decades in business. >> good morning to you. this is thursday, september seventh. >> yes. we're going to start with a check of our forecast with lisa. >> all right. hi there, everyone. a little cloudier this morning as low clouds and fog have made their way into our inland valleys. it's the system here that we are stuck in between that and high pressure that is yet to build in stronger. over the weekend. so right now, the fog with us and you can see the cloudy skies or that marine layer pushing into the east bay. it's going to be a little while until we see the sun. otherwise, it is kind of mild in hayward, 62, 63 in san jose with low to mid 50s in the north bay. so grab the jacket there, maybe elsewhere as well. and then upper 70s by noontime inland, the breeze kicks up. we're sunny in the mid 80s and our warmest inland valleys. jobina. >> thank you, lisa. good morning, everybody. so we are going to start in oakland. we're seeing a slowdown still minor on our maps and actually it looks like it just disappeared. so that's good news. westbound 24 before the caldecott tunnel, a minor crash in the process of

clearing in the south bay. we're looking great this is san jose showing you to 80. our biggest backup right now is going to be at the bay bridge toll plaza. we're metering lights came on at 531. come tsay. >> thank you. jobina happening today in the south bay. a vote is expected to decide on bringing housing for people who are unhoused to a site owned by vta. so here's a map. the land is off zanker road. mayor matt mehan says today's vote is one of the most critical votes of the year. abc7 news reporter ryan curry is live in san jose explaining why this property is so contested. ryan yeah coomassie. >> good morning. governor newsom has allocated state funding to go towards housing here in san jose. one of the sites being proposed is here at the vta lots. however some at vta do not think this will be the best location to put additional housing. vta says the saron division bus yard is the only yard the vta has that has room to expand the agency says they have already leased three other sites to the cities of san jose

and mountain view for housing. they say they will need this current bus yard in the coming years to build new facilities and charging equipment to comply with mandates to convert to zero emissions vehicles. san jose mayor matt mehan is pushing for this site to be used as housing and says they only want to use it temporarily. we are asking for a five year lease at some point when federal funding comes through and they design and bid a project and want to expand if that comes to fruition, then we will move the site. >> this is the only bus yard has that has room to expand within three years. we have immediate needs for that site. >> lawson also told abc7 news there will be security concerns if they decide to turn that location into housing. something very front of mind for vta workers following the pandemic and the mass shooting. the vote is scheduled for later on today and if it passes, you could see housing being built at the site

very soon and people moving into that housing before the year ends. we're live in san jose, ryan curry, abc seven news. >> thank you, ryan. in the east bay calls for action this morning after five people are believed to have overdose on fentanyl in union city. this happened within just 24 hours. two people died, including a 17 year old. first responders use narcan to revive two others. now can became more accessible in drugstores without a prescription. just this week, i think the easy access of narcan is very important and it's sad. >> we've come to this point. but if it's about saving a life and hopefully having that life be productive, that's what it's all about. >> union city's mayor says making narcan available is one step to combating the fentanyl problem. assembly member liz ortega, who represents union city, released a statement yesterday saying she's authored a bill to cap the cost of narcan at $10 per package. right now, a

package which contains two doses costs about $45 in the south bay. >> a new effort to stop an infestation of fruit flies. it could be devastating to agriculture. the oriental fruit fly is not harmful to humans, but it can damage more than 250 types of fruits and vegetables. eight flies were recently found in santa clara and in sunnyvale, and that prompted the state of the state secretary of agriculture to issue a quarantine for several cities until june of next year. you can see the area right here on blue in this map. it includes the city of santa clara and portions of sunnyvale, cupertino, milpitas and san jose. now that we have an established infested nation and we've established a quarantine line in that specific area, we're going to be trying to kind of lock down any movement of fruits or vegetables out of there so we don't spread the fly. if you live in this contaminated area or, i should say quarantined area, you should not remove homegrown produce

from your property. if you do need to dispose of any produce, put it in a blender down the garbage disposal or double bag it and then put it in the regular trash bin, not the green waste bin. >> the alameda county district attorney's office is trying to shut down a livermore based flavored tobacco company. the da is suing apollo future technology ag, claiming it operates a business that sells flavored vaping tobacco as well as synthetic cannabis primarily to underaged people. the da's office has obtained a temporary restraining order that bans the company from selling its products. investigator began looking into this company in december of last year and were able to connect it to purchases made by juveniles as they used a warehouse in livermore as their base of operations to sell banned flavored tobacco products , predominantly vapes and vape juice to individuals under the age of 21. there's no response to the lawsuit from apollo future technology.

>> now to a shocking new video. it shows how a convicted killer was able to crabwalk out of prison last week and jobina as the search for this man intensifies. we're learning this isn't the first major security breach at that facility recently. yes >> so what we're learning here from a prison officials is that this is the second person to get out of the prison in almost the same exact way in less than four months. so we're going to get right to this video here showing you daniela kavonte crabbe walking up the prison walls. he was able to get onto the roof and off prison grounds from there. officials say he got through razor wire that had just been installed after that previous escape prison guards noticed he was missing just an hour later during a headcount there. 16 minutes later, they had activated a public escape alarm and called 901 11. since then, there have been a massive there's been a massive search underway in the area around the

that the boys were meant to deter migrants from crossing into the state from mexico. he says the state will appeal the

justice department sued texas in july over these barriers, claiming it doesn't have the authority to put them in the river. texas has until september 15th to remove the boys. >> president biden is celebrating a new union contract. he says it will strengthen america's ports and supply chains. the new six year deal increases wages and benefits for 22,000 port workers . oakland is one of the 29 west coast ports involved in this deal. >> this landmark contract covers 29 ports that play a major role in our nation's economy. when the cost of moving goods through supply chains goes up, inflation goes up, strengthening supply chains and inflation goes down. that's why we made fixing our supply chains to bring down inflation a top priority. and it's working. >> california grown goods, as well as our consumer products coming in from asia, will be able to flow uninterrupted. >> a rally for road safety after a young girl died after a bike ride with her dad at lake merritt. one month ago, maya

carrera was in a kid seat on a bike with her dad when a car unexpectedly opened its door, caused a crash, and then the four year old died. days later after medical complications. yesterday afternoon, dozens of people came together for a rally and a vigil in honor of maya. they are now calling for better protections for bikers near lake merritt. >> we're here to protect our children and the city has chosen not to in this moment. right. and this happens all the time. oakland officials say they are working on plans to make that part of the lake safer. >> among other things, they say they'll be putting up better signage as well as looking at options like repaving the street in 2027. it's the end of an era in the south bay raging waters is closing for good. >> in an online post, the water park announced it's closed for the season and it's not reopening. our media partners at the mercury news report, the company that owns the park, decided not to renew its lease. the city of san jose owns the land. mayor matt mehan says the

city is already thinking about what to do next. >> i think we saw declining revenues and raging waters decided to pull out, which is a shame. but it also opens up an opportunity. i think they're very much will be a silver lining here and in the long run, we'll see new investment flow into that site and new amenities for the community over time. >> raging waters opened in 1985 and billed itself as the largest water park in northern california. our brand new soul food spot is coming to oakland. we were there to see the six location in a fixin's break ground in the lake merritt area . it was started by former cal bear and nba player kevin johnson. the popular soul food restaurant started in 2019in sacramento, where johnson was once mayor. he sees this as a chance to help oakland rebound and build the community. among those on hand said welcome to the restaurant was close friend fredricka newton. her late husband, huey newton, founded the black panthers. >> this is a place where the community can look for and support, thought and work in collaboration with and celebration of what's going to

for decades. this is after the show. it was wonderful. it really takes the audience on a journey. starting in the 1970s in chicago. so where don cornelius started all of this, and i learned a lot about his journey. he was working in news and really wanted to bring something. i didn't know that positive he had. he had his own like black news show and he kind of felt like it was a lot of negativity. and he said, this is not the entirety of the black experience. i want to bring something that brings people joy. and so it was really fun to see how we went from that to what we all know is soul train really just an iconic show? is it all original music or is some of it music you already know? yes, a lot of it is music you already know, so. >> oh, this is going to be fun. >> i didn't realize that. >> okay, cool. >> they when i tell you everybody's voice, every single person and the way they are up there dancing, i'm tired. did not take one step. and i'm like,

in the newsroom this morning with what we know about this investigation and what students can expect on campus today. >> gloria, good morning, kumasi. today there will be behavioral health staff on campus to support students as the school was closed yesterday while authorities continued their investigation. an and also so students could have some time away from school to process everything they went through. on tuesday, police responded to reports of shots fired during school hours at skyline high school. it's located in the oakland hills on skyline boulevard. the school of 1500 students was put on lockdown, students hunkering down in classrooms, rooms. oakland police, the chp and alameda county sheriff's department all responding. eventually two people were arrested. nobody was hurt. students talked to abc seven news about what they saw. >> as soon as like there was some gunshots and i was walking to the bathroom. and then i just see people running down and i'm like, whoa, what's going on? i knew it was real because i heard

the shots. >> parents say more has to be done, including looking into metal detectors for schools. in a letter to the oakland unified community, the superinten saying that they are united in calls for this kind of violence to end immediately saying it has become all too common in the city and adding that they are always looking to improve their response and are examining the protocols and also will make adjustments wherever necessary. live in the newsroom, gloria rodriguez, abc seven news. thank you, gloria. >> happening today, one of the most critical votes of the year , according to san jose mayor matt mehan. it involves a plan that would turn a plot of land off of zanker road into a tiny home village to get unhoused people off the streets. abc7 news reporter ryan curry is live in san jose this morning with more on today's vote. ryan. >> yeah, reggie, good morning. there are several reasons why many here at vta do not want to see this site turn into housing . they range from safety concerns to security concerns.

matt meehan very, very much so pushing for this. he wants the site turned into temporary temporary housing. he says he wants to use it until vta says they need it for something else. vta says the suburban division bus yard is the only yard vta has and that has room to expand the agency says they have already leased three other sites to the cities of san jose and mountain view for housing. the agency says workers would be concerned about safety if there are non employees living near their vehicles. mayor mehan says there will be security at the site and there wouldn't be any safety risks. >> a mass shooting which which still triggers people in and gives them concern. there's really no safety risk from the folks who are there. >> they're very well managed sites with security, with case management, vta like that site open for when they need to do more expansion when it comes to things like moving to zero emissions

vehicles that vote scheduled for later today. >> but yes, they do have a lot of safety concerns, especially following the pandemic and the mass shooting back in 2020. one. we're going to have to wait and see what this vote does that could change the future of the site here in san jose. we're live in the south bay, ryan curry, abc seven news. >> ryan, thank you. on monday, the nation will mark 22 years since the september 11th attacks. this morning, a major development in the case against five suspects. a potential plea deal now being rejected. jobina is tracking that from the live desk. >> jobina. thank you, reggie. good morning. president biden is saying no to some of those proposed conditions for a plea deal. the case involves five men accused of orchestrated the nine over 11 attacks, including alleged mastermind khalid sheikh mohammed. military prosecutor. suitors had offered the men held at guantanamo bay a deal that would have spared them solitary confinement and provided medical treatment for alleged abuse while in cia custody. but president biden has rejected some of the plea deal conditions. a spokesperson

saying, quote, the president does not believe the agreement would be appropriate in these circumstances. the terms of the agreement called for the detainees to plead guilty in exchange for being spared the death penalty. nearly 3000 people died in the attacks. the single worst assault on the us since pearl harbor. meanwhile all the new york fire department yesterday added another 43 names to its world trade center memorial, wall. all died of illnesses related to their work at ground zero. military prosecutors are now trying to hash out a new plea deal for the five men held at guantanamo bay. >> kumasi, thank you, jobina. a new report finds covid 19 hospitalized asians are on the rise, having increased now for a seventh straight week. the centers for disease control reports more than 17,000 hospitalizations during the last week of august, compared with 150,000 during the peak of omicron in january of 2022. officials believe the upcoming covid 19 booster could protect

against severe disease and death. it's expected to be available as early as next week, a win for people fighting for the rights of transgender students in one southern california school district, a judge has issued a temporary restraining order against chino valley unified. >> california attorney general rob bonta sued the district over a new policy requiring schools to notify parents if their children change gender identification. bonta said the policy will forcibly out trans students destroy. leaders say parents have a right to know the decisions their children make in schools in california is now the first state in the country to recognize transgender history month as long as there has been a california, there have been transgender people here contributing to their communities, making history and expanding civil rights, and helping to build a california that is more inclusive and prosperous for everyone. >> assembly member matt haney joined activists yesterday to
