say they are getting tough on crime. but will it be enough? >> thieves get more brazen hitting car after car thank you for joining us. news anchor karina nova. >> spoke to the man who shot the photo and he shot it to raise awareness. it is had more than one million views on youtube. the video starts with items being taken out of this vehicle. the photographer started shooting the video when he saw a person driving and another hopping out to break into cars. this is on

the cars they hit up. this white suv is the second one in less than 30s as the car drives by a hop on, hop off, big bus. you can see it speed past people on a pedicab and look here, you can see the man reach into this blue suv where it looks like there is someone inside. there is a hand right there. and you can hear someone screaming. and they keep going, making a dangerous turn here. they don't break into the white suv after looking inside. and that's when the recording stops. three cars were broken into in less than two minutes. the man who shot the video told me he didn't feel in danger, but stopped recording in case his luck ran out. he also told me he took the video to police and they said they know this is happening. returning to the area the next day, he says there was added police presence overall. all he said, this is just a sad

situation and he hopes people are aware it's happening. >> abc7 news reporter cornell bernard cornell is live in the newsroom with the city's new plan to crack down cornell. >> larry and kristen, police launching a new tactic to stop or reduce those brazen smash and grab car break-ins and officials made the announcement today near a popular tourist area. but just minutes before the news conference began, you guessed it, there was a break in. >> people that do this have to be held accountable. >> sfpd chief william scott is talking about a crime spree that's reached epidemic proportions. brazen car break-ins are happening every day across the city, especially in popular tourist areas. >> we are are restaffing our deployment for our tourist areas. >> scott says his department is adding more officers in tourist neighborhoods and he plans to use bait cars to catch thieves. >> so when people come in to

this city or people who are in this city break in the cars, they may be breaking into cars that are put out there by the san francisco police department. we intend to catch people in the act. these are very, very thank you. >> what an ironic thing. right? what are the chances? >> ironic, considering moments before this news conference began at the palace of fine arts tourist lindsay doubler from missouri had her family's rental car broken into near the same spot. >> so we pulled over park, got out, did a little sightseeing, and when we came back, we had our back glass shattered out and yeah, and four backpacks stolen with a lot of electronics and all the passports and t stuff. , guys. >> yep. appreciate it. thanks >> after an officer took their report, we asked the chief about what just happened. >> my reaction? i'm sick and tired of this happening to people in the city like you said, you know, i've had my car broken in long ago. i have people in my family whose car has been broken in. friends this impacts us all the sfpd says so far this year there have been

13,331 reported car break ins, compared to 13,493 for the same period in 2022. >> da brooke jenkins is promising penalties for those caught. >> that's what we are trying to reinstate. bill in san francisco right now is that not only will you be caught, but when you are prosecuted, there will be a consequence for that behavior. >> are you sick of it? >> of course i am. yeah. >> marina district neighbors like daphne are hopeful the break ins can be stopped. it's been going on too long, and we need to do more. >> and the only thing that we've seen as neighbors work is as actual police presence. >> meantime, lindsay from missouri says she'll come back to san francisco, but with a few changes. if you're going to sightsee, leave your stuff in the hotel and just uber somewhere. yeah, and police have the same advice. don't leave valuables inside your car. the chief says things have improved since 2017 when the city had get this 31,000 car break ins. he

says still a lot of work to be done. he hopes this new strategy will work. we will be watching in the newsroom. cornell bernard, abc seven news. >> all right, cornell, thank you . san francisco also struggling with a high number of vacancies, especially if you're talking about downtown. thanks to the vacant to vibrant program, 17 new pop up shops will move into empty storefronts next month. abc7 news reporter suzannephan takes a look at the plan to revitalize downtown at devil's teeth banking company in the outer sunset employs are busy preparing for tomorrow. >> the breakfast sandwich is our biggest seller but for owner hilary passman the months ahead will be crucial. >> passman's business. the recipient of three months free rent a grant of about $8,000 from the city of san francisco and a chance to temper rarely expand her popular bakery with a pop up space in the financial district. >> it's very exciting. so we are going to be bringing our full menu. >> her pop up will go up right here at one embarcadero center past man is one of 17 pop up shops coming to empty downtown

san francisco. storefronts in september. it's part of mayor london breed's vacant, vibrant initiative and part of the roadmap to recovery program. she announced in february. >> this program matches vacant ground floor spaces and their owners with small businesses that are either starting or looking to open a san francisco or second location. >> it's terrific that the city is helping us and not just me, but there's all sorts of diverse creative activators that are coming down there now. and i think it's going to really make a difference. >> san francisco's office of economic workforce development and nonprofit business advocacy groups sf new deal announced the 17 awardees for phase one. they include artists, designers and a radio station at this empty storefront at 201. jackson street, the gateway to pop ups are slated, including a multi media agency and then brewhouse , a skate collective streetwear apparel brand. one of the property owners participating in the program is bxp. they issued

this statement, quote, bxp is committed to supporting a strong downtown and our vibrant san francisco community by hosting four pop up activations at embarcadero center that will further our collective efforts to revitalize downtown by supporting local artists, entrepreneurs and small businesses back to the bakery. pop up coming to one embarcadero center, neighboring businesses can't wait. javid bakshi is the owner of the humidor. >> it would be great if we can get somebody here or or, you know, other places in the financial district. >> the vacant, vibrant program is accepting applications for future phases. if you're a local business, an artist, a nonprofit or a property owner, they're hoping to hear from you in san francisco. suzannephan abc7 news . >> in the south bay. city leaders are putting pressure on the owners of a vacant building in downtown san jose. >> yeah, it's been empty for years and now officials want to force the owner to clean it up. abc seven news reporter dustin dorsey with the details.

>> as this is ideally what downtown san jose would look like to residents, the city council and mayor matt mehan clean, vibrant and a good representation of the city. this on the other hand this is exactly what they do not want downtown to look like. >> my office, my team have been flooded with emails and phone calls about what our constituents call the trash bag church. >> what is a beautiful, historic landmark park has become an eyesore because of one negligent property owner in 2017. >> controversial real estate company zanele properties purchased the historic first church of christ scientist property. it's one of multiple rundown unfit buildings they own in san jose. this is what it once looked like. and this is now covered in scaffolding and construction tarps. mayor mehan says the city has been finding the buildings owners for code violations. >> we are charging xinle properties $1,000 per day because of their inaction. by mid-march we will be at $100,000

in assessed fines, which is currently the limit in the city of san jose. those fines are unpaid and the $100,000 may not be the limit for long. >> mayor mehan and council member omar torres will propose the city council approved an increased fine limit of $500,000 to further pressure properties and other owners to keep their buildings up to code. downtown resident elizabeth chen. hail says this is crucial in order to make downtown a place for people to visit and live. there's just an overall feel that the park is not vibrant. >> the neighborhood is not vibrant and may not be safe. so i think having a nice building here will only add to the utilization and enhancement of the park. >> we owe it to our community, to our history and to our vibrancy of our downtown san jose. enough is enough. >> the city hopes to obtain the building so they can work with the preservation action council to restore it to its prior glory. we tried to reach out to zeno properties, but all numbers for their business are offline in san jose. dustin dorsey, abc

moment now. this is video of his motorcade leaving new jersey this afternoon bound for the fulton county jail in atlanta. he has landed in atlanta and he's going to soon be booked on more than a dozen charges stemming from his efforts to reverse georgia's 2020 election results. the former president will be fingerprinted. and unlike his previous three indictments, is a mug shot will be taken. we're expecting live coverage from our colleagues at abc news once trump arrives. all right. >> joining us now is abc seven news political analyst jackie speier. thanks so much for coming in. so we don't know how this case is going to go, but now we've got four cases against the former president. it seems like every time he's charged, his popularity goes up with a certain segment of republican voters. how do you see this playing out? >> i don't think it's going to be much different. in fact, not only does his popularity go up, his fundraising goes up. and that it's pretty unusual in most set of circumstances with the exception of donald trump. anyone else with an indictment, anyone else with a sexual

assault, anyone else with an affair, you know, they're toast at this point in a campaign. but not donald trump. >> right. and of course, last night, the first republican presidential primary debate was held noticeably. trump was not on stage, although he seemed to dominate the attention anyway. what did you make of last night? what stood out to you? >> so last night, the big winner was donald trump. and this was an audition for the vice president partial nomination by trump, in my view, an and i think what we saw was really strong showings by nikki haley. and surprisingly surprisingly, by a 38 year old billionaire who's never held public office before. for vivek ramasamy. yes swamy yes. >> we're still learning, learning how to say his name but that was what he wanted to create. >> last night was an opportunity to become a first tier candidate . he is more trump than trump and frighten wing positions on

some issues. but it we'll see. >> like we shouldn't support ukraine. we shouldn't support taiwan. you know, just outrageous things in terms of the political spectrum and what people usually say. >> i mean, he was saying in no uncertain terms, we should not be party to nato. i mean, it would an upset and our european friends and certainly our sense of assurances that as a member of nato, one, once you're in you're in for everyone and everyone's in for you. >> yeah. also against climate change, but, you know, just add it to the list. so how do you see i mean, obviously we don't know how these four cases are going to go. is there any kind of inkling that at some point members of the republican party are going to look at donald trump as not as their savior, but as a negative when it comes to, you know, the next election? you know, as these trials unfold ? >> and it's still unclear when they will actually start, you

might see that eroding. but where will we be in the campaign cycle? will he already be the republican nominee? that's really we'll still have to wait. and see what happens there. >> yeah, you know, when the candidates on stage last night were asked, would you still support trump if he were the nominee? i think 6 or 7, depending on if you thought christie was just waving his finger or raised his hand. >> yeah, right. >> yeah, that was pretty stunning. but do you think that is out of step or in step with most republican voters, not just trump supporters, but the whole of the republican party? >> there's a cult associated with donald trump, whether you're running for the president , tsay, or whether you're a us senator or a house member, no one wants to cross him because that base, as small as it is, it's only about 34, 36% of the republican base. but it is right now the most important part. and if you can't retain that, you become less likely to be a candidate. so most of them are waiting to see if he starts to

down 11 in concord, ten degrees cooler in san jose. the sea breeze is helping. it's stronger at 38 miles an hour is sustained right now. and from our east bay hills camera, you see a little bit of haze as we look towards mount diablo. the air district has issued an air quality advisory for tomorrow due to smoke from the northern california wildfires. so keep this in mind. it's expected to be in the upper parts of the atmosphere down lower near the surface. you will notice air quality is still fine. good to moderate. a live view from our pier 39 camera. well, visitors and sea lions enjoying some sun there. 70s from san francisco to oakland, it is cooler today, no doubt about it. 84 in san jose and currently 83 in palo alto. pretty socked in from our santa cruz camera right now. 82 degrees in santa rosa, 88 in fairfield. our warmest spots today getting up into the low 90s so far. napa 77 livermore 84 degrees and you can see this blanket of fog over the golden gate bridge. here's a look at the forecast. marine layer expands patchy drizzle

overnight. breezy and cooler tomorrow afternoon and we are looking at a gradual warming trend that starts this weekend. so tonight at 5:00, numbers inland still in the 80s 60s coast side, we will notice the temperatures is dropping off. so it's not going to be quite as warm as it was this morning. tomorrow morning at 7:00, there might even be some drizzle. certainly a lot more in the way of fog as we head towards the afternoon hours. the warmest spots barely making it to 90 degrees, 91 degrees your morning temperatures in the 50s, 60s, some only a mild one. inland fog along the coast as we check out the afternoon highs, it's still going to be warm tomorrow, inland, but not quite as warm as it has been. we're talking about 88 in livermore, 64, in half moon bay, 81 in san rafael, 82. santa rosa, 74. in oakland, 68. in the city, 80 degrees in san jose. accuweather seven day forecast breezy and cooler for your friday temperatures rebound over the weekend and really it's going to be pleasant weather for

>> i actually heard the gunshots thinking that it was fireworks. >> alameda county prosecutors have informed that mother from san leandro that the teenage gang member who shot and killed her son in january could be back on the streets in as little as four years. >> she contacted the abc7 i-team to find out why the 17 year old gunman is not being tried as an adult for the murder. the i-team's dan noyes is here now with the story. dan? well, chris and larry, in addition to the mother and several sources inside the da's office, i was able to speak with a witness who was in the parked car just inches away when lamar converse died. >> i asked cassandra riley to describe her son, 35 year old lamar converse. >> lamar was a loving person. he will give you his shirt off his back. she lost lamar the night of january 30th, even heard the gunfire for a little over a block away and since then, she's been afraid to leave her home. i

get afraid i get afraid i'd be afraid. are you now afraid more going outside than you were before? >> all the time. >> i actually went to the nail shop down the street and had to call somebody to pick me up because i was nervous. i was scared. >> that monday night, just before 11:00. >> lamar asked this friend to give him a ride to meet a young woman who wanted to buy two ounces of marijuana. >> so i pulled on this side, the girl walks from the corner and i roll down his window. >> he's talking to her about the transaction of the weed. >> sources inside the da's office verified his story. lamar met the 18 year old woman online. >> they said a meeting at 167th avenue and east 14th street in san leandro. >> she traveled there with her 17 year old friend. >> authorities say he's a member of oakland's ghost town gang and that she tried to use counterfeit money. >> so he started counting. he got like 2040. and then he looked at the money like this money fake. you can see on surveillance video from a used car lot that lamar converse

argues with a woman. >> a then her 17 year old friend rushes up with a handgun. >> all i see is the gun. he, like the dude, walked to the car like, give me everything. tear it off. five, five, five, five, five, five. you start shooting. he never reached for nothing. martin never made a move. we didn't have no guns on us. we ain't. we wasn't nothing going on. funny with us, you know, he was just trying to get his money and we was going to go back home. >> three weeks later, alameda county sheriff's investigators arrested the 17 year old. one prosecutor told me the shooter confessed that it was a rock solid case for transfer to adult court and not a robbery, but a planned hit. but i was there monday at the juvenile justice center in san leandro when the da's office announced a deal. the teen admits murder in the second degree with personal and intention discharge of a firearm. but he won't receive the 40 years to life prison sentence. he could face if tried as an adult. the case remains in juvenile court. >> that's heartbreaking to hear

them say they want to trial him as a juvenile. >> everyone gets released from juvenile hall by the time they're 25. but sources inside the da's office tell me the gunman could be out in 2 to 3 years if he follows the program. >> his mother declined to comment after the hearing. >> cassandra riley directed her anger at district attorney pamela price. >> the decision that was made today up in court was not right. i need her to go deep down inside and feel the pain that i'm suffering with so she would know how it feels and make the right decision. >> riley tells me she requested a meeting with pamela price, but never got an answer. >> the people who live in this county have said, we want a different vision. we want a different administration of how we do justice. >> but i also never received an answer to my request for an interview with the da. after calling and emailing her spokesperson, price did address

alleged efforts to overturn the 2020 election in the state of georgia. this is the fourth criminal indictment this year. the motorcade arriving just moments ago. of course, in this community here, fulton county, this is the most high profile criminal defendant to ever be processed at this particular jail. donald trump, moments from being booked. we are expecting that fingerprints will be taken. there have been questions about a mug shot. the sheriff making it very clear there that donald trump would be treated like any other defendant in fulton county , indicating that there could very well be a mug shot here. he will be processed finger printed, photographed and weighed. and once inside this jail. now, we know this journey this evening. trump traveling from bedminster, new jersey, to atlanta to fulton county, where he has arrived. many of trump's 18 alleged coconspirators have already been booked. former chief of staff mark meadows surrendering just today. trump's former attorneys, rudy giuliani,

jenna ellis, sidney powell, have also been booked. these are images of, of course, the former president coming down the plane , the stairs there a short time ago upon landing in atlanta. and here you have the alleged coconspirator as those who have been booked. the top left of your screen there, mark meadows, the former chief of staff who has been working with his legal team to try to get his particular part of this case moved to federal court as they await that decision from a judge . judge, he was told he had to show up to surrender in fulton county no matter what. they were all given the deadline friday to show up, to be booked, arrested . and so he showed up today just a few remain of those 18 alleged coconspirator rioters. now, donald trump remains the frontrunner for the republican presidential nomination. trump's processing here as we're watching live here, images from wsb, our station in atlanta. the processing of the former president comes 24 hours after

the first republican primary debate, which donald trump, of course, did not attend. some of the news, though, from that debate debate involving donald trump himself. and that was not a surprise. nearly all of the candidates on that stage last night said regardless, even if donald trump is convicted in any of these cases, that they would still support him if he is the republican nominee. let's get right to abc's senior investigative reporter aaron katersky. he's live outside the fulton county jail in atlanta. aaron we were told that this could move very quickly. >> he's been inside about ten minutes so far, david, after his motorcade drove right past us and through the gates into this booking facility. and the former president, daetz vehicles are already lining up for his exit. so it is only expected to take mere minutes for many criminal defendants. this booking process can take hours in a rather unpleasant place. this is the fourth time former president trump has surrendered to face criminal charges, but the first

time he's done so at a jail and a controversial one at that known for overcrowding and for the way they treat inmates for the recent death of an inmate whose body was found covered in bugs. but the former president is not going near any of that necessarily, only there to be fingerprinted, to have his weight and his height recorded and perhaps even to take his first mugshot. or david, one was not required in the other three jurisdictions where he had surrendered. >> and the sheriff, though, there in fulton county, aaron, had indicated publicly that donald trump would be treated no differently than other defendants. and as we look at these live pictures from wsb, of course, the abc affiliate there in atlanta, covering this right along with our team aaron, that was what was expected to play out here, even though more quickly than perhaps other defendant, it's that the former president would be treated in a similar way. >> and i think that reflects the seriousness of the charges, racketeering and a dozen other counts that the former president

faces because the depth of the crimes in the way in the eyes of the district attorney go beyond mere political speech or mere advocacy for a position about what you think happened for the election. the former president is charged with leading a criminal organization that worked to overturn the results against the will of the people of the 2020 georgia vote and the former president at the top of this criminal organization as alleged. that also includes some of his lawyers, some other loyalists who took steps that included phone calls and a pressure campaign, but also included simply falsehoods about fraud, about ballot s being fraudulent, about ballots being counted in germany or spain, or election machines being linked to venezuela, and the deadly hugo chavez. all of that unfolded over an incredible nine week period now constitutes the breadth of this staggering indictment.

>> we know, aaron, that the deadline was tomorrow for the former president to show up there in fulton county. an extraordinary scene playing out here this evening. about 7:45 here in the east. the former president choosing thursday, the day before the deadline in to show up to be arraigned, to be booked. but, aaron, there has been a steady stream, if you will, of alleged coconspirator names that the american people know after years of the trump admin tradtion mark meadows showed up today earlier this week, rudy giuliani, the former president's longtime friend and personal attorney, showing up to be arrested and booked. sidney powell, another attorney who, as you alluded to moments ago, was part of this group accused of pushing lsehoods, conspiracies , lies. and there they are just an it's quite something when you mber of mug shots from these allegenspitors that already hav made public by fulton cntauthorities, aaron

. >> and when you look at those mug shots, you understand the ent groups of people that prosecutors allege were working try and overturn the results of the election. you had the laers who were pushin falsehoods, according to prosecutors, to both the publi , but also behind the scen to georgia lawmarsthen you had the so-called fake electors who were willing to cast ballots for the candthat lost the state. and then there were rs involved in this odd push to have of election machine data looked at, and some of it allegedly be stolen at the behest of some republican officials who are also now part of this indictment along with the former president. >> and we should make clear here, aaron, that the allegation in this indictment is that they broke into these voting machines after the election in in the alleged effort to look for any kind of evidence of fraud they could find to bolster their case . >> and there was no legitimate

fraud that that was ever found. an one of the people who was charged was the county republican commissioner in rural coffee county who sort of gave permission for these people to come in and have a look inappropriate. so and the indictment says that the election data was ultimately stolen. people's personal information and the like. and so it was a serious breach that comprises just part of this indictment. there are 161 separate acts that have been alleged that make up the conspiracy, the racketeering conspiracy and former president trump is alleged to have been the ringleader of all of this. >> stick with us here, aaron. now, about 14 minutes before 8:00. and as aaron reported moments ago, the former president has been inside the fulton county jail for a little more than ten minutes now. those were live pictures from wsb. and as you know, the live nature of this means they come in and out. the president inside that county jail where he is being processed. we were told that it

might go more quickly than the typical defendant, but that everything else about the processing of the former president would be quite similar to other defendantss across the spectrum who are brought to that county jail. i'm joined by former prosecutor chris timmons . is very familiar, obviously not only with the law but the way things work in georgia. prosecutor there in georgia and is very obviously read in on what fani willis is trying to do here. the prosecutor in this case, the sweeature of this case. and chris, there were so many quesamong the significant ones that stood out early on was the question to da willis when she was asked, do you intend to l of these defendants together? her answer was ver simple. in that press conferyou were on the air with us, iieve she said, do i plan to try them together? yes. but that appears to be increasing. be tested here in in the almost two weeks since that news conference. yeah, david, i

think that it's definitely up in the air at this point. you've got a judge that's going to want to try everyone together because this is going to be a long trial, maybe a year, maybe two years. and so if everybody gets an individual trial, we're talking 19 to 36 years, that's not happening. so on the side of what we refer to as judicial economy is try everyone together on the opposite side of that is what we refer to as ineffective assistance of counsel, and that is that if you force someone to go to trial when their lawyer is not ready to go to trial, it's possible that the case is going to get overturned when it gets on appeal. and so if you're a judge, the last thing in the world you want to do is be overturned on any ground, let alone ineffective assistance of counsel in a case that is the trial of the century, if not the trial of the millennium. thank you very much, chris timmons. i'm just hearing in my ear here that the jail has made it official. you're looking on your screen there. if you do a jail search, the defendants names come up and there you see the defendant's name, donald j. tr he has been booked and processed there in fulton county

, georgia. and again, as the fulton county sheriff had said the former president has been treated as other defendants are d there. the same process and let's bring in john santucci, who has learned from at least one source. john, you believe a mugshot was, in fact, taken? >> david, i have been in touch with team trump, and i'm told by at least one senior adviser to the former president that is their understanding that a mugshot was taken of donald trump moments after he entered that fulton county jailhouse. david, i'm also told and we're showing on screen right now the details from the jail that to speed up the process. david, it's my understanding that some of the keyetails that most people are going through the process, the height, the weight, some of thatre reported by donald trump's aides to the jail. so it does not aear that anybody physically took the president's height or w that those details were provided on the president's behalf to speed up thecess that he could getd out as quickly

as possible. david yk about those details and i don't share them now to be frivolous here. >> i share them because of the surreal nature of all ts you look at this, some of the details, john, that eak of, describe the former presidt having blond or raerry hair, a height of six, three weight, 215 pounds, anjohn, you're now learning thatart of that information was ed to try to speed up the process here. >> correct? david? i think the biggest thing that has been going on for the last several days is trying to find a way to get donald trump in and out. we know that the fulton county district attorney's office was giving people windows, that the jail would be a little calmer, not as busy. we know that some of the indicators is that team trump was given is that the evening would be better. obviously donald trump always the tv producer here at heart, looking for prime time to make a show of things. donald trump has often said. as you know, david, he believes every day of his life is a television program. but this one, david, has been

weighing on donald trump. i mean, obviously, he has gone through this now three times. but going to a jailhouse is different. getting a mugshot is different. and we know for donald trump, who always wants to be in control of the situation, an that is where things have been different. and in this situation, too, david, we know that donald trump, based on our understanding of the process here, was not surrounded by many aides at one point over the last few minutes. and that is something that has been very different for donald trump so far. >> david, for our viewers watching here, john santucci, thank you. for our viewers, stick with us here because we will wrap this up after we see images of the former president actually leaving that jail. but it is our understanding that he's been booked and processed and is in the process of being released right now. as you heard jon report there, the trump team, the trump legal team had argued for ways to make this move a little more quickly. and one of the ways was to provide some of these personal details. you know, the color of his hair, his weight, his height before he

even arrived. and it wasn't just trump's legal team and donald trump himself who wanted this to move more quickly. pierre thomas, our chief justice correspondent, the secret service, law enforcement in this county and at the federal level wanted this to move quickly as well. >> they absolutely did, david. and everyone in law enforcement knows that particular jail's history is colorful and none of it good. and the secret service wanted to get him in there as quickly as possible and out as quickly as possible. all they're responsible, as you know, david, for the president's security. they know about the health conditions in there. they know the kind of inmates that are held there. they simply wanted the president to be booked, processed and let go very quickly to get him out of there. david >> pierre thomas also watching along with us. pierre, stay with us. asha rangappa, former associate dean, yale law school, former fbi agent. and asha, you've been with us for much of our coverage along the way. what stands out to you as as being quite different here in fulton county from what we've seen before, this is now the fourth

criminal indictment. the fourth time he has shown up to face charges this year. >> yes, david, this is a little bit like groundhog day, but today is different in a few ways. first, i think da fani willis has really made an effort to treat him like any other defendant. in addition to this entire booking process, he's had to negotiate a bond agreement. you know, she's making clear that no one is above the law in in process, as well as in substance in terms of charging him. the other thing that's different, i think here is that this should really drive home to him, that this is real. the manhattan prosecution or charge against him while, you know, significant, it was the first one will likely not result in any jail time if he's actually convicted the january 6th and mar-a-lago charges that have been brought by the special counsel. those are very serious. but but if he wins the

presidency, he has many levers of power where he can potentially quash or get out of those charges. this is one where he can't do that. and i think he really may be when he's inside that jail, really looking around and saying, i don't have any way out of this legally, politically , you know, unless i can really get acquitted on these charges. and that should worry him in my opinion. >> asha, stay with us here for a follow up. as we look at live pictures, expecting former president trump's motorcade any moment here to leave the fulton county jail, asha, one of the questions on that debate stage last night for the other republican candidates who, of course, want to beat him for the nomination, though all of them on that stage, nearly all of them saying that they would support him even if he's convicted, if he's the nominee for the republican party in the race for the white house. but one of the questions was also about party lines. as you know, one of the candidates on the stage said, i will pardon trump. what are the rest of you going to do? and we're looking at the

president's choice, former president's motorcade now leaving, heading back to the airport. but as you rightly point out, this is at the state level pardons are very different. it's not the governor , it's not the republican governor in that state who would decide that it's a parole board and they don't even look into pardons until several years into any potential convict serving a sentence. this >> yes, david, the pardon power by a future president is not an option for him. in addition to not being an option if he becomes president himself. um, you know, this that's a big thing for him to have to consider in this situation. he just doesn't have any way out. but in this kind of case, i don't think. >> and one last quick question, and i want to bring this to chris timmons because chris, we heard that the da has set a date of when she would like this trial to begin a lot of people say legal observers who have been studying the case so far

say that's unlikely when do you believe we could actually see a trial start in fulton county, georgia? it's going to have to happen on october 23rd. david, if they don't do that, chesbrough is going to be cut loose. he's acquitted by operation of law. so we're going to see at least one trial begin on that date unless chesbrough either withdraws his speedy trial demand or pleads guilty. but it looks like we're getting ready to go to trial october 23rd. the only question is whether donald trump will be sitting next to him when they're in that trial. well, that's just extraordinary. we know the former president will try to fight that. do you believe that we could actually see this play out before voters go to the polls? i do, although i mean, i don't think we're going to have a verdict by then because i expect this to be a very long trial. i think jury selection is going to take a long time to get a jury that not only is impartial, but also has the time to be on a jury like this. i mean, they're paid the day. and so there are very few people who can take six months, nine months out of their lives to then go be on a jury, even in a case of

this magnitude. so getting a jury is going to be difficult. and then after that, you've got 161 acts in furtherance of the conspiracy. they're all going to be proved. i'm pretty sure that the da's office has all of their evidence. they're going to be ready to go on october 23rd. and so the only question is whether chesbrough is going to withdraw a speedy trial demand, whether he's going to plead guilty, whether he's ready to go, and who's going to be with him. chris thank you so much. as we watch these live pictures, as in fulton county and again, the country has watched a number of these now. now these moments involving the former president showing up to face charges, though, as asha pointed out, a moment ago, this is they all are different. they all are different from one another. but this one in particular is quite different. this is at the state level. the charges brought by the district attorney there in the atlanta area, fulton county, fani willis, involving the president and 18 alleged kokand tatars. president trump, the former president moments ago booked released on 13 felony charges himself for this alleged

conspiracy that he would have been in charge of. you know, one of the things that we have reported out here is the fact that obviously his former personal lawyer, rudy giuliani, the former mayor of new york city, also charged. he showed up. there's been a mug shot, obviously, out in the public domain this week from the fulton county sheriff. he once tried people here in new york city famously using a very similar statute, that felony willis is using to go after not only giuliani, but 18 other alleged coconspirators and the former president. we're not expecting to see any mugshot anytime soon, though. you saw it for yourself. the president's motorcade leaving apparently giving a thumbs up through the window as he left. now headed back to the airport. he was hoping this would move quickly and we have all witnessed here that is exactly the case. what has played out here in fulton county, georgia, the former president showing up one day before he had to. our coverage will continue. abc news live abcnews.com. of course, later
