it's the fourth criminal indictment in less than six months against the former president. his alleged coconspirators include rudy giuliani and former white house chief of staff mark meadows. in a conspiracy laid out in a 97-page indictment. another historic day. this time, inside an atlanta courtroom. >> ma'am? >> juju: in a sweeping 100-page-plus indictment, former president donald trump, the leading candidate for the 2024 nomination, was indicted today for trying to overturn his loss to joe biden in georgia in the last election. a state lost to joe biden by just under 12,000 votes. >> all elections in our nation are administered by the states, which are given the responsibility of ensuring a fair process and an accurate counting of the votes. the states' role in this process is essential to the functioning

of our democracy. >> juju: trump charged with 13 counts, including racketeering, conspiracy to commit impersonating a public officer, commit forgery, and false statements and false writes. he has previously denied wrongdoing. 18 others indicted, including trump's former personal lawyer, rudy giuliani, and his former chief of staff, mark meadows. and another 30 unindicted coconspirators. the indictment detailing that the defendants refused to accept that trump lost. >> they're talking about 161 acts that were committed as part of this criminal enterprise. and what she does is, she takes it through chronologically. starting actually before the election, in act number one. she makes a reference to the fact that on october 31st, he's already talking about making a speech declaring victory, even

if he doesn't win. and so, she is saying, in effect, that's where it starts. it starts even before election day. >> juju: also indicted today were some of the fake electors recruited by the trump campaign. the indictment alleges that members of the enterprise corruptly solicited georgia legislators, to unlawfully appoint their own presidential electors for the purpose of casting electoral votes for donald trump. >> this was an effort to get the legislature to choose an alternate slate of electors who could present themselves falsely, wrongly, as the duly electors for donald trump, that would give vice president pence a choice, an opportunity, to say there's a dispute here and it has to go to the house of representatives or get tossed back to the state. >> when i look at this, i look at a couple of things. the fact that so many lawyers are indicted here. these are attorneys being charged with a crime for their role in this effort. >> juju: this indictment is the

culmination of district attorney fani willis' 2 1/2-year investigation. >> president-elect biden is projected to win the state of georgia, the first time a democrat has done that in nearly 30 years. >> juju: two recounts in georgia, including one requested by trump, showing the same results, biden had won the state. >> authorities are ordering a recount by hand. >> georgia was the center of the political universe for a couple key reasons. at the time, no one thought it had a chance to go to joe biden. here's the surprise results that certified joe biden as the winner. at the same time, not one, but two senate seats on the line. >> juju: that is when the alleged pressure campaign began. trump and his associates making baseless claims of massive election fraud, online and on tv news shows. >> the recount being done in georgia will tell us nothing because these fraudulent ballots will just be counted again. >> you believe that the president still has a path to

>> juju: chris, let me begin with you. we're looking at 41 felony counts, 91 pages. you called the indictment sweeping. when people think of rico, they think of it being used against mobsters. you specialized in georgia rico charges. what's the scope of the indictments? >> it's a big indictment. 98 pages takes a while to write. it will be a big trial when we get down to it. looking at it, it's not uncommon particularly in georgia, to charge public officials with the georgia rico statute. we don't have the traditional mafia in the state of georgia like they do in new york and other states, where the rico act is typically used. >> juju: sara, we're looking at 161 acts and furtherance of the details, tweets, reserving a room. rudy giuliani is 1 of 19 indicted and so is mark meadows, his former chief of staff. these are big names with a lot of charges against them.

how serious are the charges given that there's so many coconspirators? >> it's important for people to realize that all of the acts listed are different than what they're charged with. the acts are things that something can do in furtherance of the conspiracy. but the overt act might be buying duct tape at the store, something that's not illegal. and yes, lots of coconspirators here. that's going to have a ripple effect on some of the other cases. someone that may be called to testify in the d.c. january 6th trial is going to have to consider how the testimony could affect them if they are an indicted coconspirator in this charge. >> juju: chris, you worked a lot of rico cases. there's 19 coconspirators. and fani willis said tonight, she would try them together. what does that tell you about how this case might unfold?

>> i think you can expect some of the defendants in the indictment to plead guilty, which will narrow down the folks that will be in play when it goes to trial. this is not the biggest case that's going to go to trial in fulton county history. you got the a.p.s. trial, that had the defendants that were 12. the ysl, the young thug trial, going on right now. that has multiple defendants right now. that's something that the fulton county district attorney's office can't handle. the biggest problem that someone will have is find a courtroom that finds that many defendants and that many defense tables. you'll have less than 12 defendants that will be at the trial. the first one that takes a deal usually gets the best deal. >> juju: you're saying a half-dozen indicted may take a plea deal. many believe that if president trump wins the presidency again, he would attempt to pardon himself in the federal

indictments he faces. he can't do that with the georgia state conviction. how will that play out? >> that's right. the pardon power does not extend here. and the georgia governor is limited. there will be other constitutional considerations. there's separation of powers, we think of between congress and the president. s be there's also a separation of power problem between the president and states, for instance. where they could continue of a sitting president in office is something we hasn't had to deal with yet. >> juju: donald trump has attacked fani willis. you know her. she's a former colleague of yours. what do you think of the attacks and the case she's brought forward? >> she's a proio
