right for you. >> building a better bay area moving forward. finding solutions. this is abc7 news. let's not let a one judge impact our ability to do what all san franciscans want. >> they want clean streets. they want homeless people to be helped. and that is exactly what we are trying to do today. >> the fight over homeless sweeps intensify ties as an impassioned mayor, london breed pleads for the ninth circuit court of appeals to lift an injunction that temporarily blocks the city from clearing homeless encampments. good evening. thank you for joining us. i'm dan ashley. >> and i'm ahmed daetz. but opponents argue the homeless sweeps are inhumane and ineffective. abc seven news reporter loose pena was outside the courthouse where hundreds rallied. >> she is live from the newsroom with the latest on this loose. >> dan and emma. well, today was a crucial day for both the city and county of san francisco and the coalition on homelessness. the city is being sued by the coalition as it stands, the

order is keeping the city from clearing and encampments as long as the number of people experiencing homelessness is greater than the number of shelter beds available today. the city appealed for that injunction to be removed. but the swease hundreds rallied outside the ninth circuit court of appeals in san francisco. among them, mayor london breed and the fact that the courts have crippled our ability to do our jobs, to help get people into shelter. >> there is criminals right? if we have a place for someone to go, they need to go. there has to be accountability. >> mayor breed accused the coalition on homelessness of holding san francisco hostage with an injunction that limits the city's ability to tackle homelessness. >> if this city is being taken advantage of and we are tired of it. >> among the crowd, this business owner urging the city to intervene. >> the other day we had a guy on

our literally on our front step who refused to move and then threatened one of my employees. when she asked if she could step out of the building to go home. >> according to the city's department of homelessness and supportive housing, in 2022, the city identified died 7754 people experiencing homelessness in the city as part of the injunction, the coalition on homelessness is requesting the city offer shelter to individuals before removing their belongings. the coalition on homelessness says encampment sweeps are not the answer. what we're trying to do with this lawsuit is get the city to stop abusing people's basic rights. >> we're trying to get them to stop illegally confiscating property and criminalizing them when they have no choice but to be on the streets. >> we're not saying they need to have enough shelter for everyone on. we're saying that they need to provide specific individuals with shelter inside the federal court. >> san francisco city attorney david chu tried to persuade the judges to stop the injunction. the challenge with the judge's order is, is that it has created

an impossible situation for us to implement and the order has been so vague, it's been very difficult for us to figure out where to hit the mark. the federal judges questioned the attorneys for the coalition on homelessness. in your brief, you repeatedly say individuals who have practical, which i understand you're now saying is like readily available and voluntary access to shelter. >> so are you now no longer requiring that voluntary condition on so individuals are not compelled to use shelter? >> right. but certainly if they do have access to shelter and they decide not to use it, that doesn't make them involuntarily homeless. >> the city attorney viewed this as a breakthrough. it was a major concession, frankly, surprised us. and according to the latest city data, shelters are basically at capacity here in san francisco, 92% full. now, regarding what's next, a decision from these federal judges can come any time in the upcoming months. and the implications will impact nine

western states, not only san francisco in the newsroom. los pena, abc seven news. okay luce, thanks very much. >> governor gavin newsom released this statement today saying in california, we are cutting red tape and making unprecedented investments to address homelessness. but with each hard fought step forward, the courts are creating costly delays that slow progress. he goes on, i urge the courts to empower local communities to address street encampments quickly and comprehensively. stay with abc seven news for the latest on the fight over homeless sweeps. >> we have the latest on our website abc7 news.com there. you'll also find a link to the city's dashboard showing shelter sites, capacity and occupy rates. >> a sunnyvale man is recovering tonight after being shot while confronting four people trying to steal the catalytic converter off his car. it happened in the driveway of the man's home on klamath drive around 330 this morning. authorities say one of the suspects fired four shots hitting the victim once in the left leg. >> if you do encounter suspects

, do not engage them. >> be a good witness. >> call 911. provide as much information as you can to our dispatchers. that way we have the best chance of apprehending the suspects. >> the suspects took off in a dark colored sedan before removing the catalytic converter. >> new details on the maui wildfires. officials have confirmed one of the people killed in the lahaina wildfire was a tourist from northern california. 72 year old teresa cooke from pollock pines, which is in el dorado county, had been vacationing on maui. according to a social media post by her daughter, cooke was supposed to return to sacramento on august 9th. the fires started august 8th. cooke's daughter said her mom was last seen the prior weekend near the famous banyan tree in lahaina, facing a long list of people who are unaccounted for, the fbi is pleading with people to submit their dna. more than 1000 people are missing, but there isn't an official public list or the number of dead from the fires is 115. however, officials expect that number to go up as they

search through more buildings in lahaina, lahaina public school employees will be headed back to work on monday. it is unclear, though, when students will return. >> at least one person has died in the happy camp complex fire. the fire has burned more than 11,000 acres overnight in the klamath national forest near the oregon border. forest service officials say at least 755 people were forced to evacuate that area. nine structures have been destroyed and two others have been damaged. so far, it is 2% contained. and the map here shows the smith river complex fire burning in del norte county. the fire has destroyed more than 47,000 acres and no containment at all. zero. it's just miles away from the flames at the happy camp complex. evacuation orders are in place. no one, thankfully, has been hurt. >> the plan to expand oakland international airport could be a big boost to the economy and create more jobs. but some are concerned it will be more noise and more pollution. >> yeah, the group called stop oak expansion has an even bigger

concern, one they claim is not addressed in the draft environmental impact report. abc seven news reporter sara hassan joins us live from the airport with more on that. >> unser omen. >> dan, good evening. >> oakland mayor shengtao says expanding the airport would be a big boost to oakland's post-pandemic recovery. but environmentalists say there's one problem. they claim that the draft environmental impact report doesn't take into account the planes that actually take off and land here at the airport. there are big concerns for those opposed to the proposed expansion of the oakland international airport. aerial icranet says the biggest issue has to do with the airplanes. it's important to be aware that 99% of a modern airport's emissions are actually from the flights. >> granite is part of the group. >> stop. okay expansion. it's a coalition made up of 62 local grassroots organizations. they argue that the new draft environmental impact report released by the port of oakland, which owns and operates the oakland airport, doesn't take into account the greenhouse gas

emissions from the actual airplanes. >> they claim that the impact of pollution and climate, global warming emissions are significant but unavoidable. and that's because they don't actually directly regulate the emissions from flights. >> the oakland airport expects the number of passengers to more than double over the next 15 years. the proposal is to add 16 new gates and expand the international arrival facilities. colleen liang with the port of oakland spoke to abc seven news in july. this is definitely a milestone for oakland airport. >> as i mentioned earlier, we have not modernized the terminal since it was built. >> in an email to abc seven news, the port of oakland responded to claims about the draft eir by saying, okay, continues to explore the new zero emission aviation technologies that will help us achieve our zero emissions goals. it wants to reach zero emissions by 2040. it says it's working with airlines to increase the use of what's called sustainable aviation

fuel, which is not a fossil fuel. okay says it already has commitments from southwest airlines. the airport also joined airport carbon accreditation, an international program that requires airport members to complete a review of greenhouse gas inventory. his granite says local, state and federal agencies need to work more closely with the aviation industry to come up with a plan to reduce airline emissions and for investments in alternative modes of transport. >> nation traveling is very important, but faced with the climate emergency, there's really no economy on a dead planet and there's no tourism and pleasure on a dead planet. there are two final public meetings next wednesday. >> the group plans to rally at 10:30 a.m. at the hilton oakland airport ahead of the first one. reporting live, i'm saad hassan, abc seven news. >> okay, hunter, thank you. >> coming up, we have some sports news as the owner of the oakland a's talks about his plans to relocate the team and respond to calls from fans to sell the team. >> plus, is trailer done for 40

commercial businesses as ab 1572 already sailed through the assembly and if approved by the state senate in the next few weeks it could become law in 2027. the ban would not affect residential lawns or functional grass like on sports fields or grass in parks for picnics or dog walking or recreation. for the last few years, there's been a temporary ban in place on using potable water on so-called ornamental turf, on commercial properties and now that ban could become permanent. >> what we're talking about is the keep off the grass, grass, grass that's in the middle of a median strip. >> that's on a landscape of a commercial building that's behind a wall that no one ever is supposed to sit on grass that's not doing anything except sit there and get mowed and have someone put fertilizer on. once a week and water. >> but opponents see forcing businesses to change their landscaping as an onerous expense. >> what we need is more water storage, not policies,

the 90s and one hundreds inland . our hottest spots coast is the place to be. half moon bay you're at 73 degrees compared to 24 hours ago. everyone running higher, 13 degrees warmer in mountain view up 12in napa, up ten in san jose. live views from our tower cameras pretty much show you plenty of sun across the bay area. the fog that we had along the coast got swept down to the south with a northerly wind and now up to our north, we do have a red flag warning that starts tomorrow afternoon, runs until early friday. red flag warning as they are expecting thunderstorms. lightning could trigger some fires. so something to keep in mind on that subject. you probably have noticed a little bit of haze as you look from our east bay hills camera. that's because smoke from the northern california fires still impacting us. the air district has that air quality advisory up through today. moderate air quality. expect right now it is good to moderate it at the surface, but the smoke is in the upper parts

of the atmosphere that is just coming in. and as you will notice, that smoke continues to drift into our region. so tonight, still going to have a little bit of haze and smoke aloft. it will shift a little bit more to the north tomorrow night. so there should be some improvement. a live view from our pier 39 camera where people and sea lions all enjoying the bright skies out there. mild overnight fog confined to the coast. the heat hangs around inland tomorrow and it is going to be breezy and much cooler on friday. so not much cooling at 6:00 inland areas. you're still going to be in the 90s by 8 p.m. you're dropping down to the 80s 60s coast and in the morning the fog will form along the coastline, which will help to cool you off at the beaches tomorrow afternoon. not quite as warm, but inland areas, you'll still be in that hot category. morning. temperatures 50 to 70 is clear. inland fog near the coast and it will be limited once again. so it could be dense in pockets. so just watch out for that tomorrow afternoon. it's going to be a warm one in the south bay, 87, san jose, 91in morgan hill on the
