having a beer with his cousin after a long day of work. the officers took him to the ground, breaking his nose, causing a concussion and a shoulder injury that required surgery. and today, more than a year later, after both officers lost their jobs, they appear to marine county superior court on felony assault by a public officer with great bodily injury and making a false statement in a crime report. i tried speaking with both defendants first, brandon neal, who has grown a beard. anything you want to say to the public about what you did that day? are you ready to apologize to julio lopez about what you did or any comment at all? i asked the other former officer, daisy mazariegos, about this moment when she yelled, stop, stop. when you said stop on that recording, was that at brandon or was that at the julio

? are you ready to apologize to julio lopez? attorneys for both former officers gave me an idea of their planned defense. >> we have ample evidence that this case cannot be proven beyond a reasonable doubt because the force wasn't excessive and there were no willful misrepresentations, as she's very much looking forward to being exonerated in this case . >> and i think that's what's going to happen. i think it's very unfortunate that the district attorney has chosen to do this. >> the gardener, julio lopez, had to be there as a witness, but his court wrapped up. he couldn't face the former officers. >> i went to the bathroom, you know, because i don't want i want i don't want to see them. you know, because, you know, i feel i feel scary, you know, about them. you know, i don't want to see their face. >> it's not something that he's comfortable doing at this time. he's still experiencing some of the trauma of the assault and some things are triggers for him. and seeing the officers face to face definitely would have been that uh- the preliminary hearing has been delayed for two weeks to work

out a potential conflict of interest. >> it appears brandon nail's attorney may have represented someone who will appear as a witness in the case. there's also a second track on this case. the federal civil rights lawsuit filed by the gardener. so these two cases moving forward, ahead. >> i know you're following them both. you got it. thanks stan, very much. >> and to get in touch with the i-team, you can call this number on your screen or go to abc7, news.com slash i-team. wow. today san francisco mayor, london breed cut the ribbon on y area in 20 years.pen in the >> the east palo alto location opened in 2003. shortly after ikea's first bay area store, which opened in emeryville in 2000. the san francisco store is different, though located downtown on market and fifth street. it's smaller than most ikea stores, with a focus on smaller items. yet there is hope it will have a big impact. >> this ikea is opening in the

same week and just blocks away from the nordstrom at westfield mall that's closing. in the past few months, more than a dozen stores along market street and in union square have closed this map shows some of the bigger nas st say it has to do with a lack of foot traffic in the area. some say the safety is to blame, and that's what we heard when whole foods at market and eighth street closed abruptly in april. it's been a dismal few months for downtown san francisco. >> it really has. but our focus is on building a better bay area, and that's the turnaround we could be seeing now. at least that's the hope. abc7 news reporter suzanne is in the newsroom. yes she went to ikea's opening today and suzanne, what was it like? >> it was definitely a festive day, especially for ikea. now as many as 100 people lined up this morning eager to check out that new ikea store. there was a long line music and a lot of cheers because of the new business and many people hope ikea could help jumpstart downtown san francisco's recovery. so why are and with that, the new ikea

store at 945 market street in downtown san francisco is now officially open. there was plenty of excitement and fanfare among shoppers today. daniel cherry got in line at 5 a.m. i just wanted to be the first big grand entrance to see it all. >> first, the new ikea store in san francisco has a different format. >> instead of what big box suburban stores offer, this store will carry home furnishing accessories, and it's focused on small space living. this is a different type of ikea. >> it's made out of like three stories. it's 52,000 square foot full of inspiration and solutions. >> mayor london breed has an ambitious plan to build more housing in the city in the next eight years. >> we hope to be able to build 82,000 units. and what does that mean? a bunch of people who need furniture and those units are not going to be big. they're going to be kind of small because we know how it is in an urban, dense city like san francisco.

>> ikea launched this new store at a time when many other retailers in san francisco's downtown shopping district have given up westfield mall, old navy, whole foods, nordstrom are just a few. city leaders say ikea promises new jobs and new reasons to come downtown, that this new store is a place to shop and work. and what i love about this is that it's not just retail, but it's also a community space where people can come and work on their laptops and have coffee. as for concerns about safety in the mid market area, the ikea store manager says there will be extra security during business hours. some wonder if the new ikea store can succeed. others wonder if this is a good sign of downtown's recovery. kyle havens just moved to downtown san francisco from texas for work, hopefully so. >> i think it will serve the people who already live downtown and nearby. >> it's a start. i'm happy to see a new building. >> i hope so. i hope it brings in more businesses that are empty right now. and, you know, this brings in people. so

hopefully other places will start reopening. >> and the store manager tells me there will be 8 to 10 security guards at the new ikea to ensure that the safe stay of the staff and the customers is there. again, the mayor and other supporters say ikea will help bring more jobs, more people and more commercial activity to the mid-market area . live in the newsroom, suzannephan abc seven news. >> okay, suzanne, thanks a lot. >> the city of san francisco went to federal court today appealing a temporary injunction blocking the city from clearing homeless encampments. hundreds on both sides of the issue rallied outside the ninth circuit court of appeals, including members of the coalition on homelessness and mayor london breed. and the fact that the courts have crippled our ability to do our jobs to help get people into shelter is criminals. >> we're trying to get them to stop illegally confiscating property and criminalizing them when they have no choice but to be on the streets. >> inside court, that claim about having no choice but to be

on the street took center stage in a surprise concession, the coalition's attorney acknowledged those who refuse genuine offers of shelter should not be considered involuntarily homeless. attorneys for the city consider that a major breakthrough in santa clara county. the valley water district is stepping up its efforts to clean up debris from encampments along local waterways, adding a second crew of 8 to 10 daily workers. under the program, the unhoused are given 72 hours notice of the crews arrival. once there, an effort is made to determine what is and is not trash. the unhoused say the program has been effective. >> it is working out. they've been very accommodating to that . and i haven't had any issues at all. >> it's absolutely a win win. we need to be able to provide more routine service to the neighbors , to the unhoused community and to the waterways in the south bay. >> zach fuentes, abc seven news . >> and neighbors that we spoke with agree with the goal to keep

pollutants out of the waterways. but they're also calling for better long term engagement between agencies and the unhoused to get them off the creek beds and into housing. >> let's turn now to the maui wildfires, where the fbi is getting involved to try to locate those who remain unaccounted for with a list of more than 1000 people to go through. the public is being asked to provide dna samples. so far, the fbi has received just over 100. maui officials are warning people to beware of dna, collect scams. some of the victims have reportedly received phone calls. employees with lahaina public schools are going to return to work on monday. they've been on leave since august eighth when the fire started. there is no word when students will head back into school on northern california. woman visiting maui died in the wildfire that roared through the hina. 72 year old terry cooke of pollock pines was last seen near the famous banyan tree. her daughter posted on social media that cooke was supposed to return home on august 9th. one

expansion. it's a coalition made up of 62 local grassroots organizations. they argue that the new draft environmental impact report released by the port of oakland, which owns and operates the oakland airport, does not take into account the greenhouse gas emissions from the actual airplanes. >> they claim that the impact of pollution and climate, global warming emissions are significant, but unavoidable. and that's because they don't actually directly regulate the emissions from flights. >> the oakland airport expects the number of passengers to more than double over the next 15 years. the proposal is to add 16 new gates and expand the international arrival facilities colleen liang with the port of oakland spoke to abc seven news in july this is definitely a milestone for oakland airport. >> as i mentioned earlier, we have not modernized the terminal since it was built. in an email to abc seven news, the port of oakland responded to claims about the draft eir by saying,

okay, continues to explore the new zero emission aviation technologies that will help us achieve our zero emissions goals. >> it wants to reach zero emissions by 2040. it says it's working with airlines to increase the use of what's called sustainable aviation fuel, which is not a fossil fuel. okay says it already has commitments from southwest airlines. the airport also joined airport carbon accreditation, an international program that requires airport members to complete a review of greenhouse gas inventory. his granite says local, state and federal agencies need to work more closely with the aviation industry to come up with a plan to reduce airline emissions. and for investments in alternative modes of transportation. >> traveling is very important, but faced with the climate emergency, there's really no economy on a dead planet, and there's no tourism and pleasure on a dead planet. >> there are two final public meetings next wednesday. the group plans to rally at 10:30 a.m. at the hilton oakland airport, out ahead of the first meeting in oakland on hassan, abc seven news. all right.

>> we could feel the heat right away today. you sure could. >> on most parts of the bay area, pretty warm in the city, too. meteorologist sandhya patel is here. sandhya yeah, and dan and ana. >> it was warm enough to set a record. it was a 90 degrees in downtown oakland, which tied the previous record set back in 2010. >> hot enough for you? many areas were in the 90s from napa to santa rosa, 96, in livermore , 95. san jose redwood city, 94 degrees. it was 101 in fairfield, but half moon bay, 69 degrees. so quite the stretch. a live view from our san jose camera as we're looking at the sun shining right now in the south bay, 78 in san francisco, it is 81 in oakland, still warm in san jose, 87, palo alto and 91 degrees from our kgo roof camera. there is barely a breeze, but that breeze is going to help to cool us off. temperatures have already started to drop in some areas. santa rosa, 90 degrees, 99 in fairfield, mid 90s in concord and livermore north. wind blew that fog south of the bay area

that we had this morning along the coast that same wind, though, is concerning as we i will show you in just a moment. here it is tomorrow is going to be some active weather in the northern part of the state. red flag warnings begin at 3:00, run until friday morning at 2 a.m. so that wind, that northerly wind has been bringing in smoke from those fires burning up in northern california. you can see that haze from our camera there. so the air quality advisory remains up through today day moderate air quality expected down at the surface. air quality is still fine, good to moderate, but if you smell or see smoke, certainly close your windows and doors if you can safely and turn your ac on, recirculate if you have it. so the smoke is not just up to the north, but around the northern california wildfires that is drifting into our area and that is going to be the case as we head in towards the next few hours. but then the smoke will start to lift back to our north, back up towards the northern california, oregon border, blue skies from our

golden gate bridge camera, mild overnight fog confined to the coast. the heat hangs around inland tomorrow it is going to be breezy and much cooler on friday, 7:00 tonight. still short sleeve weather. you will notice many areas in the 70s to 90s by 9 p.m. my coastside cooler inland, even though it's still going to be warm for our taste as we head into 7 a.m. tomorrow. fog near the beaches and in the early afternoon inland areas continue to warm, but it's not going to be warmer than today. it's actually going to be backing off a few degrees , 50 to 70 on your temperatures. clear inland fog at the coast tomorrow afternoon in the south bay, 87 in san jose, los gatos, 92 degrees on the peninsula. you're looking at 84. in redwood city, 67, half moon bay, san francisco, 73 degrees. some fog near the coast, 69 in the sunset district. north bay numbers 87. san rafael, 89. santa rosa heading into the east bay 78 oakland. these temperatures still well above average. 86 in fremont inland 93. concord 95. in antioch, 93 degrees in

to give people with als the ability to communicate. again, it's really something. >> abc7 news south bay reporter dustin dorsey has a look at this really remarkable technology. >> how do you feel judging by the smile on pat bennett's face , i'd say she's feeling pretty good. that's because for the first time since developing als , she is able to communicate once again this miracle. thanks to incredible new research on stanford university's campus. >> our aim is to restore communication by reading out brain signals using computer algorithms or computer software to interpret those brain signals, and then changing them into actions in the outside world. >> a need for bennett, who was a human resources director in equestria before her 2021 als diagnosis that caused deterioration in her brain stem als attacks. neurons controlling movement causing physical weakness and eventual paralysis . she can make sounds, but bennett's als led to the loss of use of the muscles of her lips,

tongue, larynx and jaws. muscles needed to communicate clearly. >> it's depressing to in 2022, stanford medicine professor of neurosurgery, dr. jamie henderson, implanted sensors about the size of popcorn kernels in bennett's cerebral cortex. >> in her brain. these sensors communicate with the hundreds of brain cells where speech production occurs. using her brainwaves, the sensors detect words that she wants to say, and the pedestals that you see on her head relay those brainwaves to the screen to develop the words and phrases. i like music . this allows bennett to communicate without being able to form the words physically. >> as pat looks at a computer screen, a sentence would appear . she would attempt to read that sentence. we would read out the brain signals, translate them using a machine learning algorithm into text, which then gets placed back onto the screen. >> in this case, practice makes perfect. bennett has participated in 25 training sessions and with time she has developed the ability to

communicate around 60 words a minute. being able to speak again is life changing for her. >> oh, i have hope, doctor henderson says. >> this is just a proof of concept, but he hopes in the next 5 to 10 years, systems can be in place to give more people their voice back again. >> people with communication disorders can sometimes become withdrawn, become less socially active, and this could allow people to get back into social situations so it could it could potentially be transformative in the south bay. >> dustin dorsey, abc7 news. >> huge difference. >> yeah. that is so great for pat. this technology has so much promise. let's hope one day they solve als just a terrible disease. well a new california bill could double the number of paid sick days, but time is running out to make it happen. we'll explain. also ahead, the first word that came up to mind was coward. >> a harsh words in response to words from the owner of the oakland a's who says he's not

>> this is abc7 news as well. >> a's owner john fisher has broken his silence regarding the proposed move from oakland to las vegas. >> in a new interview with the las vegas review journal, fisher said the a's have submitted their relocation application to major league baseball. he also confirmed that he has no plans to sell the team. >> abc7 news reporter lena howland has reaction from a's fans in a new interview, the oakland a's owner john fisher tells mick akers that the las vegas revi journal, quote, i ha not considered selling the team i've now owned the tm with my partner, lew wolff sce 2005. >> our goal since then has been to find a new home and build a new home for our team. >> this is the worst thing that's happened in the history of the oakland a's. >> fisher's interview in response to a call by fans to sell the team, the oakland a's 60 eights, leading the effort with a reverse boycott, hoping to stop the a's looming move to las vegas. >> honestly, the first the first word that came up to mind was

coward. >> george leon, president of the oakland sixty-eighths, was on the forefront of that reverse boycott, helping to print thousands of bright green sell shirts for fans over the summer. many wearing those shirts to wednesday's game. we always did this knowing that this was probably not going to come to fruition, you know, with selling the team. >> but we still feel that there is a group out there that can buy the team and keep them here and oakland. >> but fisher says the whole reason behind building a new stadium is to make it to the world series within a six year period. fisher told the las vegas review journal the a's have had a morlenging time signing free agents becae we haven't had the revenues to suora payroll. to do that, we ethat being in a new stadium, being in las vegas is going to change all of that. >> i just don't believe anything he says. they told us they were going to stay in oakland and now they're uprooting from oakland. so i think that's just a

terrible shame on his part. >> there's probably no reason for him to sell the team. >> you know, he's just in it for financial gain. i feel you can just feel that within the past ten years of just how, you know, he kind of liquidates the team each year, still, many fans are holding out hope. until i see shovels in the ground in las vegas, i'm thinking that there's going to be a way for them to stay in oakland and leon says their fight continues. >> nothing's not for sale. there's a price for everything in oakland. >> lena howland, abc seven news. >> tomorrow, former president donald trump is expected to surrender at the fulton county jail in atlanta, georgia, where he will be fingerprinted and photographed. that's what happened today to rudy giuliani . here's his mug shot. giuliani and trump were among 19 people indicted on more than a dozen counts related to alleged efforts to subvert the 2020 election results in georgia. nine of the 19 defendants have been processed so far. the deadline to turn themselves in is friday.

>> stocks closed on a high today with the influence of artificial intelligence chip company nvidia playing a huge role. the dow jumped nearly 190 points. the nasdaq earned 215. the s&p closed with a 48 point gain. stock in peloton today dropped about 25. the exercise equipment company whose stationary bikes became very popular in the pandemic, is dealing with a recall that's costing it about $40 million. peloton says the seat of its original bike model is a safety hazard because it could break during use. about 2 million bikes are affected by the recall. some 20,000 peloton members have paused their subscriptions as they await new seats. >> a new bill would more than double the minimum number of paid sick days for california workers. right now, the requirement is three. now this bill would raise that to seven. reporter sophie flay from our sister station in los angeles explains. time to make that

kremlin a few months ago is believed to have died today in a plane crash. yevgeny prigozhin was one of ten people on board the plane. it was his own private jet. he's a billionaire. apparently, all were reportedly killed. the plane crashed outside moscow. the cause is unknown, but it has triggered a flood of speculation about whether prigozhin may have been targeted. there are expert reports and speculation about a potential missile strike that could have brought it down. prigozhin is brief. mutiny in june, rock vladimir putin's rule. putin's rule which but prigozhin abruptly called off his forces after a surprise deal was brokered with putin, who pardoned mutineers. and now this. tomorrow 12 years after the disaster at japan's fukushima nuclear power plant, the country will start releasing wastewater from the site into the pacific ocean. the water is equal in volume to about 500 olympic swimming pools. japan's prime minister says it has been treated and asserts it is safe for humans and marine life. the
