it is time for that to end. larry: san francisco mayor london braid not holding back today at all on the issue of homelessness, as the city fights its ability to clear encampments. >> the fact that the courts have crippled our ability to do our jobs to help get people into shelter is criminal. larry: with that we say good afternoon and thanks for joining us. i'm larry beil. kristen: i'm kristen sze. three federal judges are reviewing an injunction that temporarily blocks the city from clearing homeless encampments. larry: luz pena is in the near-term with what happened in and out of the courtroom. reporter: today was a crucial day for the city and county of san francisco and the coalition on homelessness. the city is being sued by the coalition and the order is keeping the city from clearing encampments as long as the

number of people experiencing homelessness is greater than the number of and the fact that the court daetz have crippled our ability to do our jobs, to help get people into shelter is criminal , right? if we have a place for someone to go, they need to go. there has to be accountability. >> mayor breed accused the coalition on homelessness of holding san francisco hostage with an injunction that limits the city's ability to tackle homelessness. >> the city is being taken advantage of and we are tired of it. >> among the crowd, this business owner urging the city to intervene. >> the other day we had a guy on our literally on our front step who refused to move and then

threatened one of my employees. when she asked if she could step out of the building to go home. >> according to the city's department of homelessness and supportive housing, in 2022, the city identified 7754 people experiencing homelessness in the city as part of the injunction, the coalition on homelessness is requesting the city offer shelter to individuals before removing their belongings. the coalition on homelessness says encampment sweeps are not the answer. >> what we're trying to do with this lawsuit is, is get the city to stop abusing people's basic rights. we're trying to get them to stop illegally confiscating property and criminalize them when they have no choice but to be on the streets. >> we're not saying they need to have enough shelter for everyone. we're saying that they need to provide specific individuals with shelter inside the federal court. >> san francisco city attorney david chu tried to persuade the judges to stop the injunction on the challenge with the judge's order here is that it has created an impossible situation for us to implement, and the

order has been so vague, it's been very difficult for us to figure out where to hit the mark. the federal judges questioned the attorneys for the coalition on homelessness. >> in your brief, you repeatedly say individuals who have practical, which i understand you're now saying is like readily available and voluntary access to shelter. so are you now no longer requiring that voluntary be condition so individuals are not compelled to use shelter right. >> but certainly if they do have access to shelter and they decide not to use it, that doesn't make them involuntarily homeless. >> the city attorney viewed this as a breakthrough that was a major concession. >> frankly, surprised us. >> and according to the latest city data, shelters are basically at capacity here in san francisco, 92% full. now regarding what's next, a decision from these federal judges can come any time in the upcoming months. and the implications will impact nine western states, not only san francisco in the newsroom. los

pena, abc seven news. >> so it seems like in the meantime, it's a little bit unclear, but what's the governor saying about all this? >> well, larry, the governor is aware of what's happening here in san francisco and released a statement saying in part, we're cutting red tape and making unprecedented investments to address homelessness, but with each hard fought step forward, the courts are creating costly delays that slow progress. and he said, i urge the courts to empower local communities to address street encampments quickly and comprehensively. so he's well aware of what's happening here in our city. >> thank you. >> now to the south bay and a new effort to better clean up debris from encampments along local waterways. abc seven news reporter, south bay reporter zach fuentes spoke with officials who say it's not only good for the unhoused, but the entire community. >> santa clara county waterways have become a home for many of the unhoused to set up encampments. valley water says for at least two years, it's had crews working to keep waterways like this clean. >> there's been a significant increase in encampments the last

couple of years, and we want to make sure that we can minimize and hopefully reduce the amount of trash and debris that's encampment generated from entering the waterways. >> jack newman lives along los gatos creek and says he works hard to keep his area clean. but newman admits not everyone around him does the same. you know, it's really it's only just a few that are causing the problem now. valley water announced that they're moving to expand services to clean trash generated by encampments along waterways in santa clara county . that includes creating two encampment management crews. now we just have one encampment management crew, and that's typically for internal staff with about 8 to 10 skilled laborers on a daily basis. >> we're going to move that into two crews. >> valley water gives those living along the waterways 72 hours notice ahead of cleanups. officials say they work with the unhoused to determine what is and is not trash. something both the agency and many in-house say has been effective. >> it is working out. they've been very accommodating to that . i haven't had any issues at all. >> the new positions follow the creation of two other new jobs

approved earlier this year, dedicated to clean up other recent programs include portable toilet facilities and giving debit cards to unhoused people who keep their areas free of trash programs, funded in large part by federal grants. >> i have a heart for these folks. >> while valley water's main goal is to keep pollutants from waterways, some neighbors who live nearby say that they hope to see better long term engagement from agency is to work with the unhoused. >> it's not a solution. it's temporary. these folks are still living here. they're still creating trash. this is not an appropriate living situation right now, though. >> valley water says the newly allocated resources can have a positive impact for everyone. >> it's absolutely a win win. we need to be able to provide more routine service to the neighbors to the unhoused community and to the waterways in the south bay. >> zach fuentes, abc seven news. >> all right, turning now to the weather. you know how often do we get an 80 degree day in san francisco? it's getting warm, getting warm. >> we're there. right. meteorologist sandy patel is here now with a first look at

the forecast. hey sandy. >> hi there. yeah, i mean, kristen and larry, it got up to 86 so far in san francisco. really a warm day. let's take a look at those temperatures. everyone in the warm to hot category right now. it is 70 degrees in half. moon bay. you head out towards fairfield and it's 98 degrees. so, yes, pretty warm to hot day compared to 24 hours ago. running 14 degrees higher in novato up 13 in san jose. we're going to go hour by hour. it's still going to be hot inland at 5:00, heading in towards the 8:00 pm hour. warm inland mild at the coast and then tomorrow morning the fog starts to come back along the coastline. those temperatures will start out in the 60s for many areas. and then later in the afternoon, we're going to start to notice numbers are in the 90s inland, but not quite as hot as today. i'll be back with a full look of the forecast coming up. larry >> all right. thank you, sandhya. new details now on the maui wildfires. the fbi is asking people for dna samples as it works to find those who are unaccounted for. the list is at

confronting four people who were trying to steal the catalytic converter off of his car. this happened in the driveway of the man's home around 330 this morning. authorities say one of the suspects shot the victim once in the leg. the suspects then took off in a dark colored sedan. >> another call today for the removal of robo taxis from the streets of san francisco. members of pro-labor and taxi driver groups staged a demonstration outside of a location where crews parks its cars. the demonstrators say robo taxis and artificial intelligence are a threat to public health and safety. >> somebody is going to get killed. somebody is going to get killed because these cars are going to block the an emergency vehicle. somebody is going to die because of the reckless anarchy that this the california public utility commission and dmv allows. the group also accuses the dmv and the puc of criminal negligence for allowing the vehicles to operate on city streets. >> last weekend, crews agreed to

stores for a 23% drop in its profits. >> the retailer joining a growing list of companies including target, home depot, tj maxx and ulta, recently sounding the alarm on organized retail crime. >> it's extremely difficult to quantify the degree of the problem because not a lot of information is shared from this flash mob stealing nearly $100,000 worth of items at a california mall earlier this month to big box retailers like home depot being hit especially hard. >> and losing billions of dollars. according to the national retail federation. it's also becoming more cost tsay accounting for $94.5 billion in losses in 2021 alone, with retailers reporting a 26.5% increase in organized retail crime, the vast majority said the violence and aggression associate associated with it increased in the past year. >> a lot of the stolen merchandise just ends up being
