the bizarre mid-flight incident that led to the arrest of a pilot aboard an alaska airlines flight headed to san francisco has now led to a lawsuit by multiple passengers. good evening. i'm karina nova. >> and i'm dan ashley. thanks for joining us. it's been nearly two weeks since that off duty pilot was accused of trying to cut engines mid-air. >> and now three passengers on that flight have filed a class action lawsuit. abc seven news reporter zach fuentes has more from one of those passengers and from an expert who says this suit is premature. >> many passengers aboard alaska

airlines flight 2059 on october 22nd are still working to process what happened. passenger paul stephen from washington was aboard the flight heading to san francisco. he says a flight attendant let passengers know something was going on. >> she says we're having an emergency. we need to take an emergency landing, though. >> passenger saw an arrest made on the plane. stephen said they didn't know specifics and it was only until the next morning when i had read on the news what actually had happened. charging documents claim that alaska pilot and pleasant hill resident joseph david emerson was off duty riding in the jump seat in the cockpit when he suddenly said, i'm not okay. authorities say he tried to pull handles that would have cut fuel to the engines. the document said he had not slept for 40 hours and had discussed using psychedelic mushrooms. the flight was diverted to portland, where he was arrested. stephen and two other passengers from san francisco are listed on the lawsuit against alaska airlines. >> the passengers experienced something quite dramatic and underlie deserve to be compensated for that. >> the lawsuit said that the plaintiffs have suffered from a variety of emotional effects

because of the incident. attorneys who filed the suit say the airline should have done more to screen the pilot before he sat in the cockpit extra seat. >> they failed in their duty here. >> in a statement sent to abc, seven alaska airlines said, we have received the complaint and are reviewing it. they go on to say that they are proud of the flight crew for keeping passengers safe for 30 some odd years. >> we have not had a problem with anybody in a jump seat and consider this, 32,000 flights a day times 12 times 30. that's a pretty impressive situation. >> abc news aviation analyst and attorney john nance said the lawsuit is premature. he said that the way pilots are screened is effective. >> i don't know what you would change it to because we don't know of any methodology of giving a psychological test to somebody stepping on an airplane or not stepping on the airplane. we just don't have that methodology. haji yes, we can test the drugs and absolutely should. and yes, we can test for alcohol, but you can't test for psychological instability if there's been no indication in the past the firm that filed the class action lawsuit said it's now heard from even more passengers and will continue to

push for accountability. >> the best case scenario is that we will plug a hole in the airline security system. >> zach fuentes, abc seven news. >> an attempt to stop a us military ship on a mission to deliver aid to israel has failed at least three demonstrators chained themselves to a ladder attached to the ship at the port of oakland as dozens of others protested at the port's entry, demanding a cease fire in gaza. abc seven's ryan curry has the latest from the port. >> a mission to deliver military supplies to israel is off to a rocky start. the naval ship left the port of oakland friday afternoon after protesters chained to the hull were finally arrested. >> the occupation has got to go demonstrate was angered by the us promise of $14.5 billion to aid in israel illegally entered the port friday morning. >> this vessel will be loaded with military weapons from the united states to go to israel. so we're here to disrupt it by 11 a.m, police arrived and some

protesters attempted to board the ship, locking themselves to a ladder where they sat for hours. >> oakland police and the coast guard circling the ship to keep everything orderly that line on the stern. >> we actually took that line and we ran it through the fence. and then we have three women who are holding on to the ladder. >> it's been almost a month since hamas militants attacked israel, killing more than 1400 people and setting off a war in gaza. the death toll is now over 9000. demonstrators in oakland want the violence to stop. >> we stand against any us aid to israel in aiding it in this genocide against the palestinian people in oakland. >> ryan curry, abc seven news. the apec summit may be an economic boom for san francisco, but it will be a traffic nightmare for commuters. >> check out all of these road closures that are coming. th include lane closures on both directions of the bay bridge, plus offramp closures on fourth and fifth streets. the closures start on tuesday, november 14th, and will continue until friday,

november 17th. >> our goal for this is to make it as low impact as possible, but obviously with the very heightened security for this event, these closures are necessary. >> chp says the off ramp from 101 to the golden gate bridge, vista point will also be closed to pedestrians, cars and cyclists during that time. but security will be highest around mosconi center. the secret service designated the apec summit a national special security event. attendees including president biden as well as heads of state from china, japan, mexico and other asian pacific countries. and san francisco will showcase three local neighborhoods, particularly during the apec convention. >> chinatown, soma and japantown are being highlighted as important cultural destinations that are safe for visitors to come to san francisco. >> our public transit is going to be working our subway to chinatown is going to be working. our businesses are going to be open. there are going to be lion dances. this is

really a moment of community pride, community celebration in a moment of rebirth to put on our best show. >> the city says chinatown will also host a series of promotional events from november 10th through the 17th. and smoke filled the air again in the north bay as firefighter in marin county take on one of the largest controlled burns they've had in decades. >> the plume of smoke from the burn could be seen for miles and it's raising concerns about air quality. tsay. >> abc7 news reporter cornell bernard is live in a smoky novato tonight with the story. cornell >> yeah. hey, dan and karina this controlled burn is still going. check it out. high on a ridge above novato and highway 101. certainly got a lot of attention today. lots of smoke considering that another burn yesterday impacted air quality. firefighters say the work needs to be done. we take fire with us as we come out instead of taking

all the heat as you go in, big flames and plumes of smoke rising from remote big rock ridge near novato, more than 50 firefighters weren't trying to put it out there, making the fire grow there. >> throwable ignitable devices. so we can get more penetration and depth for our burn. >> i think once we get the edge buttoned up, then we can start working those interior sections. >> like you were doing. >> this controlled burn operation under the command of battalion chief grant groneman to eliminate acres of dry manzanita and chaparral those fuels when they burn, they're incredibly powerful that getting in here and reintroduce the fire under controlled conditions, under the right wind of no wind or the right direction helps us burn out this hazardous fuel and minimize the threat to our communities. firefighters say this is one of the largest controlled burns. marin county has seen in decades. the goal is 130 acres, but they may end up

burning half that to produce impacts to air quality. smoke from another controlled burn on thursday impacted air quality in parts of marin and san francisco, prompting complaint from the public. firefighters admit they walk a fine line when it comes to air quality and public safety. >> i want to remind people all of the years that we've been impacted by those devastating wildfires, the air quality was so, so bad for so long. if we can get out here and do this work and have a lesser impact on our communities or no impact on our communities, we're going to be better off when it comes to summer. >> did that get your attention? >> yeah, i was leaving. i was leaving the parking lot and like, oh my gosh, i pulled over to take a photograph of it. the smoke plume had sybil mcwaters from greenbrae worried at first, but as i was looking at it, i know our firefighters are really good in this area, so i'm not concerned about it. i know they'll take care of it. >> yeah. and firefighters say with rain approaching this weekend, this is likely the last large controlled burn of the

season. the bay area air quality management district says smoke from today's burn was above the inversion layer. about 1000ft up, keeping air quality in the good to moderate range today and we're live in novato cornell bernard abc seven news. >> okay cornell thanks very much. a live look now at the north bay through our traffic camera in san rafael. conditions are looking a little clearer there this evening. abc seven news meteorologist sandhya patel is here with the forecast. sandhya. yeah >> and dan and karina, let's take a look at a live picture from our mount tam cam because we are looking at some smoke that is just kind of hovering right here. okay. so there's that layer as cornell mentioned, air district is not concerned about the air quality because down near the surface is not where that smoke is. it's in the upper parts of the atmosphere. but the wind direction has been transporting that smoke into parts of the bay area. good news is air quality has not been impacted down near the surface. we're looking at pm 2.5 levels and the good to moderate range

37, san francisco 43. san rafael , you will notice livermore 44 and as we look at a live picture from our emeryville camera, some high clouds going through good to moderate air quality is expected for the upcoming weekend and this weekend will also include some showers and atmospheric river is moving into the pacific northwest. i'll let you know what part of your weekend you might need those umbrellas coming right up. karina >> all right, sandhya, thank you. and we have new information tonight about a burglary caught on camera this week at a beloved oakland bookstore. the owner of marcus books in north oakland tells us police showed up to take a formal report around 1130 today. one day after abc7 news first reported what happened. surveillance video from sunday shows a person breaking the store's front window, then reaching in to grab four books. nothing else was taken. the owner tells us the officers who showed up today were apologetic about how long it took to show up. the owner also says marcus

on fencing or the buying and selling of stolen goods. officials say the sale of illegal goods is attracting violence to the area. sf public works employees say they've been attacked when asking vendors for permits. many of the city's

licensed street vendors are worried about making a living when that ban takes effect. for the first time in a decade, san francisco is opening up a wait list for section eight. >> low income housing more than 40,000 people have already applied to join the waiting list. that list is expected to grow to 60,000 people by the deadline, which is monday at 5 p.m, just a couple of days from now. only about 1 in 10 applicants will make the cut. a housing authority spokesperson says 1000 units are currently available and it will likely be two more years until all 6500 eligible waitlists get their turn for an affordable home. speaking of housing, there's a debate raging in san jose over what to do with the land next to the new bart station in the berryessa neighborhood. the city wants to bring thousands of housing units to the san jose flea market property, but the land's owner says thousands of units simply may not be feasible and is offering to build fewer. abc7 news south bay reporter dustin dorsey explains what this

effect could have on the community. in an attempt to bring more housing to san jose, the city council approved zoning on the berryessa flea markets land next to the new bart station to bring between 17 and 3400 housing units and millions of square feet of commercial space. >> but mayor matt mahan says the developer is trying to evoke a state law called builders remedy to actually build fewer homes. >> the entire premise of bringing mass transit out like bart into san jose is that we are going to put dense jobs and housing near transit so that we don't continue to sprawl out. and this is frankly a perversion of state law. >> builders remedy was created to get housing project approved in cities deemed by the state to not have substantially compliant housing. eric shanower is the land use consultant for the flea market ownership and says san jose has some of the lowest housing production in america and their housing plans are not always feasible to build. instead of a housing plan that includes so much unwanted office development, genauer says the owners want to build a project

with fewer units and less commercial space to allow work to get done now to help the housing crisis cities plan. >> right now, it can't be built with half the site required to be office when there's no office market. our plan would be feasible to finance and build and would yield up to 1128 units. >> this neighborhood's council representative, david cohen, says builders remedy was not intended to downsize housing projects. he believes even if it takes longer, the city should push for more units instead of less. the sacrifice, the loss of that economic engine of the flea market really requires that we maximize the value of this property and this new proposal does not maximize value. >> this property in fact, it way under values of the property. >> if the city is deemed to be compliant with housing needs, when the plans were made, builders remedy cannot be used and the city can deny the downsized plan. in san jose, dustin dorsey, abc7 news. >> well, it's official. the late rapper tupac shakur now has a

weekend starting tonight, workers will be repairing the pavement on 680 between the 580 and 680 connector and state route 84. officials say the work will make that stretch of 680 safer for drivers. all southbound lanes of that section of 680 will be closed tonight, tomorrow and sunday from 9 p.m. until 4 a.m. so be warned. >> all right. so we know traffic is not going to be good for those folks. let's see if the weather's going to be better. >> i suspect it might be pretty nice. meteorologist sandhya patel is here with the forecast. >> absolutely. it will be. dan and corina, let's take a look at those temperatures right now. it is so pleasant, mild to warm at this hour. 70 and 80, believe it or not, it was actually a little warmer today as we check out the

live views from our tower cameras, you can see plenty of sun out there. there are some high, thin, wispy clouds in that layer of smoke from mount tamme ville, all due to that prescribed burn in marin county. let's check out live doppler seven atmospheric river aimed at the pacific northwest. they're going to get soaked. several inches of rain through early next week as this system moves in. another one comes in now for us. we're going to get the tail end of that system saturday night going into sunday, which means we'll see some showers on live doppler seven right now, just some passing high clouds. a live view. look how lovely it is from our santa cruz camera. good day to be on the beach cooler this weekend. chance of some showers in the north bay tomorrow night. scattered light showers on sunday across the region and we are looking at daylight saving time ending fall back sunday morning. we lose that hour of daylight, but we do gain that hour of sleep. all right. it's the walk to end alzheimer's right here in san francisco tomorrow, 59 degrees in the morning as the walk begins at 1030. it'll be mostly cloudy, low 60s peeks of sun in

the early afternoon. reggie aqui will be there emceeing the event as he's done in years past. temperatures in the 50s first thing in the morning. a lot of cloud cover around tomorrow afternoon. you'll notice that it's mild, but but not quite as warm as today. so we'll go mid 60s to upper 70s cloud cover will be increasing throughout the day, leading to a level one system for your sunday. we are looking at scattered light showers, some slippery roadways breezy as well. rainfall will be under 1500 of an inch as we go hour by hour. the clouds thicken up tomorrow night at 9:00, we start to notice some showers moving in. really this system doesn't have a whole lot to it. so it'll be just enough to dampen some of the roadways. 630 in the morning, most of the focus is in the north bay, but a few spotty showers not out of the question. elsewhere now, 3:00 sunday afternoon, you start to notice this batch of moisture coming in. so some scattered showers continuing into the early evening hours and then late at night, just an isolated shower here and there. rainfall

estimates. this isn't something that is impressive, but just enough to add a little more moisture to the fuels and lessen our fire danger. we'll take it all year round. you know that we're dealing with potential for fire danger. so a 10th of an inch in ukiah, a few hundredths elsewhere. the accuweather seven day forecast does feature cooler weather this weekend. spotty showers with the level one sunday a chance of rain monday looking like a pretty good likelihood as also a level one. but you'll notice that we do have that clock on there so you'll want to change them back one hour. we go to standard time sunday morning and then early next week, lingering chance of showers on tuesday as well. and then we'll dry it out. but those temperatures will start to come into line with more november like weather, even below average korean indian. >> i'm hoping for some showers here soon. just we need it always, but really kind of put an end to the fire season risk. >> that would be nice. we need a good soaking to end that fire season. >> yeah, make it a level two. we'll see if we can do that.
