her father and now an east bay group is honoring her by fighting to protect cyclists. good evening. i'm larry bell. >> and i'm ama daetz. this rally comes exactly a month after the accidental bike crash in the lake merritt area. >> the four year old victim died days later after medical complications. abc seven news reporter tim johns was at tonight's rally and spoke with the girl's family. >> she is a firecracker, firecracker, sassy. told you how she felt all the time. >> uh- tears and trauma on the shores of lake merritt in oakland on wednesday afternoon. dozens gathered for a rally and

vigil in honor of four year old maya correa, who died last month after a crash near the intersection of hanover and lakeshore. maya was riding a kids seat on her dad's bike when suddenly a driver in a parked car opened the door, leading to a collision. maya fell to the ground and cracked her helmet after getting checked out by emts. maya and her father went home later as her family kept an eye on her. she took a turn for the worse and ultimately ended up in a coma after a blood clot formed in her brain. >> we could keep her body alive , but she would never know us. she would never be able to receive our love anymore. and that the maya we knew and the maya we love wasn't coming back to us. >> this is not something that we can accept as part of this rally , many are calling for change. >> they want to see the city of oakland do more to protect cyclists and pedestrians here on the other side of the lake from where the accident happened, the bike lanes are protected and kept away from traffic. that's something that maya's family, as

well as many cycling advocates here in oakland, want to see all over the city. oakland officials tell abc seven news they're working on plans to make this part of the lake safer. among other things, they say they'll be putting up better signage as well as looking at options at repaving the street come 2027, options that advocates say don't go far enough, quick enough. >> we're here to protect our children and the city has chosen not to in this moment. right. and this happens all the time. >> as for maya's family, they say they know nothing will bring her back. they just want to ensure others don't have to suffer the same pain they are. >> i just want my death not be in vain and something good come out of it in oakland, tim johns, abc seven news. >> it has to be agony for her family. we want to update you on a story we first brought you last night on abc7 news at 11. it's an important one in our path to building a better bay area. a federal appeals court is denying san francisco's request to make it easier to sweep homeless encampments. but the

city claims despite that it still has a way to be able to clean up the streets. so we're going to get to the bottom of this. what's the truth here? what does the ruling mean for clearing homeless tent camps in san francisco? so we posed that question earlier today to abc7 news insider phil matier. >> it's not like they got a green light to go out there and clean up the encampments. what they did was get a flashing yellow that said under certain conditions you can tell people they've got to get off the streets and one of those conditions is if they're there because they want to be or that they're voluntarily there and they can't say, i any longer under this past injunction, then they were going up to these people and saying, we have a bed for you. and they would say, i don't want it right? and they couldn't touch them. now they can say, you don't want it, you got to go. so it's glass half full. glass half empty. if you're an elected city attorney, it's half full. if you're the other side, it's half empty. >> phil says the city spends $1 billion a year on homelessness, yet billion with a b. by the way, we have more analysis on

this issue right now on our website, abc7 news .com. >> all right, let's move to the south bay now. a big decision is set for tomorrow to bring homeless housing to a site owned by vta in san jose. the mayor says it's one of the most critical votes of the year for the land. sits here right off zanker road tonight. abc seven news south bay reporter zach fuentes explains why this piece of property is so contested. >> vta busses and light rail cars are seen throughout the south bay, and when they're done running for the day, they're held at different locations. this is one of the most unique ones. >> this is the only bus yard vta has that has room to expand and that's why some are looking at the surrounding division bus yard as the site for a quick build interim housing community. >> earlier this year, governor gavin newsom committed state funding for 200 quick build units for unhoused individuals in san jose. san jose mayor matt mehan is a board member and at thursday's board meeting, plans to push for the sironi yard to serve as that housing site. >> we have actually surveyed over 100 sites in the city of

san jose. i can say with confidence we have found no better site than sironi. >> but this vta staff report says that's not the case. >> there's a lot of reasons why the site at sironi is just not the right place. >> vta has already leased three other sites to the city of san jose and mountain view for interim housing, but they say the extra space at the sironi yard is spoken for within three years. >> we have immediate needs for that site. >> 1st may need, they say, is for massive facilities and charging equipment that all needed to comply with mandates to eventually convert to zero emission vehicles. but mehan says until then, the city can put a third of the 17 acres to use. we are asking for a five year lease at some point when federal funding comes through and they design and bid a project and want to expand if that comes to fruition, we will move the site. but the vta report also found that staff at the sironi had safety concerns over non employees living near large vehicles constantly on the move. the staff also had security concerns about a mass shooting which which still
