ie. -- captions by vitac -- ♪ or bullet casings on a peninsula freeway brings traffic to a halt during the evening commute. and just minutes ago, investigators revealed new information about that shooting. good evening. thanks for joining us. i'm larry beil. that shooting injured a driver and shut down southbound lanes of interstate 280 in burlingame in what investigators tonight say was a case of road rage. sky seven shows the traffic jam on 280 in burlingame . and investigators are looking into this. this was a truesdale drive. drivers were backed up to larkspur drive and lanes were closed for about half an hour,

reopening around 630 this evening. the chp says they think the shooting happened on 280 near the crystal springs off ramp, but they're still working to try to figure out the exact location. the injured driver was able to drive to burlingame. officers spoke about the case about a half an hour ago, saying they have yet to talk to the victim. >> he's at the hospital right now. i'm not sure if he's finished being treated by the medical staff. obviously, the first priority is his well-being. so we want to make sure that he's tended to before we start speaking with him. >> the wounded driver is expected to survive. investigators are still searching for the driver who opened fire in oakland. community groups are coming up with their own proposals to try to improve public safety. abc7 news reporter tim jonze spoke to local leaders and neighbors who say they have had enough. i mean , tim, it seems like never ending shootings. yeah larry, you're absolutely right. >> now one of the biggest organizations speaking out tonight is the oakland branch of the naacp. folks at home might remember several weeks ago, the group called on city leaders to declare a state of emergency

over rising violence. today they released a list of ten points they want to see enacted to make oakland safer. crime is continuing to spike in oakland on monday, a gun battle near lake merritt resulted in one woman getting shot. >> very busy day. lots of people out, lots of lots of shots. obviously no regard for public safety. >> and on tuesday, for were detained and two arrested after gunfire rang out at skyline high school. >> my kids are not coming to school for the rest of this week and if i don't find out what really happened, they won't be here next week either. >> these incidents, just two more examples of soaring crime in the east bay city and growing sense of unease among many of its residents. >> oakland is by many accounts, worse than we have been in a long time. >> lauren taylor is a former oakland city council member who ran for mayor last year. on saturday, he'll be taking part in a rally to demand city leaders do more to combat crime, which he says disproportionately impacts people of color. >> as we talk about equity and progressive values, it is not

progressive for us to saddle the black community. those that have been marginalized and disenfranchized for so long with the weight of all of this public safety. these issues. >> taylor isn't the only one calling for change. on tuesday, the oakland branch of the naacp released a ten point plan they believe will make the city safer. among other things, they're calling for increasing the number of police officers, creating job training and mentorship programs for young people, and installing license plate readers throughout the city. >> the ten point plan is not really a difficult plan. it's just one that needs to be in place so we can at least do our best to make public safety a priority. >> bishop bob jackson is a member of the local naacp branch. he says many people in the community are scared to be out in their own neighborhoods. jackson believes city leaders are disconnected from the public. >> it seems like the priority of our elected leaders is not the

same priority of the voters and the taxpayers and something that's just into our newsroom in the past few hours, the superintendent of the oakland unified school district said in a statement that skyline high school will be closed tomorrow. >> she also reiterated that this type of violence in oakland needs to end immediately. in the newsroom tonight, tim johns, abc seven news. >> tim, thank you. new developments now. a federal appeals court has weighed in on the clearing of san francisco homeless encampments. the court upheld an injunction that blocked the city from clearing those encampments when the number of homeless individuals is greater than the number of available shelter beds. san francisco officials were trying to get that injunction removed, but according to the chronicle, the city attorney believes today's ruling does give them a little bit more leeway for sweeps. the legal battle began with a lawsuit filed by the coalition on on homelessness, the investment firm that bought nearly $1 billion worth of solano county farmland to create a utopian city met again with

members of congress and they spoke to the abc7 news i-team. >> as long as this organization will not commit to protecting travis air force base with the existing zone and development requirements. i remain very, very concerned. >> abc7 news i-team reporter stephanie sierra explains. federal officials say there are now even more questions after years of secrecy, the billionaire backed investment firm that's behind a massive land grab in solano county is now in the hot seat facing the second round of questions from congressional leaders. >> it was a continuation of my disappointment. for the first time in five years, congressman john garamendi sat down with the ceo of flannery associates, former goldman sachs trader jan sram, to discuss his vision for a so-called utopia, a new city in eastern solano county focused on affordable housing, clean energy and sustainable infrastructure.

>> but garamendi says their proposed plans could hurt travis air force base. >> it's very, very clear that they intend to go to an initiative to change the zoning requirements for that entire 55,000 acres. in doing so, they may very well diminish or eliminate the protections that travis air force base presently has. so i remain very, very concerned. >> did they specify to you specific plans they wanted to do with that land surrounding the base, why they bought it in the first place? >> no specific development plans were given to us, and i don't believe they have any specific development plans. i think they had a pie in the sky, a fairy tale. >> congressman mike thompson shared similar concerns. the i-team's spoke with him last week. if the intent here is to build a city, why do you think the land surrounding travis air force base was a priority years ago? >> well, i asked them about that because there city plans there.

there new city plans are considerably distanced from some of the properties that they were purchasing. and they had, i guess, an explanation for why they bought some of those properties. and it ranged from anywhere there from housing that they want to be able to build to an area that would be maybe suitable for housing, flannery told the i-team. >> there are currently no plans to build any homes within one mile of travis, but both congressmen say it's unclear what that land would be used for , especially given it's an area that's already restricted. supervisor mitch mashburn represents the area. >> it's all zoned agriculture and now it has an overlay that makes it even more restrict with regard to agriculture and any industry that can be put in there related to that. so i do not see an investment purpose in that. >> last year, solano county implemented what's called the

travis reserve overlay, which adds more restrictions for development near the base. in an email obtained by the i-team, flannery expressed interest in using some of the parcels near travis for olive orchards, but didn't specify details or any permits pulled to signal any change of land use or new developments. since we last talked. >> no, nothing in the meantime, there are other concerns surrounding the lack of infrastructure and the price tag attached to it. well, here's what i learned from my discussion, is that that investors were sold a fairy tale, an and right now the sermak and the leadership of this flannery group is busily trying to figure out how to justify what they have sold. >> flannery told the i-team. they thought they had a very productive conversation with congressman garamendi, adding any proposed project in eastern solano county, which would be subject to voter approval, would protect and support travis air force base for the i-team's.

stephanie sierra, abc seven news, burning man has now concluded tonight's temple burn was the final official event in the nevada desert. >> now there's this mass exodus. thousands of burners are trying to head home through a muddy mess. one of the first cities that the burners will pass through is nixon, nevada. it's about 60 miles from black rock city. abc seven news reporter j.r. stone is in nixon, where he's been talking with people, getting a jump start on their departure. >> people have left burning man by the thousands over the course of the last 24 hours. now, this gas station here in nixon, nevada, is one of the first spots that they hit. and it has been busy here. people needing to fill their gas tanks. it's been so busy, they've actually had to bring in extra fuel. so people could fill up. it's just been a mess. it's been a mess. kimberly collins, who just left burning man with her friend james smith, is having that kind of tuesday. they left their burning man camp and spent the overnight hours sitting in traffic like it was from

midnight till 7:00 till 7:00. now they've got air quickly leaking from their tire. >> i have a spare, but i'd have to unpack the entire car to get to it. >> but they're fine. relax the same thing they did when the torrential rain started falling friday night and led to mud everywhere. for once, the sun started drying out. black rock city, the conversation among burners quickly went from mud to when's the best time to leave? some here decided to leave when the man was burned monday night. >> we thought, okay, well, they're out there. let's sneak out the back door. didn't work alone. didn't work. we left black rock at about 7 p.m. last evening. took us eight hours to get off the playa. and then another probably what, 3 or 4 to get into nixon. >> and while traffic leaving is common when we're told by regulars that this type of backup was much longer than usual, this accident along highway 447 left things at a

around. so here's a look at what you can expect tomorrow morning. it will be foggy to start 50s on your temperatures. sunny for most areas by noontime and in the afternoon. really pleasant, mild weather for summer, low 60s to mid 80s. once the sun sets the fog and the low clouds will regroup once again in the evening hours. larry, i'll be back to tell you when the summer heat will be back in the forecast coming up. >> all right, sandy, i'll see you in a few minutes. tonight local officials and california representative jimmy panetta hosted a community forum on the recovery from the winter storms that we saw earlier this year. capitola near santa cruz was hit really hard and continues to rebuild. tonight, they listened to concerns from the public, especially about the response from fema and the efforts to have homes fixed. panetta assured people that there staying persistent in resolving residents issues through any bureaucracy they might face, and they have plans to rebuild the capitola wharf and hope to address rising sea levels as well. it's usually a popular

time of year in capitola. people flocking to the coastline, soaking up the last bit of summer sun. many businesses are still picking up the pieces, though, from those storms. they were looking forward to the labor day weekend foot traffic. but amid so much construction, owners are saying it's slower than usual in that area. it wasn't quite as good as a normal labor day weekend, but still a little slow. >> i think people are worried that we're not quite open. >> we are very grateful for all the people that come down. and, you know, they visit and they spend their hard earned money and it keeps all of us afloat. >> some visitors who came out were curious to see the restoration and say the city really is making a nice comeback. all right. happening tomorrow, lyft will welcome employees back into their san francisco offices. the new plan will require corporate employees to have a hybrid work schedule working in office three out of five work days. the company believes this will boost the city's economy and improve the nation's loneliness epidemic following the covid 19 pandemic.

biden will meet with port officials to celebrate their recent contract agreement. he'll deliver remarks at the white house about strengthening america's ports and supply chains. this follows the international longshore and warehouse union and the pacific maritime association agreeing to a six year deal that will increase wages and benefits for some 22,000 workers. that deal impacts 29 west coast ports, including the one in oakland. first lady jill biden recovering from covid at the family's home in delaware. the white house says she tested positive yesterday, has only mild symptoms. as president biden has tested negative. the diagnosis upended the first lady's plans to begin teaching this fall semester. today at northern virginia community college. covid cases, as you probably are hearing, they're on the rise in the us. earlier today on our 5:30 p.m. streaming newscast, we spoke with abc7 news special correspondent dr. luke patel and he shared things that we need to know and how to stay prepared

during yet another covid spike. why are we seeing more covid cases? >> is it because of back to school? it's probably a combination, karina, of the fact that we are seeing back to school. >> we're seeing people get back together. we also potentially have variants that are better at infecting people, better at evading the immune protection that we've built up, either from getting vaccinated and or actually getting covid, which encompasses more than 90% of people. so it's a combination of all of these things. that's why we're seeing it on headlines and the truth is it hasn't really gone away. it's just kind of hung out at a lower level. i have old tests at home. >> i have a couple of them. if i feel covid symptoms. is it okay to take those tests? >> of course it's okay. right. >> but like, are they going to be accurate or are they really going to tell me if i have it or not? >> so they're still accurate. the antigen test you may have are still accurate. what i would do, depending on when you got these tests is look at the expiration date. they're still accurate. now, here's a little asterisk about the accuracy. if you have symptoms, you really feel sick and you're potentially

going down earlier and earlier. here's your sunset tracker. tomorrow it will set at 731 october 6th, 645, and november sixth it will be down just past 5 p.m. so, yes, we are noticing a change as we're just a few weeks away from fall. and as we take a look here on water vapor imagery, there is a trough here that is carved itself out. it's not going to budge much. so as long as it's around, we're not expecting any heat as we head towards the weekend. high pressure over the desert southwest will bring some warmth back to the bay area as we take a look at live doppler seven, we do have the fog right near the coast and it's going to start to impact parts of the bay and some valleys as well. tomorrow morning, temperatures right now in the 50s to the 70s, that marine layer has deepened to about 1600 feet. it's looking pretty cool from our mount tam cam. here's a look at the forecast headlines. areas of fog in the morning, dense and patches near average temperatures. the next few days and it's going to be warming up

towards the end of the week from our san jose camera. a lovely view from the shark tank area. san jose, good air quality. the next three days. so if you want to do any outdoor activities, you don't have to worry about any smoke or haze around the bay area. 5:00 tomorrow morning. watch out there will be fog around parts of the north bay, the east bay, the peninsula, the coastline as we head towards the afternoon hours, it pulls back to the coast and then it comes right back in. by the evening, your morning temperatures will be in the 50s and the 60s. once again, watch out for that fog. it will be dense near the beaches tomorrow afternoon. we're looking at low 60s at the coast to the mid 80s. inland today we had mid 90s in places like fairfield. so cooling off a little bit, but still going to be pleasant for your wednesday day. not so pleasant is the atlantic right now tropical storm lee has formed it's east of the lesser antilles right now it is just a tropical storm expected to quickly intensify into a major hurricane as we

head towards friday. a category four. we will monitor this for you, especially if you have any plans to head to the east coast . accuweather 70 forecast morning fog giving way to sunshine near average temperatures really for the next couple of days. a little warmer on friday and the warmth will continue to gradually build. we'll bump those temperatures up into the mid 90s for sunday and monday, mid 60s coast side and then a little bit cooler on tuesday. but overall, larry, looking like a very quiet weather pattern, which around this time of year, we'll take it . yes. >> and pleasant. >> yes, absolutely
