pilot accused of trying to take down a plane on its way to san francisco show. good afternoon. i'm kristen sze. >> and i'm karina nova. 44 year old joseph emerson appeared in a portland courtroom just a few hours ago. the pleasant hill man is accused of trying to crash a plane heading for sfo on sunday. >> he's facing federal charges and those documents are providing detail of a terrifying 90s in that cockpit. i-team reporter dan noyes is live in the newsroom with the latest. >> dan, it was a tense 90s. you know, emerson is no longer an airline captain. alaska airlines announced this afternoon that they have removed and relieved him of all duties. court documents say he was off duty and riding in a jump seat as the cockpit sunday when he suddenly said, i'm not okay and reached for the emergency engine shut off handles. one pilot struggled with emerson while the other declared an in-flight emergency. it took 90s for the pilots to wrestle with emerson and get him under control. he left the

cockpit on his own, telling the flight attendants, you need to cuff me right now or it's going to be bad. one passenger took these photos. emerson appeared in court this afternoon to face 83 counts of attempted murder and endangering an aircraft in the first degree. >> good afternoon, your honor. for mr. emerson, he is truly named. we've received two copies of the district attorney's information. we would waive further reading and advice of rights reserve all rights, read into the record this morning. enter a not guilty plea on all counts. i will not be addressing in those federal court documents, emerson told police he thought he was having a nervous breakdown on the flight and that he hadn't slept in 40 hours. >> now, he also discussed taking psychedelic mushrooms, though the time frame and whether he had taken them right before the flight was not clear. in the court documents. but abc news is reporting tonight that he took the mushrooms is just 48 hours before that flight. so clearly, they may have played a role in what happened or he could have been claiming that they played a

role in what happened. now, one other note. once emerson got cuffed into a seat in the back of the airplane, he tried to open an emergency door door, but a flight attendant stopped him. i'll have more on the court documents and more from court coming up on abc7 news at five. all right, dan, before you go, i wonder how did emerson look to you in court? >> we saw him grimacing a little bit in that video and we know he's been suffering or he says he's been suffering from depression. >> right. you know, as he walked in, clearly he seemed tense, which you might expect. and. right before his lawyer talked, you could see that he was caught someone's eye in the audience and started to kind of mouth a message to them. and he was close to tears at that point. so clearly be an emotional time for him. his life as a pilot is over. so he has a long road ahead in the legal system. >> all right, dan, thank you so much. to get in touch with dan and the i-team, you can call this number on your screen, 1888 40 i-team or go to abc7,

news.com slash i-team. >> california is hitting the brakes on cruise. the decision by the bmv today came shortly after a protest began outside the robotaxi makers headquarters in san francisco. abc7 news reporter ryan curry has a look at what effect the decision will have on the autonomous car company. >> cruise cars sit behind the company's gates in san francisco. if any of them leave this lot, they need someone behind the wheel. the dmv says their self-driving cars are too dangerous. we have seen several times where cruise cars stall on the street and blocked traffic. earlier this month, a woman was trapped under a cruise av after being hit by another car. experts think this could have ripple effects for the whole industry. we're still at a point where, you know, one incident reflects on every automated vehicle developer or so. so in some way, this probably does hinder the whole industry. cruise was the first av company allowed to give rides to people

without a driver. the city's transportation committee spoke about avs tuesday. supervisor peskin says crews needs to be more transparent when sharing data in their cars are doing, you know, charging a pedestrian or going through an intersection with a red light. >> they need to make all of that data transparent and if they do that, we can actually see whether or not their software is evolving and becoming safer. >> mayor london breed wants to see cruise operate in san francisco, but she wants to see it done safely. >> they can spend some time working on improving their safety measures because we want to welcome this technology, but we want to do so responsibly and safely. >> the federal government doesn't really have unified laws when it comes to self-driving cars. therefore, it is up to the states. in california, the dmv is the ultimate decision maker right now. in a statement, cruise said, we learned today at 10:30 a.m. pt of the california dmv suspension of our driverless permits. as a result, we will be pausing operations of our driverless avs in san francisco.

av experts say if cruise doesn't solve this fast, their future is in doubt. all of their plans kind of suddenly get called into question where and when. maybe they've, you know, tried to run too fast before they could walk in the city where they're they're really operating. you know, in a major way right now. and the dmv says it will not allow cruise to use their self-driving cars until inspectors deem them safe. in san francisco, ryan curry, abc7 news. >> abc7 news is doing a deep dive into self-driving vehicles in a new docu series. as part of the series. we talked with a witness to that incident in san francisco in our exclusive interview he described what he saw there. >> i stop about right here. the green honda was about right here. and when i step out of the vehicle, i put my emergency pocket lock on before i ask her to visit. i stood down, you know , and i started asking, finding out whether or not the person. hello? hello? are you okay? okay

then the person stopped moaning. did you see there's still blood here. the person stopped moaning and then i raised up and i started yelling. anybody call the police? anybody call the police. three people said, no, no, no. immediately i put out my phone and i dialed 911. what's still the person? and explain to them we had market and post street and there's a body underneath accruals called that been run over by the cruise and the person is alive. >> well protesters in southern california took aim at waymo's autonomous vehicles today. the protest by teamsters and other labor unions was at google's venice headquarters. waymo is owned by google's parent company, alphabet. waymo has recently been expanding in southern california, california was among the dozens of states suing meta, the parent company of facebook and instagram, a federal lawsuit filed in northern california accuses the menlo park based company of harming young people's mental health. >> the suit claims, features on the platforms are designed to addict children, while lowering

their self esteem. today california attorney general rob bonta accused meta officials, including mark zuckerberg, of publicly lying about the addictive nature of the platforms. >> we know that meta knows that instagram is addicting. it even used that word internally addicting meta's conduct is deceptive. it's dangerous. and as we make clear in our lawsuit, it is illegal. >> the suit also accuses meta of routinely collecting data on kids under 13 without parental consent, in violation of federal law. meta issued a statement saying, quote, we're disappointed that instead of working productively with companies across the industry to create clear age appropriate standards for the many apps teens use. the attorneys general have chosen this path. >> family members of the more than 200 people taken hostage by hamas militants during their siege october 7th are accusing world leaders of failing to work for the release of their loved ones. families of the kidnaped

joined forces today at the un. among them, rachel goldberg. she's the mother of berkeley native hirsh goldberg, poland, who was wounded and taken captive during the attack on a music festival. >> why is no one crying out for these people to be allowed access to the red cross? why is no one demanding just proof of life? this this is a global humanitarian catastrophe. >> goldberg decried what she sees as a lack of compassion for the victims of the hamas attack on israel. she says it's time to stop the hatred that exists, saying, quote, in the competition of pain, there is never a winner in the east bay. >> oakland police are investigating a shotspotter activation that led to a car crashing into wings restaurant near 65th street. when officers arrived, they detained multiple individuals and recovered two firearms the black audi had multiple bullet holes in the rear window. police say the crashed vehicle was related to the original shots that were

fired at walnut creek. >> police have managed to put a big dent in a retail theft ring involving lululemon stores in the last five days. they've made arrests and shared their strategy for preventing retail crime going into the holiday season. >> here's abc seven news reporter leslie brinkley. >> the arrests of eight suspects in a retail theft ring at this lululemon store in walnut creek uncovered a chain of events that started earlier in the month when police say thieves targeted two lululemon stores in napa and santa rosa taking 10,000 in merchandise from each their network of loss prevention agents will communicate out to include photographs and general descriptions. that's what broadway plaza shopping center officers and store employees had to work with last thursday afternoon. the north bay suspects showed up at the store in walnut creek. police say these retail theft suspects are bold, taking. 3 to $4000 worth of merchandise up to the counter

in the hopes of getting a gift card or cash. >> in this case, they were stalled and then our officers moved in and detained them and then subsequently arrested them. >> two were arrested in the store, two more arrested in a waiting car with an additional $13,000 in stolen merchandise. then just two days later, four more suspects stormed the same lululemon store in walnut creek. >> they go in, they grab as much as they can, and then and then they leave. and the officers that responded responded quickly and were able to detain those individuals and subsequently arrest them. >> the police department's doing a great job of saying, yes, a crime occurred, but arrest was made so that the communication out to the world is if you come to walnut creek, the to commit a crime, you're going to get arrest. and it was nearly two years ago that a gang of thieves took over the nordstrom store in walnut creek, the street through broadway plaza was blocked to traffic after that as it reopened uh- this fall, suspects

chase center with a look ahead. larry, pretty exciting. >> this is going to be fun. karina, kristen, i mean, you have a season opener that's always fun, but there's going to be some extra juice, some extra energy in the building tonight as kevin durant returns as a member of the phenix suns. katie, of course, the former golden state warrior and help the dubs to win champion ships. he came in 27, 2018, and 19 got hurt. otherwise they probably would have had three championships. unfortunately durant decided at that point he wanted to move on to become a member of the brooklyn nets, two time finals mvp should receive a huge ovation tonight, and warriors owner joe lacob has already said that durant's number 35, his number will be retired at some point. here's durant on his return to the bay. >> yeah, i'm excited to play in

front of those fans. i spent some some some incredible moments there. and you know, we built a bond that i don't really have to be spoken about. me and the fans there in the bay area and i feel like they've been supporting me well before i came there, actually. and then once i became a part of the warriors, they just went even harder to in support of me, myself and my teammates and then to win a championship. you just immortalized there. >> i anticipate our fans giving kevin the love that he deserves to championship. and you know, trying to help us win a third and literally giving his body to the cause and you know, he was he was incredible here. and uh- will go down as one of the great players in franchise history. >> now, if you remember, durant was part of the groundbreaking when they began building chase center. this will be his first time in the building playing in front of fans. of course, there was a one game that he played

here during the pandemic and nobody was allowed in the building. so it's going to be fun to see. kd probably not as much fun to guard him because the warriors are going to be about draymond green tonight as he recovers from a sprained ankle. but again, there's going to be a lot of energy in the building tonight and the warriors debut of chris paul facing his old team, the sun. so the storylines galore and we'll have them for you at five and at six. >> a lot of drama i feel like going to be happening tonight. i know. i think that's going to give the warriors and the fans an extra boost, don't you think? the durant drama, like just the extra juice like, oh, there's going to be juice. >> in fact, there's going to be a tribute video for kd before the game. and again, as i said in the beginning, there's probably going to be a huge ovation and he deserves it. i mean, you know, two championships and he gave up his achilles for the franchise. so, you know, we should we should all be applauding kd tonight for sure. >> but also extra incentive to win too. thanks, larry. sources tell abc seven news the giants are poised to hire peninsula native and cowlam bob melvin as

their new manager. multiple reports indicate melvin met with giants executives just yesterday. melvin has one year left on his contract, but the giants received permission from the padres to speak with the three time manager of the year. melvin managed the oakland a's from 2011 to 2021. the nhl has reversed course on its controversial ban on pride tape and other colored stick tape for years, players have used specialty tape to support social causes during games and in practices. the leagues decision comes after public outcry from players and fans. the ban was first instituted by the nhl earlier this month in an attempt to crack down on the use of special on ice gear for theme nights. some players have continued to use pride tape to protest the ban. all right. we're going to take a look at our weather today is just perfectly comfortable, i think. yeah, it's a good day out there. you can see it behind us. looks beautiful. let's check in with spencer for the details. you know, sometimes perfection doesn't last very long.

>> that's going to be the case with our weather. let's take a look at what's going on right now with the satellite radar composite image. we've got some active weather to our north. you can see a frontal system sweeping out through the seattle portland area. that front is going to be moving in our direction. in fact, it is moving in our direction. and as we look at live doppler seven with the satellite overlay, you can see clouds kind of sliding down along the coastline right now. but more important will be the clouds coming down from our north. right now, the wind is relative calm, although it's breezy here in san francisco and down at sfo and the 24 hour temperature change is not very dramatic. we are 2 to 5 degrees cooler in most locations than at this time yesterday. so let's take a live view over sunny san francisco where currently it's 61 degrees. we have 66 in oakland, 70 degrees at mountain view. san jose, 76, 71 at palo alto and 57 at half moon bay. not sunny at the golden gate, which is not unusual. other temperature readings right now, 74 in santa rosa, we've got 70 at petaluma and napa. fairfield and concord, both at 77 and 78 in livermore. and as you look back toward san francisco from

emeryville, you can see the clouds building along the coastline there. and these are the forecast headlines. we'll see partly cloudy, breezy and cool conditions overnight, even cloudier tomorrow as the cold front moves through. and we can expect cooler days ahead going into the weekend. so here's the forecast animation starting at 5 p.m. notice by midnight or so, we'll see that the clouds ahead of that front beginning to swing through the bay area and into tomorrow afternoon. it'll certainly see lots of clouds all across the bay area. we don't expect any rain from this system, although it's possible a spot or two of drizzle could develop. but based likely, this is going to be a dry front bringing us lots of clouds, breezy and cooler conditions. overnight lows will be mainly in the low to mid 50s highs tomorrow. low 60s at the coast mid 60s around the bay shoreline up to about 7071 degrees in the mildest inland locations. now as we skip ahead a bit with the maximum temperature trend, you can see on thursday, not much change. still a relatively cool day. temperatures mainly in the 60s, 1 or 2 inland spots may top

out at 70 degrees. similar conditions on friday. in fact, it's not likely we'll see anyone hitting 70 degrees on friday. so a little cooler than average saturday. temperatures begin to rebound just slightly. so here's the accuweather seven day forecast. we might get some showers on friday. there's a chance not a great chance, but a better chance than we'll see from this system that's moving through tomorrow. then as we look at the weekend, you see mainly sunny skies saturday and sunday, a sunnier, drier weekend than we can expect on friday and going into early next week. little bit of a warm up. not much. just enough to feel it, make it feel, as you guys are saying perfectly, okay, what was the word you like? >> perfect. perfectly perfect. yes. for fall. >> but as mentioned, it does last perfect as last for a long time. >> no, it doesn't. >> that's okay. and then it becomes somebody else's perfect. >> you can see perfect doesn't last long. we're getting ready to end the weather segment right now. >> oh, you are perfect. he is perfection.

adults with disabilities is making a difference in the robotics industry. >> abc7 news reporter luis pena spoke with the young adults who are hoping their job opens doors for others in their community. >> at 6 a.m, tim zalewski grabs his safety glasses and is ready to build. >> we're making parts of unit and of course this is the unit and you got to like use this like this wrench. >> tim showed us around his new job at omron, an electronics company in pleasanton. what do you think about this place? >> i just think it's kind of awesome. >> tim got hired a month ago after excelling as an intern here. getting that call is still a bit surreal for him, realizing that i got hired for a full timer, you never thought that was a possibility? yeah. why well, because.

>> because i thought it would be really impossible since omron is a really busy company. he comes to work knowing that his role is vital to build robots. >> he is part of a team. well it just feels like that i'm starting a new adventure. and what is the adventure bringing you so far? well, becoming an adult. >> and also working with others. it just sort of feels like i'm making friends. i mean, with adult friends. >> one of his friends sits right next to him, joseph carter. >> i do led lights for the top desk. >> joseph is an intern now, but he's inspired by tim's story. do you like your job? >> yes. >> what do you like about it? >> working with people and friends. >> the one who saw potential both in tim and joseph is their mentor. jesse >> i gave him a set of tools. he knew what they were. he knew how to handle it. we just kind of kind of grew on that curiosity. we harnessed it. >> pleasanton adult and career education or pace for short is

an adult school within the pleasanton school district that prepares adults with disabilities for the workforce paying them to intern at different companies. in the last five years, about 56 adults with disabilities have learned key skills to find jobs in this community. and this is one of the 25 sites they work with and we give them three different work experience pieces. >> we help them get as many transferable work skills as possible so that they can get a job at the end of the nine month program that matches what they want to do. >> for example, coal right now is learning to take technical orders, but his dream is a bit different. >> become an executive chef and own my own restaurant. >> his mentor understands him. >> it feels pretty good. i actually have two stepsons that are both autistic and in their 20s. >> turns out omron is one of the first factories to hire people with disabilities over 50 years ago in japan, that factory has more than 50% of the workforce

this is very significant and we are looking forward to the relationships that occur. the financial connections that are made oftentimes is the things and the innovation that happens in san francisco. other places follow while we lead. and this is why san francisco is the perfect place to host apec. >> we are just two and a half weeks away from the asia pacific economic cooperation forum, or apec police in san francisco say there won't be mass sweeps of unhoused individuals in preparation. still, some people living on the streets near moscone center have started clearing out on their own. abc7 news reporter leanne melendez has more on where those people have relocated, where are they going? >> well, really different parts of the city, but if you've noticed, van ness has a lot of encampment outs recently. have you noticed that? yeah because to a lot of the unhoused people,

it's less chaotic than the tenderloin. and also south of market. but i will say this in december 2022, a federal judge blocked the city from clearing homeless encampments and moving the unhoused. unless the city could come up with some shelter. remember that? what people don't realize is that just recently the ninth circuit court of appeals made some clarifications and said, hold on a minute. if someone is offered shelter and they refuse, then the city can certainly ask them to move. and that has given the city more leverage. judge david martin moved to san francisco from castro valley in the east bay for one reason. >> i came here to get fentanyl, so i could cope. i mean know, do i look like a drug addict? not at all. right. that's because i only do what i need. he told us a little fentanyl helps to manage his pain in his knees and hips after being injured in a motorcycle accident. >> he's been moving around the

city most recently the van ness corridor for until today, when he was offered shelter, which he refused. so you would prefer to live out on the streets than get shelter? >> that's correct, ma'am. is it that bad? yes, it is. yes, it is. it's awful. they treat you like garbage. >> large businesses along van ness avenue complained after seeing the encampment rapidly expand and then it just kind of grew, just kind of expanded. >> and so then then it started with one tent and then it expanded to two. and three. >> but under a revised city guidance, a person will now be asked to move their tent and belongings if they decline an offer for shelter. >> we've had enough and we have clarity of what we can do and we have places for people to go. and so now they need to go. otherwise we can't just continue to walk past and let them stay on the sidewalk where other problems are being created as a result of it. the folks handling this kind of outreach are part of the city's healthy street

operation center, and they are quick to tell you their focus is not on conducting sweeps, but getting people into shelters. >> it's a lesson learned in early 2016, when san francisco hosted super bowl 50 streets that were lined with tents were cleared, followed by pro tests in support of the unhoused. just because you're poor, it doesn't mean you should not have access to housing. the city also gave outside citations for blocking the sidewalk. temporary shelters were erected, but then after super bowl 50, many of the people who were moved just returned to the streets. unhoused today, those who are given shelter can take up to two suitcases with them and they are offered storage for the rest of their belongings. gary thomas has been living on van ness avenue after moving here from sixth and market streets, just one mile from moscone center, where the city is getting ready to host the asia pacific economic cooperation summit. he
