they were not injured. the other big story that we are following this morning, the crisis on the southern border and a major development from washington. >> the biden administration is giving the green light to build a border wall in part of texas. it comes amid a new surge in migrant crossings. as this move marks the biden administration first use of a sweeping executive power and will waive environmental laws in the region. here's abc's andrea fujii. >> this morning the biden administration is waiving more than two dozen federal laws to allow the construction of a border wall in south texas. as more cities along the border and in the north struggle to handle the influx of migrants coming from latin america, homeland security secretary alejandro mallorca saying there is presently an acute and immediate need to construct physical barriers and roads in the vicinity of the united states in order to prevent unlawful entries. september marked the highest number of migrant encounters at the us-mexico border so far this year, with border patrol apprehending more

than 200,000. in new york, the number of busses filled with migrants has nearly tripled in recent days. nearly 600 people are arriving each day. the mayor is now on a four day trip to south and central america to deliver a message. >> we're going to tell them that coming to new york doesn't mean you're going to stay in a five star hotel. it doesn't mean that the mere fact you come here, you automatically are going to be allowed to work. >> the mayor is also pushing to suspend the city's so-called right to shelter law, which mandates new york provide shelter for any homeless person. he says the city simply cannot house the 120,000 migrants who've arrived since last spring. chicago also struggling, bracing for up to two dozen more busses of migrants sent from texas by governor greg abbott. the mayor now planning to visit the border. >> we need to go assess the situation, just like our team has gone to dc. we need better coordination, quite frankly.

>> illinois governor in a letter this week called on president biden to address what he calls a humanitarian crisis, citing the federal government's, quote, lack of intervention and coordination. as for the border wall construction, it's for a limited area in south texas, where about 245,000 migrants have entered this year. there's no timeline yet as to when that construction could start. rhiannon lionel. >> andrea, thank you. a memorial service for longtime us senator dianne feinstein today will no longer be public. officials made the change citing security concerns. feinstein will be laid to rest today after lying in state at san francisco's city hall yesterday. she died friday at the age of 90. >> back in washington, new drama on capitol hill. a new push to punish the man who led the revolt against house speaker kevin mccarthy. this morning, moderate house republicans tell abc news they're pushing to expel florida congressman matt gaetz from the house gop conference and punish the other

republicans who voted to remove kevin mccarthy as speaker. >> matt gaetz just got schooled by aoc and others. he was totally manipulated into doing this. i think there needs to be accountability. >> there needs to be consequences. his gates and seven others provided enough votes to force mccarthy out after the now former speaker worked with democrats to pass a short term spending deal last week, keeping the government open. >> in the meantime, two candidates have already emerged , hoping to replace mccarthy as speaker. majority leader steve scalise throwing his hat in the ring despite undergoing treatment for blood cancer. >> i feel great. i know we have a lot of work to do. >> ohio congressman jim jordan also running for the post. one big issue will the new speaker support more funding for ukraine ? congressman jordan already making it clear where he currently stands on the issue. >> i'm against that. the most pressing issue on americans minds is not ukraine. >> another big issue for the new speaker will be whether to do away with the rule that allows a

single house member to call a vote to remove the speaker. the rule that was used by gates that led to mccarthy's downfall. the house is adjourned until next week with no action expected until wednesday. former president trump returned to florida after sitting through two and a half days of his fraud trial in new york. >> his lawyers filed an appeal with a higher court to dismiss the judge's pretrial ruling that found he committed fraud by inflating the value of his properties. as he left court. trump unleashed new attacks on the judge and the attorney general. >> why attend? because i want to point it out to the press how corrupt it is because nobody else seems to be able to do it. >> i will not sit idly by and allow anyone to subvert the law . and lastly, i will not be bullied. mr. trump is no longer here. the donald trump show is over. this was nothing more than a political stunt. a fund raising stop. >> the state is seeking a $250 million penalty.

>> some progress has been reported in talks between ford and the united auto workers. the company and the union have reportedly narrowed down their differences on pay increases, despite that, ford is laying off another 400 workers in michigan and about 75,000 kaiser permanente employees are still on strike. most of the affected health care facilities are in california, but workers are also on the picket lines in colorado , oregon, washington, virginia and d.c. the key issues are staffing levels and pay. the strike is set to end saturday. >> we have been reporting for months now on the rise of violent crime in cities both large and small. but this case really stands out. the victim is an innocent bystander, a pregnant woman, and her baby. this morning, police in massachusetts are investigating a shooting that wounded a pregnant woman on a passing bus and led to the death of her child. >> it's ridiculous that this has to continuously happen. like what are they doing? what are

they doing to make us safe? >> gunfire erupted in holyoke, 90 miles west of boston, after authorities say three people got into a fight. a stray bullet traveled through the bus, hitting the pregnant woman sitting inside. she was listed in critical condition overnight. the district attorney says doctors delivered her baby, but the newborn did not survive. >> this is very outrageous. i don't understand how much gun violence has to happen before something really changes in holyoke, but it's another day it's just another day in holyoke. just two hours before the shooting, police in holyoke held a news conference about gunfire detection technology, which they began using earlier this year to track shootings. >> since march, the technology has detected 113 gunshots. but remarkably, in only 14 of those cases did anyone call 911. police now urging all residents, no matter how familiar the gunshots may become, they should

always call police immediately. we it's a tragic story. the technology did pick up on yesterday's shooting, helping police take three suspects into custody. >> some troubling new accusations against the man accused of kidnaping a nine year old girl from a campground in upstate new york last weekend. a woman who lives down the street from the suspect says her nine year old grandson was also approached by the suspect over the summer. but she says after she intervened, he took off. as for the little girl taken last weekend, she is now home with her family. >> well, some more disappointment for powerball players for the 33rd consecutive drawing, there was no jackpot winner last night. so that means saturday's grand prize will be worth an estimated $1.4 billion. the third largest powerball jackpot ever. >> time now for your thursday weather. through the dallas area last night with large hail and strong

surprise you can't miss on good morning america. new video this morning from a deadly highway pileup in arkansas. >> drivers say smoke from a nearby brush fire reduced visibility at least two people died. several others were injured. traffic there was backed up for hours. >> a mcdonald's worker in florida is recovering after she was burned by hot coffee by a customer claiming that he was overcharged by a penny. this was all caught on camera. the drive through customer is seen knocking the coffee out of her hand. you see it there. and then she was left with burns on her arm. >> he always orders a sausage muffin with an egg on the side. he started insulting me, calling me names, insulting the guy in the back. and as soon as i put the coffee out, he just matched the coffee and it went all over me. >> that customer facing a felony battery charge. >> we turn now to the corruption case against us, senator bob menendez. the gold bars

allegedly found in his home made headlines. but now there's new information about a deadly car crash. here's abc's derrick dennis this morning. >> the indictment against new jersey senator bob menendez is shedding new light on a deadly car crash involving his now wife. >> if we can clear you from any wrongdoing, i want to get you home and comfortable and not here anymore. in newly released dash cam video, a new jersey police officer is seen speaking with nadine menendez in 2018 after a man named richard coupe was hit by her car as he was walking to his home. >> he jumped on my windshield. >> okay. okay, officers questioned nadine and concluded she was not at fault, saying in the police report that coupe was jaywalking and had darted across traffic. >> surveillance video shows nadine stayed in her car for seven minutes after hitting coupe. >> she never comes to the aid of my client. she doesn't come anywhere near it. in fact, she drives around and avoids him. >> the deadly incident before

nadine and senator menendez were married is alleged to be the foundation for a bribe laid out in a federal indictment against the couple nearly half a million dollars and gold bars were allegedly found in their home. the senator says the cash was for emergency use, but he is not explained the gold. prosecutors said in those charging papers that nadine needed a car so badly after a 2018 accident that senator menendez was willing to suppress an unrelated criminal prosecution for a businessman. in exchange for this mercedes convertible. and authorities claim in the indictment, the senator pressured an unnamed official to favorably resolve the investigation. when asked about the deadly car crash yesterday, senator menendez called it a tragic accident. derrick dennis, abc news, new york. >> derrick, thank you. nadine was released and was apparently not tested for drugs or alcohol as for senator menendez, he is due in court later this month. >> well, coming up, an airbnb nightmare. >> also ahead, one nfl player's
