over tonight during a fight over flying the pride flag at school. what has become an educational culture war across the country now finds its way into a tiny east bay town. good evening. >> i'm ama daetz and i am julian glover. the sunol glen unified school district encompasses a single k through eight school, but tonight it was supercharged with a whole lot of tension. >> yeah, it really was. now, the district voted to ban any flag, any flag from being flown on its campus besides the us and california state flags. >> it's a big issue at that school. abc7 news reporter tim johns has been at that meeting

all night and shows us how this debate is dividing that small community. >> we apologize. we do not have that for you right now. so we will get back to that in just a moment. for now, though, we want to tell you that building a better bay area is a key part of our mission here at abc7. and tonight there are two new initiatives to combat retail theft and clean up san francisco's landmark mall. now we're breaking down both plans and why it could be months before we find out if the tactics work. >> so first, let's talk about cutting down on organized retail crime. governor gavin newsom announcing today that the state will spend more than $267 million to 55 cities, the largest ever single investment in california history. that money would go toward hiring more police, leading to more rest and securing more felony prosecutions. sheriffs and police departments across the state could be awarded up to $23.6 million each. it includes all of these bay area regions. you see here on this map from

san jose to san francisco to santa rosa, several district attorneys offices could also receive some of that funding. it's all a part of the governor's real public safety plan and now to san francisco's landmark mall. >> tonight, a retailer in the mall formerly known as the westfield san francisco center, has filed a lawsuit against the former owners. >> the company behind american eagle is alleging mismatch management and letting crime run rampant. abc7 news reporter joe stone has the story. >> the mall operator, westfield is no longer running san francisco's downtown mall, but now one retail store in that mall. america an eagle is saying not so fast. a retail west, the group that owns american eagle has filed a lawsuit against the owners of the mall. former known as westfield san francisco center, saying they are to blame for problems their store has encountered. i think what american eagle's end game here is to say that we want out of our lease. that's legal analyst steven clark. after analyzing

this complaint, it claims that between may of 2022 and may of 2023, there were more than 100 security incidents at this american eagle, san francisco location. quote, amid an eagle, employees have suffered much multiple physical attacks and assaults. in one instance, a patron even threatened american eagle staff with a machete. clark says this case has huge implications for other major cities. >> if american eagle is allowed out of its lease based on the crime, the violence, the shoplifting and the other problems at the mall, i think you'll see a lot of other retailers looking at this as a tool to say we want out as well . >> reporter laura waxman was first to break news of the lawsuit in the san francisco business times. >> this lawsuit is interesting because now we have a retailer inside of westfield, one of the big remaining ones, saying, hey, wait a minute, you guys didn't take care of some of the conditions inside of the mall when you could have. >> the complaint argues that

westfield must be held accountable for the damage caused by its failures and broken promises going on to say that westfield failed to maintain common areas of the mall like they were obligated to do in their ten year lease that was signed in 2017. calling it a breach of contract. while there is no mention of wanting to break their contract, clark believes it could come to that. >> certainly american eagle doesn't want to be the last retail tenant at the mall. that could be a disaster financially. so i think because nordstrom's left and others have left, i think that's what american eagle is looking at, saying we don't want to wait till 20, 28 to leave. we want to leave now. >> it is important to note that within this complaint there is a request for monetary compensation for american eagle. no specific number was given, though. i did reach out to american eagle representatives who told me they would not be commenting on the matter. i also reached out to westfield reps

who told me westfield is declining to comment because we have not been served. the lawsuit. j.r. stone, abc seven news. all right, j.r. thank you. >> now we want to get you back to that contentious school board meeting over in the small town of sunol. >> yeah, that's just south of pleasanton. the school district there just voted to ban pride flags and it got quite heated. >> it did. abc seven news reporter tim johns was at the meeting all night. he shows us how the debate is dividing that community. >> yeah, the school board meeting was extremely heated, so much so that they actually closed it down to the public because so many people were interrupting and screaming over each other. and it wasn't just people in the audience either. at one point, the superintendent of the district was fighting with the president of the school board right in front of the crowd. dozens of people from both sides packed the small meeting room hall on tuesday. while the resolution passed, technically states that the district can only fly the us and california flags on their campus. much of the debate has stemmed around the lgbtq pride flag. the topic has divided many in the community, which was

evident at the meeting under my superintendent support. >> you're saying you cannot speaking on you're a secretary to the board. >> this is the board's meeting. we're going to move along with the agenda items for order. why not. what is why should why is there an issue with that? move on to divide us? because we have protocol. we have a way that we run our ship and there's protocol. oh, there's not an order. to nobody >> the snow glen district has flown the pride flag on its campus in the past. >> many of those opposed to this new rule say being able to fly flags like the pride flag demonstrates that the district remains an open and inclusive place for all. several people also tell us they believe the resolution will have detrimental impacts on the district's lgbtq students and community. for many kids, the only safe and welcoming and affirming place they have is their school. >> and when we see school board

members that don't acknowledge that and actively push policies against that, it harms gay kids, it harms gay families. >> others, though, disagree. they think the us flag is inclusive of everyone and said they thought this entire process was being politicized. others say they think that without this resolution, certain flags are favored over others. >> i don't agree with the lifestyle, but at the same time i don't agree. having it in the schools and being pushed down everybody's throat because nobody's doing their lifestyles down everyone's throat. now, one thing that's important to note is that many people on both sides of this issue believe that even though this is a small district with less than 300 students, they think that this decision will have wider ramifications. >> these are discussions that are being held in school districts around the us. certainly something that will continue to come up many believe, in sunol. tim johns, abc seven news in san francisco. >> pedestrian safety advocates returned to the intersection at fourth in king streets, where a

four year old girl was killed. four weeks ago. the group walk sf set up this memorial here featuring a ghost stroller much like the ghost bikes. you've seen the memorial eyes cyclists killed by cars. police say 71 year old karen cartagena hit and killed that girl who was being pushed in a stroller last month. she was in court yesterday pleading not guilty to vehicular manslaughter. >> we want to make sure people do not forget this happened and we especially don't want our city leaders to forget what happened because we need them to fix our deadly intersection. >> as city crews have since removed one turn lane on fourth street to improve the intersection in. but advocates are calling for more, including a pedestrian only phase of the turn signal. there >> we sat down today with alameda county's district attorney, pamela price. our conversation was wide ranging both on what she has done and what she still wants to accomplish. >> it's an adventure. it's a great adventure. we came into a situation that was highly unstable, so ill prepared for

inland tomorrow for your wednesday. >> let's take a look at some live pictures from our tower cameras and this is a pretty good indication of what you can expect to start the day. we're going to see some fog and drizzle temperatures in the mid 50s to upper 50s by the lunch hour. some clouds will linger near the coast away from the coast, though, you see plenty of sun and for the afternoon hours low 60s to low 90s so just a little bit warmer here away from the beaches. the sun sets at 720 tomorrow night and the temperatures will be in the 50s to 70s. we're on a roller coaster ride. i'll let you know if it's going to be a miniature one or a big drop as we hit the weekend coming up. alma. >> all right. look forward to finding out. thank you, sandhya. let's move to the peninsula where san mateo county is giving the green light to turn a la quinta hotel into affordable housing for unhoused families and seniors. the 100 room hotel on el camino in millbrae may look like your average hotel, but tonight it's the source of one of the most contentious debates in the bay area. abc7 news reporter lauren martinez shows us what's to come for the

site. >> this conversion will harm our city finances affect local businesses for the price of $33 million. the san mateo county board of supervisors is purchasing this hotel in millbrae. the la quinta inn will be remodeled into permanent supportive housing for families and seniors. i'm a mother. >> i have three kids. we were homeless for a year. you didn't need to be afraid of us. >> at a meeting today, county supervisor millbrae city leaders and residents discussed the purchase decision, but the property has been controversial for months. >> because we are all one group, you know, we're going to show his strength on friday, residents held a rally outside the hotel. >> abc7 spoke with millbrae mayor about how news of the county's intentions were out before they were communicated. >> they then signed an agreement in june to begin negotiations with a hotel in millbrae without coming to millbrae. and in fact i found out about it by reading

the local newspaper the next day. >> on tuesday, the board voted 4 to 1 to purchase the property. supervisor david canepa was the only no vote. it's the sort of imposition of us making a decision for a city cannibas concern is for the 35 hotel workers and staff at the connected sushi restaurant. these are housekeepers. >> these are people who work at the front desk. these are people who work in the in the restaurant. >> some of the main concerns from residents were public safety, loss of jobs and the financial loss for the city. the existing hotel garners hundreds of thousands of dollars from tax revenue every year. supervisor noelia corzo felt like those concerns were addressed in the vote, and she brings personal experience to her decision. >> for me personally, as someone who experienced homelessness s with my family as a child in our county, that is part of the lens that i see the world through. there were compromises made and there was support given and i felt like we got to a really good place for some millbrae

decongestant use by millions of americans is ineffective. reporter denise dador from our los angeles sister station explains what's next for medications like sudafed, allegra and dayquil. when a stuffy nose hits. >> aurora o'connor often reaches for one of these popular over-the-counter cold meds. >> they seem to help at least i think they help. >> but now an fda committee says that could be a placebo effect. >> that does surprising in a unanimous vote. >> fda expert said that nalorphine a common ingredient in some over-the-counter nasal decongestants, does not work when taken orally. the decision is based on several new studies , so some patients might respond. >> but a lot of patients we find will say, well, i took it and it didn't work. >> dr. allison chacon with the usc mann school of pharmacy says when phenylephrine reaches the nose, it constricts blood vessels, which helps open up congested nasal passages. that's why nasal sprays containing this ingredient can be effective. but when taken by mouth, by the time it's metabolized, it's not strong enough to be effective.

those products, such as sudafed, are available without a prescription. but are stored behind the counter. experts say the fda's findings on phenylephrine could have a huge impact. >> it's pretty major because there's not a lot of times where we see medications get pulled off the shelves, especially one that's been around since 1960. >> so what should you do the next time you have a stuffy nose? dr. chacon says reach for a nasal spray containing phenylephrine or you can try allergy meds with antihistamines that can help dry out your nose. >> loratadine or the cetirizine. those ones are able to help decongest the nose as well. >> denise dador, abc7 news. >> so where do we go from here? the fda says several steps would need to be taken before any medications are actually removed from store shelves and many don't purge your medicine cabinet just yet. many products have multiple active ingredients, so those medications will still treat other cold symptoms like those headaches or coughs tonight. >> walgreens says appointments are now open for the new covid vaccine. it comes just one day

low 60s coast below average on sunday low 60s to low 80s and i get asked about this every so often and when are we going to see some rain. well the climate prediction center is saying the 8 to 14 day outlook is showing above average rainfall for the central us and it includes us here in the western us near normal expected for the southwest. so let's take a closer look here. it's a 40 to 50% chance of above average rainfall between september 20th and the 26th. stay tuned. we had a little bit of rain in the sierra with some thunderstorms still isolated across the region. trough as you'll notice, on the water vapor and radar imagery has been digging in across the pacific northwest. that brought us the wind today that also brought us the cooler weather. right now, we do have fog along the coastline. the marine layer went from 2000ft to about 1500 feet, indicating we're in for some changes tomorrow. so mid 50s to low 70s. right now, the ocean temperature

is 59 degrees. so when that wind is coming off the ocean, it's feeling cooler from our san jose camera. we are looking at the shark tank right now and the air quality will remain good for any outdoor activities the next three days. as we check out a live view from our golden gate bridge camera, here's a look at the forecast. low clouds, fog and spotty drizzle overnight. a little warmer bay and inland tomorrow and then cooler than average for the upcoming weekend. so we start off the morning with the fog and the drizzle temperatures is at around 7 a.m. we'll be in the 50s and 60s. look at what happens by noontime in land areas are warming up but there's still some cloud cover near the bay and along the coast, which is why the coast is not going to warm much compared to the bay and inland. tomorrow afternoon, we'll see those temperatures popping up into the 90s for the warmest spots. so your morning numbers will be in the 50s and 60s. watch out for the drizzle and the fog as far as tomorrow afternoon goes, it's going to be a nice day. low 90s inland low 60s coast. breezy right near the coastline. category three
