is america. >> this morning. >> good morning, everyone. i'm andrew dymburt. >> and i'm morgan norwood, in for rihanna. and we begin with the latest indictment of former president donald trump. >> prosecutors in georgia laid out 41 felony counts against trump and 18 others, alleging a sweeping criminal conspiracy to overturn the 2020 election. >> rudy giuliani and former chief white house chief of staff mark meadows are among the co-defendants accused of scheming to help trump illegally cling to power. let's get right to abc's em win who joins us live from atlanta, where the grand jury worked well into the night before handing up the charges. >> good morning, m. >> good morning, andrew. yeah, the fulton county district attorney says warrants have now been issued for all defendants in this indictment, including trump to be taken into custody overnight in georgia. donald trump hit with the fourth set of criminal charges implicated the former president as the head of a sweeping conspiracy to overturn the 2020 election results in the state. trump and 18 others, including lawyers

rudy giuliani and john eastman, facing a 41 count indictment. all charged under georgia's racketeering act of often used to prosecute organized crime. >> as i make decisions in this office based on the facts and the laws, the law is completely non partizan. >> willis probe sparked in part by that phone call from trump to georgia's secretary of state, where the former president appeared to pressure the top official to find the votes needed to win. trump and his former chief of staff, mark meadows, both charged with solicitation of violation of oath by a public officer in relation to that call. these new charges, which also include violating the rico act, engaging in a conspiracy to replace public officials with fake electors and plotting to tamper with voting machines, add to trump's legal woes in the midst of his race for the white house. those are the kinds of allegations that are tougher to defend against at the republican frontrunners campaign, slamming the indictment as bogus, saying the legal double standards set

against president trump must end. and on capitol hill, top democratic leaders issuing a statement saying this indictment portrays a repeated pattern of criminal activity, adding praise to willis, saying no one is above the law but house speaker kevin mccarthy and other top republicans are defending trump , accusing willis of politicizing persecution, saying she's following biden's lead by attacking president trump. district attorney willis has given all defendants in this case, including trump, until friday, august 25th, to turn themselves in. she says she wants this trial to start within the next six months. andrew. and we're learning trump recently met at his new jersey club with his legal team. >> what can you tell us about that meeting? >> right. andrew so we understand that lawyers have been working with trump since willis did announce that she was having this investigation, which started more than two years ago. we understand that the lawyers have also warned trump that this case is different from his past three indictments because of the

sheer number of other people who are also facing charges. sources say trump has been particularly concerned for rudy giuliani, who he considers a close friend of over three decades. and sources also tell us that trump has likely not spoken with meadows for several months. >> andrew, thank you and much more on this latest indictment against trump later on good morning america. >> we take you now to maui, where police will start releasing the names of those killed by the lahaina wildfire today. if their families have already been notified. now, overnight, that death toll was at at least 99 people. and hawaii's governor says that number is all but certain to keep climbing. this morning, a grim message from hawaii's governor as the death toll from the deadliest wildfire in more than a century continues to grow. >> it's going to be emotionally catastrophic. nick, i understand that people want numbers. it's not a numbers game. it's not just ash on your clothing. when you take it off. it's our loved ones. >> and with hundreds still

unaccounted for, officials are urging survivors to provide dna samples to help identify the dead. overnight, a vigil was held for joe schilling, known locally as uncle joe. his family says he died a hero trying to help his elderly neighbors escape the flames. these photos , the last they received from him, showing homes going up in flames. >> as always, there isn't anybody in the family or who knew joe that would be surprised and that he would put himself at risk to help somebody else. denny ueckert survived. >> but as he was stuck in traffic with the smoke and flames bearing down on him, he didn't know if he would make it out alive. >> if you could feel the heat off the traffic. >> denny recording a message to his family, fearing the worst. my dad and my mom, my son david . >> i love you all. i can honestly say i've been through hell and back and thank god they

didn't want me. >> firefighter ina kohler was on the scene as the flames took over lahaina. >> were there moments when you feared for your life? >> yeah, yeah, a few. >> she and her colleagues desperately working to save homes even as their own burned to the ground. ina says she and her husband are among the 17 of 18 firefighter who lived in lahaina and lost their homes. and now new issues for those who escaped the flames. residents in lahaina and kula have been advised not to drink or even boil water because of what could be in it. and today, wind gusts up to 35mph are expected on maui as fire crews continue to fight flare ups. but around the island, scenes of hope. at least six donation centers have sprung up organically. local community members coming together to help those who have lost everything. >> we have delivered over 1 million pounds of food, water and supplies to the lahaina community. >> and fema also says the agency has more than 300 staff on the

ground giving out more than 50,000 meals. >> a landmark climate change ruling is being called a victory for young people and democracy, montana judge said officials violated the state constitution by not considering the effects on the environment in their fossil fuel policies. the 16 plaintiffs in the case ranged from age 5 to 22. they say climate change is overwhelming their lives as we've gotten a lot more wildfire smoke in august. >> so you can't go outside when it's really smoky because you don't want to get sick and then also the rivers have been going down a lot. the water level, because of drought. so you can't float the rivers as much. the state officials are appealing the ruling. >> they say eliminating co2 production would not have an effect because other states and countries still produce it. >> a massive explosion ripped through a gas station in southern russia, killing at least 27 people and injuring more than 100 others. officials say that fire started last night at an auto repair shop in the dagestan region before spreading to a nearby gas station. no word

yet on the cause of that fire. now to the texas woman sentenced to 30 years in prison for her role in the murder of army specialist vanessa guillen. >> it brings closure to a case that's credited with changing the military justice system. this morning, cecily aguilar sentenced to 30 years in prison. she pleaded guilty to one count of accessory to murder after the fact last year in the death of army specialist vanessa guillen. guillen was murdered on fort cavazos military base, formerly known as fort hood. >> we are hoping that this sentencing will bring some sense of relief and some sense of justice to the family who has waited so long to have this moment, to have their time in court. >> aguilar was indicted in 2021 for assisting her then boyfriend , aaron robinson, on mutilating and helping conceal guillen's body. robinson died by suicide after being confronted by authorities in 2020. vanessa sister mayra, reacting to the sentencing. >> there's relief today as to know that cecily will fight,

really be held accountable for her actions. >> vanessa disappeared in april of 2020. investigators spent more than two months searching before discovering her remains in a shallow grave 20 miles away from the base. it was later revealed that vanessa had been a victim of sexual harassment while serving. her story sparked calls for reform in the military to protect women and men from sexual harassment. if eventually inspiring new laws to address the way the military handles criminal investigations, i just want to thank everyone for their full support. >> and i'm happy to say that we can, in a sense, close this chapter. >> the vanessa guillen act introduced new protocols for handling sexual abuse complaints, ensuring that cases of sexual assault and harassment are now investigate by independent prosecutors outside the military's chain of command . >> time now for a look at your morning weather. >> good morning. severe thunderstorms out there across the appalachians to southern new england today into tonight. be careful of water over the roads

back alex collins. >> police in south florida say he was involved in a fatal motorcycle crash on sunday night . the incident is under investigation. collins played for the seahawks and ravens during his career. he was 28 years old. >> well, next, a new legal battle stemming from the movie that once. sandra bullock, an oscar, the blind side, the real life nfl player whose story is told in that film is now taking on the family he says never really adopted him. abc's lionel moise reports. >> tony here, here's your quarterback. all right. you protect his blind side when you look at him, you think of me. >> this morning. a bombshell allegation from the man who was the center of the 2009 film the blind side is your decision. >> michael. it's your life. >> michael oher, the real life inspiration behind that film, says he was blind sided by a family who calls him their son. the oscar winning film tells the story of a homeless black teen taken in by a well-off white family in the south. defying the

odds to become a first round nfl draft pick. >> i would like to become a legal guardian. >> lord help that child. >> the family telling good morning america in 2010, they viewed michael as a miracle in their home. michael's life necessarily wouldn't have been changed if we just wrote a check. >> he needed our time and our attention. >> but in a new petition filed in shelby county, tennessee, or says sean and leigh anne tuohy tricked him into signing what he thought were adoption papers, he says those documents were really for a conservative starship, which he claims the couple used to get rich at his expense. s writing they only saw him as a gullible young man whose athletic talent could be exploited for their own benefit . orr also claims the tuohys negotiated aid for themselves and their two birth children to get a lump sum of more than $200,000 each, plus royalties. based on the movie's success, the tuohy family has not respond to abc news request for comment

, but sean tuohy told the daily memphian newspaper, we're devastated, saying the conservatorship was done to avoid any ncaa conflicts with or attending ole miss. since tuohy is a booster at the school, adding it's upsetting that people would think i would want to make money off any of my children, but we're going to love michael at 37, just like we loved him at 16. sean tuohy says the family, including orr, got an equal share about 14 000 each. each the attorney for the tuohy family tells espn the family would file a legal response to those allegations in the coming weeks. andrew morgan lionel, thank you. >> a consumer alert this morning . nestle is recalling some of its cookie dough bars because they may contain wood chips. it includes two batches of the toll house chocolate chip cookie dough break and bake bar produced in april and distributed to stores nationwide . nestle says there were no reported illnesses linked to the product, and the fda is warning

of north carolina, instead turning into a 12 hour ordeal for a group of scuba divers. >> now they're all back with their families, not without some help from above with this morning, new video capturing the moment for scuba divers were rescued by the coast guard after getting lost in the open ocean for over 12 hours. >> the current just kept taking us further and further away. >> ben wiggins, luke lodge, daniel williams and evan williams were reported missing more than 60 miles off the coast of myrtle beach, south carolina, sunday after not resurface from a dive. coast guard crews in the area jumped into action searching the atlantic in the dark for any signs of life. >> whenever a diver goes missing, it's like trying to find a needle in a ginormous haystack. >> early yesterday morning, a coast guard airplane spotted a strobe light in the water about 50 miles northeast of cape fear river, north carolina. i saw this flashing light out of the corner of my eye coming down the left side of the aircraft and alerted the crew. >> and we turned to go check it out and immediately called second north carolina and
