the home where 42 year old suspect daniel garcia lives. police say garcia went to mass at saints peter and paul church late sunday afternoon in san francisco's north beach neighborhood after communion, he confronted a parishioner. >> he demanded money from that person. the parishioner continued to pray and ignored him, at which point the suspect then and violently assaulted this parishioner, punching him in the head. and we believe that the parishioner went unconscious temporarily. >> witnesses say he left the church with a knife in hand and a police pursuit began when he got in his car. police said officers felt their lives were in danger as the suspect intentionally threw two explosive devices at their patrol car. once on filbert street. and again at eighth and mission. >> the officers described not only seeing the flames of the device that hit the ground, but also the officers could feel the

when the bomb detonated, they could feel the blowback from that in their vehicles. >> ten squad cars and chp joined the chase as the suspect took off over the bay bridge. the pursuit ended in martinez. suspect daniel garcia was put into an ambulance as a bomb seeking robot probed his car and witnesses from the church arrived and he was able to look at the suspect and positively identify that he was the individual who was in the church. >> the church was swept for bombs or and was found to be safe. >> that's chilling. and i'm just really thankful that not only the officers did not get hurt, but there are innocent people. i mean, it was close to 6:00. there are still people out on the street. >> garcia is jailed in san francisco, facing three counts of attempted murder, two counts of igniting explosive devices with intent to commit murder and more than a dozen other charges. garcia was already due in court tuesday on a different domestic

violence charge in contra costa county. i'm leslie brinkly, abc seven news. >> strange story today. a natural gas leak led to a mandatory evacuation order in a richmond neighborhood. this happened about lunchtime. that order lasted for less than an hour. sky seven was over the scene of this leak at carlson boulevard near shasta street. the fire department ordered everyone in the area to leave their homes and meet at a nearby fire training depot. that order was lifted about half an hour later. you can see p-g-and-e's crews working there to cap the leak. firefighters say the danger posed by the leak was resolved quite quickly. >> new developments. it's a 15 year old is now in custody in santa clara county juvenile hall for a hit and run accident that killed a woman and her baby who was delivered after the mother died. police say they arrested the teen on saturday, four days after the fatal accident at blossom hill road and winfield boulevard in san jose. investigators say the white hyundai sedan involved in the

crash was stolen. police say there were three people in that car. there's still looking for the passengers. the woman who was killed was driving a black nissan sedan that was hit by the white car. she's been identified as 21 year old april zaghloul power. she died at the hospital shortly after the crash. her baby was delivered but died the next day. a flight from the bay area to salt lake city had to make an emergency landing in sacramento this morning. you can see the flight path on this animation from flightaware to the delta flight left san jose mineta international airport at 6 a.m, about an hour and a half into the flight. it diverted to sacramento, landing at around 7:40 a.m. delta has not confirmed why the plane had to make an emergency landing. >> the smell of bacon wrapped hot dogs sold on san francisco sidewalks is irresistible to a lot of people. but san francisco health officials are hoping to convince you to think twice with a new social media campaign questioning the safety of those street eats. abc seven news

reporter luz pena is in the newsroom. lose that it is tempting sometimes yes dan? >> well for months the san francisco public health department has been cracking down on on permitted street vendors along embarcadero. but now instead of confiscating carts, they're also starting a social media campaign to alert the public of what they say are unsanitary conditions. it's the street food that captures the attention of many tourists in san francisco. >> so we were looking forward to it, been planning it for three days, but not everyone loves these hot dogs in san francisco, the city's department of public health has effectively started an online campaign against these vendors with the hashtag don't risk it. >> citing lack of proper refrigeration access to clean water and unsanitary conditions. we went to pier 33 to speak to vendors and see it ourselves. is all fresh fresco esta comprando it's a bread i bought today.

>> yeah, we met anna escoto, who owns several food carts and showed us a box with hot dogs wrapped in bacon and a receipt of all the ingredients she bought today. >> what do you think about what the city is saying, what the health department is saying? esta diciendo el departamento de salud. >> como digo somos muchos muchos vendedores. >> many vendors, no puedo hablar por me otros companeros de trabajo. i speak for the others. for months the department of public health has been cracking down on street vendors on the san francisco port. >> it's the volume, the sheer volume of vendors that are out there. one vendor, a little bit of debris, a little bit of issue 18 vendors out there, lots of debris, lots of grease, lots of issues. >> in a statement, the public health department said they require permits for any street and sidewalk vendors to sell food in san francisco. and regarding sanitation said in part, these incidents of foodborne illness due to unpermitted vending are

difficult to track because they range from vomiting and diarrhea to salmonella and e coli for mild symptoms. the majority of people do not report it. ucsf's infectious diseases. dr. monica gandhi looked at the photos and said bacteria is breeding in there. >> if they're kept at room temperature and not cooked to at least 165 degrees, the kind of bacteria that hot dogs can breed are for salmonella, for example, which is a common type of food poisoning. >> dr. gandhi pointed to bacon, increasing the risk of foodborne illness. >> here's the thing about bacon is it doesn't have the same level of preservatives that hot dogs do. >> vendors like milka said they have never heard of anyone getting sick from their hot dogs. i would like for city workers to train them. we can learn how to manage these products to give us tips. i also asked the san francisco public health department if they have any reports of foodborne illness related to these food vendors. i was told the majority do not

report so effectively no. i also asked if anyone from the department has reached out to these vendors and we have not received a response from the department yet in the newsroom. luz pena, abc7 news. >> we will wait and see. luis, thank you. more than 3700 union nurses with santa clara county's health and hospital system are now working without a contract. members of the registered nurses professional association staged rallies outside three health facilities today, this one at o'connor hospital in san jose. the nurses are demanding better working conditions and staffing levels and better care for patients who rely on the county's public health system. they're contract expired yesterday, the county issued a statement saying, quote, we look forward to working collaboratively with our nurses to reach an agreement on a contract that reflects our mutual commitment to supporting our nursing workforce and delivering excellent care to our patients. >> now to efforts to build a better bay area antioch. businesses impacted by crime can

now get help from the city. a new $500,000 grant program will help some store owners make improvements. abc seven news reporter ryan curry spoke with some of the owners who have been impacted by crime. the chain links are the harsh reality of nisha and her family's life. >> their store is closed and fenced off. no one can go near it. >> our business is exposed. we're personally exposed as well too. we've had three burglaries over the course of the week for over 20 years. >> they've owned this convenience store. it was next to a supermarket, but that supermarket has closed and they say unhoused use the vacant store for shelter. two weeks ago, they say a fire inside caused enough damage to render the entire building, including nisha, store unsafe, forcing them to close the code. >> enforcement came in and they mentioned that the fire alarms had a code as well as the sprinkler systems. so because of that and then there's no power to any of the units. they told us, shut your doors down. your business is no longer safe to

operate. >> her store is one of many struggling in southwest antioch. the unhoused camp behind buildings, parking lots are empty, stores are boarded shut. the city is trying to change that. mayor lamar thorpe announced a new grant program where business owners can apply to get the fronts of their stores upgraded. >> go outside. right now, you can take a look at some of the businesses that are boarded up and some of the businesses that continue to exist. but they may not have enough capital to make the types of investments that we'd like to see. >> the goal is to use the money to make these storefronts nicer and in some cases safer. but what's going to stop criminals from just breaking the new storefronts after they're being built as well? mayor thorpe says it's about a collection of different measures to make the city safer. >> i would never say that one strategy is going to fix all the problems, just like i'm not going to say that a adding all these different police is going to solve the problems it has to be a collective effort of all these strategies in order to

legacy he built beyond his stardom, focusing on healing those with addiction. >> a journey perry struggled with himself for some reason. >> it's obviously because i was on friends, more people will listen to me. so i've got to take advantage of that. i've got to help as many people as i can. >> the 54 year old opened up to abc's diane sawyer last year about his addiction to alcohol and prescription pills. he admitted that at his worst, he took dozens a day. >> but i wasn't in a position to stop, you know, and that's what addiction is. >> fans leaving flowers at the friend's a new york city apartment building, and on perry's pacific palisades doorstep just feet away from where the lapd says he was discovered by his assistant, unresponsive in his jacuzzi, requesting two additional units and a supervisor respond to hill drive. >> authorities say there were no signs of foul play in perry's death, though their

investigation is ongoing. >> just last week, perry had posted this photo from his hot tub. his parents sharing how they are heartbroken by the tragic loss, adding that matthew brought so much joy to the world, both as an actor and a friend. the star once sharing how he would like to be remembered beyond his acting. >> when i die, i don't want friends to be the first thing that's mentioned. i want that to be the first thing that's mentioned. and i'm going to live the rest of my life proving that . >> an autopsy was performed on perry, but his cause of death remains unknown. while they await the toxicology results, which could take weeks. melissa don, abc news los angeles. >> happening tonight, the entire eastbound direction of the dumbarton bridge will close. crews are repaving the roadway. the closure runs from 7 p.m. to 5 a.m. every night, starting tonight through friday. the bridge will remain open in the westbound direction. all right. vta is restoring a bus route between gilroy and monterey

county. bus line 59 will offer four weekday round trips between gilroy transit center and the international transit center in salinas. the transit line was discontinued back in 2020 because of the pandemic. passengers asked vta to bring it back. >> i'm heartened to see vta partnering with yet another transit agency to ensure that residents throughout santa clara county, including gilroy, have these very, very needed mobility options. >> vta is partnering with monterey salinas transit to offer this route. >> all right. if you like your weather, perfect. we're a little worried this weekend about fire danger. and we seem to have gotten lucky. >> yeah, it's the winds have died down and it's warming up. and i think we escaped that one. >> we did. we were very fortunate because we did have the strong, gusty winds and the dangerously low relative humidity, but we didn't have any major fires. and right now we've just got mild conditions. here's a look at our live doppler seven radar and satellite showing just high pressure dominating our

weather picture right now. no weather disturbances headed our way. so let's move along. take a look at current wind, which is basically light to calm 12mph. the strongest wind we have right now and the 24 hour temperature change shows most locations about 1 or 2 degrees cooler than yesterday at this time, except oakland. the big cooldown there, five degrees cooler than this time yesterday. we are now looking at blue sky over san francisco from sutro tower. 71 degrees here in the city right now. oakland, 70, we have 72 at mountain view, mid to upper 70s at palo alto and san jose and 73 at half moon bay and the sky is also blue over the golden gate of the temperature readings right now, 77 up north at santa rosa and we have low to mid 70s at novato, napa, fairfield, concord and livermore. and here's a nice view from mount tam looking down onto the bay. just a few thin clouds off in the distance, but it's a beautifully sunny late afternoon, mostly clear with a few high clouds developing overnight, mainly sunny and warmer. the next two days, clouds will increase on friday and there's a chance of some

showers coming in on saturday. but for tonight, we'll see mainly clear skies until after midnight. then we'll see a few more high clouds passing over as we approach sunrise, begin the day with bright skies, but with some high clouds. overnight lows will be mainly in the low to mid 40s in the inland areas and upper 40s right around the bay shoreline and then highs tomorrow 72 at half moon bay, 73 here in san francisco mid 70s and many bay shoreline locations and we'll see mid 70s for the most part in our inland areas 1 or 2 locations may top out at about 78 degrees. and if you're looking forward to halloween and trick or treating tomorrow evening, well, we're going to start the evening, 6 p.m. with sunny skies and a few high clouds. but the sun will set at 612. so as we get closer to 630, it'll get darker. it'll be milder, though, with temperatures at that time in the upper 60s around the bay and inland, 7:00, of course, it'll be dark by then. we'll still have mainly clear skies into the later hours of the evening with a few high clouds around. so mid 60s at 7 p.m. of course, most of the younger trick or treaters

will probably be done by 7 p.m. as we get after 8 p.m. it starts to get a little bit cooler, a little bit chillier out there, but still a very pleasant halloween evening is coming our way as well as the daytime will be pleasant too. here's the accuweather seven day forecast. you can see high temperatures in our inland areas for the next two days, up around 78 degrees mid 70s around the bay shoreline. an upper 60s to about 70 of the coast. this is really mild weather for the end of october and then thursday marks the beginning of oh, actually wednesday is the beginning of november. that's right. so it's still warm even as november begins going later into the week, we'll see a little bit of an increase in clouds. still pretty mild going into the weekend. and don't forget, we fall back to standard time saturday night into sunday. the sun will set saturday at 6:07 p.m. but not but it'll set early on on monday, on sunday, rather at 506. >> yes. that time of year already one hour and one minute of daylight from saturday to sunday. >> easier to get up in the

the dow surged more than 500 points today. the nasdaq was up 146 and the s&p closed the day, up 49. >> all right. let's move on to consumer news. an important safety notice about eyedrops. you may have in your home right now. yeah, seven on your side's. >> michael finney is here with that important warning. and also today's other headlines. michael >> yeah, this is really, really a serious warning from the fda. 26 different brands of over-the counter eyedrops should not be purchased at or used. they carry the risk of infection that could lead to blindness. the eye drops are sold at cvs target, cardinal health and rite aid, a complete list of recalled eyedrops can be found on the fda website. the fda encourages consumers to immediately discard the possibly harmful eyedrops. last week, fda inspectors found bacteria and unsanitary conditions at the factory, producing the eye drops. no cases of blindness have been reported, but the fda says that it is monitoring. do

you remember the scheduling meltdown southwest airlines had last december for the lasted all the way into january of this year? federal regulators say the airline did not provide its customers with enough help during the fiasco. so southwest could be facing a large fine. regulators say a civil penalty is abhorrent. and after southwest canceled more than 16,000 flights and left passengers stranded without much help, the airline said it lost more than $1 million from the episode. the average fico credit score in the united states now stands at 718. not too bad. that's two points higher than it was last year. you may be asking why the increase? well, new laws were move medical collection data from credit files is a large reason for that. and fico says slowing inflation and lower unemployment also helped. now,

it can speed up cancer detection , help the environment, and it is bringing business back to san francisco in a big way. >> we've talked a lot about the pros of ai, artificial intelligence, but what about the risks? >> could it impact your privacy? president biden is signing sweeping regulations to make sure that's not the case. abc7 news reporter zach fuentes has more on biden's order today and how the bay area played a role leading up to his signing. >> i-team's over and sign that the document signed by president joe biden monday is an all new executive order on artificial intelligence. >> it's one his administration says includes the most sweeping actions to protect americans from the potential risks of ai systems. the main pillars of the executive order, safety, security, trust and protection.

the order was teased back in july in our interview with the president's director of the office of science and technology policy. >> we're working on an executive order that the president will consider to take all the actions we can under existing law within the executive branch, because we got to play our part. >> that july interview followed an announcement of ai safeguards . the biden administration got seven major tech companies to agree to the newly signed executive order was built on those guidelines. but experts say it takes things forward in a major way. >> it's the enforcement factor here because in the executive order, they talk about asking the department of justice, the human services is the commerce department. they ask them to take certain actions. >> for example, the commerce department now has to develop guidance for watermarking content that shows the public that it was made by ai. developers will have to share results of their safety tests with the federal government before it's released to the public. much of what's in the executive order has roots in conversations the president had right here in the bay area. in june, he sat down with experts and leaders in ai at a san

francisco conference. >> silicon valley, you know, the bay area is the brain of the united states when it comes to ai. so you talk to the brain first before they can do anything else. >> governor gavin newsom issued a similar state executive order in september where in a statement monday, he said in part, today's action will directly complement the executive order i signed to shape the state's use of ethical, transparent and trustworthy ai biden's executive order will be completely rolled out over a range of 90 days to a year in the south bay. zach fuentes, abc seven news. >> but this order goes beyond consumer protection as earlier today on getting answers, i talked with michael santoro, a professor at santa clara university, who says this is also about national security. >> this is the first time, i think we're seeing that the concerns about ai extend beyond just issues like privacy and issues that affect consumer, others and extends now to issues such as safety, literally from biological weaponry and nuclear

weaponry. >> that was a he adds that the executive order is an attempt by the us to catch up with europe on regulating how ai is used in private and public sectors and really how it develops and grows well, the last planned us charter flight will leave tel aviv tomorrow. >> the us state department says it's because there are no longer enough american passengers to fill the planes. abc news reporter ines de la cuetara is in jerusalem with a look at the latest in the war between israel and hamas as the war rages on between israel and hamas militants, there is some reason for celebration in israel. >> prime minister benjamin netanyahu announcing that a young female soldier who had been held hostage was freed during an israel defense forces ground operation. >> on the ground action actually creates the possibility, not the certainty, but the possibility of getting our hostages out because hamas will not do it unless they're under pressure. >> officials say private uri

it's national candy corn day. although some believe it's a perfect treat on this halloween eve, others think it's more of a trick and want nothing to do with it. the national confectioners association says 9 billion pieces of candy corn are produced each year. the classic treat has been around since the 1800s. apparently it used to be called chicken feed. oh yeah. because of its resemblance to chicken feed. >> yeah. yeah. yeah. >> with its traditional yellow, white and orange color. so i guess we'll take a little straw poll here. do you love or hate candy corn? >> i know spencer is going to say, well, it's definitely not my favorite. >> it was always too. i found it too sugary sweet. i just. i never liked it. i don't hate it. that's. that's a strong term. but i just don't really like it.

>> all right, let's switch topics from holidays to housing. is it really a bad time to buy in a new bankrate.com survey for 49% believe that, yes. yes, it is about time to buy mortgage rates are at their highest point in decades. and the combination of low supply and high demand is keeping prices pretty high. but experts say it's unlikely that things will get better anytime soon. so buying now, now might not be any worse than buying later, huh? okay michael, i'm going to you here. would you advise people to buy looking at this? >> yes, absolutely. and let me tell you why. back in the day when you got a mortgage, your rate had to drop about 2% or rates out that you could get would have to drop 2% below your current rate before it was worth getting rid of an old mortgage and getting a new one. those are all old rules. your mortgage is not set up like that anymore. more so you can buy today if you can afford these higher rates and every time it drops a half percent, even a quarter percent go get a new mortgage, just
