talking to some of the police officers working the scene here today, they're finding it difficult. many of them have children of their own. it's just unthinkable. as you said, two children drowning in a backyard swimming pool at a daycare where you take your children somewhere and expect that to entrust them in someone else's supervision and someone else's care. let's start off with this from the emergency dispatch that went out this morning. >> two year old boy unconscious . his breathing is uncertain. he was found drowning, attempting cpr instructions. >> now the emergency call came in around 9 a.m. fire and police personnel rushed to this home in the san jose suburb. happy, happy daycare operates out of a home on fleetwood drive at clover hill drive. three children were rushed to the hospital where two died. one survived and is said to be in a condition that is not life threatening. the pool is seen

from sky seven, has a fence and a gate and a pool cover. the san jose police department homicide unit and the santa clara county da's office are conducting a joint investig gation into the circumstances around the drownings. neighbors said the daycare operates from 8 a.m. to 5 p.m. and charges 2000 a month per child. >> this is a daycare with five children present. all five are accounted for. >> it just breaks my heart and i feel bad for the families because we do. >> when i take her to school, we watch. we watch the families bring their kids and so we see their faces. it's so heartbreaking. just another neighbor as well who has a four year old child. >> they live here in this block we're in. and they said that just last week they put a phone call into this daycare for their friends. three and a half year old son. but they were told that there wasn't room for him. right

area coming over us, as well as jet skis from, um, stinson beach fire department. >> according to witnesses, the missing swimmer was with a group that was celebrating a wedding at the wild cat campsite around 10:40 a.m. sunday. the us coast guard received an emergency report. samantha edell used her satellite phone to help the group call for help. >> they said it was a shark attack and said that i said, how how bad is it? he said that his friend was attacked and that didn't come out back out of the water and that, um, and so i hit the sos on my, my satellite communicator took the communicator down to the beach, which was right below us because we were on the edge of the bluff . um, so that they'd be able to locate this. the community later to get to the area where the swimmer was last seen. >> workers here confirmed he had to hike 6 to 7 miles to make it to that spot. an area that is

uncommon to swim at the national park service is categorizing this incident as an unconfirmed shark attack, but stated a strong population of white sharks in the area. >> we're hoping for the best possible outcome. >> according to the california department of fish and wildlife, there have been 210 shark attacks or incidents off the california coast since 1950. in point reyes, beakman says there haven't been any fatalities in the last 20 years. >> sometimes we get in our head and we're like, oh, the water looks nice. why not just jump in? cool off? things can change , so you never know what's out there. >> this morning, the us coast guard ended their search by members of the national park service are set to continue until at least tomorrow in marin county. lou pena, abc seven news. >> in shark experts also caution beachgoers that it is shark tober at that time when adult white sharks returned to the west coast after their summer migration. >> yeah, and it comes as the weather is about to warm up in the bay area. spencer christian

joins us now with a first look at the forecast spencer. >> okay, chris and karina, it's going to warm up rather significantly by midweek and that includes our beaches and our coastal areas as well. let's take a look at what's going to bring this warm up. as you look at the satellite radar composite image, you see huge ridge of high pressure that will be nosy in to dominate our weather picture for the week ahead. that means sunny skies and very warm conditions. in fact, right now in the 24 hour temperature change, you can see most bay area locations, several degrees warmer than they were this time yesterday. so the warm up has already begun. as we look ahead midweek at our maximum temperature range, you can see highs will be in the low 90s in our inland areas by wednesday and 70s on the coast on thursday, which is expected to be perhaps the warmest day in the forecast future. in the forecast, seven day forecast up to 80 degrees in coastal areas mid to upper 90s inland pretty much the same range on friday. and if of course, this is fleet week. so if you're thinking about watching the blue angels at the end of the week, the air

show should be just fine because we expect sunny skies, even here in san francisco and absence of a marine layer and warm conditions here in the city as well. i'll have the full accuweather seven day forecast a little bit later. >> karina i'll take that. thank you spencer sorry. the care act begins today in california. it's a program meant to get more people with severe mental health disorders into treatment, even if the person doesn't want the assistance. san francisco will be one of the first seven counties in california to implement the new program. it's the only bay area county taking part at this time. the idea is to have the courts step in for people with untreated mental illness to try to get them stable housing and other services. thousands of people on the streets may qualify, but people don't have to be unhoused to qualify. it's been a controversial program because judges have the last say in ordering a treatment plan. >> san francisco's fentanyl epidemic continues to devastate the city. >> yeah, we want to focus on why law enforcement says it's so difficult to convict drug

dealers and who's ultimately responsible for allowing them to go back on the streets. >> abc seven news reporter leanne melendez joins us now. and leanne, you looked into this. what did you find? >> well, i found that usually people like to point the finger or blame just one person for a drug crisis here. >> but as we all know, when it comes to drug dealers and enforcing the law in san francisco, to quote a colleague of mine, we're all in this together. meaning it's not just city hall. it's also san francisco legal system. it's sacramento. and lawmakers who are not willing to properly address the fentanyl crisis and finally, back to san francisco. it's the jury pool. it takes more than just police and its supporting cast to make a dent in san francisco's drug trade. the role played by judges inside the superior court is now coming under scrutiny by city hall and the district attorney. >> even though we've been advocating for repeat offenders to stay in, they're still being released by lint and repeat offenders. da brooke jenkins

took office nearly 15 months ago and only last week was her office for the first time. >> able to convict a drug dealer who claimed that he was a victim of human trafficking and forced to sell drugs for fear of his safety as well as others. >> and the jury was not persuaded by his story and did find him guilty. >> 20 year old eduardo rosales silva had been arrested in may 2022 for possession to sell cocaine, fentanyl and meth, but was released by a judge. less an a month later. he was arrested a second time for selling drugs and again was released by the court. he was arrested two more times. and finally kept in jail after the fourth arrest. he will be sentenced on october 6th. according to jenkins, so far this year, there were 511 individuals with open bench warrants who failed to appear in court after they were released by the judge. we wanted to get some context and asked if this

kind of leniency is followed in other bay area counties. i mean, if somebody has no record whatsoever and they've got a stable address in the like most of the time, they may not be kept in custody. >> but if there's a second time, not three or for a second time, they're going to occupy the san mateo county jail. but before san francisco's da was able to convict rosales, silva, three similar drug dealing cases resulted in a hung jury. >> it may not come as a surprise is that san francisco jurors tend to be more liberal and sympathetic. in a recent newspaper editorial, someone who served on a jury explained why they decided to vote to acquit a drug dealer from honduras. quote i believe the idce showed that the accused, who i'll call esteban to protect his identity , was coerd to selling drugs against his will. i hope that he will now have the opportunity to reild his life and separate himself from the coercion and violence that have gotten him

here. a few months ago, i went to the tenderloin to ask those who weren't using drugs in spanish if it was true that some drug dealers were being coerced and threatened. they chose not to answer. last may, a survey of 500 potential san francisco voters conducted by emc research found that 70% of them said sanctuary city policies should not be extended to those undocumented people selling drugs. supervisor hillary ronen i think that this is a distraction. >> i don't think that low level drug dealers from fentanyl, from from honduras are the real cause of this drug crisis. >> instead, ronen blamed the makers of oxycontin for the current opioid crisis in san francisco. but shouldn't we do something about it now, though? shouldn't we do something about it now? >> 100? and that combined with poverty, is what led to the crisis in the streets today. not immigrants. >> still, even the former speaker of the house had to concede that one way out of this

crisis was to bring in the drug enforcement administration. the dea. nancy pelosi writing to attorney general merrick garland. people are dying from fentanyl and violence. and we hope to hear soon about a designation of operation overdrive for san francisco to combat the cartels. we've got critics who are hand-wringers and navel gazers and defenders of the status quo without even having the courage to admit that they're defending the status quo. >> we need to try new approaches, so we turn to sacramento to see if the state is taking harsher action and found that lawmakers there are still taking a lukewarm approach to the fentanyl crisis. >> for example, three bills introduced in the california legislature did not advance this ab 367 to add sentencing enhancement for those who serious injure or kill through fentanyl poisoning. rejected ab 955 to increase penalties for dealers who sell fentanyl over social media. reject it ab 1058

to increase penalties for those possessing a large amount of fentanyl. also rejected prosecutors worry what will happen if courts aren't given the tools to convict drug dealers. in the 1980s and 90s. as the crack cocaine epidemic led to harsh sentences mainly against african-americans. but in 2014, calif voters passed proposition 47, making simple drug possession for first time users a misdemeanor rather than a felony. that eliminated jail sentences and made offenders eligible for drug diversion programs. >> they have adopted an approach that know to do that will shove us back into the 1990s. that is their attitude. that attitude to me is a sorely mistaken attitude that is costing human lives. >> and there is a difference here, right? according to the cdc, more than 150 people die every day from overdoses related

to fentanyl in the united states with crack cocaine in the 80s and 90s. the causes of death among those who either used or sold it, sold it were homicides. and remember, aids. leanne different. >> yes. and you kind of mentioned this in your story. you know what wasn't done in sacramento, but is there anything coming down the pipeline in sacramento that could help in dealing with the fentanyl crisis? >> well, there were some things that were proposed and passed. for example, i just have a moment right here, a few example, expanding treatment for addicts, also having schools have a plan and emergency plan in case of overdose and also more access to also narcan, for example. and all of those are wonderful, great, you know, but when it comes to dealing with the drug dealers from sacramento, those crickets. >> yeah, crickets. >> yeah. >> leanne, i opening. >> yeah. great reporting. thank you. sure. >> looming strike could impact

a.m. to 7 p.m. a book of condolences is available to sign at city hall through wednesday. a private funeral is scheduled for thursday at the war memorial opera house. the public can gather at city hall where a simulcast of the service will be shown. a private family only burial will follow the service. >> more than 75,000 kaiser permanente workers are making plans to strike wednesday morning in what could be the largest health care strike in us history. a coalition of unions representing nurses, nursing assistants, pharmacists and lab technicians is plan to hold a three day walkout at if a new contract deal is not reached. the focus of their demands center around increase staffing levels along with better pay and benefits specific to different markets. kaiser permanente issued a statement saying, quote, this past week, we reached tentative agreements in four key areas. travel for continuing education. the use of temporary workers such as traveling nurses. tracking of staffing vacancies and dispute resolution. kaiser says

hospitals and emergency departments will remain open if there is a walkout. >> all right. are you ready for the heat? >> it is coming, right? so i better be. yeah. >> and that's what we're talking about with spencer christian right now. let's get the details. >> okay, christian, we are talking about heat coming our way. and lots of people, of course, are asking about fleet week weather here in san francisco for all the various activities, including the blue angels air show at the end of the week. so i'll start with the fleet week forecast for san francisco. and you can see we're going to have sunny skies all the way through the week. it doesn't look like we have to worry about any interference of fog in viewing conditions for the blue angels at the end of the week. and we say thursday is going to be the hottest day of the week because we're expecting a high here in san francisco of 84. and any time temperatures are in the mid 80s in san francisco, that's considered hot. now we're looking at the looping live doppler seven image, just a little bit of coastal fog forming up along the north bay coastline, but mainly free of fog at the moment. in other parts, other areas of the coast. and it's pretty breezy

near the coast as well with surface wind speeds right now between 20 and about 26mph. okay. here's the view from sutro tower looking out over san francisco under blue sky right now. it's 62 degrees here in the city. oakland, 68. we've got 70 at mountain view, 81 at san jose, which is one of our warmer spots at the moment, 72 at palo alto, 59 at half moon bay. now at the golden gate, we see some clear skies out from the distance, but you can see more and more clouds beginning to descend upon the golden gate. other temperature readings right now, 75 at santa rosa novato 79, also 75 at napa. we have low to mid 80s at concord and fairfield and 78 at livermore and a lovely view from mount tam looking down onto the bay. the broader picture here. these are our forecast headlines mostly clear overnight with some patchy coastal fog. not very widespread. we can expect an area wide warm up wednesday through friday. so all parts of the barrier will feel it and it'll be warm and we can expect warm and sunny days into for the weekend. overnight forecast animation shows just a few passing high clouds, but in the

it's a go. this is the second time this motion was denied. lee was the chief product officer of mobile coin when he was stabbed to death on april fourth in san francisco's rincon hill neighborhood. moumneh, a friend of lee's, has pleaded not guilty to murder. >> donald trump slammed prosecutors during the first day of his civil trial in new york. the former president called the trial a disgrace and says they're trying to damage him and his run in the 2024 presidential election. trump is accused of fraud over several of his assets, including his namesake wall street building. trump tower. the city's attorney general, letitia james, says trump and his two oldest sons inflate their assets to cheat the system. court officials say the gop leader valued trump tower at $500 million when its actual worth was 200 million.

last week, the judge overseeing the case determined that fraud was committed and trump faces being banned from doing business in the state. >> the 49 ers are mourning the loss of former super bowl champion russ francis. he was one of two people who died in a plane crash yesterday. francis and his friend who was vice president of the aircraft owners and pilots association, crashed shortly after takeoff from an airport in lake placid, new york. it's not clear who was flying francis had a passion for aviation and recently bought lake placid airways during his retirement. he was a tight end for the 49 ers back in the mid 80s and helped the team defeat the miami dolphins in the 1985 super bowl. russ francis was 70 years old. >> the impact of the 49 ers reach beyond just the team. >>n abc7 news at four. we're getting a look at a new report about the economic impact uh. levi's stadium is having on the local community. we'll be joined by 40 niners. president el guaido to discuss it.

i'd be remiss if i didn't give our thoughts and prayers to russ francis and his family. it was tough to go to bed last night after obviously a big win and to know that we lost one of our own in such a tragic fashion. so first and foremost, thoughts and prayers for his family as it relates to the story that we're that you were talking about. it's amazing to sit here today, almost ten years or ten years since the day that we opened levi's stadium. and to think that we generated $2 billion of economic impact for this region , over 12,000 people, or nearly 12,000 people that it impacted directly in jobs related to working on the stadium. and that would not happen without our community partners here in santa clara and san jose, san francisco and oakland. as it relates to super bowl 50 and the other events we've put on, we've hosted probably the most events of any other open air stadium since we've really been here at levi's a global pandemic. and so, look, the first ten years have been phenomenal on and off the field. i know we're excited about the current team on the field right now and on the

business side, we're also really getting ready to ramp up for super bowl 60 and the fifa world cup in 2026. >> yeah, so many exciting things happening. we're going to talk about the team in just a minute. but but i want to ask you about this because just recently our media partners at the mercury news reported that none of the money of the millions, levi stadium earned from last year will go to the city of santa clara. the team citing security, going over the yearly limit and the city needing to pay the difference. can you tell us more about that? >> yeah, i would say it's hard to get into these nuanced. certainly we've had i mean, it's no secret we've had some disagreements with the city of santa clara, but i would say they're few and far between as it relates to our ongoing work with the city staff, our ten years here. what i would point everybody to is we would not be a successful stadium operations if people weren't coming back to the stadium, whether it's the artist. taylor swift has now been back here twice. you know, ed sheeran going from oracle stadium to levi's stadium, the

super bowl now returning. and so if we weren't doing our job on behalf of the city or the community, this these positive impacts wouldn't be happening. and there's no question we still have things to work out with the city of santa clara. and i'm encouraged by our current communications there. and. there is a lot of different ways that you can shape these things. but i think the good news is, is that we're discussing numbers around how big the positive impact is. i love when people comment on economic impact to say, well, you know, is it really that much? i mean, the reality is it's more than it would have been if not for levi's being here. and what i want to point to is that there was not a stadium built in california in 50 years before levi's stadium and there was not a super bowl hosted in this region, you know, until all the super bowl that was hosted at santa clara or stanford stadium. and so without levi's, without these everything that everybody came together to do, we wouldn't be discussing the super bowl and the world cup. and you're right, these things are hard to pull off. it takes not just local and state officials, frankly, but federal officials to get to a

level to pull off the massive events that we have to do. and so i'm i'm encouraged. i remain positive that we'll get to a point in our relationship where we will continue to bring events here, because, frankly, our community and our citizens deserve it. we know it's important to do our job on the field, but is as important to do our job off the field for all of those who frankly benefit from that. >> yeah. and you know, we've covered the taylor swift concerts and of course, beyonce. so a lot of excitement around that. so keep bringing those back. okay. but lastly, you had some big wins with contracts this year. okay, nick bosa and of course, extension wins for shanahan and lynch. and there are big super bowl expectations for the team this season. your thoughts on what you've seen so far and what you expect to happen in terms of maybe getting another ring? >> well, every day i walk in here and i see those five super bowl trophies, i get reminded of what our goal is, is to put the six lombardi trophy in that case. and i'm thrilled about

what we're seeing on the field of play. you mentioned kyle and john's extension and, you know, knowing that we have continuity within our staff and our nick bosa talked about that during his interviews this week. we have a big game coming up this sunday. you know, you're only as good as your next game, so we've already moved on. we're looking at the dallas cowboys on sunday night football on nbc. it's going to be really interesting for us to kind of go through that period of time. but look, it's we've gotten close. last year, we had an injury to our quarterback, which made it tough in an nfc championship game. we're hoping we can get over the hump, but we got a lot, a lot of football left to play. what i've been most thrilled about, though, is the fans that come to levi's stadium and also the fans that actually show up on the road. i know your network has covered it. you know what happened in sofi, what's happened in other places. so not only show up this sunday if you have tickets, but look forward to seeing us on the road if you can. we'll be watching and rooting for you and hopefully at the super bowl. >> al-quaeda, thank you so much for your time today. >> thank you. >> all right. this is kind of

because china is winding down its loans of the endangered animals to us facilities. the national zoo in washington is returning its three in december, meaning zoo atlanta will be the last to have pandas in the us until next year. china has loaned pandas to countries as a form of diplomacy. spencer this is worrisome for me because as you know, they are symbols of goodwill and it's coming at a time of increased tension between china and the us. >> yeah, there is a little concerning, more than a little concerning. as a matter of fact, love the pandas love the expression of goodwill that they represent and, you know, if they're being pulled back that, again, as you pointed out, indicates more diplomatic tension and that's not a good thing. >> and they're just magical to see. i mean, i've seen them at the zoo in washington, dc, and my niece and nephew, they just get so excited about seeing them. they're such special creatures. >> yeah, they are. they really are. >> yeah, they really are. all right. that's going
