>> yeah, larry and christine, it's moving day for this party promoter who told me that he was not doing anything illegal. the host who goes by the name fresh had until 7 a.m. today to leave the townhome. neighbors tell me he spent the night packing up some welcome sounds of leaving outside a row of townhomes on camille circle in san jose by phone, residents tell me they are relieved their neighbor is hopefully taking his parties with him once the news got involved and shined a light on the situation in which was so terrace really egregious, it stopped for months. they say they complained to 311911 the hoa and later code enforcement and the department of alcoholic beverage control about what they described as a strip club being run out of a townhome. here the parties were advertised openly on social media, including publicly posted video from inside. each weekend, residents tell the i-team people would come and go at all hours of the

night with security guards escorting them to the townhome by flashlight. but the party's promoter told me the guests and even entertainers, as he described the dancers, were friends and family. >> i think it's laughable a person helping the townhomes owner recently filed eviction paperwork, and last thursday, a sheriff's deputy posted an eviction notice on the window, giving whoever was inside until 7 a.m. today to get out this morning, the locks were changed and deputies posted a no trespassing sign. >> residents say it was a quiet weekend. >> i've gotten multiple good nights sleep, a longer string of good nights sleep than i've had in months and months. the department of alcoholic beverage control previously told the i-team it could not confirm or deny an investigation, but reiterated that it looks into every complaint received also that the sale of alcoholic beverages in california without an appropriate license is a misdemeanor violation of the business and professions code. >> san jose's code enforcement deputy director told the i-team. code enforcement opened a case to investigate any potential zoning building or municipal

i-team. >> happening now, a truck that overturned 6.5 hours ago still has a section of interstate 780 shut down in solano county. i want to show you the scene where crews are cleaning up the mess. the closure is affecting both lanes of the westbound interstate 780 at east second street through benicia. now, around 930 this morning, a tanker truck flipped over on its side and it spilled liquid asphalt. that is a slick, dark liquid you can see right there onto both westbound lanes. >> developing news out of san francisco where a standoff just ended in the fillmore district from sky seven. you can see the huge police presence near the intersection of eddy and franklin streets. earlier now we're told by san francisco police, this all started just before 1230. officers responded to a report of person in a car with a gun. and when they got there, the person was still inside the vehicle. police say the suspect was not responding to any communication attempts

and they called in a negotiating team. some streets in the area are reopened now in the east bay in just the past 24 hours, five people overdosed and two died in union city. >> all involving the drug fentanyl. police say one of those victims who died was 17 years old. first responders used narcan to revive two others. the union city police department says it wants to raise awareness about this recent trend. and detectives are working to pinpoint the source of these drugs. the alameda county district attorney's office has issued a temporary restraining order against a livermore based vaping company. >> investigators in alameda county say the company apollo. future technology was running a massive synthetic cannabis and flavored tobacco operation. the da says many of apollo's e-cigarettes ended up in the hands of students at local schools. office hours began their investigation back in december last year involving items sold online and from a warehouse in livermore. >> they used a warehouse in livermore as their base of

operations to sell banned flavored tobacco products, predominantly vapes and vape juice to individuals under the age of 21. the da is pushing for the company to be shut down. >> most employees of the rideshare company lyft are doing something that they haven't done since the beginning of the pandemic, and that is returning to work in person. >> ceo david risher says personal connections matter and bringing people together is important. abc7 news reporter leanne melendez tells us how this will impact the employees and the company. this sound system coming back to the office has that human connection that can never be replicated when working from home. >> there's a lot of energy here today out. lyft ceo david risher, shown on the left, gave employees four months to make the necessary arrangements to come back into the office three days a week. monday is thursdays, and the third day is

of tech layoffs here in the bay area, so we're keeping track and you can as well. this layoff tracker is on our website at abc7 news.com to the south bay now and today california's agriculture secretary placed a 112 square mile area of santa clara county under quarantine following the detection of oriental fruit flies. >> that area includes all of of cupertino, milpitas, san jose and sunnyvale and will likely remain in place untilt june . abc7 news reporter stephanie sierra has a look at what that quarantine actually means as an insect infestation posing an economic and environmental threat to santa clara county. >> the oriental fruit fly native to asia may look like a wasp, but it actually poses no danger to humans. it's a pesky problem for more than 250 types of fruits and vegetables like this rotting guava. >> but they're pests because they attack the fruit directly and lay their eggs under the

skin. the maggots develop and they destroy the fruit. >> after detecting eight flies that look like this are in the cities of santa clara and sunnyvale, the state secretary of agriculture has placed santa clara and portions of cupertino, milpitas, san jose and sunnyvale under quarantine, meaning the entire area outlined in blue will be prohibited from shipping out fruits and vegetables until next june. >> now that we have an established infestation and we've established a quarantine in that specific area, we're going to be trying to kind of lock down any movement of fruits or vegetables out of there so we don't spread the fly. >> agricultural commissioner joe deveny says the infestation has doubled statewide in recent years. >> the female deposits usually tend to 100 eggs per fruit. so when you go to pick your fruit off your tree, stephanie, you open it up, it'll have 10 to 100 maggots a single female fly can lay 1500 eggs.

>> easy to prevent the spread, the county asks residents in the quarantined areas not to move homegrown fruits and vegetables from their property. instead you can eat or process the food on the property where they were grown, whether that's in the blender or down the garbage disposal, or simply disposing them with double bags in regular trash bins, not the green waste bins. >> although farmers were trying to get away from the use of pesticides, they would have to spray even more to prevent their fruit from being infested. >> the state department of food and agriculture will treat the area where the flies were trapped through march of next year using an organic pesticide administered through an application device. >> if we don't go into backyards, nothing from helicopters. it's just very just a splat. all all through the neighborhoods in this area, according to the state, the value of california crops threatened by the fruit fly in 2020 was more than $19 billion dollars. >> it's really devastating if for many of the growers, especially the small growers, pretty much destroys any

it's just an interesting little twist. >> we've got some policy here, some legal stuff and a lot of politics at play. you know, right now what we just had was san francisco saying it's going to be easier now to clean up these encampments that we've been seeing for years in the streets. you know, but the fact is, it's going to be easier than it was a couple of weeks ago when we had an injunction that said we don't want you touching them. so it's not like they got a green light to go out there and clean up the encampments. what they did was get a flashing yellow that said, under certain conditions, you can tell people they've got to get off the streets. and one of those conditions is if they're there because they want to be or that they're voluntarily there and they can't say i any longer under this past injunction, they were going up to these people and saying, we have a bed for you. and they would say, i don't want it. right. and they couldn't touch them. now they can say, you don't want it. you got to go. so it's glass half full, glass half empty. if you're an elected city attorney, it's half full. if you're the other side, it's half empty.

>> so it's part success, part spin. >> i would say i would say that's the recipe we're dealing with right here. >> okay. all right. what is next for the city in this? never ending quest to try to clean up this problem? >> well, we are spending about $1 billion a year on it, a billion? $1 billion a year. and even when we do get the homeless into shelters, let's say we put them in those temporary tents in parking lots, whether it comes to about $61,000 a year. so there's no real quick fix and more. what we do have is a situation where san francisco is and i think you've probably seen it driving around. you're seeing less tents, you're seeing fewer tents. but we've got them in temporary shelters. we've got 3000 shelters, beds out there. we've got them in hotels. we've got them in halfway houses. we've got them off the street. those people. but what we're also seeing as much of is the people that look homeless, the people that because they are a lot, they're the drug takers. they're the mentally ill. they are the ones who are choosing to

live on the streets. and that is the challenge that san francisco has, because this ruling and the money have yet to kick in in a way that makes change. what we have to see and you're seeing london breed doing it is continually she's got to get her people to go out there and enforce the existing laws. that's that's the bottom line. >> you know, this is obviously part politics and london breed has an election coming up. what is this whole homeless situation mean for her legacy and her chances of getting reelected and staying mayor of san francisco? >> it's the ball game. it's the whole thing. it's the whole thing. i mean, if you talk to san franciscans and you look at the polls and everything out there, two things safety and homelessness. that's it. that's that's issue number one. number two. number three. and number four, if mayor breed doesn't make a significant change or at least perceive in voters minds that she's making a change, she could be in trouble, especially with ranked choice voting and the way people feel about

recall. she'll be running against herself. and that's not that's nobody wants to do that. >> you know, there have been other cities that passed so-called. no camping laws and that prevents the tent cities from popping up all over the place. i know in austin it was successful. do you see that happening here? >> it's interesting. it's interesting. first of all, you know, in austin they can do it. but you see austin isn't ruled by the ninth circuit court of appeals, which runs the western part of the country. and that's where the san francisco case is. and this other earlier one, boise, that said you can't get them off the streets unless you have a place to go. so there's different laws sort of being applied in different parts of the united states. do i see a time when san francisco or other california cities say, you can't camp here? i would say yes, it's going in that direction and it's not just san francisco, it's los angeles with new mayor karen bass. and it's even governor newsom who publicly said a week ago one of the big problems i had and continue to have is we

say, you got to go. and then the courts say, wait a minute, you get to stay. well, it's mind boggling that you could talk about spending $1 billion and still not really get it fixed. it is mind boggling. but but, larry, if you look at the streets, it's mind boggling that it got this bad. >> well, you're absolutely right. abc7 news insider phil matier. phil, thanks so much. >> new developments. a court victory in the fight against a school district's trans gender notification policy. today a judge issued a temporary restraining order. it blocks the chino valley unified school district in san bernardino county from enforcing the rule while it's being challenged by california attorney general rob bonta. the policy requires schools to notify parents if their children change their gender identification. bonta said the policy will forcibly out transgender students. district leaders say parents have a right to know the decisions their children are making in schools. just about two hours ago, california became the first state in the country to recognize transgender history month. >> as long as there has been a
