you're going towards the bay bridge toll plaza, it is full, definitely packed in there. but the chp has not updated the log and showing us when those metering lights came on. so we'll let you know when they turn on if they haven't already, but it looks like they have. san rafael 101, nice and clear for you. and we do have one issue popping up here on our sensors and you're starting to see a minor slowdown in the spot westbound 580 before castro valley boulevard. we have a crash involving an overturned vehicle. reggiane kumasi, thanks for being an all clear in the east bay after a wildfire engulfs a home threatening a community in contra costa county . >> many of you may have been woken up with alerts about this fire. it happened near the canyon post office, which is not far from moraga, abc7 news reporter lena howland is live in canyon with what we know right now. lena reggie the fire happened about a half mile up the road from where i am standing right now. >> i'm at the post office which is where the neighbors were told to prepare to evacuate to on foot in the middle of the night. that's because the narrow winding roads leading up to the

fire were blocked by emergency vehicles. this video of the scene was taken around 1030 last night. it shows one home destroyed after a house fire which spread into a nearby brush. according to fire officials, you can even see someone's car fully engulfed in flames as the moraga orinda fire marshal said. the fire burned between half an acre to a full acre. here's what one neighbor had to say. >> we heard an explosion and then a few minutes later, we heard fire trucks. and i went out onto the deck and we saw a house completely engulfed in flames as the fire marshal s they faced major access issues fighting this fire with very narrow roads and a limited water supply. >> maybe that's why they brought in support from cal fire. east bay regional park district and the san ramon fire protection district. we are still waiting to hear if there was any other

damage to other homes in this neighborhood. so far, no injuries. have been reported. live in canyon, lena howland, abc seven news. >> thank you, lena. in the east bay, a bike path that cuts through an upscale neighborhood, causing a big stir and a lawsuit. so thousands of cyclists were using this path that goes from the diablo neighborhood in danville to the summit of mount diablo. yesterday, a group of protesters gathered outside of us bank in danville. a man who filed a lawsuit was a part of this group. the lawsuit claims the bank recently foreclosed on the property and then a fence you can see there was installed which blocked the trail. the suit claims the easement for the trail was dedicated to mount diablo state park in 1979. so that makes it public property. but the issue is the park never formally accepted it. >> we're claiming we want the court to declare that through its actual use for the purpose for which it was dedicated, that it is in fact a public easement and therefore the bank has no right to block the public's

access over that easement. in an email to abc seven news, us bank says it is the trustee of the foreclosed property and directed questions to the loan servicer for the trust. >> such as a company named mr. cooper. the company and its lawyers did not return requests for comment. here's an interesting idea from the mayor of san jose. >> a scorecard that tracks the city's progress. and this is how it will work. the city will survey a new group of 800 residents every quarter to add information to the scorecard. by the end of the year, city officials hope to have 3000 residents surveyed, much like report cards. the system will focus on several key subjects. and we'll look at the city's progress. that includes community safety, homelessness, reduction, neighborhood cleanups and attracting jobs and housing. the mayor says the plan will be used to track other city programs in the future. i just think we need to do our best to make the scorecard level be really easily digestible for the public. mayor mehan says

realistically, san jose won't become 100% perfect, but his goal is to get the city to a much better place. >> president biden is now calling for a pause in fighting between israel and hamas to allow time to rescue more hostages and jobina. his comments come as attacks are increasing. >> yes, kumasi. president biden is calling the israel hamas crisis incredibly complicated. and a heckler confronted the president at a fundraiser yesterday in minneapolis. the president responded saying, quote, i think a pause is needed for what he says could give more time to get the get more than 200 civilian hostages taken by hamas out of gaza and the rafah at the rafah crossing. injured palestinians were among the first to enter egypt from gaza. hundreds of foreign nationals followed at least five americans were able to leave, including two aid workers. this morning, hundreds more trapped americans have been approved to cross into egypt, as president biden insists the us is focused on bringing them home.

donated $10 million to rise east. the money will go toward improving a 40 by 40 block area in east oakland in hopes to keep and bring back displace families of color. improvements include black led nonprofits and a black cultural zone and a youth development center. organizers need to raise $50 million by the end of the year to start the project. >> i'm a big fan of making sure that we work with community to have community led efforts so that we can actually come to the community with trusted messengers. the 40 blocks make up oakland's largest concentration of black residents . >> survivors of abuse are challenging the archdiocese of san francisco to sell parts of its multibillion dollar real estate portfolio to compensate victims. the archdiocese filed for bankruptcy in august, help manage hundreds of sex abuse lawsuits, according to the chronicle. uh. the survivors network of those abused by priests argues the archdiocese could sell vacant land on two of

its properties on the peninsula. snap said this could generate up to $1 billion for victims compensation. a representative for the archdiocese did not respond to the chronicle's request for comment on the group's valuation. there's a renewed effort to legalize sports gambling in california. it comes just a year after voters overwhelmingly rejected the idea. two men, rev collins and ryan tyler walz, introduced a new measure. we've learned the state's major tribes have to be involved for a deal to pass. it would be a exclusive to the state's native american tribes who could offer sports betting in person at their casinos or across the state online on using apps and sites that we would be branded with the tribes. >> branding. >> the california nation indian gaming association said not only do they not support these measures, but they weren't involved in the planning. in a statement, the association said decisions are driving the future of tribal governments should be

is looking into restrictions. live nation writes into its deals and whether those agreements restrict venues ability to work with other promoters or ticket services. a spokesperson for live nation said, quote, we participate in competitive bidding for both artists and venue deals. the skate park at un plaza in san francisco is set to open next week. rec and park is telling our news partner, the sf standard they're completing finishing touches before the opening on wednesday. they're adding ramps, platforms, ledges and chests and ping pong tables. the plans for the skate park were unveiled over the summer as a way to improve conditions at civic center because of crime, drug use and homelessness issues. the renovations will cost about $2 million. san francisco's only outdoor ice skating rink is back and while the return signals the start of the holiday season, it also means a turning point in the year for the businesses in that area. organizers are hoping locals and tourists make their way to union square to kick off the holiday shopping season. and

saints. peter and paul church sunday night. he allegedly threw multiple bombs at officers while leading them on a chase to the east bay. he was taken into custody in martinez. garcia is also dealing with a domestic violence case. he was found guilty in 2012 of detonating a bomb underneath a car of one of his then tenants. legal experts say garcia's past could weigh on any potential sentencing. >> if the person is found guilty when it comes time for sentencing, then the judge is going to consider a range of factors and there someone's criminal history can make the punishment more severe. >> da brooke jenkins says she plans to keep garcia in custody because he of the threat he poses to public safety. >> san francisco city leaders are taking a stance against license plate covers that drivers are using for sideshows. the products cover plates with a screen at just the push of a button that can be bought on amazon, on ebay, etsy and at walmart. city attorney david

hearse to promote the store, and it really brought a lot of people in. she's a great sales person now with her seasonal job over, julie says she's looking for work full time, promising to be a dependable go to employee. >> happening today, a former president donald trump's younger son, eric trump, will be testifying in new york courtroom in his father's civil fraud trial. yesterday, trump's eldest son testified that he never worked on the key documents. donald trump jr. ran the trump organization while his father was president. but the family and their company are being accused of exaggerating their wealth on financial statements to secure loans. the trumps are blaming irregularities on the organization's outside accountant, donald bender. bender testified last month that the trumps weren't always forthcoming with all the required information for financial statements. donald trump is set to testify on monday. >> the house has blocked a move to censure democratic congresswoman rashida tlaib for her criticism of israel over its

letitia james has claimed this is now the largest wage theft settlement her office has ever secured. now these drivers will be entitled to paid sick leave as well as back pay. the two bay area companies will now start to give that money back to those drivers who file claims. according to the attorney general, from 2014 to 2017, uber deducted sales taxes and black car fund fees from drivers payments. when those taxes and fees should have been paid by the passengers. lyft deducted an 11% administrative charge from drivers payments, when it also should have been paid by riders. the new york attorney general said in a statement. for years. uber and lyft systemically cheated their drivers out of hundreds of millions of dollars in pay and benefits while they worked long hours in challenging conditions. this settlement were ensure they finally get what they have rightfully earned and are owed under the law. not only will they get that back pay, but they will also now get that paid sick leave and a minimum wage increase. we reached out to uber
