confirm local and federal officials are concerned that flannery has acquired land adjacent to a critical communications squadron on the base that is privy to sensitive information tied to our national security. all of this unfolding as a survey was sent out to residents this week. several mayors believe is tied to flannery. it's raising questions as to what will happen with more than 55,000 acres that's now been acquired. the mystery shrouding a massive nearly billion dollar land acquisition encroaching one of the most critical military bases in the western us has yet another layer . >> flannery just bought other land that goes right up to the base. and so the entire base is encircled. >> now public records obtained by the i-team show the investment firm flannery associates has now acquired all the available land surrounding travis air force base county. maps are still in the process of being updated, but the parcels highlighted in red on this map

show the land flannery has acquired since 2018. have you seen anything like this in your career? >> no, i definitely haven't. >> glenn zook is solano county assessor. >> we see a lot of investors. there's usually a target, a plan. there doesn't seem to be that in this case. >> public records obtained by the i-team show flannery has purchased land nearby the 60th communications squadron that's housed on the base. according to travis, this squadron defends, operates and controls critical communication and network infrastructure for 58 military aircraft, including some of the largest in the world used for the rapid delivery of troops and global mobility. >> and that could be a very dangerous thing to have in a communications intercepted. >> katherine moy is the mayor of fairfield and the most high security communications that happen at the pentagon. >> they also happen at travis. now, not all bases have that, moy says. >> this is where highly

sensitive communication occurs about national security, including the president's whereabouts at any point in time . the i-team asked flannery associates about their acquisitions, reportedly made near a communication tower and whether or not that was a coincide science. michael leiter, the lead attorney representing the firm, is known nationally to represent clients for investigations and incidents involving national security. leiter did not respond to our emails, but i did speak with him on the phone today and he told me no comment. >> the whole it just worries me, worries me. >> the firm's new acquisitions come as a survey was sent out to solano county. residents this week wanted to get your general consensus about this survey we're getting a look at what might be in the heads of whoever flannery is, but i'm not sure if it is a smokescreen or a legitimate poll. according to moy, constituents who were sent the survey were asked dozens of questions ranging from political

preferences to potential ballot initiatives, one of which hinted at plans to develop a new city in the eastern part of solano county. with tens of thousands of new homes, a large solar energy farm, orchards with more than 1 million new trees and over 10,000 acres of new parks and open space. the survey questioned, estimated it would generate thousands of jobs and hundreds of millions of dollars in tax revenue for the county within the first ten years. the questions that followed asked things like woulyou vote yes or no on the initiative? which way do you lean? >> i don't know that it's realistic. what they're what they're talking about at all. >> are you referring to the plans to build a city? >> makes zero sense. there's no mass transit. there's no water for that. you'd have to dig wells or convince fairfield to give water, serve water. and that would be a big fat no. >> what makes you think flannery is behind this survey? >> flannery is the largest landholder in solano county, so

it has to be them or somebody pretending to be them. >> and when you say pretending their suspicion, any evidence to suggest that someone is trying to impersonate flannery? >> yes. i mean, i think that, again, it could be a kind of diverse tactic, according to a transcription. >> the second section of the survey listed names of different people and asked participants to indicate their opinion of them, ranging from very favorable to very unfavorable. flannery associates was listed as one of five options next to joe biden, donald trump, mike thompson and john garamendi. >> i saw that as well. and i says, gosh, it suggests that this is from flannery that they're searching for this thing. and then when you start reading the questions, it reinforces that more ronald cate is the mayor of neighboring town rio vista. >> he says he was never directly sent the survey but received a copy from numerous constituents . >> really no way on the survey or nothing on the survey that

shows this is from flannery. >> the i-team asked flannery associates if the firm is any way connected with the creation or distribution of this survey. we were again told no comment. >> i believe that if they wanted to build a city, the smart thing would be to talk to local, not only officials, but staff people here that look at land use. >> solano county has told the i-team flannery has not pulled any permits since acquiring the land in 2018 to signal any future development or change of land use. have you received word any of those requirements? >> have been pulled? necessary permits, things like that? >> not at all. nothing. >> nothing at all. you know, that's that's kind of the mystery of this whole thing. >> no permits, no known plan. and as mayor moy put it, some of these questions include plans that are just not feasible. the infra structure isn't there. >> number one, didn't address transportation, which is a major problem. >> there are no other real big

roads to get in and out. >> so when you're talking about adding another 150,000 people, i don't know how that's going to get addressed. >> moy says. the survey also asked about the potential for a large solar energy farm, which would reduce energy bills by 10% and would generate tens of millions of dollars in tax revenue for the wind farms. >> is a no go. and the reason for that is the wind farms themselves selves already block or interfere with travis radar systems. i've seen it firsthand . and so we can't see things in coming. travis air force base would be crippled. >> moy says the only other possibility 8-80, a mecca of natural gas believed to be along both sides of highway 12 between rio vista and fairfield. >> and what hasn't been tapped is there's a very, very deep they called a balloon way deep in underneath there in the formations. that would be the only thing that i see there, unless they were able to shut

down travis air force base. >> that, of course, would be devastating to the community and the economy. moy says the only way she could see travis being forced out in this scenario is if there becomes plans to build an airport. but again, there are no public records to suggest any new development like that is in the works. so the question now, as far as this survey, it's still unclear if flannery is tied in any way. yeah, it's so mysterious. >> and we know you're going to stay on top of this. we appreciate all the follow up stories you've been doing. stephanie, thank you. >> absolutely. and we have another i-team exclusive for you coming up at 630, our dan noyes speaks with a mother seeking a fair punishment. she says, for the person who murreher son . she says she's not getting justice from the alameda county da. >> former president trump is on his way back to new jersey tonight after surrendering about 90 minutes ago at the fulton county jail in atlanta. >> now, this is his mug shot. he was booked and had his photo taken and was then released. his plane was has already departed georgia.

>> the former president faces 13 charges in georgia, where he's accused of leading the effort to overturn the results of the 2020 election. his 18 co-defendants in the case have until friday to turn themselves in. the former president was defiant as he prepared to get onto his plane and head home. >> what has taken place here is a travesty of justice. we did nothing wrong. i did nothing wrong, and everybody knows it. i've never had such support. >> abc seven news political analyst jackie speier joined us at 5:00 to discuss the latest indictments. she was a bit taken aback by the legal peril the former president faces. >> we have to sit back and think this is the former president of the united states who, while he was president of the united states, committed potentially criminal acts. now he's considered innocent until proven guilty. but the charges against him are truly daunting and they're really piling up. >> they are, fear added. >> she fully expects the former

into three vehicles in just two minutes, all while watched and recorded. the photographer says he captured it to raise awareness as a public service. you can watce entire video on abc7 news .com. it is quite something to see it as it happens and the san francisco police department is fed up with those break ins and today chief william scott announced a new plan to crack down on them. chief scott says he'll use an increase in funding to add more patrols and tourist neighborhoods. he also plans to use bait cars to try and catch thieves in the act. >> now, i'm not going to go into a whole lot of details because as by design, we want the people who are breaking into cars to be caught and bait cars, we believe will do that. >> the operation has the full support of city prosecutors, as da brooke jenkins promises to go after those who are caught saying there needs to be consequences. listen to this. there have been 13,331 reported car break ins. so far this year. that's actually slightly fewer were than this time last year. more than 13,000. you can track

new pop up shops will move into empty storefronts next month. abc seven news reporter suzanne fan looks at the plan to revitalize downtown at devil's teeth banking company in the outer sunset. >> employees are busy preparing for tomorrow. the breakfast sandwich is our biggest seller, but for owner hilary passman, the months ahead will be crucial. passman's business is the recipient of three months free rent a grant of about $8,000 from the city of san francisco and a chance to tempoorary expand her popular bakery with a pop up space in the financial district. >> it's very exciting. so we are going to be bringing our full menu. >> her pop up will go up right here at one embarcadero center. passman is one of 17 pop up shops coming to empty downtown san francisco storefronts. in september. it's part of mayor london breed's vacant, vibrant initiative and part of the roadmap to recovery program. she announced in february this program matches vacant groundfloor spaces and their owners with small businesses

that are either starting or looking to open a san francisco or second location. >> it's terrific that the city is helping us and not just me, but there's all sorts of diverse creative activators that are coming down there now. and i think it's going to really make a difference. >> san francisco's office of economic workforce development and nonprofit business advocacy groups sf new deal announced the 17 awardees for phase one. they include artists, designers and a radio station at this empty storefront at 201. jackson street, the gateway to pop ups are slated, including a multimedia agency, and then brewhouse, a skate collective streetwear apparel brand. one of the property owners participating in the program is bcp. they issued this statement, quote, a bcp is committed to supporting a strong downtown and our vibrant san francisco community by hosting four pop up activation at embarcadero center that will further our collective efforts to revitalize downtown by supporting local artists,

red flag warning is going until early tomorrow morning as dry lightning is a concern, although they did have a flash flood warning. a short time ago as they are getting some rain, which is good news. area of low pressure off our coast is approaching and that's what's deepening. the marine layer. also providing the lift for the instability up to our north. temperatures are down as that marine layer has really deepened 18 degrees cooler right now in santa rosa, 13 degree drop in san carlos down 16 in concord. a strong sea breeze right now. gusts to 35 miles an hour in oakland. and this is going to continue as we head towards tomorrow from our walnut creek camera. it is a hazy sunshine out there. air quality advisory issued for tomorrow as smoke from the northern california wildfires will continue to drift in. but in the upper parts of the atmosphere, good to moderate air quality is expected tomorrow down below. and that's what we're seeing right now. as you can see from from our emeryville camera. now, we are looking at the port of oakland where low clouds have already made their

push. 67 degrees in the city. it is 71 in oakland, mid 70s around mountain view, 80 in san jose and 81 in palo alto. gray skies from our golden gate bridge camera right now, 73 degrees in santa rosa, 83. fairfield, 79 degrees in livermore and one other live picture from our kgo roof camera. as you will notice, the low clouds starting to advance. breezy out there as well. marine layer expands as patchy drizzle overnight breezy and cooler tomorrow afternoon and we are looking at a gradual warming trend to start this weekend. so hour by hour we go pretty good push tomorrow morning. many of you will wake up to low clouds and fog and there will be some spotty drizzle at 7:00. visibility watch out could be low, especially near the coastline. now, the fog is never going to clear the coast completely. so we'll hang on to it all afternoon and evening for your morning. temperatures coming down from today. you probably remember today started off pretty mild to warm. tomorrow, we're going to look at cooler weather. 50s 60s out the door

toyota, let's go places. >> brand new season of the tamron hall show starts september 5th. abc seven building a better bay area moving forward, finding solutions. >> this is abc seven news. >> i actually heard the gunshots thinking that it was fireworks. >> alameda county prosecutors have informed this mother from san leandro that the teenage gang member who shot and killed her son will be back on the streets in as little as four years. >> she contacted the abc seven news i team to find out why the 17 year old gunman is not being tried as an adult for the murder. >> the i-team's dan noyes is here with this story tonight. dan? well, dan and karina, in addition to the mother and several sources inside the da's office, i was able to speak with a witness who was in the parked car just inches away when lamar converse died. >> i asked cassandra riley to describe her son, 35 year old lamar converse.

>> lamar was a loving person. he would give you his shirt off his back. she lost lamar the night of january 30th, even heard the gunfire for a little over a block away. >> and since then, she's been afraid to leave her home. i get afraid. >> i get afraid i'd be afraid. >> are you now afraid more going outside than you were before? all the time. >> i actually went to the nail shop down the street and had to call somebody to pick me up because i was nervous. i was scared that monday night, just before 11:00. >> lamar asked this friend to give him a ride to meet a young woman who wanted to buy two ounces of marijuana. >> so i pulled on this side. the girl walked from the corner and rolled down his window. he's talking to her about the transaction of the weed sources inside the da's office verified his story. >> lamar met the 18 year old woman online. they said a meeting at 167th avenue and east 48th street in san leandro. she traveled there with her 17 year

old friend. authorities say he's a member of oakland's ghost town gang and that she tried to use counterfeit money. >> so he started counting. he got like 2040. and then he looked at the money like this money fake. >> you can see on surveillance video from a used car lot that lamar converse argues with the woman. and then her 17 year old friend rushes up with a handgun. >> all i see is the gun. he like the dude, walked to the car like, give me everything, tear it off. five, five, five, five, five, five. you start shooting. he never reached for nothing. martin never made a move. we didn't have no guns on us. we ain't. we wasn't nothing going on. funny with us, you know, he was just trying to get his money and we was going to go back home. >> three weeks later, alameda county sheriff's investigators arrested the 17 year old. one prosecutor told me the shooter confessed that it was a rock solid case for transfer to adult court and not a robbery, but a planned hit. but i was there monday at the juvenile justice center in san leandro when the da's office announced a deal. the teen admitted murder in the

second degree with personal and intentional discharge of a firearm. but he won't receive the 40 years to life prison sentence. he could face if tried as an adult. the case remains in juvenile court. >> that's heartbreaking to hear them say they want to try him as a juvenile. >> everyone gets released from juvenile hall by the time they're 25. but sources inside the da's office tell me the gunman could be out in 2 to 3 years if he follows the program. his mother declined to comment after the hearing, cassandra riley directed her anger at district attorney pamela price. >> the decision that was made today up in court was not right. i need her to go deep down inside side and feel the pain that i'm suffering with so she would know how it feels and make the right decision. >> riley tells me she requested a meeting with pamela price, but never got an answer. >> the people who live in this

county have said, we want a different vision. we want a different administration of how we do justice. >> as i also never received an answer to my request for an interview with the da. after calling and emailing her spokesperson, price did address her vision for juvenile justice at her first staff meeting in march at the oakland arena. video i obtained using the california public records act. >> we want. to end harsh penalties. we don't want three strikes. we want to give young people another other way, another path way. >> new state law is helping price's efforts. assembly bill 2361, signed by governor newsom last september, makes it more difficult to transfer juvenile cases to adult court, even for the most serious crimes, including murder. >> the prosecution must demonstrate weight by clear and convincing evidence that a young person cannot be rehabilitated within the juvenile court system. in order for a judge to

to make the city safer. abc7 news reporter answer hassan talked with him about this. do it yourself attempt to protect people and property sideshows may seem innocent and kids playing, but it turns into something more. >> that's what happened earlier this month when one car ended up in the water at the antioch marina and another hit a fire hydrant, leaving three injured. >> sean mccauley owns property at the marina. they just need to be held accountable. >> it's ridiculous. we're tired of it. personally, i'm tired of it. i'm not going to put up with it. >> so mccauley is now going to put up license plate readers at his properties at the marina and other parts of the city, and he's paying for it all himself, costing upwards of $50,000. >> all that data goes right back to the police department. and if there's anything that occurs, incidences that occur here, they can get real time data and they can get historical data. >> but that's raising privacy concerns. the electronic frontier foundation is a nonprofit that defends civil liberties in the digital world. it calls automated license plate readers a mass surveillance

technology. because of the data that's collected. >> i do have a concern about privacy and these license plate readers aren't meant to have people with expired registration on. these are meant for criminal activity. mccauley worked with the city of antioch and the police department, which has strict protocols around the use of data. >> he even consulted a private security firm headed up by kenneth lakes police department , already have license plate readers on a lot of their patrol cars that you see, and they ride around communities and stuff. >> so i think a license plate reader is very appropriate to have. >> mr. mccauley is trying to bring a lot of business to the downtown area and to do that and to be successful and to bring other investors in, we have to show the community that it's a safe place. >> antioch city council member mike barbanica supports license plate readers. he wants the city to install more cameras. meanwhile mccauley says he just wants people to be accountable. >> we're going to go after them. >> we're going to go after the parents if they're underage,
