so you can enjoy them for breakfast, brunch, or even brinner. did i just make up brinner? can we trademark that? ♪ year old jeremy stoner abducted, sexually assaulted and strangled in 1987. and now we've learned police once made contact with the new suspect more than three decades ago. it's only on seven tonight. good evening. thank you for joining us. i'm dan ashley. this new update in the case is only after solano county investigators used dna to identify the new suspect and make an arrest. it comes as the district attorney is set to give new details about this case at a news conference tomorrow morning . abc7 news reporter j.r. stone is following the story with new leads tonight.

>> this is the image coming from jackson county, oregon. it shows 69 year old fred cain, the third who faces murder, kidnaping and charges in the vallejo disappearance and death of six year old jeremy stoner in 1987. prosecutors say cain is now being linked to the case by dna evidence. >> i hope he rots in hell. he's got he got what he deserves. >> chris delaney is cain's niece and is not shy about her feelings towards her uncle. she says she had an extremely rough childhood because of cain. someone who records show previously did time for rape by threat and burglary. >> if found out that he died and i was able to show up and see him. >> i'd i'd literally i would not mourn. i'd spit in the man's face if i could get face to face with him. absolutely >> stoner was abducted in this area near his family's vallejo home. his body was found on sherman island, near antioch. days later. for years, vallejo police had said this man, sean

melton, was to blame. two juries disagreed, though, and a judge eventually dismissed the case. >> this whole thing about sean having special knowledge, i ask that very question at the preliminary hearing to one of the detectives. what is this special knowledge you say? my client had and it really couldn't answer peter for represented melton, who is no longer alive. >> he admits that his client was odd, saying that melton thought he was helping police with theories on what could have happened to the boy, but was only hurting himself in doing so. >> i guess what i'm saying here is, is when sean walked in the door, their investigation completely shut down. they'd actually talked to cain once during this time and they were going to follow up on it. but they didn't because they were convinced they were the ones that were telling the press they were 100% convinced that he was

the killer. >> solano county's district attorney credits detectives within her cold case unit for linking cain to the case by a dna match, a move that some look at as exonerating milton's name . >> i hope you know that this can help the stoner family who, you know, have gone 36 years without any resolution to this. >> and my reaction was, oh, my gosh. and i felt horrible for this child, but thankful that he's going to get caught and hopefully put away for a long time. >> we did reach out to stoner's family members, but were unable to touch base with them. j.r. stone, abc seven news. >> a notorious bay area serial rapist and killer who eluded capture for decades has died in prison. john arthur getreu was convicted of the murders of three people. a high school sophomore in germany who was raped and strangled, and two female students at stanford, gutsu, served only six years for

the murder of a high school girl at a us army base in germany. he was released in 1969 and came to california. once here, he killed at least twice more in the 70s. two people at stanford, including the daughter of the athletic director and hall of fame football coach chuck taylor . for more than 40 years, he escaped justice until police using dna evidence linked him to the murders at stanford. i spoke today with a reporter who has covered the case extensively over the years. grace and all of your years of reporting this story, you have long been convinced that getreu was responsible for other killings as well. but we may never know. with his death. >> and that is incredibly vexing. but hopefully with the advances in dna and we have a dozen other cases that we believe that he's responsible for working hand in glove with the serial killer son who was a very moral guy. hopefully we will find an answer and we will close some of these cases. and we're very, very close. >> gertrude died friday at the

state prison in stockton at the age of 79. all right. let's turn your attention now to the weather kind of active out there. meteorologist sandy patel is keeping an eye on it for us. sandy >> yeah, dan, we've got a few showers passing through the north bay tonight. let me show you live. doppler seven and this is the first light showers of the season. so we get you into street level radar. santa rosa, south santa rosa, todd road, very light returns right now, seeing the same around tomales road in the north bay. so the showers have been pretty much in the north bay so far. it's an atmospheric river that is pushing into the pacific northwest. it has been hammering that area along with northern california. as we take a look at the hourly forecast here, some showers will pass through at 4 a.m. so sliding south and east and then sort of falling apart by 8:00 in the morning in terms of the winds, they have been picking up around 27 miles an hour. mount diablo, a live view from our sutro tower camera. and so far, occidental picking up 10th of an inch of rain. bodega bay, sebastopol for hundreds

venado 11 hundredths. cloverdale four hundredths of an inch. i'll let you know how long the wet weather will last and when will start to see some changes around here for fall coming up. dan okay, sandy, thanks a lot. >> we'll touch base again in a few minutes. our central mission here in building a better bay area means not shying away from tough conversations. and right now, san francisco is locked in one of its long time difficult debates. how to handle the issue of homelessness. it has stumped city leaders for years, but with san francisco's reputation falling more into jeopardy tonight, the city says it's forced to take a drastic step up. abc seven news reporter tim johns explains. home this encampments. >> a familiar sight across san francisco, could soon become a little less common in the coming weeks. on monday, mayor london breed announcing the city is stepping up its efforts to clear encampments. the move coming after local leaders said they received clarity from a federal court about an injunction which limited their clearing response. it's just the latest development

in a months long legal battle between the city and homeless advocates. >> this lawsuit and this injunction has put the city in an impossible situation. >> david chiu is the san francisco city attorney. he says the court gave the city the okay to clear encampments as long as they first offer shelter to those living on the streets. chiu believes it's a step in allowing the city to enforce its own laws. >> san francisco has really tried to balance providing compassionate services and shelter to unhoused individuals with maintaining a healthy and safe streets. but that balance was really upset, particularly as over half of the folks who have received offers of shelter would turn it down. >> others, though, have concerns. that includes jennifer friedenbach, the director of the coalition on homelessness, the group suing the city. >> and our whole intent of the lawsuit is to really get more folks off the streets. >> friedenbach claims even before the court's clarification, the city was never prohibited from clearing up encampments. however, she worries the increased sweeps

could lead to the city violating its own rules. friedenbach specifically pointed to policies prohibiting the destruction of homeless people's property, which she says can be counterproductive. >> criminalization in general does not lead to an exit out of homelessness. and it, in fact, usually lengthens homelessness. >> the legal battle is far from over, though, with more trial dates on the issue set for the months ahead. until that time comes, friedenbach says she wants real solutions. >> we're looking for a much more thoughtful response that has increased numbers of people getting off the streets in san francisco, tim johns, abc seven news. >> happening tomorrow in oakland, more than 200 small business owners are poised to shut down for part of the day to protest the rising crime problem. and it comes after the city missed its chance to get millions of dollars in grant money to help prevent retail theft in town. the mayor says they're working on it with 300 surveillance cameras to be installed by november. and more assistance from the california

abc7 news reporter lauren martinez explains an urgent race to find emergency funding. if we do not help departments like the broadmoor police department, there is no service for this area. >> san mateo county supervisor david canepa says a small police department within the county is at risk of shutting down due to staffing and financial issues. broadmoor and its police department are located in the center of daly city. on monday morning, canepa announced he's requesting $750,000 in measure k funds to help the department hire more officers. this money will not just benefit broadmoor, but the municipalities along the peninsula stretched thin as well. homer has two big malls. >> their agency isn't that much larger than we are, and they're inundated by crime. >> chief michael connolly said right now his department has five full time patrol officers and four reserve officers who are volunteers. >> because of our fiscal stuff, i've stepped into a part time

paid role as working full time, part time paid. >> connolly said officers work in 12 hour shifts and they're doing everything they can to reduce overtime. this is the first time in 75 years the department is requesting anything from the county. >> we are a special district, so we get our funding from taxes and from special assessments. we don't get a sales tax. somebody buys a car here. we don't get that revenue. >> the police chief said. this money will go towards helping current staff and hiring reserve officers. >> so we're all in this fight together. so when you talk about crime being specific to broadmoor, it may not seem like much, but it's all part of a larger pattern. >> my biggest concern in worry, you can see daly city, sarah sounds is that there will be a donut hole. let me say that again. there will be a donut hole of no police service whatsoever. the broadmoor police chief says the department covers 1.8mi■!s in the population is around 7200 residents in san

mateo county. >> lauren martinez, abc seven news. >> to uc berkeley now, where a college fraternity prank has turned into a felony theft investigation. that's according to the mercury news. the sigma chi fraternity on college avenue was raided by uc police earlier this month. they were looking for a sign that had been stolen from the unit one dorms. a cal student spotted the sign on the roof of the fraternity party. officers recovered it with the frats. greek symbol spray painted on it. well, with an estimated value of $25,000, the theft has been escalated now to a felony in washington. lawmakers now have five days to avert a government shutdown. pressure is really on for congress to pass a spending plan that will keep the federal government open past the end of the month. a shutdown, no doubt, would be disastrous, affecting every part of american life travel, public health, food and housing, along with parks and museums. so who's to blame for

everyone? according to one lawmaker, house republicans are to blame. >> senate democrats are to blame. and the president is to blame. and there's real people they're going to get hurt. everyone thinks that they can just point the finger at someone else. >> and what about fleet week in san francisco, which starts on october 2nd? well, the association tells us, quote, san francisco fleet week is standing by to take guidance from the navy and our other military partners. currently, our staff are continuing planning, as usual, for the greatest fleet week ever. we'll make adjustments as needed as we receive guidance, but we'll have to see if a government shutdown happens. it will certainly affect fleet week activities. well, after plenty of online sparring over their respective policies, california governor gavin newsom and florida governor ron desantis are finally agreeing to a debate. the blue versus red state leaders will face off on november 30th at 6 p.m. on fox news, hosted by the network's anchor, sean hannity. the two

coming through san diego. yeah it's just a little bit of rain here. >> dan, but it's beneficial and it's welcome because it reduces our fire danger, as you know. so let's look at live doppler seven. no it doesn't show a whole lot, but we do have some spotty showers showing up around the north bay. this is dylan beach, dylan beach road and tomales area street level radar. so we're going to pretty much watch this system as it pushes most of the energy into northern california as it has been in the pacific northwest daily rain records were set. crescent city, 2.30. eureka. 1.56in. both surpass icing by over a half an inch. there previous records for the day so it's had some oomph for an early system, early season system. this storm has an atmospheric river that has been pushing into the pacific northwest for us. we're pretty much going to deal with not just the waves, but some spotty showers at least through tomorrow morning. so, look at

these wave heights off our coast, 12 footers. look at this , closer to the low 20 foot waves. and there is a high surf advisory that starts at 5 a.m. tomorrow, runs until 11 p.m. point arena, right now, 13 footers, same thing for monterey bay. it's 12 to 16 foot breakers and higher for steep slopes, beaches. that's what's bringing dangerous swimming and surfing conditions. so if you're going to be at the coast, just watch those waves from far away and never turn your back to the ocean. as you know, it's pretty mild outside right now. most areas in the 60s. live view from emeryville. you can see that bouncy camera, spotty showers and drizzle through early morning sunny and milder weather midweek. and we're looking at a cooler pattern towards the end of the week. so while you're sleeping, a few showers will continue to march southward and eastward, but they don't all hold together. so they'll be very spotty in nature through the morning commute, at least through 5 a.m. to 8 a.m. and then it'll be done. rain fall estimates anywhere from nothing measurable all in the south bay to about 11 hundredths of an inch. as we take a look at your morning temperatures in the 50s
