moving forward, finding solutions. this is abc7 news. if it quacks like a duck, walks like a duck, it's a duck. it's a strip club that that's what some people in san jose say has taken over their quiet neighborhood and only the abc7 news i-team has the story tonight. good evening. i'm karina nova and i'm larry beil. thanks for joining us. neighbors say loud parties every weekend. it's been going on for months despite endless calls to 311911. code enforcement and more. and we should warn some viewers that some of the images and the content that you are going to see could be graphic. abc seven news i-team reporter melanie woodrow is here with the story. you'll see only on seven melanie. larry and karina, residents tell me if they didn't see this party house with their own eyes, they wouldn't believe it. the i-team got a look at what's happening thursday through saturday night from after midnight until the early morning hours, both outside and inside these parties.

i also spoke with the person hosting them about what's going on as exotic dancers, alcohol and stacks of ones before fresh promotions, private party was up and running on camille circle in san jose. neighbors say they heard construction during the middle of the night for months. what they were building, i had no idea. so we called the general manager and he thought maybe it was them lifting weights. andy bensinger is laughing because he believes he now knows what was being built. residents provided the abc7 news i-team with pictures of empty exercise and dance pole boxes thrown out in a communal garbage. once construction stopped, the music started. it's not mozart. it's strip club music. neighbors say they found video from inside the parties by clicking on a map within the snapchat app. all of these videos public, most of them too explicit to show here. it's literally every weekend. benzinger is an attorney whose

relative lives on camille circle. he's now representing approximately 12 units. this is an unlicensed commercial activity right in the middle of a group of townhomes. it's flabbergasts thing. it's it's unbelievable. abc7 news obtained video of people coming and going from the complex during the middle of the night at the base of the stairs into people's was wearing shirts that say security escorting them to the party by flashlight. but it's mild for me. i don't want to live like this. it's why this resident agreed to talk with me, but asked me not to show her face because of concern for her safety. for months, she says, she called 311911 and even police directly. when you're calling, what are you telling the 911 call operator? i'm telling them that there is a strip club at this particular unit. and what is the response of the 911 call operator when you say there's a strip club going on at this unit, basically they take the call and they tell me that they will deal with it. but she says despite her efforts every weekend, the parties continue to police come out for

each of those calls. i have no idea. the i-team asked san jose police to look up several case numbers provided to us by the resident. a spokesperson said they were either noise or music complaints. i asked further about three calls to nine one 1 in 1 weekend, one on august 18th at 442, a m, a spokesperson told the i-team police did not respond to that 911 call because the supervisor requested the information be turned over to the bureau of investigations for follow up, police said. another call on august 19th at 4:58 a.m. was solely a music complaint and there was no police response in a final call to 911 on august 20th, at 4:08 a.m., san jose police said communications personnel called the reporting party back for an update on the noise disturbance prior to dispatching officers when unable to reach the caller for a status update. the call was canceled in a follow up email to abc7 news, a spokesperson referred to the noise disturbance as a low priority call. there isn't the sense of urgency that i think this kind of a

situation is entitled to. a san jose police spokesperson told the i-team. public information officers and other department personnel were not available for interviews by email. the spokesperson told the i-team bpd was first made aware of the allegations in early august and that an investigation into what they call the illegal business is open and ongoing. but the person hosting the parties told me he's not doing anything illegal. i called the number listed on the invitations and spoke with someone for 22 minutes who identified himself as fresh. he told me the private parties are for friends and family and that his mom, who lived in the townhome, recently passed away. he denied charging money to get in or for bottle service and told abc7 news that 204 bottles referred to tokens, not dollars. he said the exotic dancers are entertaining neighbors, family and friends, not employees. he called these security guards his brothers who work a graveyard shift at clubs and that if they're outside it's because they're smoking. if it quacks like a duck, walks like a duck, it's a duck.

it's a strip club. in addition to sfpd, residents filed complaints with other agencies. san jose's code enforcement deputy director told the i-team code enforcement has opened a case to investigate any potential zoning, building or municipal code violations within its purview. also, that it is coordinating with sfpd on the issues at the townhome. then coordinate, take care of this problem now before it gets worse. the department of alcoholic beverage control told the i-team it could not confirm or deny if it's investigating, but reiterated that it looks into every complaint received also that the sale of alcoholic beverages in california without an appropriate license is a misdemeanor violation of the business and professions code. an attorney for the homeowners association told me he had no comment. enforcement aside, a person who told me she's been helping the landlord said an eviction process is underway, but also takes time. texting me, quote, we are doing everything we can to get these people out asap while we are waiting for the court clerk to process the paperwork, an effort

the parties host may be aware of. when i shared neighbors concerns, he apologized and offered to keep the music down. he also said he expects to leave within the next 20 days. thursday afternoon, a sheriff's deputy walked up the stairs and placed an eviction notice on the window, giving the people inside until september 6th to leave or be forced out. in the meantime, people who live here are at their wits end. i really feel traumatized by it. this is not safe. it's dangerous. it only takes one time for things to go terribly wrong here. so whoever is inside has until next wednesday to leave the premises and we'll have to wait and see what happens. big holiday weekend. so the question here is, will they have some parties to sort of close out the weekend? we'll talk to residents and find out. it's pretty bold just to to do this. but then even more brazen to post video on social media. it's almost inviting the

scrutiny and the police. well, you saw there were invitations that were posted. and of course, the person who's hosting the parties had an explanation for all of that. he said donations, tokens, not not, not charging people. it's friends and family. but yes, on snapchat, on social media, certainly put it out there for anyone to take a look. well, we'll be looking forward to your follow up next week on this to see what happens on wednesday. thank you, melanie. thanks, mel. to get in touch with the team, you can call the number on your screen, 1888840. i-team or go to abc7 news.com slash i-team to mechanics are being treated for smoke inhalation after a vta electric bus caught fire in north san jose. the worker suffered injuries trying to put out the fire and move the bus out of the garage to keep the fire from spreading. vta is calling them heroes for their quick thinking. first responders arrived moments later and extinguished the flames. the fire prompted the evacuation of two buildings at the bus yard. vta says the bus was not in operation at the time of the

fire, but the cause of the fire is under investigation. an we don't know if it was related in any way to what the mechanics were working on. we just know that they were working on the bus. something sparked it turned into a fire, and then the rest happened after that. the bus is one of vta's ten electric proterra busses, which have all been suspended from service until further notice. concern about 911 service in oakland. and now the police department is given a one year deadline to speed up its emergency response or face serious consequence charges. and as abc7 news reporter lena howland explains, it comes after a troubling grand jury report and a system shutdown. in a letter from the california governor's office of emergency services dated a little more than a month ago, the state warns the oakland police department may be ineligible for state funding, according to the state agencies must answer 90% of calls within 15 seconds to receive state funding for 911 services.

but over the past year, oakland has met that standard for about 46% of calls. not only extremely frustrating and emotionally distressing to be on the other end of that call when nobody answers the phone, but it can also have life and death consequences, says marlene sachs, a public safety advocate and local attorney. filed a series of public records requests, which eventually brought this letter to light. she started looking into this after the city's 911 system went down for two days back in july. if you imagine the kinds of victims that we have in oakland today who are carjacking victims, victims of domestic violence, victims of rape, attempted murder, they need to be able to get somebody on the phone within 15 seconds. that is a reasonable amount of time. oakland city councilman noel gallo says he gets complaints about this on a regular basis from people in the fruitvale district. i grew up here in the city of oakland and i've never seen the level of requests for public safety like i have today. we need to get our 911 system in order.

the letter threatens if oakland pd's numbers do not meet compliance by the end of july next year. 911 calls could get rerouted to another agency. in a statement, the city said the oakland police department has identified to cal oes that the primary contributing factor to call answer times is lack of staffing. there are currently 63 dispatch call taking staff and 14 vacancies to address vacancies. they say they're continuously recruiting for dispatcher jobs, adding they've already interviewed 54 candidates since june and they also plan community outreach and public informational events like one held on wednesday night. you know, i was surprised to hear that from the state with their threat. but but, you know, hopefully that'll move the city of oakland to get it done repaired and fixed immediately to address the needs that are happening at our streets in oakland. lena howland, abc seven news. labor day weekend is off to a rather cool and cloudy start here in the bay area. we do have a little patch of

blue up there which is nice to see. abc7 news meteorologist sanjay patel here. what's what's going to be like elsewhere in the state as we head into this holiday weekend? a very different aren't larry and karina as we take a look at live doppler 7 right now, you will notice it is just wet up in northern california and the sierra nevada. thunderstorms right now flaring up in the northern california mountains. they also have stormy weather down in the deserts in southern california. so if you are traveling, let me show you the forecast. 64 degrees in tahoe, 80 at yosemite, looking at tahoe with thunderstorms and up around eureka, 66 degrees. los angeles, 79 degrees. so if you are traveling, keep that in mind. and a live view from zephyr cove, where it's cloudy. tahoe is reporting light rain right now, saturday and sunday, you're going to have thunderstorms gusty winds, showers, temperatures cool. you'll notice 60s, 50s. and then monday, labor day will turn things around. so if you're heading up there, there will be plenty of sun both days and warmer weather.

i'll let you know what we're going to see here in the bay area for the holiday weekend coming up in just a few minutes, larry. sandhya, we'll see you then with the seven day forecast. it part of westbound i-80 is closed for all of labor day weekend so they can repave it. westbound 80 is closed between. interstate 780 and highway four. that includes the carquinez bride detou hhlighted in green on the map right here. drivers should tak680. then highway four back to 80. as you can imagine, a lot of slow traffic on that detour. here's what it looked like this afternoon on on southbound interstate 680. a bunch of trucks sharing the road with cars and everybody's moving about five miles an hour. 80 is closed. so caltrans can do some repaving. they plan to pour 9,000 pounds of concrete to resurface four lanes of traffic. caltrans says condensing the work into the long holiday weekend will spare drivers from months of overnight closures. here's is a live look at the traffic right now. the bay bridge that is about as

skin that you snuggle up, cuddle up and lay in the center. one of the marin's few subsidized low cost childcare providers serving 85 families. many who are totally stressed out these days. she asked me on the way to school today if you know they were going to close their school. parent lauren goodwin had no easy answer for her young daughter. this facility is a special place to so many families. they've, you know, there's generations that have come here. this year is our. 50th anniversary, heidi. executive director heidi tomsky isn't sure the center will make it to 51 after the ross valley school district, which owns the five acre campus turned its lease with the center this week, citing costly seismic and other repairs. the district can't afford to to make. it leaves us in a precarious position. it feels not like we're not on solid ground, hard to think about the future and how to move forward. i started here when i was three

months old. best tutorials grew up at the center. now she's a teacher and her own daughter goes here. our space here is a huge part of the program. to have that possibly removed from our program is terrifying. we'll never be divided. hundreds of parents marched toward the school board meeting this week to save the center, but a lease extension was not granted. as was stated at the board meeting the other night. we have the district has taken no steps or actions toward eviction. superinten marci trahan says the board is still talking with the center. now the daycare has launched a go fund me to help purchase the property from the district. upwards of $1 million and pay for safety upgrades. directors say it's a long shot, but losing the center is not an option and if we were to be gone, it would be that this waterfall effect i mean, you're looking at loss of employment, then you're looking at loss of housing, loss of food, everyone keeping fingers crossed in marin county, cornell barnard abc7

news. it is now official. today cal and stanford accepted invitations to join the atlantic coast conference. this decision comes after eight pac 12 schools changed conferences in a mass exodus, leaving cal and stanford without a conference of their own. the schools say a majority of their sports will not be impacted by the change, but for traveling, athletes, football, basketball, etcetera, to the east coast, strips are going to be an adjustment overall. both schools see this win this move as a win. being in a conference with a long term media rights deal with schools that are very similar to ours that compete at the highest level of the power five feels like we're putting ourselves in a place that's going to allow us to be successful for the long for the long term. cal stanford will begin playing in the acc starting in 2020 4th august of 2024. this football season upcoming

will be normal in the pac 12, but whatever jim milton is saying, there, they're just making the best of a really horrible situation. they've landed in a conference so they'll be set for however long until everything blows up again with another round of realignment. well, and as you mentioned, you know, the travel is going to be extreme for these young athletes and their families and, you know, it's also going to be weather dependent, especially, you know, going to the east coast. yeah, a little humidity to get used to. fortunately, sandhya patel, we don't have to worry about too much humidity in these parts heading into the holiday weekend. yeah, but we may be dodging a few drops, that's for sure. larry and karina, let me show you live picture right now from our sutro tower camera. we are seeing some sun breaking through the cloud cover that we had. it was pretty heavy this earlier today. and we even had a measurable drizzle or showers between san francisco, two hundredths of an inch, half moon bay, eight hundredths. we did get trace amounts from napa, sfo to oakland. so some of you may have needed those wipers earlier this

morning at sfo this afternoon as well. here's why. there's a pretty deep upper level low that's spinning just off the northern california coast and it's certainly producing a lot of thunderstorm activity in northern california. some wet weather from the sierra to northern california. and right now, the concern is the burn scar areas. they do have flash flood watches in effect as heavy rain is expected to cause the potential for debris flows. a flood advisory until. 8:15 p.m. now for parts of shasta and tehama counties. as we look at live doppler 7, notice that clouds are here right near the coastline and a few scattered around the region. but it is all quiet at this hour. temperatures are running lower than where they were just about everywhere. ten degrees cooler in concord, down 11 in santa rosa. still breezy out there, 23 miles an hour. as far as the gusts go in santa rosa, it's an onshore breeze which kept our temperatures in the mid 60s to upper 70s today. a good 4 to 9 degrees below average. get used to that, at least for a

couple of days. here's the live view from our pier 39 camera o sea lions are soaking up a little bit of sun there. 64 degrees in san francisco, 66. oakland low 70s. san jose. palo alto. a live view from emeryville looking back towards san francisco. and you can see it's a little bit gray out there. mid 60s novato santa rosa, 71 in fairfield and it is 68 in livermore blue sky from our golden gate bridge camera breezy to this evening, mostly cloudy overnight. we're looking at isolated shower chance tomorrow and sunday and cooler than average for your holiday weekend. so we're going to start this animation at 7 p.m. tonight. the clouds regroup again tomorrow morning. could be a pop up shower in the north bay at 7 a.m. really can't rule it out. just about any time this weekend, on saturday and sunday, sunday, you'll notice a few showers trying to break their way through the region, just enough to dampen the ground and that's about it. morning temperatures in the 50s and 60s. watch out for those slippery roadways just really isolated at best.

that's a slowdown from recent averages, but more than expected. today, interest resumed accruing on student loans. this after a three year pause. so come october 1st, payments will resume as well. it's estimated 43 million people owe money from a student loan. and earlier today, we talked to a bay area dentist who has a student loan bill of $3,000 per month. if i owe. somewhere around 470 to 480,000 and i didn't take out any student loans for my undergrad. so that's all straight dental school loans. wow. that is a massive amount of money to pay back. borrowers facing hardship can find lower payment options by going to student aid. dot gov. coming up next, hear from local firefighters who spent a week helping out with relief efforts on maui. closed door discussion in sacramento could make homeowners insurance more available, but at a higher price.

this is abc7 news. california insurance companies are pressing the legislature for some big changes in the state's homeowners insurance market. seven on your sides michael finney joins us now with that. michael, this picks up where we left off last night. actually california insurance companies are underwriting fewer policies and even leaving the state. but why are these companies pulling back? the industry says it's because they can't make money. consumer activists say it's all a scheme to press lawmakers into deregulating the industry. what's happening up in sacramento in the waning weeks of the legislative session is a time tested tactic by big special interests and their allies in sacramento to get something done that will really hurt consumers. attorney harvey rosen field wrote prop 103, which regulates california's insurance industry. he he says he's been excluded from the insurance talks and says consumers are having the discussion hidden from them, too. i would call it an insurrection

by the insurance industry, trying to overturn a law that the voters passed that the industry doesn't like, that is not everyone's. take karl sussman is a west los angeles insurance broker and expert. i'm happy to say for the first time in probably 3 or 4 years that i've been jumping on shows like this and giving my $0.02, i'm optimistic that things are finally taking a turn in the right direction, sussman says. if we want affordable insurance in california, there must be change. at the end of the day, again, we're just looking at math. nobody is doing anything fancy. nobody is doing anything underhanded. the department of insurance is going to look at the numbers. they're going to see what insurance companies are losing, what they need to change, what type of guidelines they need to change, to be able to be profitable again. and that's what's going to get the market jumpstarted. media reports and those seemingly in the know tells seven on your side. the insurance industry is looking for three main things to

increase rates by looking forward rather than back using undisclosed data that can't be challenged by regulators and search changes to all policies to cover cost overruns of insuring high risk policyholders and charge consumers for reinsurance. s. that's the insurance insurance companies vie to spread out their risk. and now reinsurance has considered simply the cost of doing business as insurance companies under the disguise of claiming they cannot afford the risk of climate change, want the legislature to, number one, roll back all the protections of proposition 103 that have kept rates low for the last 35 years. at the timing of it is nefarious feeling, but it doesn't necessarily mean that the outcome is going to be dramatically different than it would have been had it taken, you know, a long drawn out period of time.

i'm doing my best to keep track of all of this, and i'll report back how difficult is it to get insurance or to change companies now? is that kind of dicey? it's a really dicey and especially where you stand. so if you think you're being overcharged, you need to make sure you can get another policy before you move. what we are also finding, though, is being a long time customer is a much help. anyone doesn't do anything right, doesn't do anything unfortunate. thank you, michael. we are getting a closer look at the aftermath of hurricane idalia from florida to the carolinas. houses were ripped from their foundations, trains, cars and debris now litter the landscape. idalia made landfall near tallahassee on wednesday as a category three hurricane. the storm devastate buildings and businesses and flooded homes. it was heartbreaking. she had many tears and. just thank god nobody died. it sucks to lose everything, but we're safe and healthy and well.

everything is replaceable. president biden has signed a major disaster declaration for florida. he plans to visit florida and survey the damage tomorrow. the number of people unaccounted for on maui following those deadly wildfires could drop from nearly 300 and to 50. that's the word from maui's mayor, maui county today reports that crews have searched the entire the lahaina disaster area. they've confirmed 115 deaths, fewer than half of those have been identified, though victims of the august 8th wildfires were honored during a day long vigil held across hawaii. oprah winfrey, who's a part time maui resident, owns a lot of land there. and dwayne the rock johnson, who spent part of his childhood on oahu, created a wildfire fund. the two stars donating a total of $10 million to the relief effort. firefighters who volunteered to help with those efforts following the fires were welcomed home to san francisco today. these members of the asian firefighters association met at chinatown's far east cafe after

for la cocina marketplace as we know it in san francisco's tenderloin. the food hall portion of the nonprofit operation is closing to the public after today. other spaces will remain open. the food hall opened in 2021 as an incubator business led by women, immigrants and people of color. a shortage of funding is prompting the closure about a year and a half sooner than expected. an affordable housing development is expected to go up on that site. gelato is coming to taco bell for the first time ever. only in california and pretty limited at that. the neon blue dessert, which is lime flavored, is called mountain dew. baja blast, and it debuted yesterday. it'll be on the menu for two weeks. it's just a test run and it's only available at one taco bell location, which is in irvine. so you really got to want your bop blast to go get it. that's an interesting flavor. yes. well, there's a huge celebration that took over the streets of downtown san jose today to mark

the first anniversary of the removal of the city's cruising ban. abc7 news south bay reporter zach fuentes spent the day with some excited members of the lowrider community, an activity that was once illegal is now happening and proudly on display outside of san jose city hall. this is what we needed. finally recognize this being good people, hard working people just love cars. it's been one year since the last sign proclaiming cruising in the city of san jose is banned came down the decades old prohibition was called blatantly racist by critics who felt it gave police officers the power to unfairly target people of color because of their culture. we sent a message to the entire state and to the entire country that we can no longer demonize certain activities based on who participates in them. robert gutierrez is cared for. lowriders like this since the 70s. he says to be here today is surreal. just to be recognized today, this year, 2023. this is awesome. the celebration shut down a block of santa clara street cars of all years. makes models and colors could be

seen around every corner. this is my 1963 chevy impala super sport. david polanco is president of the united lowrider council of san jose. he says the ban didn't stop the lowrider community from expanding its culture. this just didn't pop up in a year. this is generations and generations of people sharing this passion with their kids and growing, and it's still thriving. the city council voted unanimously last year to repeal it, though the city now has a new mayor and several new council members. since then, many current leaders were on hand to show support. city of san jose is capital of the lowriders. city hall is everyone's city hall, so i'm excited to invite the lowrider council and the many owners of these beautiful cars to come on down to city hall. though today is a celebration of the ban being lifted here in san jose. the united lowrider council here says they still have more work to do now focusing on statewide legislation. so september 7th, the senate will vote. and if that gets passed, it will go to the governor and that

off our coast are offering a big thank you to shipping companies for taking action to prevent deadly collisions with whales. abc seven news anchor dan ashley has a look at how this system works. if they could do it in their own language. thousands of migrating whales would probably want to say thank you. so now a group of marine scientists is saying it for them. they're awarding several admittedly splashy whale tail trophies to commercial shipping companies, thanking them for slowing down to help protect the

whales from deadly collisions. and i think it's something that's well deserved because we have a number of shipping lines who have drastically changed their operations and drastically changed their scheduling to ensure that they're slowing down to ten knots. jess morton is with noaa, the national oceanic and atmospheric administration, and the california marine sanctuary foundation. she says the awards are part of their protecting blue whales and blue skies program, which asks shipping companies to reduce the speed of their vessels voluntarily. it's traditionally included financial incentives until now, the money really isn't the main incentive and the main reason that they want to be involved in this effort. and so actually, this year, for the first time in 2023, this has become an incentive program that's just based on positive press and recognition. the top tier award winners include eight major shipping companies that achieved close to full compliance. one winner, msc, told us in a statement. wereommitted to making sustainable shipping a reality by doing everything in our power

to protect marine life, which is really exciting to see. and while the list of shipping companies participating in the program is growing, so is the technology behind it. in 2020, a partnership led by benioff ocean science laboratory helped place special eavesdropping buoys outside san francisco bay to actually hear the presence of whales in the area and relay the information to managers. kelly leaphart is a project scientist and says the system is multi tiered, so that includes dynamic blue whale habitat model sightings, data and the data. so real time acoustic data and all three of these, you know, complement each other. organizers are also reaching out to corporations that rely on shipping to move their products to help them use the data to assure their customers that their supply chain is whale safe. they say it's all part of an evolving system to protect some of the most magnificent creatures on earth. in san francisco, joe dan ashley, abc7 news.

and cal are headed to the atlanta coast conference, better known as the acc. now the additions are in all sports and begin next school year 2024, 2025. so august of this coming 2024 season. well, this decision heavily based on football. stanford women's head coach tara vanderveer says she thinks it's going to be great for her program at an smu to the acc. now at 18 schools is decision a long time coming after the collapse of the pac 12, when nearly all the schools have jumped to bigger conferences, including the big ten and big 12. and larry, we've been talking about this a lot and a lot of it's based on football. but an interesting quote there from tara. i want to start with your perspective on that, how at least it's going to affect women's sports and all sports on that side? well, i think it's interesting. you know, everybody's trying to spin this positive positively, whether it is or not, because the travel is going to be significant. it's going to be hard on not only the kids, but their families. but i have to say, stanford women's basketball has been a dominant program for them to be able to play and for the men's team as well, to play to duke and north carolina. these are blueblood schools.

those will be interesting rivalries. but, you know, football charters, the other teams do not. and so, look, when was the last time you've been on a flight? how long was the delay? how long were you sitting there? you know, these kids are going to be doing homework and airports and on planes and the adults get rich. the parents suffer and the kids suffer even more physical stress, mental stress, waiting to see what that happens. we won't know these answers until we start getting into it. what do you think is in this for the acc we mentioned? we think maybe in 3 to 5 years there could be a realignment. we talk about florida state, north carolina, clemson, maybe wanting out and that's why stanford, cal and smu are in, right? larry yeah, they're just trying to survive at this point because the notion is that florida state and clemson and north carolina are going to bolt in the next round of realignment. if they don't have enough teams, they will lose power. five status is huge. then they lose all their revenue and the great tv deals and all that. so this is kind of an insurance policy, getting cal stanford and smu is not taking any money for nine years from nine years
