recovering at home after being shot in what the chp is calling a road rage shooting. chp investigator say it happened tuesday evening around 630 near the 380 and 280 interchange in san bruno. the victim's daughter and his sister described what happened when he merged onto 280 south. and then this car just like sped up behind him and was like tailgating him. >> my dad tried to move to the other lane to try to just like, avoid him. but this car continued to follow him. >> amanda lynn roper said the car continued to follow her dad until he tried to exit off crystal springs. he told her that's when the suspect drove on his left side and fired a gun out. the passenger window. >> he heard the pop, pop, pop. and then that's when he saw like, the window shattered. but he on his car. but he did not know he was hit. there was a bullet that entered and exited on his left shoulder and then it grazed like the back of his head. >> there, grateful he survived. but are still processing what happened. >> a small incident that can trigger someone and then trigger

someone to the point that they can pull out a gun. it's quite a scary experience. >> investigators are still searching for the driver who opened fire. they don't have information on the suspect. they can publicly disclose, but they asked drivers that may have seen the shooting to call their tip line. the victim's family says a road rage incident can happen to anyone. >> you don't know what's going on in their head and you don't know what they could have. i mean, it could be like the finger or they can have like an actual gun to pull on you. there's a really anything that you can do besides during the moments and really think about your safety in the south bay. >> lauren martinez, abc seven news. >> an investigation is underway after hayward police officers shot and killed a man last night. the department's acting chief says officers responded to a report of a man with a gun near a parking garage. the man who was unhoused apparently refused orders to drop the weapon and officers opened fire when he pointed that weapon toward them. officers later determined the weapon was a b-b gun. angela koonce lives on the

streets and says she knew the man and he was up in here last night drinking with a fake gun like a fake gun. >> a fake gun in his backpack and like i think he might have pulled it wanting suicide by cop . >> she claims she did not hear officers say stop or wait or put the weapon down. police have not said how many shots were fired. the name of the man killed has not been released. >> new developments tonight out of the state capitol. psychedelics are one step closer to becoming decriminalized in the golden state. in fact, it's just governor newsom's signature away from becoming law. >> but that's not all. there's actually more than one bill moving through the state legislature to ease drug laws in california tonight, abc seven news reporter tim johns is unpacking what could change in the debate that's coming with it. >> several pieces of drug legislation making their way through the state capitol on thursday. >> first, both the state assembly and the senate voting to decriminalize some psychedelics like magic mushrooms. they're not a panacea. >> this is not a silver bullet.

but there are plenty of people who have literally been able to turn their lives around because of psychedelics. >> state senator scott wiener has been championing the bill for several years. he believes everyone from combat veterans with ptsd to those who suffer from disorders like anxiety and depression could benefit. >> the tide has turned and shifted dramatically on these issues in california. support for decrim analyzation of substances and full legalization of cannabis is overwhelmed. >> now state assemblyman matt haney supported wiener's legislation and also is advocating for his own. haney has introduced a bill that would allow certain cannabis retailers to sell food and beverages. the idea behind it would be to create cannabis cafes similar to ones in places like amsterdam. um, on thursday, the state senate passed haney's bill by an overwhelming margin and now needs just one more vote before heading to the governor. >> california should be a destination for cannabis just

yes, the weekend is looking good. let's take a look at a live picture right now from our pier 39 camera. and you will notice that we do have fog here in san francisco. so that's how we're going to start the morning areas of fog, 50s and 60s. over the next 24 hours, you will notice that by noontime it is warmer 70s and 80s, inland 60s coast and by the mid afternoon we're talking about 90s for our warmest inland valleys 60s coast side in the evening it'll still be comfortable for most areas with limited fog. temperatures are going up for the weekend. i'll let you know exactly how warm coming right up. >> all right sandhya thank you. we'll check back. part of our effort here at abc seven is to build a better bay area and find solutions, which is what's going on in the south bay. san jose is inching closer to building quick build homes for the unhoused on vta property. the land being focused on sits here right off zanker road. a lengthy discussion at tonight's vta board meeting led to a number of changes to the proposal that

would result in san jose leasing land at what's known as the sironi site. among the changes, san jose mayor matt mehan is asking for a five year lease. they will revisit the plan at the next meeting. mayor mehan has said if this gets the green light, the project could open sometime next year. >> today, governor newsom announced that he's beefing up the state's drug enforcement efforts at the mexican border to help battle the fentanyl crisis in 2023. >> so far, 93% of fentanyl seizures in our state have occurred at legal crossing points or interior vehicle checkpoints, which is where our work is being targeted. >> the governor says he plans to increase the number of california national guard members at the border from 40 to 60. the goal would be to expand on the operations that he says have led to a 594% increase in fentanyl seized in the state, according to newsom. law enforcement agencies seized more than 28,000 pounds of fentanyl last year. well, cleanup is now underway at burning man after

heavy rain left thousands of the so-called burners stranded in ankle deep mud. it was just a mess. organizers now have three weeks to clear out rugs, tents, trash, abandoned vehicles, everything there from a stretch of black rock desert in northwestern nevada this year, the aftermath of heavy rains will make the clean up harder than in previous years. and some people, they just left their belongings behind because they were in a rush to get out. i think each year i've been so i've been for five years, people have done worse and worse about leaving no trace. >> before, i'd say five years ago, i used to see absolutely nothing and nowadays, yeah, it's pretty bad. so people are starting to leave a trace or forgetting the core principles, the cleanup deadline is because of an event permit issued by the federal government. >> some festival goers plan to stay as long as it takes to help clean up the grounds. federal employees will then evaluate the area after the cleanup. >> all right. now to tonight's abc seven news advancer. at 11.

it's our way to keep you ahead and in the know on some headlines you'll be hearing much more about in the coming days. first, it's the threat of another strike looming in the us. the united auto workers union is asking the detroit three automakers, general motors , ford and stellantis, formerly chrysler, for a 46% pay raise over the next four years. it comes amid the writers and actors strike, which has been ongoing since late spring. those strikers are now calling upon the california state government to step in as they've been feeling the pinch of lost wages. >> it is beyond time for striking workers for all workers to have this tiny bit of relief during something as stressful and as powerful as a strike. >> the wga strike has now lasted 129 days, and the sag-aftra actors strike has been going for nearly two months. there were talks between the studios and the two unions recently, but so far no deal is imminent. our next abc's seven advancer at 11 takes us to the world stage. president biden is preparing for this weekend's summit with g20 leaders in india. the president is currently aboard air force

one on his way to germany. once refueled, he will continue on to india for the conference. noticeably absent from the g20 will be china's leader, xi jinping and our final abc7 advancer at 11 is looking ahead to your monday morning commute. apologies in advance for bringing it up so early, but bart says you won't be waiting as long for a train to come next week. the agency is running more trains starting monday, so it says at no time will you be waiting more than 20 minutes for a scheduled train. people can expect a 50% increase in evening service, seven days a week. service on bart's busiest weekday line. the yellow line will increase from running every 15 minutes to every ten minutes from pittsburg bay point. all these changes are to get more riders back on board north bay food bank is doing its part to help build a better bay area by helping those experiencing sight loss and food insecurity. >> the redwood empire food bank has partnered with the earl bomb center in santa rosa. that's a nonprofit that helps visually

today. but the man again eluded capture. sources tell our sister station in the area, the man was seen on a nearby trail camera yesterday, but investigators didn't see the footage until today. they believe the suspect has been moving across an area spanning 8 to 10mi■!s. >> well, time is running out for a man to get his sailboat off a bay area beach or else authorities will come in and chop it up. the boat is stranded on stinson beach in marin county after washing ashore at the end of july. logan walker now has until noon on monday to get it out to sea. >> you have helped plan to get the boat out of the sand. >> yeah, it could be out of here. real, real soon. >> how soon? the next tide, walker, who calls himself captain. >> he left federal court today without his shoes. after getting a temporary restraining order that bought him some more time. he was on his way to seattle when his boat got stuck. the boat is certainly a hot topic in marin county, with some people wondering why is this taking so long? the captain is worried that the county could ruin his boat if they chop it up and that

to the queen in a speech tonight . >> mexico is in line to make history in its 2024 president election. the country's two leading parties have just named women as the winners of their respective primaries, and they'll face off for the presidency. so that means, barring any upset by a third party candidate. mexico is on track to have its first female president ever once the ballots are cast in june of next year. new developments with a viral internet challenge known as the one chip challenge. >> the company behind the chip is now taking action. it comes as a family is blaming their son's death on the challenge. they say their 14 year old died the same day he tried the chip, marketed as being one of the spiciest in the world. it includes a carolina reaper, pepper and viper pepper. and now the chip company is removing the product from shelves. >> what a good boy. he was a great boy. good boy. yes loving, loving son. >> the medical examiner is still looking into the boy's exact cause of death. in a statement,

the chip company says the voluntary recall of its chips from stores is out of an abundance of caution because of an uptick in teens not following the product's warnings, a protest interrupted the us open tennis tournament for nearly an hour tonight. >> it was a disruption going on in the stadium right now in the upper upper deck, a group of environmental activists in the upper level of the stadium halted play there in the second set of a semifinal match. >> while a couple of them were cleared out by authorities. one protester glued his bare feet to the concrete floor. and that caused an extended delay because they had to figure out how to how to get him out of there. he was finally led away in handcuffs. and the match did resume a similar protest took place in july at wimbledon with activists running on the court and spreading orange confetti. but gluing yourself to the concrete is, yeah, that's different. >> yeah. all right. we have some intense weather to check on tonight. >> yeah. let's check with sandhya patel. hurricane

warnings? >> yeah. it's a cat five in the atlantic. hurricane lee is what we're talking about. larry and alma, take a look at this powerful storm. it is just it really churning in the atlantic as a category five with 160 mile an hour winds moving to the west northwest at 14 miles an hour. the biggest threat with this is expected to be life threatening surf and rip currents in the caribbean over the next few days . it's expected to get even stronger in terms of the winds. look at that 175 mile an hour winds tomorrow evening. and then it starts to weaken to a category four. now, the danger, aarhus and life threatening swells could reach these coasts as early as sunday. so just keeping an eye on that. also keeping an eye on hurricane jova, not quite as strong, southwest of cabo san lucas. this is expected to weaken as it continues to move out over the waters. but it is going to send some rough surf to southern california, as you will notice on saturday. and there's a

shower chance all the way up to the central coast and the sierra . so if you are traveling to tahoe, keep that in mind. friday, tomorrow, bright and mild, 75 degrees. there's that slight chance of showers on saturday, upper 70s on sunday and will brighten it back up over there. well as we look from our exploratorium camera, we have a beautiful view of san francisco areas of fog and low clouds overnight. sunny and warmer the next few days. and we do have hot summer weather inland sunday and monday. nothing extreme, though. high pressure is going to start to build back after this trough has been dominating. and as that ridge builds back, it is going to warm us up. so as we take a look at live doppler seven, we do have some fog near the coastline, but it is pretty much going to be coast and bay tomorrow morning. 50s and 60s on those temperatures. and as you get out the door tomorrow morning, watch out for that fog right around the bay and the coastline. some higher clouds in the morning and then later in the afternoon, we will notice that the fog begins to get cleared out from north to south,

setting the stage for that warmer weekend. temperatures in the morning in the 50s and the 60s tomorrow afternoon. you are looking at a warmer day, upper 80s to low 90s today we made it up into the upper 80s in the warmest spots mid 60s coast side. a little breezy, but really beautiful weather for your friday and also for oakland pride festival and parade on sunday. it's going to be comfortable at 11:00 in the morning mid 70s by 2 p.m. 79 later in the afternoon and the sun goes down and the temperatures still going to be in the comfort zone. answer hassan and zach fuentes will be hosting the event. so go by and say hello. accuweather 70 forecast warming begins as it takes us through the weekend. we bring in the heat with mid-nineties inland on sunday and monday mid 60s coast and then temperatures are going to drop back down to average or even a little bit below later on even a little bit below later on in the week, we used to struggle with greasy messes. now, we just freak, wipe, and we're done!
