joining us. the principal of a sonoma county catholic prep school has been fired over unauthorized charges on a school credit card. more than $100,000, according to the pastor. >> and the man now faces a criminal investigation. i-team reporter dan noyes has been looking into the case. and you've got the story for us, dan? >> well, and larry, this now former principal is well known at several of the bay area's catholic high schools. he worked at riordan in san francisco, marin, catholic, and now has been forced out of saint vincent de paul in petaluma. the lead detective in the petaluma police investigations unit confirms to the i-team that they have opened a criminal investigation at the request of officials at saint vincent de paul college prep into former principal patrick daly, who got fired just as the school year gets underway. they suspected some type of wrongdoing in the realm of embezzlement or unauthorized purchases. >> they asked us to open a criminal investigation, which we have. daly worked at the school

for six years now. >> staff members are combing records and researching questions posed by investigators. the cases at a very early stage at this point, we're waiting for those documents and asks and that's really where we're at. no one at the school would comment today, well, you're in public, so i'm on property. yeah, so am i. okay >> good luck to you. >> not the director of admissions, the interim principal or officials at saint vincent de paul parish or the santa rosa diocese. as a parent sent me this message they received from the pastor of the school, father william donahue, detailing more than $100,000 in unauthorized charges on a school creditsied to principal daly, including $52,000 in cash advances and thousands more inlth related expensrestration, life insurance premiums, a payment t the state tax board. thousands to the san leandro marina and in vet bills, the pastor points out the school doesn't own a boat or a pet. well, i'm very disappointed. the controversy comes as a shock to the parents,

students and neighbors of the school. >> the families and the staff have put their trust in mr. daly. >> and i feel as though it's been violated. well i'm pretty shocked. >> i mean, i've lived here for over 20 years. i've never had a problem with the school. >> daly became known to the community after he fired african-american staff in 2020, sparking this protest race played no part in in the layoff of four individuals. and after he appeared at a white house symposium with then-president trump that same summer. >> good afternoon, mr. president. i'm patrick daly, the principal of saint vincent depaul high school in petaluma daly pushed for schools to reopen as the pandemic faded. i can't thank you enough for your leadership of our country. and thank you for this honor. >> i called daly, visited his home and the marina where he allegedly kept a boat and have not been able to reach him to the petaluma argus-courier. he denied using sch money inappropriately, saying, as far as i'm concerned, the truth will ultimately come out. and i'm getting new information about

people. video shows the moment officers arrived and saw the suspect identified as 50 or 54 year old richard everett. they spent about 20 minutes trying to get him to drop the knife. >> hey, put the knife down. put the knife down. hey, gentlemen, get out of here. hey put the knife down, down! hey, get out of here. john five. we're giving one commands for wait stage. put the knife down. now. >> police say two officers opened fire when everett came at them swinging the knife, which was tethered to his wrist. new information on last night's fatal shooting of a man by hayward police officers. the department's acting chief says officers responded to a report of a man with a gun near a parking garage. he says the man who was unhoused refused orders to drop the weapon and that officers opened fire when he pointed it at them. officers later determined the weapon was a b-b gun. andrea koontz lives on the streets and knew the man and he was up in here last night

drinking with a fake gun. >> like a fake gun. a fake gun in his backpack. and like i think he might have pulled it wanting suicide by cop. >> she says she didn't hear officers say stop or wait or put the weapon down. >> police haven't said how many shots were fired. the name of the man killed has not been released. >> building a better bay area in downtown san francisco. it's been a little over six months since mayor breed laid out her roadmap to revitalize the downtown area. and while some of her strategies for bringing people and events back appear to be working, others are clearly more of a work in progress. abc7 news reporter suzannephan taking a closer look at the state of downtown, suzanne. >> so larry, one of mayor breed's strategies was to make downtown san francisco a cultural destination and tomorrow night it will be just that with as many as 12,000 people expected for the last scheduled bhangra and beats night market on battery street, business leaders say these cultural events have injected energy and excitement into the area. but the question now is how can the city keep this

momentum going? what do you say? >> no to? >> i'll say it's big, it's beautiful, it's loud. it gets people dancing. >> bhangra and beats. night market has drawn big crowds to downtown san francisco to times now. >> it's been a huge success. the first two events had about 10,000 folks come to them. >> it'll happen again friday night from 5 to 10 p.m. they're expecting as many as 12,000 people. three blocks of battery street will be shut down for the south asian night market. >> what they love about the event is the music and the dance and the food. so it is the culture that is bringing them and what's making them want to come back. >> mayor london breed has nine strategies to help revit's rise downtown san francisco. one of them is to transform downtown into a leading arts culture and nightlife destination by creating an entertainment zone, a major pillar of the downtown recovery strategy is to bring arts and culture and nightlife to downtown and to make it a destination for all of those

different activities south of market desi dungannon with cultivate labs says night markets and block parties work undiscovered. sf is a free filipino block party coming up on september 16th, undiscovered sf has been going on for seven years. >> it's first five years. we were a night market and has done wonders in revitalizing south the market for the filipino community. >> another challenge comes from the definition of downtown. some say revitalizing downtown is a lot more complicated because there are so many different neighborhoods facing their own challenges. a point san francisco standard reporter kevin trung highlight during a virtual chat today. >> the problem with this sort of amorphous definition of downtown is that the problem is facing mid market. are not the same problems facing the financial district and there are some difficulties in kind of coming up with a comprehensive strategy when the challenges are a little bit different and the mayor says a key part of downtown san francisco's recovery is attracting big conferences and

conventions. >> of course, we've got a big one coming up, dreamforce, that brought in 40,000 attendees last year and then in november, san francisco will host apec, the global economic summit, live in the newsroom. suzanne vaughn, abc seven news. >> suzanne, thank you. tonight, the vta board is considering a plan to build hundreds of those tiny homes for unhoused people on one of its properties in san jose. the location is the suburban division bus yard. vta has already leased three other sites to the cities of san jose and mountain view for interim housing. and tonight the board will vote on whether to lease the sironi site. the mayor says if all goes as planned, the quick build community could open sometime next year. >> vta officials have a decision to make whether to put narcan on busses and trains. abc7 news south bay reporter zach fuentes has a look at the plan on fentanyl overdose deaths have been a problem plaguing the south bay. >> we have had a death as young as three months old from fentanyl poisoning all the way up to you middle aged adults.

>> now a referral by county supervisor cindy chavez aims to put overdose reversal treatment. narcan on vta busses, light rail cars and transit stations. chavez is also a vice chair on vta's board of directors. >> we want to make narcan available and make it ubiquitous , really anywhere that people are. >> this vta passenger who did not want to go on camera says he recently witnessed what he believes was an overdose on a bus. >> the paramedics came and had to take him off the bus and he was unconscious. and i don't know what happened to him after that, but i think that if he was oding, that narcan on the bus could have helped. >> we also spoke with other public transit users who support the possibility. i don't see any downsides to it. >> if it can, you know, potentially save someone's life. >> but some have reservations, including some v.t.a employees. i spoke with one who did not want to go on camera. vta passenger william was also part of that conversation. i got a big education here today. the concern center around the pressure it could put on vta employees during an emergency, like giving mouth to mouth or

something like that, which could be a practicing your whole life. >> and now you see somebody overdosing on drugs and you don't know exactly if you're doing the right thing at the right time. chavez says training, education and support will be key. >> very easy to use. it's a nasal spray that can be sprayed very quickly, and it's intended to keep spraying as you keep the person alert until help arrives . and because of that, the training is not long. it's not complicated. and while i think it could for some people feel like a lot of pressure, i think for others it will feel like an opportunity to help. >> for now, the referral would direct staff to look into the possibility of equipping vehicles and centers with narcan if the board votes in favor of doing that thursday night, they would work with the transit union on the best ways to start the program. if that happens, chavez hopes vta will have the narcan by the beginning of next year. in san jose. zach fuentes, abc7 news. >> if you or someone you know is struggling with drug addiction, you can find a list of local resources on our website. abc7 news.com slash take action. >> all right, still to come on abc seven news at six seven on

the two unions recently, but so far no deal is imminent. outside the warner bros. studio clergy joined the picket lines, praying that the strike will end soon. >> the match is set for today. is sitting in the table and trying to do some solution as soon as possible. >> now that sb 799 is out of committee, i'm told it could be on the governor's desk for his signature by next friday. in culver city outside amazon studios, i'm sid garcia, abc seven news. students return to class today at oakland's skyline high school, days after a shooting on campus for which police arrested three people. >> the shooting happened tuesday morning and forced the school into lock down for hours. no one was hurt. on tuesday, oakland police arrested two people and confiscated a gun. today, the department announced the arrest of a third person and that a second firearm was recovered. all the suspects are under 18. a fundraiser for a woman hit by a stray bullet while walking her

dog around lake merritt is nearing its goal. the shooting happened on monday, labor day, around 1230 in the afternoon. oakland police say several suspects fired at a car on lakeside drive near madison street. a bullet struck kylie kienitz, an innocent bystander. she runs a vintage shop called heads or tails, on piedmont avenue. her gofundme says she underwent surgery and is recovering more than 500 people have donated and the total is approaching the $35,000 goal. we have a link to the gofundme on our website. you're seeing it there. abc7 news .com. >> solemn tribute today for a california man killed during world war two. firefighters and first responders lined overpasses to honor the repatriation of the remains of sailor wilbur mitts, which arrived today at san jose mineta international airport and then taken by hearse to a cemetery in monterey county. mitts was killed when the plane he was in went down in the pacific ocean 79 years ago this sunday. according to the monterey herald, a team recovered mitts

remains. in 2019, more than a decade after they located the plane's wreckage, mitts will be laid to rest in mission memorial park in seaside. >> all right. we are getting to our weather now. >> yeah, here's sandy patel. a little bit of a warm up coming. >> yeah, absolutely. we're going to bump those temperatures up into the low to mid 90s this week. and larry and emma, let's take a look at a live picture right now from our sutro tower. camera was a mild to warm day with temperatures ranging from the mid 60s to the upper 80s and a combination of this sunshine and fog over san francisco that low pressure system that has been just kind of lingering out west, keeping our temperatures down is going to be moving on out. high pressure here nudging towards the bay area. and as it does, temperatures going up by a couple of degrees as the flow around the high is clockwise as it may draw up some of this tropical moisture from hurricane jova. now so it's not going to hit california or baja. it's actually going to move away over the waters west northwestward

and weakened. but the leftover moisture could result in a couple of showers around the central coast between late tomorrow night and saturday. so keep that in mind if all the right dynamics come together, instability, they could see a thunderstorm or two. but for the bay area, it's a stable pattern . we have the fog on live doppler seven and here it is from our emeryville camera. as we look at the port of oakland low to mid 60s san francisco, oakland right now, san jose, 76 degrees. really mild in palo alto at 71 and a cool 57.5 moon bay. blue skies from our walnut creek camera and really good air quality out there mid to upper 70s santa rosa novato 83 fairfield and in concord 81 degrees in livermore and a lovely view from our pier 39 camera. the sea lions seem to be just relaxing. we've got the low clouds there as you can see. areas of fog and low clouds overnight sunny and warmer. the next few days. hot summer weather coming your way inland sunday and monday. not exactly hot tonight, but at 7:00 it'll be mild in the 70s, inland 50s,

coast side, the fog will spread across the bay by 9 p.m. temperatures in the 50s to 70s. tomorrow morning we start you off with the fog. tomorrow afternoon. those temperatures coming up by a few degrees. they'll be in the 80s to low 90s for our warmest spots. so your morning numbers will be in the 50s and 60s. that marine layer that deepened is going to compress. so there may be some thick fog right near the coast. keep that in mind as you're commuting tomorrow afternoon in the south bay, los gatos, 86 degrees, 83, san jose, 87 in gilroy on the peninsula. san mateo, 76 degrees, 75. menlo park, mid 60s, coast side. and it's going to be nice in san francisco, 70 degrees. breezy with some patchy fog lingering near the coast. north bay, 83 in san rafael, 86 in santa rosa, heading into the east bay 75. oakland 77. hayward inland areas will be warm up to 86. in walnut creek, 88 in livermore, 90 degrees in brentwood and fairfield. now pride festival is

tech fear of more interest rate hikes remains after unemployment benefits fell last week. the dow was the only index that closed in the green today. here's a closer look at thursday's numbers. the dow added 57 points. the nasdaq lost 123. the s&p closed down 14. mortgage rates dropped slightly for the second week in a row. but home affordability remains at its lowest, lowest level in nearly

added sailboat has been stuck in the sand for more than a month, and the sailor only has until monday to move it. he ran aground at upton beach right near stinson beach today. >> a federal judge extended a temporary restraining order, giving him a few more days to move his boat before the county intervenes. >> abc7 news reporter stephanie sierra has the latest from the beach and the courtroom. >> a sandy shipwreck on stinson beach. a sailor in route to seattle stuck on the shoreline since july 31st. it belongs to logan walker who calls himself captain. what happened to your shoes? i'm uh- they're gone. >> i don't know what happened to them. >> the captain walked out of federal court today without shoes, relaxed, lighting up his pipe after a federal judge extended a temporary restraining order, giving him a few extra

magic mushrooms are one signature away from decriminalization in california . >> this afternoon, a final state senate vote sent the bill to the governor's desk. this measure would allow people 21 and up to possess and use small amounts of psychedelic picks. opponents say hallucinogens can cause paranoia and psychological trauma. lisa hudson lost her son in 2020 after he took mushrooms, thinking he could fly. he jumped off a deck. >> i'm fearful for teenagers for young adults, for veterans that don't have a therapist there, and a supportive, controlled setting. >> proponents claim hallucinogens can be used for monitored treatment of addiction, ptsd, depression and anxiety. a new bill that's in response to the deadly shooting two years ago at the vta yard is making its way through the legislature. it would require businesses to have plans to respond to violent incidents, including smash and grab robberies. reporter carlos

granda with our sister station in los angeles, spoke with a bay area lawmaker who's behind this proposal. >> we have seen these violent smash and grab robberies. it all happens in a matter of seconds. and workers often don't know how to react or deal with it. the bill is saying is, my god, we don't even have the basic protocols in place for violence that we have for earthquakes and fires. state senator dave cortese authorized senate bill 553, which requires that all businesses create plans and provide extensive training to deal with any workforce violence. the bill came about after the shooting in 2021 at the santa clara valley transportation authority. it left nine people dead. >> an active shooter that, frankly, could have been apprehended pretty quickly if that swat team could have just gotten inside the door. but there was no plan for that. >> detailed plans would prepare workers for different types of workplace violence like these smash and grab robberies. there was controversy, however, over an earlier version of this bill, which would not have allowed

businesses or even security to confront any robbers. that has been eliminated. >> we actually went back into the bill and took out any reference to the word shoplifting and retail at all prior version of sb 553 made it difficult to even speak to suspected shoplifters. >> and that was something that retailers thought they had to be able to do at minimum, someone has to check your receipt. someone has to be a security guard in the store. >> after those changes, the california chamber of commerce is now neutral on the bill, but says with detailed records of all incidents and more training, it could still have a financial impact on small businesses. >> setting up a workplace violence prevention plan and getting training done. keeping records. those are still costs. >> the bill now moves to the assembly if it passes and is approved by the governor, it would go into effect on july 1st of next year. i'm carlos granda, abc seven news as well. >> today first lady jill biden tested negative for covid. the white house says she first tested positive on monday and

had mild symptoms. negative tests came shortly before president biden left the white house for his trip to india for the group of 20 summit. the president also tested negative for the virus today, as he was throughout the week. pressure on legislators is heating up in sacramento as insurance companies ask for industry stabilization and consumer activists are asking for transparency. seven on your side's michael finney is keeping track and he's here now. michael trying to keep track. >> trying to keep track. wow. nothing official has gone public yet, but the industry is said to want looser rate regulations and for policyholders to pick up the tab for high risk property owners. is information floating around. sacramento points to an industry push for a major change in california's insurance regulations. robert harrell heads up the consumer federation of california. >> rumors are abundant, but the thread through all of this is the consumer groups. and we've

asked i know cfc did have been literally exclude added from the conversations and the negotiations by the insurance industry. >> ralph nader is concerned too, though this means a lot of the deals that are going to be cut will be cut in secret. >> there won't be public hearings and groups like consumer watchdog will be put on the sidelines. >> however, industry group, the personal insurance federation of california, says we do not and have not had a legislative proposal. consumer groups aren't so sure and today sent a letter to the governor and legislative leaders asking for a halt to discussions. >> this is no way to run a country. this is no way for the state of california to conduct its business. >> then there is a memo being passed around where a handful of business groups say ensure commissioner ricardo lara supports sorts an industry proposal. we asked the commissioner's office if that was true. we did not get an

answer to that question, but we're told in part many claims are flying. the commissioner is actively at work on behalf of consumers and moving at the speed of good decisions on what's best for the health of the market. congressmember john garamendi was california's first insurance commissioner and wrote much of what regulates the industry. >> today, the governor seems to be involved, fearing a crisis that led legislature doesn't know what to do and the insurance industry seems to be writing the playbook. garamendi says any proposal passed in this legislative session would be bad news for consumers if they succeed. guaranteed california policy holders are going to once again be screwed by the insurance industry. >> now, if there is legislation, my understanding is it must be introduced by monday. so this could be a wild weekend in sacramento. i'll report back when it comes to insurance, it's
