it was really scary. dan: in our interview come his wife said his ordeal has changed julio. >> he does not have the same

confidence as before. he has tried to be the same, but he says the -- he is a man t lost his family. dan: the complaint has dozens of -- of action, including battery and it says a reasonable law-enforcement officer would not have used aggressive tactics for something as minor as an open container of beer. >> maybe they should not been drinking there, but that was not conduct that justified the level of violence the officers inflicted on him. dan: he says that julio wants his day in court and for a jury to decide the case. neither officers responded for comic, but the police chief emailed me that the department would not comment on pending litigation. the san rafael city attorney did not respond to my calls. the former officers are facing felony charges of assault by an

officer and false statements in he crime report. they will make a court appearance next month. neither officers are with the force any longer. and the terms of their departure have not been released. we do not know if they left on their own. dan: ok. ama: new details on what led a car to drive off of a san francisco cliff on saturday. it was traveling on sanchez when it hit a guardrail and went over the embankment. this is the moment the car went over the cliff. it landed on its roof. witnesses say the driver and passengers took off running. the owner says he was a victim of a carjacking. >> he was driving past here. uh, they opened his door, got the guy out. he said he was hit by a gun on his head. ama: a witness is police found a gun and tasers in the car.

city crews have been assessing the damage to the stairs. dan: well, traffic is moving smoothly in both direction the richmond-san rafael bridge now but it was a different story last friday. a 17 hour shut down has bay area leaders saying never again. a man suffering in mental health crisis brought traffic to a standstill and shut down the bridge. we found out what could be improved to avoid this from happening again. >> 100-150 feet above the water line. reporter: the fire district battalion chief is talking about the rescue of a man who crawled underneath the richmond-san rafael bridge on friday afternoon. >> he was underneath the lower deck of the bridge. it is very complex and hazardous for himself and our rescuers. reporter:reporter: he says the man was suffering in mental health crisis. >> he was not responding initially, but through our bilingual rescuer we were

finally able to have a conversation with him. reporter: after more than 17 hours, he agreed to be rescued. he was taken to the hospital. the situation created chaos as many drivers were stranded for hours. people got out of their cars. some commuters detoured to the bay bridge but that was a mess too. chris hours to get from moran to alameda. >> i have been commuting there for 11 years and it was the worst i have ever seen. reporter: on social media, visit which in gaining national attention. >> he is making people camp out. that's crazy. california, got to love it. reporter: the chp says it is a delicate situation. traffic signs were posted. >> it is an unprintable situation. so making sure the individual is safe, because you're the officers are safe, and making sure motorists are safe.

reporter: the situation has many asking what if it happens again. leaders are thinking about solutions on resolving the crisis and keeping traffic moving. >> when we have major incidents and shows how interconnected our interpretation systems are. reporter: joh organization is proposing a movable barrier on the lower deck. >> that would have enabled, in this example, if they could have moved that temporary wall and allowed the police to do their important work they were doing, helping the person. but still allow the traffic to go by. reporter: in the north bay, abc7 news. dan: caltrans was able to reopen i-80 early after closing the section all weekend long. it opened by midnight ahead of the estimated time of 5:00 a.m. so it made it no problem for the morning commute. this was the first of three weekends for shutdowns.

they replaced the pavement with concrete. it takes a whole weekend to repave one lane of traffic. this is the affected aa om there will be no closures this coming weekend b next closure will begin on friday, august 4. and there will be another starting on august 18. ama: education is part of building a better bay area. three weeks before the beginning of the school year one school is facing a staff fish shortage -- staff shortage. but it is compounded by the fact that vacancies are in special education, which are required to be filled. our report explains what action they are taking. reporter: when teachers and students in west contra costa return to school on august 15, the desist -- the district must have enough professionals. >> they are the lifeblood of our specialty programs -- special ed programs. and the services and they

provide are individualized, for tutoring, supporting the students with academic work in the classroom to supporting medical needs. reporter: so far, they are sure about 200 because there are not enough of them, west contra costa unified had to contract with a staffing agency called procare therapy. >> we work with outside agencies to make sure we have that staffing obligation in students have the support they need. reporter: there is no way around it, the district is required by law to properly staff special education classes. hiring and retaining paraprofessionals has been difficult because the starting salary is between $19 and $22 an hour. >> the affordability crisis impacts all staff and we have heard from staff you have left that that has been part of the why. reporter: because they are spending more on hiring people

dan: tonight, and insight into a company that has purchased a $1 billion worth of land in solano county near travis air force base. >> it does not make sense. they are not farmers, so whatever they are i know what they aren't. dan: if officials say that they are skeptical of the lack of transparency from the buyers. stephanie sierra has the latest. reporter: the group flannery associates llc has acquired a of thousands of acres of farmland equivalent to double the size of san francisco, and nobody knows why, not even the federal government. we are learning the company's alleges silence is exposing the need for change.

>> that is what makes it scary, we know nothing about them. nothing about their intentions. reporter: in mysterious $800 million purchase of dry farmland near travis air force base, one of the most critical military bases in the u.s. has raised questions. local officials say the process has gone from suspicious to intimidating. >> the intention is not to grow olive trees. it feels nefarious. all of the land, to the point where you will sue someone to intimidate them to sell to you, those are not farmers. poer: cindy donnelly is of federal officials say they are struggling to identify who is behind the investment group that has purchased 55,000 acres near the base. and what it will be used for. >> it seems like there is something larger in the works.

reporter: the problem is nobody knows. but why are we in this situation in the first place? we brought it to the chair of the armed services committee. don't you think principal owners who are purchasing land near military bases should be required it identify themselves? >> absolutely. i think we should have greater transparency on that. reporter: we confirmed over the past six years of land acquisitions there was no clear reporting structures f sensitive basis to federal agencies responsible for investigating these kinds of situations. john garamendi is working to change that, adding new language in the national defense authorization act that would streamline communications to the proper authorities so they can review the cases. >> if you are not nefarious operation, why are you keeping it secret? reporter: 300 acres was purchased near an air force base

in north dakota last year. >> a company in china was acquiring land around the base, and wanted to build a 400 foot silo that could look into the base. we said, wait a minute. reporter: flannery associates says no foreign person or group holds any substantial control over flannery. but congressman smith says that is charmingly nonspecific. if it is determined that the purchase of the land is in any way connected to a foreign adversary, what should happen next? >> excellent question. i think we need to look at options and evaluate it. it will depend. we have foreign investment in this country for a wide variety of things. we need to get the information and evaluate next steps to determine national security also recognizing that we are doing business with china. but we need to be cautious. reporter: congressman smith

added he is unaware of evidence released so far that ties the flannery group to china, and made it clear we do not have the transparency yet to completely rule it out. dan: it is a mystery. something is going on. thanks. ama: countless pounds of food each day go to waste, but work is being done to make sure that food that is edible is given to those in need. we talk about a law that will have businesses doing their part to build better bay area. reporter: patty is the executive director director of a local nonprofit that's a food recovery organization committed to taking food from businesses that would have been thrown away and they bring it to other nonprofits. >> eggs were going to get tossed. and they are good for three more days. so, we give it to the food pantries. reporter: some businesses are already required to donate

shelfstable food. a law aims to reduce food waste and also combat climate change. mixture, it will apply to certain hotels, large event venues and more. we were with a nonprofit as they packed up meals. michelle pearson says they have been donating since the end of 2017. >> we had a lot more leftovers and i was able to reach out to a colleague who put me in touch with patty with the daily bowl, and we developed a partnership. reporter: they find of the meals in a refrigerator and load them up to take two organizations a -- to organizations where prepackaged meals are appreciated. >> it is great for the clients. they can have a well prepared meal. it still tastes good. reporter: it takes effort to put food aside to keep safer donation by the benefits outweigh the hassle. >> it feels great.

reporter: on a sunday afternoon in may at the shopping center, a 28-year-old suspect assaulted a woman in this fast food parking lot. he then attacked the second woman and stole her purpose at

gunpoint nearby. police tracked the suspect down using his ankle bracelet. it is a crime that terrorized residents. >> we found the person responsible was currently on parole for a prior violent felony involving a firearm and was wearing an ankle monitor. reporter: according to court documents, the suspect is facing numerous charges, including robbery and assault with a deadly weapon. his next court date is august 11 and could include possible revocation of parole and a diversion hearing which could open up the potential for no jail time. the police chief was upset that alameda county's new district attorney did not file sentencing enhancements against the defendant, which if convicted wouldn't make his sentence longer. the chief wrote a letter to the da on july 6 asking for

accountability. >> we found that enhancements were not filed and that was disappointing because i feel that puts our community at risk. reporter: has she reached out to you? >> no. reporter: in march, she altered the policy around the use of enhancements. she campaigned on and was elected on a platform of taking steps of ending mass incarceration to address racial imbalances in the justice system. monday afternoon, she release this video statement. >> while there may be some people who disagree with our evaluation of the evidence or decisions, they are ours to make. we are the lawyers for the people. reporter: for now, the suspect

remains in the center retain jail. i am leslie brinkley. dan: a jury has been selected in the competency trial of a man suspected of a stabbing spree in davis. 12 jurors will decide i dominguez is competent enough. prosecutors pushback on findings that he was not competent enough. the former u.c. davis student is accused of stabbing three people, killing two of them. criminal proceedings will move forward if the jury decides he is competent. now into the investigation into an ohio traffic stop that ended with an unarmed man being attacked by a police dog. it was all captured on video. reena roy walks you through what happened. >> release the dog. reporter: disturbing video shows the moments police in ohio
