daniels. >> but this case could be the most serious and the most consequential. this morning, a lawyer for former president trump says the new indictment against his client, the third. so far, will be the hardest to prosecute, arguing trump is protected under the first amendment. >> this is unprecedented, and it affects not just donald trump. it affects every american who now realizes that the first amendment is under assault. >> trump's lawyer also expressing doubt that the special counsel will be able to prove trump did not believe his own election fraud claims when he allegedly tried to overturn the 2020 election results. we now have a political incumbent who is attacking americans for their beliefs, attacking americans for their speech, and attacking americans for their politics. trump is charged with conspiracy to defraud the united states, conspiracy to obstruct an official proceeding, obstruction of and an attempt to obstruct an official proceeding and conspiracy against rights. >> and the last one, and this is really important is that he was

trying to prevent count votes from being counted from people's votes, from being counted in a variety of states, millions of votes, which is a deprivation of their civil rights. >> the indictment accuses trump and coconspirators of creating fraudulent slates of electors in seven states, allegedly trying to compel the justice department to conduct sham investigations into election crimes and pressuring vice president mike pence to reject legitimate electoral votes on january 6th. ultimately sending his supporters to the capitol to obstruct the certification proceeding and pressure the vice president next. in this case, trump is due to appear in court tomorrow. >> he will be right here behind me. it's possible that he could remain completely out of view. this is a federal courthouse, so there are no cameras allowed. there's garages where he can go underground and get into many of these courtrooms without being seen at all. >> the indictment does not name trump's coconspirators, but abc news has uncovered coconspirator . one is rudy giuliani described in the indictment as an attorney who was willing to spread knowingly false claims and

pursue strategies that two defendants, 2020 reelection campaign attorneys would not. the other coconspirator include attorneys john eastman, sidney powell and kenneth chesebro, along with jeffrey clark, a former official in the justice department. and one more unknown coconspirator. none of the alleged coconspirators has been charged as of yet. and their lawyers have not commented. the indictment also outlines a number of tense conversations between trump and pence, citing notes taken directly by pence. according to pence's notes from january 1st, trump said, you're too honest, as he urged pence not to certify the election after the indictment was unsealed, trump accused the justice department of piling on and claimed the indictment is election interference because it comes during the 2024 primary season. >> attention is now turning to the potential timing of trump's trial and the judge who will oversee it. abc's em win continues our coverage. em good morning. >> good morning. rhiannon the judge who will oversee trump's case, has already given out some of the toughest sentences against the january 6th rioters.

judge tanya chutkan was nominated by president obama. she has sentenced at least 38 people connected to the january 6th attack, matching or exceeding prosecutors recommended nations and many of the cases and judge chutkan previously ruled against trump in a separate january 6th case. in a memorable line in that ruling, she wrote, presidents are not kings and plaintiff is not president. meanwhile, special counsel jack smith is pushing for a speedy trial, calling january 6th an precedented assault on democracy . >> it's described in the indictment it was fueled by lies , lies by the defendant. it targeted at obstructing a bedrock function of the us government. the nation's process of collecting, counting and certifying the results of the presidential election. >> trump has tried to delay hearings in his other indictments until after the 2024 presidential election, but the timing of this trial will be up to the judge. rhiannon and thank

you. >> we have much more analysis of the indictment on the abc news app and we will bring you live coverage of trump's appearance in court tomorrow at 4 p.m. eastern. >> turning now to a frightening scene in new york. police say the driver of a stolen suv fleeing police crashed into a group of pedestrians in midtown manhattan. ten people were injured. police say the crash was not intentional. the driver is in custody. the victims are expected to recover. and a deadly crash at the grand canyon. one person was killed when a bus carrying dozens of passengers rolled over near the canyons western rim. authorities are investigating the cause. >> the lawyer for the suspected gilgo beach serial killer says there will be no plea deal in the case. 59 year old rex huberman appeared at a court hearing yesterday charged with three murders on long island, new york, more than a decade ago. prosecutors say they turned over hard drives to the defense , along with 2500 pages of documents and photos, including surveillance footage from the suspect's home. his lawyer insists huberman is innocent. he

said from the moment i met him that i did not do this. >> so we're prepared to go forward. we will defend this case in a court of law. meanwhile police now say there does not appear to be a connection between huberman and a string of murders in atlantic city back in 2006. >> the biden administration is criticizing a new hit to the united states. credit rating. the ratings agency fitch has downgraded the us to double-a plus from triple-a, citing political divisions in congress and the recent drama over lifting the debt ceiling. the downgrade could make it more expensive for the us to borrow money. treasury secretary janet yellen called the move arbitrary. hollywood studios and screenwriters may be ready to restart talks as the writers strike drags on. the writers guild says the studios have requested a meeting on friday to discuss negotiations. now the sticking points that led to the strike include pay and streaming rights back to school is coming up fast and the nationwide teacher shortage is getting worse. >> some parts of the country are reporting the biggest staffing

shortages in years. abc's andrea fujii explains why. >> this morning, with some school districts just days away from welcoming students back to class, many are scrambling to fill vacant teaching positions. >> we're facing an epidemic. when it comes to a teacher shortage. >> more than 40 states are suffering a severe teacher shortage. the reason teachers list low pay a starting salary averages $40,000. burnout from the pandemic. school violence and lack of respect from students in louisiana. jefferson parish public schools have more than 200 teacher vacancies. los angeles more than 450 empty teacher spots. data shows nearly half of public education employees who left their job last spring resigned. and 1 in 3 teachers say their likely to quit in the next two years. experts also say teachers are worried there have been 23 school shootings that resulted in injuries or deaths so far this year, with some schools

under construction. >> neighbors wrote city officials two months ago about several dangerous fires in the area near homeless encampments. fire remains under investigation. the former alabama beauty queen accused of plotting to kill her husband on vacation in the bahamas has been released on bail. >> lindsey shiver and two alleged coconspirators were arrested last week. police say text messages detailed a murder for hire scheme. robert shiver had filed for divorce, citing adultery, and lindsey accused him of domestic violence. her legal battle going forward may be tougher in the bahamas than it would be in the us plotting to kill somebody in the united states. >> you can get really a long sentence. my guess is that something similar would would occur in the bahamas and their standard as to how much evidence you need to convict somebody, maybe less than it would take to convict them here in the united states. >> the husband is back in georgia with the couple's three young children. he tells the new

york post he hasn't had the heart to tell the kids what happened. >> a manhunt is now underway after the brutal killing of a man who was dancing at a new york gas station. police are now investigating the case as a possible hate crime. and now singer beyonce is speaking out. here's abc's lionel moise. >> overnight, a vigil for 28 year old o'shay sibley, the stabbing death of the professional dancer at a brooklyn gas station is now being investigated as a potential hate crime. >> police are reviewing this video. witnesses say o'shay and a group of friends were dancing when they were approached by another group. >> this guy walked from the store. he's like, why are you dancing? i'm muslim. >> they appear to have a heated exchange. and as the shirtless sibley walked away, he was stabbed in the torso. his friends say the other group shouted homophobic slurs. >> the neighborhood we live in, it's a very homophobic neighborhood. progress, yes, but we don't see it. cries of a skin. >> sibley is being described as a beacon of light and was well
