election is being closely watched across the country because it's directly linked to the battle over abortion access. >> and this morning, abortion rights supporters are celebrating the results of the so-called issue one referendum. abc's justin finch is here now with those details. justin, good morning. >> good morning, andrew. an ohio judge has put the state's six week abortion ban on hold already. the issue, one defeat, now marking a critical setback for conservatives seeking tougher abortion restrictions in that state. this morning, issue one failing in ohio. the republican supported ballot question would have called for a 60% supermajority to make changes to the state's constitution instead of a simple majority. with nearly all ballots counted, close to 60% of voters reject putting that measure. ohio republicans putting issue one to the people just before november, when voters are set to decide whether to enshrine abortion rights into the state constitution.

>> the constitution is under attack and we want to protect the constitution in ohio. >> it was important to protect my rights, especially as a woman and, you know, the abortion protection. so i wanted to vote no today in columbus, the bipartisan coalition group, one person, one vote celebrating ohioans will have a say when november comes and we will vote yes. >> the president of the anti-abortion rights organization ohio right to life , stopping short of conceding defeat on cnn. >> look, this was a battle worth having. we needed to have a decision with the state of ohio. all 88 counties. >> the anti-abortion rights, susan b anthony, pro-life america group calling the issue one outcome a sad day for ohio. and a warning for pro-life states across the nation. the group also blaming outside money for the defeat, even though both sides benefited from that spending from the white house, president biden slammed issue

one as an attempt to weaken voters voices, saying ohioans spoke loud and clear. and tonight, democracy won. before polls open tuesday, nearly 700,000 ohioans voted early and soon after last year's supreme court decision overturned abortion rights protections. kansas voters rejected an anti abortion amendment in that state . since the high court's decision, more than a dozen states have passed near or total abortion bans. andrea. >> justin, thank you. we're following a developing story near austin, texas, where crews using helicopters and other heavy equipment are fighting a fast moving brush fire. people in the suburb of cedar park were ordered to evacuate. the flames have already consumed an apartment building and damaged two others. the hot and dry conditions are not helping the largest flame reported is 60ft in the air. >> so no. and that was when it was hitting the trees beside the apartment complex. the wind

moved this fire quickly. >> the fire had burned 50 acres and was 0% contained overnight from hot and dry in texas to this scene in massachusetts to rare tornadoes causing widespread damage. >> a tree sliced into one home near cape cod where winds hit 95mph. the same storm system dumped eight inches of rain in some areas. we'll check today's forecast in just a few minutes. meanwhile, on wall street, stock futures were lower overnight after the credit agency moody's downgraded ten regional banks. among those taking a hit was aa bank, the nation's 19th largest one. concern is higher interest rates, which forced banks to pay customers more money to their savings. the downgrades come just months after the downfall of silicon valley and signature banks. moody's says it will also review the financial health of six large banks, including bank of new york mellon and us bancorp. >> now to the fallout from that massive brawl in alabama. charges are being filed, but authorities say they're not yet done with the investigation.

this morning, our first look at one of the people allegedly at the center of the riverfront brawl in montgomery, alabama, richard roberts is one of the three men now facing assault charges, along with alan todd and zachary shipman. police were waiting for todd and shipman to surrender overnight, an event that certainly was avoidable. the brawl erupted when a riverboat coach captain tried moving a pontoon boat parked in the designated spot for a commercial ship coming in. >> the co-captain was doing his job. he was simply trying to move the boat and just enough to where the cruise ship can park safely. and it's and it's identified location. however it quickly escalated into a fist. you can come in these videos that are part of the police investigation in a shirtless man confronts the co-captain and a fight breaks out. >> several people then jump in, outnumbering the captain. moments later, witnesses who happened to be black rushed in to help the worker running, even

swimming to the scene. oh my god. beating back the people who attacked the man. one used a folding chair to hit someone over the head. police say that man with the chair is now wanted for questioning. but for now, investigators are not filing any charges related to racial bias. >> we did examine if there was enough to file hate crimes charges on this case. and again, we rely heavily on advice from the fbi. we've also looked at what it takes to elevate this to a riot, inciting a riot. we've worked with our local district attorney and it didn't fit the criteria for that, although police said they found no evidence for hate crime charges. >> they say the investigation is ongoing. >> former president trump may be just days away from a fourth criminal indictment. sources say the district attorney in fulton county, georgia, investigating efforts to overturn the 2020 election is likely to present her case to a grand jury. as soon as next week. trump attacked the da while campaigning in new hampshire yesterday. another shakeup for

trump's biggest republican rival in the race for president, florida governor ron desantis has replaced his campaign manager. the new campaign chief worked for desantis in florida but has never managed a campaign. >> we're learning more about the six year old in virginia who shot his teacher back in january. new details are surfacing about what happened in that classroom. here's abc's alison kosik. >> the boy accused of shooting his teacher in a newport news, virginia, classroom earlier this year alleged he admitted doing it, according to newly released court documents. it's after a bullet hit first grade teacher abby zwirner in the hand and chest. the six year old said, i shot that expletive dead and i did it. i got my mom's gun last night. >> and i remember him pointing the gun at me. i remember the look on his face. >> the documents also claim the boy's mother, deja taylor, told police that she believed her firearm was stored in her purse with the trigger lock in place

and that her purse was placed on top of her bedroom dresser with the key for the gun lock under her mattress. but prosecutors say they never found a lockbox, a trigger lock or a key to a trigger lock. they say they did find drugs and drug paraphernalia to. >> do you feel in any way responsible for the shooting? >> yes, of course. that is my son. so i am as a parent, obviously willing to take liability for him. abby zwirner needed several surgeries and has since resigned from teaching at richneck elementary. >> she sued the school district, claiming officials were warned that the student had a gun. but dismissed the concerns. the school district not immediately commenting on the lawsuit, but said it is committed to ensuring the well-being and care of all students and staff. a lawyer for the boy's family said the child had extreme emotional issues and we are all working to see that he improves every day. court

embankment, then launched into the air. >> rapper tory llanes has been sentenced to ten years in prison for shooting fellow rapper megan thee stallion in what prosecutors called an act of misogyny. prosecutors had requested a 30 year sentence, but attorneys for llanes vowed to appeal. he told the court that he still cares for megan. in a statement, megan said, every day i think of others across the world who are victims of violence. it's truly the most powerless feeling, especially when you question whether the justice system can truly protect you. fortunately the district attorney's office fought for me . but if it can happen to me, imagine those who lacked the resources and support systems to help them. >> we turn now to the battle over self-driving taxis, possibly coming to a street corner near you, but not if some people have their way. this morning, first responders and cab drivers in san francisco are hoping to put the brakes on the city's proposed expansion of self-driving taxis at a time when they've proven to be not up to the task would be a grave, grave mistake. tomorrow, the

california public utilities commission is set to vote on whether to authorize two companies. cruz and waymo, to deploy self-driving taxis across san francisco. at all hours of the day. critics are raising concern about the self-driving taxis already on the road. >> they're still not ready for prime time because of how they have impacted our operations. >> the fire chief has reported 55 incidents this year where self-driving taxis interfered with firefighters duties. >> this includes not just unexpected stops in front of our fire stations, not allowing our vehicles to respond to incidents. >> tomorrow's vote has been delayed twice already with representative from both cruz and waymo testifying they would provide training for first responders to familiarize themselves with the self-driving vehicles that waymo. >> we're working to ensure that our vehicles stay out of the way of active emergency vehicles whenever possible. >> taxi drivers like matthew sutter say they barely got through the pandemic, and now they say they're fighting for their survival with the possibility of robo taxis
