rising crime is having on small businesses. >> good evening. thank you for joining us. i'm dan ashley. >> and i'm karina nova. one of their demands is they want governor gavin newsom to come to oakland to meet with them and hear about the problems. >> abc seven news reporter unser hassan was there as they rallied and talked with several owners who participated in today's strike. it is enough that we are having to put up with this. >> this is enough. can i hear enough? enough. this is enough. >> enough, enough, enough. >> organizers say when a legacy business like le cheval restaurant in oakland is forced to close due to crime, it's time to demand more. >> demand that our government city, state, federal fulfill their end of the social contract to provide basic safety in our streets. you're here. hey without basic safety, there is no business without basic safety, there is no community. without safety, there is no city . >> oakland business owners who

closed their stores showed up for a rally in front of le cheval. some of the demands include a meeting with governor gavin newsom and small businesses, state grants for struggling businesses and more police. >> if you look at richmond, there is nothing like that. it's only the oakland. and if there's something wrong in oakland, they need to fix it. >> derek johnson owns home of chicken and waffles. he closed for a few hours as part of the strike. >> but i hope and what i urge that comes out of today is that the city wraps their arms around le cheval and those of us that are struggling to stay open. >> in a statement to abc7 news, the city of oakland points to efforts already underway, such as expanding police foot patrols in commercial districts, chp helping with traffic enforcement $2.5 million to improve the 911 response system as well as numerous small business assistance programs. johnson says he supports city leadership, but he says policies need to be in place now. my rebuttal to that is then you go open up a business and you have payroll every two weeks and see how much time you have.

>> we don't have time. car break ins down here is not exaggeration. it's every single day it has to stop. >> organizers say more than 200 businesses took part in half day strikes, but some places like senor sisig tell abc7 news they knew about the strike but decided to remain open. we don't need no money. >> we need police security. >> professor of management kumar mishra at cal state east bay says it's very unusual for businesses to go on strike and adds that the city needs to recognize the impacts of increasing crime, especially coming out of a global pandemic. so recognize that this is a unique moment in time and changing strategies to adjust to the to that emergency situation . ali al-bashir was one of the organizers. he says this strike likely won't be the last. you think this will be effective? >> of course it will be effective. every voice affected, every everything it takes us. i mean, we are part of the community and they have to listen to us and if we don't speak, nobody listens. >> in oakland, hassan, abc7

news. san francisco supervisors and community leaders are calling for more police patrols . >> supervisor ahsha safai has asked the police chief to put foot and bike patrol officers in every district to address the san francisco's rising level of crime. the proposed ordinance would require sfpd to build community policing plans for the area that are experiencing areas, rather, that are experiencing the most crime. safai says this will lead to positive interactions between the community and officers. >> every study that has been done shows that crime reduces dramatically. community engagement increases dramatically, and we see a suppression of crime. >> safai will also challenge mayor london breed for her seat in november's 2024 election and a major challenger is entering the race to replace london breed as mayor of san francisco, philanthropist and heir to the levi strauss family fortune, daniel lurie announced his candidacy this morning. >> lurie says that san francisco

is facing a crisis of leadership, blaming breed and labeling her as an insider who's failed to tackle the city's biggest problems, specifically crime and homelessness. you can't solve san francisco's problems if you aren't willing or able to challenge the systems that have allowed these problems to fester for that's why we need new leadership from the outside. >> the 46 year old is the founder of tipping point community, a nonprofit working to fight poverty. >> he also led the effort to bring super bowl 50 to the bay area in 2015. >> today, the state's superintendent of public instruction officially announced his plans to run for california governor when gavin newsom's term ends in 2027. tony thurmond says his campaign will focus on his life story and overcoming adversity. prior to serving as the state superintendent, he served in the state assembly and before that on the richmond city council and the west contra costa county school board. lieutenant governor elaine

kounalakis is also running to take over newsom's job. >> the war of words between governor gavin newsom and florida governor ron desantis is set to take a new stage. the two will debate each other in just a few weeks. the 90 minute debate will be moderated by sean hannity on fox news. it will take place on november 30th in georgia. of course, we know desantis is running for president and this debate has fueled speculation that newsom is also prepping for a run. but he has repeatedly denied presidential aspirations. does cleaning up the streets of california factor into a potential presidential run? >> i'm never going to over promise that in the short run. >> i mean, we are struggling in this state. >> is that a yes or no? >> that was was a never ending response to your question before the governor's debate. >> seven gop candidates are prepping for tomorrow night's primary debate at the reagan library in southern california. >> right now, president biden is here in the bay area. he arrived in just the past couple of hours

at moffett field, abc seven news reporter dustin dorsey was there as he arrived and joins us live to explain what the president, dustin, will be doing during his visit here. yeah dan, and those activities really just started going as he just left here, moffett field, about 3 or 4 minutes ago. >> he is in the south bay on his way to the peninsula after landing air force one, that is this afternoon around 3:00. and he was greeted by santa clara county supervisor susan ellenberg, as well as a group of supporters, as select employees here at the nasa ames research center were chosen to meet mr. biden, including aerospace engineer alex mazari, seen here talking and even getting a selfie with the president himself. mazari said it is a once in a lifetime opportunity to meet the president. >> it was incredible. president biden is extremely kind and extremely patient. seem like a very genuine person and proud to

be our president. yeah what an opportunity for them. >> the president will be in san francisco tonight staying at the fairmont hotel. he's scheduled to meet the president's council of advisors on science and technology tomorrow morning. but first things first. he's on his way to atherton right now. that's where a fundraiser will be held this evening, starting at 630. for now, live at moffett field, dustin dawsey, abc seven news. dustin thank you. >> retail crime is also being cited as one of the main reasons target says it's closing nine of its 1900 stores nationwide. and three of those stores are right here in the bay area. abc7 news reporter liz pena spoke to shoppers and city officials about the impact these closures will have in our communities and she joins us live from the newsroom. liz >> that's right, karina target categorized their decision as a difficult one, saying they implemented multiple strategies to try to operate the stores safely. but target says none of those efforts succeeded in less

than a month. three bay area target retail stores are set to close. target located on century boulevard in pittsburgh, broadway and 27th in oakland. and the one located on folsom in san francisco. gone effect of october 21st. i think it is a disappointment, especially because i moved around the area to be close to shopping centers and things like target and get my groceries. target is blaming organized retail theft for their nnot continue operating these stores because theft and organized retail crime are reening the safety of our team and guests and contributing to unsustainable business performance. >> i see them when they are in the front and they take they are taking things out of their bags. yeah. yeah >> how often do you see that here? >> i have seen it at least three times and i don't come here that often. so i know it's bad. it's

bad around here. yeah. >> rows of tents surround the area where target on folsom is located. residents are not surprised by target's decision here, pointing to a decline in safety. >> so i'm not really sure why. like security doesn't do something about it. i mean, i always see them inside not doing anything. >> the closure of these stores go beyond retail convenience. lynette gibson, mcelhaney is a former oakland council member who says this is a devastate loss for the community. she worked for four years to convince target to open the store. they're now closing here. target was a big was a big fish for us. >> we now lost the cvs and target, which is where people were being directed in san francisco, supervisor matt dorsey believes closures will continue unless more police officers are hired. >> it breaks my heart. it's because we've seen this a lot in whether it's the mid market area or the whole foods that closed in my neighborhood or the westfield mall. >> he's proposing a charter

amendment to fully staff sfpd in five years. what can be done today? what can san francisco do today to prevent more stores from closing? >> i honestly wish i had better answers on near-term solutions, but time is ticking for residents like yolanda, who's seen her city change before her eyes as it takes a toll in the community. >> she to be honest with you, it's san francisco. yeah it's not what it used to be. >> now, oakland's mayor responded to the closures by saying she is disappointed by the news in her city, and her goal is to continue working in partnership with members of the business community to help ensure their safety and success in her city. target also said they made significant investments to keep stores safe , including hiring private security guards. there are still 32 target stores in the san francisco oakland market in the newsroom. louis pena, abc7 news . >> louis, thank you very much. coming up here, new details about the 1987 kidnaping and

♪ bmo ♪ has the latest on how investigators cracked this unsolved case using dna technology. >> over 37 years ago, six year old jeremy stoner was abducted outside his vallejo home about four days later. >> unfortunately, jeremy stoner's body was found at sherman island. obviously, every

parent's worst nightmare. >> this man, shawn melton, was later arrested and charged with the murder. but two jury trials ended with no verdict and a judge dismissed the case. an unsolved cold case until a year ago when two solano county investigators dug deeper, reexamining evidence from the boy's autopsy. and developing a dna profile. it did not match that of melton, the original suspect. >> we are exonerating him here today and the importance of dna in exonerating him and actually leading to the suspect that is responsible that we, our office believes is responsible for the brutal murder of jeremy stoner. it led to a suspect by the name of fred kane, who was arrested on september 18th, last monday in oregon. >> kane knew the six year old boy, according to the solano county da, and was even interviewed by investigators as a possible suspect back in 1987. >> they'd actually talked to

kane once during this time, and they were going to follow up on him, but they didn't. >> but kane, the new 69 year old suspect, is now in custody. >> we have charged him with murder, with special circumstances with respect to kidnaping, and a lewd act on a child. >> kane's niece reacted to her uncle's arrest. >> i hope he rots in hell. he's got he got what he deserves. >> now. martinez police are looking at the new dna evidence and the cold case murder of nine year old eric coy a month before stoner was abducted back in 1987. abc7 news tried to reach out to the stoner family as well. >> camping jeremy back. it's absolutely horrible what the family's gone through for the last 37 years, but hopefully this will bring a slight bit of comfort. >> suspect fred kane will be transported from oregon to solano county tomorrow and the da says they expect to have him

arraigned in court by the end of the week. in fairfield, i'm leslie brinkly, abc seven news. >> california has enacted the first statewide gun and ammunition tax in the country. governor newsom signed the bill into law today. it doubles the tax already placed on guns and ammunition by the feds. that's typically 10 or 11, depending on the type of gun. the law. newsom signed adds another 11% tax. on top of that. >> there is a pattern that's solved from leadership, and that pattern is being advanced here in terms of the strategies and solutions that we know statistically, the data bears fruit, save lives and reduce gun violence and gun deaths. >> the money collected from the tax will be used to pay for more security at public schools and for various violence prevention programs. >> us regulators and 17 states are teaming up to sue amazon, accusing the company of being a monopoly. the suit claims amazon inflates online prices and stifles competition by burying

listings offered at lower prices on other sites. this mirrors allegations made in a separate lawsuit last year by the state of california. amazon has not responded to a request for comment. the lawsuit filed this morning is one of the most significant legal challenges brought against the company in its nearly 30 year history. >> we're getting a better idea of what's in the tentative agreement that ended the writers guild strike. formal details are not being made public, but wga is telling its members this deal is exceptional and the board must approve the three year contract. and then it goes before membership for final approval. they got a huge bump in residuals in addition to a new bonus structure that will be tied to how many people watch their show in a certain amount of time. wga suspended its pickets, but did encourage members to support sag-aftra this week, even with the tentative agreement, writers have not returned to work just yet. they need the guild's

for dangerous surf and rip currents is in effect until 11:00 today. that's this evening. some beaches could see waves between 12 to 20ft. so it's pretty big. so today, more than ever, don't turn your back on the ocean is never a good idea. >> good advice. and we know that sandy patel is tracking that right now. >> indeed, the surf pretty strong today, sandy. >> yeah. dan and corina, take a look at this live picture from our santa cruz camera. it's pretty rough as it's just pounding the coastline right now . hopefully people keep those things in mind about never turning their back to the ocean . we do have that high surf advisory until 11 p.m. tonight. a 15 to 20 foot waves on steep

slopes and beaches, 12 to 16 otherwise. but those breakers, you can see they've been basically going up as we got closer to today, 12 footers at point arena, 16 footers around monterey bay, dangerous swimming and surfing conditions. this is the low pressure system that is sending us the big waves. it has been really bringing a good soaking to the pacific northwest where they've seen several inches of rain. we didn't get as much, but we didn't expect much. it's a sunny sky right now. take a look at the rainfall totals. half an inch at mount tam. that was the highest total. everyone else, anywhere between 6300 santa rosa to four hundredths in oakland. and as we take a look at those temperatures right now, they're in the comfort zone. we have low 80s for our warmest inland areas, 63 degrees right now in half moon bay. now, one of the things that you've noticed is the clean air. we have good air quality for just about everybody moderate around oakland. but look at much of the west coast. i mean, remember all those fires that have been burning across the pacific

northwest, northwestern california. they're reporting good air quality tsay. so the rain definitely helping out in terms of the air quality, obviously helping out in terms of the firefight as well. oakland airport camera showing you a sea of blue right now. good air quality is going to continue the next three days. so enjoy it. never take it for granted. as we all know, golden gate bridge camera, just a little wisp of fog there. rough and dangerous surf through late tonight. sunny and warmer the next few days and cooler weather is expected by the end of the week. maybe even a few sprinkles on saturday as we go hour by hour, the low clouds will fill in to parts of the bay area based around the bay and the coast. it's not going to be a solid marine layer. and then tomorrow afternoon, by noon time, you're already seeing clearing low clouds will be back later on in the evening. your morning temperatures in the 40s, 50s, certainly getting a little cooler out there as we're in the middle of fall and it's going to be fine. fall weather for you tomorrow. breezy coastside mid 60s there low to mid 80s inland

mild and sunny. as we look at the accuweather seven day forecast, we're going to keep that pattern going for your thursday as well. and then temperatures start to drop drop off as a trough develops. could see a little drizzle saturday or some sprinkles. certainly cooler than average for the weekend but don't worry, those temperatures will rebound early next week. one thing that we're keeping an eye on is the potential for offshore winds. so karina and dan, that is something that we always watch out for around this time of year, not out of fire danger completely by any means. >> okay. thanks, andy. >> well, not $1 out of the millions that levi stadium earned last year will be going to the city of santa clara. the stadium made almost $9 million in profits for non nfl events last year, according to our media partners at the mercury news, about half of the money earned by levi stadium is meant to fund local services like libraries and parks. but there's an ongoing legal dispute between the city of santa clara and the 40 niners over who should pay for public safety costs. the team manages the city owned
