area moving forward. >> finding solutions. this is abc seven news is now underway into a san francisco public works employee who you see there caught on video knocking over a street. >> vendors cart, sending its contents everywhere. good evening to you. i'm karina nova. >> and i'm dan ashley. thanks for joining us. you see these vendors on the streets of san francisco selling hot dogs and fruit, but you don't often see an interaction like this. a city employee knocking a cart to the ground. and when people saw this video, they wanted answers. >> abc seven news reporter lou pena went to the area where the incident happened to speak to vendors who say they want the city to intervene. and she joins us live from the newsroom now. lose >> that's right, chris. that's right. the san francisco public works department confirmed this was a food vending operation that took place on on sunday. they said the health department

directed them to impound carts, something that has been happening for over a month. street vendors said they feel mistreated. now gone viral. a san francisco public works employee can be seen pushing a street vendors cart condiments, onions, hot dogs and bell peppers end up on the ground while the worker can be seen picking up some of his cooking tools. >> vendors we purchase everything that we're selling. >> i have receipts of what i'm buying. we went to fisherman's wharf area where the incident took place and didn't find any street vendors up the street on pier 33. we met six of them selling hot dogs and fruit. they confirmed knowing that street vendor in the video and said public works employees have been confiscating many of their carts . >> pasado. >> so last month the city took six carts. in a statement, the city's public works department said their workers are trained on the escalating techniques and regarding the videos said in

part, we're still looking into what led up to that moment and the events that preceded. we strive to treat members of the public with respect act during permit enforcement operation. in this circumstance, we did not meet that threshold and we apologize. milka casimir said. they feel harassed and mistreated. she said this has happened before and showed us a video from another incident that happened a month ago, several times. it hasn't been the first time supervisor bonin's office denounced the act and confirmed that the city's street vending ordinance is there to check that people have receipts of items they're selling. but it doesn't include food at this point, we're still waiting on public works to issue their orders on how they're going to issue permits for food vending. >> so at this moment, there are no permanent food vendors in san francisco, so no one has permits not for selling food, no. there are food trucks that do have different permits, but like what you saw out there, like hot dog vendors, people selling fruit on the street out there, currently,

none of them are permitted by san francisco's department of public health said they do require a permit for street vendors to sell food in san francisco and added in part, the environmental health branch also issues permits to mobile food vendors to lower the risk of foodborne illness and protect public health, all permitted vendors display a current year decal premio de la ciudad. >> you would want a permit from the city. >> quiero un permiso. yes, i would. >> now, many of the vendors we spoke to said they want to get permits. they said that every time their carts get confiscated, they said they have to pay a $300 fine, something that's hard for them to make. they want the city to intervene. in the newsroom, luis pena, abc seven news. >> it's not an easy way to make a buck. luce is the public works employee going to continue working on food vending operations? have you heard? >> well, don, it's still unclear . the san francisco public works department said they are reviewing the video and investigating what led up to it and to the worker. and as to the

worker, they said that action will be taken once that investigation is finalized. so we will see. >> yeah, we'll follow up on that. luis, thank you very much. >> developing news now. negotiate oceans continue to prevent 75,000. kaiser permanente workers from going on strike. they could walk off the job tomorrow morning if their demands are not met. they want the hospital to address staffing shortages as well as what they call unfair labor practices. as kaiser says, the work of doctors and registered nurses should not be affected. but disruptions could include a wide variety of other hospital services. patients will feel an immediate impact, especially when they need lab work. >> diagnose astic imaging pharmacy vision care and so on. because most of the employees who are the bulk of those workers in those facility cities would be on strike. >> the union representing those kaiser employees says a walkout would take place from 6 a.m. tomorrow to 6 a.m. saturday, due

details about the tragic drownings that happened at a san jose daycare to children died at happy, happy daycare yesterday. >> a third was hospitalized and police spoke for the first time today about the investigation that's underway. now to abc seven news south bay reporter zach fuentes. it's a tragedy that has shocked the community. >> three children fell into this pool at a san jose home daycare. one was hospitalized with non-life threatening injuries. two drowned. we now know from the santa clara county coroner that there were two one year old girls, payton cobb from hollister and lillian hannon from san jose. >> this is the type of call that's the worst that a parent can receive as a department. we're going to investigate this. >> police were called to the scene after nine monday morning for a welfare check. it's not clear yet who made that initial call and how the children got into the pool. police say homicide detectives are investigate, waiting along with the department of family and children's services, the santa clara county district attorney's office confirmed with abc7 that they are reviewing the case to see if charges will be filed.

according to the department of social services, the home daycare center was licensed in january of 2021 to 2 women. the pool was noted as an off limits area in their license. christina andrews of morgan hill founded a nonprofit to teach kids survival skills in the water. it's named courtney's course after her young daughter, courtney, died in a friend's pool. >> i feel for those parents so deeply because i know firsthand what it feels like to lose a child to this, though, details are still not clear as to how the kids at the daycare got into the pool. >> andrews says it's critical that children learn survival skills in the water and pools are secure. there's a total difference between a fence around a pool and a pool fence. >> this is actually designed to keep children out it so cannot be climbed. >> but beyond just the fence, andrews says that homes need layers of protection. >> we open this door right now. it is going to be an obnoxiously loud noise that goes off immediately. >> other measures include a keypad on the gate leading into the backyard. also an automatic pool cover that covers the pool entirely. >> survival swim lessons is the last layer of protection aside

from cpr. but the last layer of protection that the child has, and that is not reliant on any human but the child themself. >> as for the investigation into that san jose daycare, police say it will take several months in san jose. zach fuentes, abc seven news. >> police are searching for the driver who hit a pedestrian at fifth and market streets in san francisco last night, then took off. the pedestrian was then hit by a second car, an autonomous vehicle with no driver. she suffered serious injuries. abc7 news reporter suzanne fawn has more on this from the newsroom. suzanne cory rina cruz showed media dash cam video of the dramatic collision, but the company would not let us share the video with viewers so as not to compromise the police investigation. now, this incident was so serious, emergency crews had to use the jaws of life to save the person who was trapped under a driverless car that would not move. rescue crews work to secure the vehicle in place and extricate the victim quickly within three minutes, crews had

to use the jaws of life to free a pedestrian trapped underneath the cruz vehicle. on monday night. it's a first for police and fire departments involving a driverless car. >> the victim was found to be under the left rear wheel of the vehicle, according to police, a black sedan struck a woman crossing the street at fifth and market on monday night. >> immediately after that collision, an empty cruz car in the lane beside the sedan hit the same person this morning. cruz allowed abc seven news staff to review the video, but not record it nor share it. reporter gloria rodriguez describes what she saw in the dash cam. >> the black sedan hits the pedestrian very hard. it was just very graphic. the pedestrian then goes flying into the other lane, and that's when the av then hits a pedestrian. the video stops soon after that. so we can't tell how long the pedestrian is there on the ground with the av over on top of the pedestrian, we reached out to cruz asking for further clarify location. >> today, cruz says it's working with police in their

investigation. in a statement, it also said, quote, the av then braked aggressively to minimize the impact and at the request of the police, the av was kept in place. sam abuelsamid is an automotive technology analyst with guidehouse insights. he says that automated driving systems are constantly adding data. >> sometimes, though, things happen so quickly that there is simply nothing you can do. no matter how well you are tracking all of the other road users around you, abdul-samad says. >> a driverless car most likely could not have avoided the collision on monday night. >> the basic physics, i mean, when you have a 4,000 pound vehicle, it is inherently going to take a certain amount of time to stop and according to san francisco police, the woman who was struck is in serious condition at san francisco general hospital with multiple traumatic injuries. >> again, police are still looking for the driver of the black sedan involved in that initial collision. that driver left the scene after hitting the woman. live in the newsroom, suzanne fan abc seven news. suzanne, as you mentioned, we

know police are looking for the hit and run driver. but what could happen with cruz in the wake of this incident? well, the dmv is the agency in california that regulates the testing and permits for avs. now, all av companies are required to report crashes to the dmv for investigation. if the dmv finds that the av was at fault, they could modify or revoke a company's permit. but again, that does not sound like the situation for cruz in this incident. back to you. all right , suzanne. good to know. thank you so much. and earlier today on our 3 p.m. show, getting answers, we asked an expert to evaluate rate the collision and he said people are too quick to blame. autonomous vehicles and the need and they need to look at the bigger picture. you know, these pedestrians walking through intersection are so-called vulnerable road users and although there's a focus here on automated vehicle companies, what we really need is automated intersections that consider vulnerable road users

that can come into conflicts with vehicles, be they human driven or automated vehicles. >> whether or not the vehicle did what it needed to do. there's clearly a need to have smart intersections to protect vulnerable road users. live interviews like the one that you just heard happen every weekday at 3 p.m. you can watch getting answers live on abc7 on tv or wherever you stream. >> jury selection started today in the trial for ftx founder and former crypto billionaire sam bankman-fried. prosecutors say the bay area native cheated thousands of people who deposited cryptocurrency on the ftx exchange by illegally diverting massive sums of their money for his personal use. bankman-fried has pleaded not guilty to all he could face up to 110 years in prison. in a former federal prosecutor tells us what to expect. >> at the end of the day, i think what's important about this case is this is about bail

base level, garden variety fraud . it's about abuse of investor funds. it's really less about crypto, which has gone up and down just as investors payments generally have gone up and down . and it's more about the abuse of the money. the trial is taking place in new york city and is expected to last up to six weeks. >> a federal appeals court has ruled california can be held responsible for a 2020 covid outbreak at san quentin that sickened thousands of inmates and killed 29 people, including one corrections officer. a ninth circuit panel panel upheld a lower court's finding today. judges dismissed the state's argument seeking qualified immunity. 2000 people were infected within weeks after 122 inmates at high risk of complication were transferred from chico to san quentin. the suit was brought by the spouse of one inmate who died. >> happening tomorrow, be on the lookout for a nationwide test of the emergency alert system. at

their home, though, is on the streets pre-pandemic, contra costa county counted fewer than 2300 homeless residents. well, the last count last year topped 3000. that's a 34% increase. so what's being done about it? abc seven news reporter anzar hassan has some answers. >> housing advocates say people are suffering in silence in east contra costa county. >> i did not receive any support or any resources during the time me and my children were homeless. i had to pay for a hotel stays weekly on my own, agrees clayton shared her struggles on a panel discussion on homelessness and housing. >> she was joined by activists and city leaders from pittsburgh , antioch and brentwood. every city can do better. >> we do have to think about things on a regional and a state level. brentwood vice-mayor susanna meyer says her city raised the inclusionary rate for the number of affordable units that must be built in new developments to 13% and remove

in-lieu fees, which developers could pay. >> instead of building low income housing. >> the developments that are being currently built will actually have to stand to that. and so we will, as we get more build out coming in, we will be getting more affordable housing coming in as well. >> pittsburgh mayor chanel scales preston spoke of several new projects underway, such as this one for low income veterans. she says there is no shortage of construction around the city. the challenge is funding to build affordable housing. >> i think the hardest part is getting the funding. you know, it comes from all these sources from the federal government. the state, you know, the county, you know, your city, and then the nonprofit. and we're trying to figure out how to put all that funding together to build that housing. >> antioch mayor lamar thorpe says aside from the red tape, until there's better coordinated efforts, housing, the homeless will remain a big problem in antioch. >> we you know, we've invested in and bridge housing stabilized people getting them the wraparound services and then them getting them into housing. but i'm not sure we're all doing that. and so that's concerning

because we're going to continue to see an explosion of homeless people in our streets. >> housing advocates like the group a's, which is working in east contra costa county, says they're encouraged, but that more still must be done. >> we want to keep these conversations going because it does help in the long run. >> in pittsburgh, san hassan, abc7 news. >> all right, let's talk about the weather now. what did spencer say? heat week, fleet week. fleet week side. >> they kind of merge which actually spencer's great news, right? yeah, right, exactly. >> but aren't they the same right. they they rarely are. i should mention that often we look for blue skies for the blue angels. we have only fog. but not this time around. here's a look at what's the controlling factor in our weather. this huge , large area of high pressure centered just off shore. it'll be the dominant feature in our weather through most of this week. and of course, it's clockwise circulation there is going to bring us offshore winds which will contribute to the warming and the drying of the air as the winds flow downslope. right now, we're seeing low clouds being pushed away from the coastline. so it's going to

be a clear night and it's much warmer right now than at this time last night in most bay area locations, 5 to 9 degrees warmer. so you see the warming, the heat. i was talking about is already with us. here's a view from sutro tower looking out over san francisco under clear skies, 64 degrees here in the city right now excuse me, 70 in oakland, 72 in mountain view, 77. san jose, palo alto, 72. half moon bay, 57 at the golden gate. we have blue skies as well. of the temperature readings at this hour, 79 degrees in santa rosa. novato 81 napa 77 mid 80s at fairfield and concord and 81 at livermore and emeryville gives us a view of downtown oakland right now. also under blue skies and these are the forecast headlines. clear skies overnight. no cooling coastal clouds tonight it'll be warm along the coast the next few days. and hot along the bay shoreline. and in our inland areas. that'll be saturday, wednesday through saturday. and of course, that means heightened fire concerns. it also may mean near record high temperatures in

some locations tonight. no clouds, no coastal cooling, clear skies going into the early morning hours. so it'll be a sunny start to the day tomorrow. overnight, low temperatures will be mainly in the low 60s, which is pretty mild and maybe even uncomfortably mild if you're living in one of the warmer zones in the bay area. and if you don't have air conditioning, then tomorrow look for a sunny skies and mild to warm to almost hot conditions. highs of 77 and half moon bay, 82in san francisco, which is quite warm for san francisco around the bay shoreline, we'll see mid to upper 80s tomorrow, close to 90 in some spots and only low 90s inland. i say only low 90s because inland areas will be much, much warmer as we get later into the next seven days. so here's the accuweather seven day forecast thursday, friday and saturday. we'll see mid or even mid to upper 90s in our inland communities around the bay shoreline. upper 80s to about 90 and it's certainly likely 1 or 2 bay side locations

level in more than a decade since mortgage rates tend to follow ten year treasury notes. investors are worried the housing market could stall further. the dow tumbled 430 points and wiped out its gains for the year. the nasdaq sank by 248 points and the s&p 500 dropped 58. nearly $4 billion. that's how much the united auto workers strike has cost automakers. that's according to a new report from the anderson economic group. that cost is up significant from the 1.6 billion in losses reported the first week of the strike. the strike has gone on for more than two weeks. 38 motors, more for general motors and stellantis plants went on strike this week and an estimated 18,000 auto workers are now on the picket

line. general motors and ford have recently laid off 500 workers, blaming the expansion of the strike. >> and more labor news. the sag-aftra union will resume negotiations tomorrow with movie studio ceos. the two sides met yesterday. that was the first official meeting since actors went on strike back in july. actors are demanding a deal similar to the one with the studios that the wga writers recently negotiated. they want wage increases and artificial intelligence protections, and they also want to include video game performers under the same contract that the wall street journal says netflix is planning to raise the price of its ad free service once the actors strike ends. it's still unclear how much it will cost. netflix was the only streaming company not to raise prices in the past year, but the company did boost revenue by cracking down on password sharing. >> coming up next, history made in america. the speaker of the house, california republican kevin mccarthy, is out. plus

and prosecutors fell apart in july. hunter biden has become a central figure in the ongoing house gop led impeachment inquiry into president biden. so far, republicans have uncovered no evidence of an improper business relationship between the president and his son. >> donald trump was back in a manhattan courtroom this morning , day two of the civil fraud trial against the former president saw more witnesses take the stand. the case was filed by new york state attorney general letitia james. she's accused king trump, his eldest sons and the trump organization of inflating the value of their real estate property to obtain loans and insurance on more favorable terms. the former president has denied wrongdoing and blasted james repeatedly calling the trial a scam and a sham. >> donald trump and the other defendants have can committed, persistent and repeated fraud. >> she ran on the basis i will get trump without knowing anything about me. >> the trial will determine how much trump and his company will

pay in damages and penalties. trump is expected to be the prosecutor, final witness today . >> california's newest senator, laphonza butler, was sworn into office in washington. governor newsom appointed her to fill the seat of senator dianne feinstein , who, as you know, passed away on friday. abc7 news reporter ryan curry has more on today's ceremony. >> so help you god. i will. congratulations, thomas. >> thank you. >> congratulations. >> laphonza butler is california's newest us senator. taking the oath tuesday afternoon to fill the seat left vacant by the death of dianne feinstein. majority leader chuck schumer met butler and her family before welcoming her on the senate floor. i can't help but think how proud senator feinstein would be seeing someone as brilliant, as accomplished as history making as laphonza butler take her place. she's only the third black female senator in history and the first lgbtq senator from california. butler's wife, nancy lee, held the book during the

swearing in ceremony, and butler's mother, sarah, was there as a witness. >> she does become, i believe, the 60th woman to serve in the us senate, which on its own is significant. >> jessica weiss, a history professor at cal state east bay, says her appointment is reflective of the state's diversity and the equality efforts made by women and people of color throughout the nation's history. >> we've made tremendous progress, but this progress has been the result of protests. it has been come at sometimes a very high price and it's not anything to be taken lightly. and we need to continue to move forward. >> butler served as a senior adviser to kamala harris during the 2020 presidential campaign and most recently as the president of emily's list, a nationwide organization that raises money for women candidates who support abortion rights. sen butler released a statement saying, this has been a day i did not expect and will never forget. i'm humbled to have the privilege and responsibility of serving the people of california as their senator. it's unclear if butler

isn't shopping for the past decade. holiday shopping has been creeping back week by week in stores and online. michael chechik is with jungle scout company, which helps online merchants like the third party sellers on amazon and elsewhere . he says the new amazon big deal days are pushing sales earlier in the season. >> there will be huge deals the second week in october when amazon comes out and says that they are going to have a big deal day. they say will mean it. they will have some amazing deals on a lot of the things that people want for the holidays. >> and because amazon is so big, other retailers will join in on the earlier sale. so if you want a deal this year, you may have to buy earlier than in years past. >> and you think about like amazon devices, you think about instant pots, you think about dyson vacuum rooms, you know, all of the things that wind up being big ticket items for the
