migrants even declaring an emergency, the biden administration is clearing the way for venezuelan migrants to get work permits. >> some of those migrants have been bussed to new york, where another protest was held last night. >> the new policy extending legal status for some venezuelans is just one new move that was announced last night by the homeland security department . this morning, the biden administration is announcing new policies to handle the surge of migrants crossing the southern border. and overwhelming cities across the country. >> there's no end in sight. we don't know, you know, when it's going to end. >> the administration will now send 800 defense department personnel to the border in addition to the 2500 national guard members already deployed to help customs and border protection. the administration is also expanding deportation protocols to remove more families under an already existing program. um, and in perhaps the biggest move, it's granting temporary legal status to 400,000 venezuelan already in

the us, making it easier for them to get authorization to work. new york's governor praising the decision. you have people here who are in shelters supported by the city and mayor adams is doing an extraordinary job. >> but they can't work this is for people who came before july 31st. so it's not an enticement for more to come after new york city is currently paying to house 60,000 newly arrived migrants and more could be on the way as the southern border sees a new surge. >> eagle pass, texas now declaring an emergency with 2500 migrants arriving yesterday alone. this chaotic unfolding at an asylum office in mexico. a crowd of mostly haitian migrants trying to rush the building, some having waited weeks for an appointment and hundreds of migrants were seen riding on top of this mexican train heading north. >> this isn't a political situation, an this is not a left or right issue. this is a an

immigration system that has failed as a county. we are not resourced to handle this. many people coming in. >> chicago is also struggling to cope with the migrant surge. the city is now spending $29 million to build tent camps for migrants. >> two people have now been fired after a murder suspect was released from an indiana jail by mistake. kevin mason has been on the run for more than a week. he's accused in a fatal shooting in minnesota. officials blame a clerical error for his release. two clerks have now lost their job. mason's girlfriend has also been arrested, accused of helping him after he left jail. officials in chester county, pennsylvania, now acknowledge there were concerns about the management of a local prison one year before for the escape of that convicted killer from last month. he was recaptured after a two week manhunt. new prison security measures have now been approved. >> we turn now to a disturbing allegation against rudy giuliani, the man once known as america's mayor is now accused of groping a former white house aide. here's abc's andrea fujii

this morning. >> former trump white house aide cassidy hutchinson claims rudy giuliani groped her on the day of the january 6th riot at the capitol. that's according to the guardian newspaper, which obtained a copy of hutchinson's upcoming book, enough in which she reportedly says giuliani placed his hand on her and she writes, i lower my eyes and watch his free hand reach for the hem of my blazer. i feel his frozen fingers trail up my thigh . according to the guardian, hutchinson then says giuliani told her, i'm loving this leather jacket on you and she writes, his hand slips under my blazer, then my skirt. hutchinson, an assistant to then trump chief of staff mark meadows, provided key evidence at the january 6th committee hearings last year. the now 27 year old claims the giuliani encounter was seen by others. but a giuliani political adviser calls the allegations a disgusting lie and says it's fair to ask why she is just now coming out with these

allegations from two and a half years ago as part of a marketing campaign for her upcoming book, it all comes amid giuliani's mounting legal woes, including the georgia election interference case. a georgia judge is also deciding how much giuliani will have to pay for defaming two election workers. he's also being sued by one of his own former lawyers. for more than $1 million in legal fees. giuliani's biographer says the former new york mayor is nearly broke. >> he lived very well and now he's penniless and facing prison. it's extraordinary story. former president trump's political action committee has previously paid for some of giuliani's legal bills as for cassidy hutchinson's book, it's due out next week. >> andrew rhiannon. >> andrea, thank you. meanwhile in washington, the clock is ticking down to a potential government shutdown. but there is word of a potential compromise to keep the government running. abc's justin finch is here now with those details. justin, good morning. >> andrew good morning. house speaker kevin mccarthy is now

scrambling to corral enough members of his own party to pass several spending bills. conservative republicans have been demanding deeper spending cuts and have stricter border policies as well. at a meeting last night, we're told, speaker mccarthy outlined a new short term plan to fund the government , which would include deeper cuts. but it's still unclear if mccarthy has enough votes to pass the short term plan. lawmakers have only nine days left to take action. one of mccarthy's biggest critics, matt gaetz, called mccarthy weak yesterday day, accusing the house speaker of, quote, lying like a dead dog. in the meantime, president biden is expected to announce a new aid package for ukraine today, just as ukraine's president zelensky visits the white house and capitol hill. zelensky is asking for more us support for the war, but he's facing growing opposition, even among some republicans who want more accountability for the billions of dollars already spent. rhiannon. >> all right, justin, thank you

for that. and the race for the white house. florida governor ron desantis appears to be losing steam in new hampshire. a new poll finds him in fifth place. the cnn poll shows him with 10% among republicans that is down from 23% back in july. former president trump remains on top. desantis criticized trump's stance on abortion during an interview with abc's linsey davis. >> can you trust that donald trump still has the views with regard to abortion that reflect the base of the gop party? >> he claimed to be pro-life. he spoke at the march for life and was waxing eloquently about how everybody counts. for him to then attack people like iowa, south carolina, florida, all these other states i thought was a big mistake. >> desantis is standing by florida's six week abortion ban. >> hunter biden has been ordered to show up in person for his arraignment on gun charges that will be on october 3rd. a judge denied a request from the

president's son to appear, virtually saying he should be treated like any other defendant . the decision came on the same day house republicans grilled attorney general merrick garland, accusing him of weaponizing the justice department. garland was visibly outraged when a congressman suggested that he approved the targeting of catholics. >> yes, the idea that someone with my family background would discriminate against any religion is so outrageous, so absurd. >> garland told lawmakers he is not the president's lawyer and he is not a prosecutor for congress. >> this new fallout this morning from the auto workers strike. general motors is laying off 2000 workers in kansas. chrysler's owner, stellantis, is also warning of more layoffs. the united auto workers union is threatening to expand its strike tomorrow unless there is substantial progress in contract talks. meanwhile talks aimed at resolving the hollywood writers strike are set to resume today. they spoke yesterday. they were described as encouraging the

good morning america. >> an update now as authorities in massachusetts say the death of a fan at sunday's patriots dolphins game does not appear to be linked to any trauma. a preliminary autopsy indicates dale mooney had a medical issue , but the report did not elaborate any further. investigators say mooney was involved in a fight in the stands during the game. witnesses say someone punched him, knocking him out. his cause of death, though, is still listed as undetermined. no charges have been filed. >> it's something millions of people use every single day. google maps. but this morning it is the subject of a lawsuit suit stemming from a deadly car crash . the family of a father of two killed after driving off this bridge is now suing google, claiming the company's app led

to his death. >> everything that we thought was our future kind of just changed and disappeared in an instant. >> philip paxton was driving home late at night from his daughter's birthday party outside charlotte, north carolina. his family says he was following a google map route that led him down this road to where a bridge had washed out nine years earlier. paxton's car flipping as it fell off the unguarded edge of the collapsed bridge, trapping him underwater where he drowned. still had no idea that for nine years there was a 20 foot canyon in the middle of the road in the middle of a residential neighborhood. this image allegedly captured after the incident shows the route. paxton's family says he took the red box, shows the road with the collapsed bridge. the blue line denotes a passable road. >> for years. google attempted to lead people over a collapsed bridge despite being notified by users of this exact danger. >> the lawsuit claims in the years before the accident, multiple people wrote to google

about the error, but nothing was done. i want who's ever responsible. >> i mean, to be held accountable. and, you know, i just we want to make sure that this doesn't happen to anyone else. >> in response, google saying we have the deepest sympathies for the paxton family, our goal is to provide accurate routing information and maps. and we are reviewing this lawsuit. the family is seeking compensation and punitive damages. no amount has been requested yet. the owners of the bridge and private road are also named in that suit . >> in medical news, too much junk food, frozen pizza, french fries and soda could be making you depressed, especially if those items contain artificial sweeteners. a new harvard study found eating large amounts of ultra processed foods may be linked to the onset of depression, increasing your risk by up to 50. the study involved only women and researchers say the processed foods can cause inflammation and that affects your gut. that has been linked to brain function. >> coming up, big money, a rare

request to chat, gpt, there were three pages that sounded like a lot of books that i'd written with names of characters that i'd used in the past. and i thought, oh my god, i feel so violated. it's like someone had just taken my entire library without my knowing it. the lawsuit claims openai reproduced copyrighted books without the author's consent to train chatgpt allowing it to produce derivative works, including material that's based on mimics , summarizes or paraphrases the author's work and harms the market for them. >> openai responded to the lawsuit saying, we respect the rights of writers and authors and believe they should benefit from ai technology. but michael connelly, bestselling author of the lincoln lawyer, now a hit netflix series, says he's ready for battle. >> you kind of feel like a little bit like a david vs a goliath in this. but but we're you know, we're going to fight the good fight. >> the authors are seeking a permanent injunction along with damages to cover license fees. >> coming up, a very haunted
