♪ transfer marks a new era in california politics, and with it made history. more history made. tonight good evening. i'm j.r. stone. thanks for joining us. governor newsom was facing pressure for months to pick a possible replacement ever since the late senator ran into failing health. the san francisco and california icon died thursday at the age of 90.

her life work sending shockwaves through the political world. let's bring in abc news reporter tara campbell with more on what we know about this next appointee and new plans to honor senator feinstein later this week. tara? yeah j.r. governor gavin newsom is appointing democratic party strategist laphonza butler to serve out the remainder of senator feinstein's term until the until the 2024 election. >> butler is the current leader of the political action committee. emily's list. the group supports democratic women candidates who favor abortion rights. notably, she has served as an adviser to the kamala harris 2020 presidential campaign. butler will be the only black woman to serve in the senate and the first openly lgbtq person to represent california in that chamber. newsom says butler will step down from her. emily emily's list role to assume the duties of senator and the governor. also says butler will move from

maryland back to california and rewrite register to vote here. meanwhile the officer office of senator feinstein is releasing plans for her funeral arrangements this week. feinstein will lie in state for public viewing at san francisco city hall on wednesday from 9 a.m. to 7 p.m. a private funeral service is scheduled for thursday at the war memorial theater. that will be broadcast to the public at city hall. feinstein took her final journey back home to san francisco yesterday. her body, accompanied by her daughter, kathleen, and former house speaker nancy pelosi. people were out paying their respects along the way. >> she got everything together. it was a beautiful city. it's still a beautiful city. but she was very well known and she took care of san francisco. >> she led during a dark time in the city and brought a beacon of light and hope to us. and she will be sorely missed. >> all throughout the city, senator feinstein loved this

city and she fought for this city. and you can pay your condolences at city hall through wednesday. there will be a book there to sign in commemoration of the senator. big day, j.r. wednesday certainly is. >> thank you so much, tara. many were calling for governor newsom to tap longtime bay area representative barbara lee to fill the seat she just tweeted this, saying in part, quote, i wish laphonza be well and look forward to working closely with her to deliver for the golden state. then, pointing to her push to win the full term of office in the 2020 4th november election. and this statement from the current california senator welcoming butler as his new colleague, alex padilla, saying in part, quote, throughout her career, laphonza butler has been a strong voice for working families, lgbtq plus rights and a champion for increasing women's representation in politics. i'm honored to welcome her to the united states senate and to make

keeps the government running for another 45 days until november 17th. and we're hearing more on the matter from president biden urged congress to work towards a budget and pressuring for more funding towards ukraine. abc news reporter andrew dymburt has details. as speaker kevin mccarthy putting forth a stopgap funding measure on saturday that keeps the government funded through november 17th, president biden signing the bill late saturday, which includes $16 billion in disaster relief but does not include any new aid to ukraine. >> despite that, i did not believe we could let millions of americans go through the pain of a government shutdown. >> on cbs's face the nation, mccarthy said his priority is border security. >> he i support being able to make sure ukraine has the weapons that they need, but i firmly support the border first. so we've got to find a way that we can do this together. >> while republican senator lindsey graham also appearing on cbs, said the senate will soon have a bill that includes ukraine aid and funding for

border security to the republicans who say ukraine doesn't matter to us, you're wrong. >> respectfully, you're wrong. the war gets bigger, not smaller. >> unable to unite his own party, mccarthy relied on democrats for the votes needed to pass this temporary bill, a move that could cost him his speakership. florida republican representative matt gaetz says he's determined to vote him out. i am relentless and i will continue to pursue this objective, though some feel that's just wasting time by putting this motion to vacate on the floor. >> you know what? matt gaetz is going to do? he's going to delay the ability to complete that work over the next 45 days. >> congress now has until november 17th to pass bills that will fund the government for the next fiscal year. president biden urging lawmakers to get the job done, saying americans are tired of the brinksmanship. andrew dymburt, abc news, new york. >> the annual blue angels air show, a mainstay of fleet week, is now safe after the approval of that short term federal funding bill. and today we captured one of the big ships

coming into the bay to get ready for the tours and events. you see it there under the bridge. and what a sight as we caught that, we caught that is at oakland airport tonight, the first of the blue angels arriving with that unmistakable sound. and what a roar that was. the rest of the blue angels will be arriving this week with air shows coming on friday, saturday and sunday. tonight, abc seven news reporter cornell bernard spoke with the navy to get some sneak peek insights on the events as. get ready f heart pounding rumble of jet engines over san francisco. >> the us navy says the blue angels are clear for takeoff. >> fleet week is happening. the blue angels will fly. >> that's the word from navy spokesman brian o'rourke, 24 hours ago, he wasn't sure if a looming government shutdown

would cancel most of the famous air show. >> but i would say that the excitement, the suspense and the drama has come down and the excitement has gone up and the sailors and marines are very happy that they're coming up here for fleet week was a little suspenseful over the past several days, but everyone's been looking forward to this trip for months. >> navy and marine ships are now en route from san diego, setting a course for the bay. >> it's our most busiest week of the year. fleet week troy reese says fleet week is just what his louisiana style cafe on the embarcadero needs now. >> business has not returned to pre pandemic levels, but he hopes next week will be a game changer. >> we overstocking the restaurant looking for it for the large crowds keeping later hours fisherman's wharf looking for a boost in business after a dip in tourism due to the pandemic week is a huge event for the war for the city, for the bay area. >> you know it is a it's a standard event that everybody

lot. so not really a marine layer. temperatures will be in the low 50s at that point. by midday, we'll see mild conditions with temperatures in the low 60s at the coast, upper 60s around the bay low, 70 inland, 4:00 in the afternoon, sunny and mild to warm conditions mid 60s will be the temperatures at the coast mid 70s around the bay shoreline. low 80s inland and then 7 p.m. about nine minutes after sunset, we'll still have clear skies, about 70 degrees inland mid 60s around the bay, mid 50s on the coast. and there is more wonderful weather coming our way later in the week. i'll have the accuweather seven day forecast in a few minutes. j.r >> spencer thank you so much. developing news now on a possible worker strike at kaiser permanente. a strike could begin on wednesday. it would be the largest health care strike in us history. today kaiser said contract talks are continuing through this weekend. the company says it is making progress on key issues and recently reached tentative agreements on four key areas. more than 75,000 health care

eating disorder battle and tsay madison talks her tumultuous climb to the top. that's coming up this week at 1 p.m. right here on abc seven. >> a man missing in the waters off the marin marin county coast is believed to have been attacked by a shark. the first 911 message came from satellite communications at 1030 this morning. callers were at wildcat beach, north of bolinas, in a remote part of the point reyes national seashore. for there, a witness said a man was in the water with a group when a shark attacked him. other members of the group managed to get out of the water. one ran to a camper who just happened to have a satellite phone which helped him bring this air medical chopper to the scene. >> there was it was a group that went up there for to celebrate someone's wedding. and that it was someone with the group that went out into the water and got attacked. this is not a typical attack that we've heard of. >> so it does create some

complicate options when you can't find someone in the water . >> usually shark attack victims make it back to shore so they can be helped. tonight, the us coast guard tells us the search for the victim is ongoing. tonight 28 million people paying off their student loans are again being required to do so after a three year pandemic pause. repayments are restarting tonight out along with all that interest, some borrowers in the bay area are bracing for a big financial hit. i-team reporter stephanie sierra explains the projects and impacts across the state. >> millions of californians are bracing for a dreaded deadline. student loan repayments now back on the schedule starting today. for emily machado, it means a lot of adrenaline and just kind of frantic scrolling, like trying to understand the us supreme court ruled against the biden administration plan to forgive loans to over 40 million americans, including up to

$20,000 of debt for those who received a pell grant offered to low income families. >> so because i come from a low income background, growing up, i was a pell grant recipient, so i was eligible potentially to receive up to $20,000 in cancellation as opposed to the standard $10,000 cash isolation due to income thresholds that were set, which don't take into account where you're living. >> machado got nothing, and like many in her position, she's still left struggling with inflation and the overall high cost of living in the bay area. >> it's certainly overwhelmed coming out of college to a large pile of money that that needs to be taken care of. i'm just trying to get a better grasp on kind of what what i need to do. >> according to the us department of education, borrowers should log in to their federal student aid website to update any information and find out who your loan servicer is to explore repayment options. these include autopay or income driven payment plans. economist bryce gill says the impact is really

dependent on income. >> so, you know, for example, you look at the average payment that people are going to have to make, it's about $300 for people with undergraduate degree, it goes up to about $500 on average a month. for someone with a graduate degree. but the biden administration has passed what's called the save plan. >> the save plan is an income driven repayment plan. the white house says borrowers who make more than $15 per hour and enroll are expected to save about $1,000 more per year, compared to other payment plans, according to the most recent report compiled by the public policy institute of california. as of 2020, us borrowers hold about $1.6 trillion in federal student loan debt, and millions of californians are responsible for more than $142 billion of it. but the program is rolling out some help. gill explains. it's the on ramp transition period which protects your credit if you have missed or late payments. just remember it's temporary, so you're not going to be able to, let's say,

five years from now, keep missing payments. >> right? and have your credit score not be impacted. so this is sort of a short term bridge, short term help for a long term check definitely will need to be a little bit more mindful of spending. >> stephanie sierra, abc seven news. >> joined right now by spencer christian, big week when it comes to being outside for the blue angels. what is it going to look like? we have fleet week warmth coming our way and it's going to start tomorrow. >> let me give you a look at what's happening right now, though. remember the showers we had yesterday? they have moved well to our east, out over the great basin right now, as you can see on the satellite radar composite image, high pressure is building in. and that's going to bring us a week of sunny skies and a week of warm weather and the wind right now is rather calm under clear skies, temperatures are dropping. you can see several most locations are several degrees cooler right now than at this time last night because with the clear skies, the daytime heating is able to escape. so here's a view from sutro tower looking out over san

francisco, where it's 54 right now, 57 degrees in oakland. mountain view, 59, 62 in san jose and mid to upper 50s or low to mid 50s, actually at palo alto and half moon bay. nice clear view from emeryville looking across the bay 52 degrees right now. both santa rosa and novato. we have upper 50s at napa fairfield and livermore concord 62 degrees. one final live view, beautiful one from our exploratorium camera. looking across the calm bay waters toward the bay bridge. these are the forecast headlines. mostly clear skies overnight. sunny much warmer days through the week ahead and record near record heat is possible. wednesday through friday. overnight, we won't see much in the way of clouds at all except a little patch of some low clouds near the peninsula coastline by about 7:08 a.m. overnight, low temperatures will be mainly in the low to mid 50s. i mentioned temperatures will be dropping under the clear skies and then tomorrow, a mild day with high temperatures ranging from low to mid 60 at the coast to mid 70s around the bay shoreline to low 80s inland. and looking ahead to next weekend,

this is abc7 news today. >> it is a somber marking of the horrific case of 12 year old polly klaas. 30 years ago, on october first, 1993, she was kidnaped from her home at knife point in petaluma. she was having a sleepover with her

friends at the time. today, her murder has had a profound effect for missing children and crime prevention, shaping groundbreaking measures in california and across the country. tonight, abc7 news reporter tara campbell takes a look back at how polly's case transformed the criminal justice system. today >> bring her back. don't hurt her. just bring her back. let her go. >> a father's plea three decades ago. october first, 1993. the day 12 year old polly klaas was kidnaped from her home in petaluma. polly's parents begging for her return. if you're the man who who has polly, please just let somebody know the community rallying and searching, determined as the days passed. >> it's the sixth day and i'm i'm exhausted. we will never stop. we will never stop. we will never close until we have accomplished our mission. and we

get my little girl back. polly was found dead two months later by mark klaas, recalling the moment he knew his daughter was gone. >> talking with 2020 juju chang this week, they didn't have to tell us anything. >> christ. we walked in and there were tears in their eyes decades later, describing the haunting memory. i'll never forget this. i remember that that eve started crying and the cops were crying. >> and i didn't cry. but we said, we need to tell our families. so i made a phone call and i said, you know, it's over. they she's dead. >> polly's killer identified as richard allen davis. after leading investigators to where he left her body. davis was sentenced to death, but the death penalty is on hold in california. >> this guy tossed her off for two months under a piece of plywood. >> mark klaas moved into action starting the polly klaas foundation and helping to transform the criminal justice system. the polly klaas murder case was a huge shift in the

criminal justice system across the united states. steven clark is a legal analyst and says the three strikes law is among the most notable of changes. >> richard allen davis was a career criminal and he was out of jail and what the three strikes law did as a result of the polly klaas case is said, we're going to be putting people away for ever who commit a series of violent felonies. the case also credited with helping to lead to the establish of the amber alert. a lot of change in law enforcement and how they conduct and these types of investigations, including amber alerts and so that people quickly could respond to a kidnaped child. >> the murder of polly klaas forever changing a family and a country. tara campbell, abc seven news. heartbreaking >> happening tomorrow, the care act will begin in california. it's a program meant to get more people with mental health disorders into treatment, even if the person doesn't want assistance. san francisco will

be one of the first seven counties in california to implement the new program. it was signed into law by governor newsom last year. the idea is to have courts step in for those with untreated mental illness to try and get them stable housing and other services potentially thousands on the city's streets qualify care court allows for a wide range of petitioners, including first responders, family members, somebody who lives with an individual who's worried about them. >> it's voluntary in that the court cannot force you to take medications or put you into a locked facility, but you're still having to come to court. the court's still going to order a treatment plan for you. >> it has been a controversy special program because judges have the last say in ordering a treatment plan. the san francisco public defender's office is preparing to represent many people in court. if you or someone you know is struggling with drug addiction or other issues, you can find a list of

local resources on our website. abc7 news.com slash take action. happening tomorrow, former president trump is expected to be in new york state court for opening statements in his civil fraud trial. that's according to abc news. trump is not expected to speak during the morning proceedings. he is expected to appear when the state calls him as a witness in the case. the new york state attorney general accuses trump and his family business of inflating his net worth by more than $2 billion. that led insurers and lenders to give trump better terms. opening statements are scheduled for 7 a.m. our time. a man is under arrest in san francisco tonight for what police believe are random assaults, three of them stabbings. sfpd says they responded to a report of an assault near market and battery streets just before 8 a.m. police did not give details about that attack, but around

raising funds for cancer survivors is our abc seven news team was there and caught up with two longtime friends who do this walk together every year. >> i am a two time breast cancer survivor, author and blessed to still be here today. i have been through chemotherapy radio station and surgery. i am so blessed today to be able to be here to say hello and support what the fight funds go towards service access, direct support and treatment breakthroughs was a downed tree. >> did some major damage in san francisco overnight last night, causing damage to a p-g-and-e's transformer. power lines and at least one car. a viewer sent in these videos to us on mason

street between bay and francisco in the north beach neighborhood. you see that tree on the car there? the viewer says multiple complaints to the city led to them installing a metal pole to support the tree. this morning, just after 3 a.m, they heard a loud pop and came out to see a broken transformer, former and downed tree. they say p-g-and-e's sent out a hazmat team to fix the lines. public works later removed that tree. and yes, snow fell over the weekend in the sierra. uc berkeley central sierra snow lab posted this video of the flakes falling early saturday morning. that's at an elevation of nearly 7000ft. no snow accumulated on the ground, though, so it doesn't count as the first snowfall. but it was certainly exciting for the research center to get us ready for the fall and winter. speaking of snow, i'm joined by spencer christian. you were just talking about how hot it was outside. exactly. i feel like i'm all over the place here. we're all over. well

that's how the weather is these days. >> it's all over the place. you know, october often brings us some of our warmest weather. and we're going to get a taste of that this week. coming up. so here's a look at our forecast heading signs as we look across the bay from our exploratorium camera. mostly clear skies overnight, sunny and much warmer days ahead through the upcoming week, we can expect near record heat possibly on wednesday and thursday. here's a look at our overnight conditions. clear skies, low temperatures mainly in the low to mid 50s, comfortably cool overnight and pleasantly mild tomorrow. under sunny skies. highs will range from mid 60s at the coast to mid 70s around the bay shoreline to low 80s inland. but as we look at the accuweather 70 forecast, you see the kind of warmth i was talking about beginning on wednesday. look at thursday, friday and saturday, inland highs. those three days low to mid 90s around the bay shoreline mid to upper 80s. i wouldn't be surprised if 1 or 2 locations near the bay hit 90 on thursday or friday and on the coast it on thursday near 80 degrees will be the highs so quite a warm spell
