officer mark mcnamara face criminal charges. abc7 news reporter cornell bernard has details. >> it pretty much hurts me and it scares me to know how much hate a person can have in their heart. >> 22 year old keon green reacting to newly discovered racist texts sent by a former san jose police officer who shot him last spring outside la victoria taqueria, where green says he disarmed someone involved in a fight. >> i feel like the hero of the situation that took place on march 27th. >> officer mark mcnamara shot green as he was backing out of the restaurant with a confiscated gun in a newly surfaced text dated the day after the shooting, mcnamara wrote to fellow officers in wanted to carry a gun in the wild, wild west, not on my watch. the shooting sent green to the hospital, where he faced a long recovery, forced to take a break from his football career at contra costa college. his

attorney, adante pointer, says the racist texts are the final insult. >> these were disgusting text messages, these vile text messages and some of the texts, mcnamara said. >> i'm pretty sure the district attorney would have charged me if i used excessive force. but she didn't because i didn't use excessive force. i'll shoot you to. mcnamara said of green's legal team. they should all be bowing to me and bringing me gifts. otherwise he would have lived a life of poverty and crime. in another text writing that he hates black people. mcnamara resigned from the sfpd last week after the text surfaced. lawyers are demanding mcnamara be charged with a hate crime and be decertified as a police officer. >> for you have allowed an avowed racist cop in opportunity to go and seek employment in another community just to terrorize another person on another day. >> i never thought somebody could just have that much hatred

in their heart to where they would want to kill me just because of what i look like. >> san jose mayor matt mehan says his city has a zero tolerance for racial bias. >> we are not going to tolerate races ism. we are going to continue working hard every day to build a culture of the utmost respect and professionalism within our department. >> green says he's moving forward, hoping to achieve his dream in football. >> i'm still hoping to make it to the nfl. >> cornell bernard, abc7 news. >> fish and wildlife officers continue their search this evening for a wolf hybrid spotted twice this weekend in sonoma county. both sightings were captured on video. this is the most recent incident. the animal was seen trotting along the road along highway 12 south wright road and sebastopol early this morning yesterday. what's believed to be the same wolf, hybrid was recorded on a doorbell camera at a home a few miles away in santa rosa. >> come look at this dog.

literal literally, it looks like a wolf. >> authorities say the animal crossed paths with two people who are walking their dogs but was not aggressive towards the humans or the animals. multiple local agencies are now involved in the search. officers say if you see the animal, do not approach it. now, the latest in the israel hamas war. another israeli airstrike has hit jabalia. jabalia refugee camp in the central gaza strip. the un now says that half of the hospitals in gaza are no longer functioning. us secretary of state antony blinken met with palestinian authority president mahmoud abbas in a surprise visit to the west bank. the biden administration now says that it supports a humanitarian pause, but stopping short for calling a cease fire. >> i think everyone would welcome humanitarian pauses, there's no doubt about that.

there are obviously different views, including on the question of the cease fire. but there's no doubt from my conversations with all of our colleagues who are in amman yesterday, that everyone would welcome the humanitarian pause. >> israel's prime minister says there will be no cease fire unless all israeli hostages are released. happening tomorrow, jury selection begins for the federal trial of the man charged with attacking nancy pelosi's husband, paul, last october. surveillance video showed david depape breaking into the pelosi home and eventually striking paul in the head with a hammer. depape has been charged with federal attempted kidnaping and assault, along with a slew of charges in state court. that trial date won't be set until after the federal trial finishes . here are some of the key dates for his federal trial. jury selection begins tomorrow, november 6th. opening statements are expected thursday, november ninth. there will be no court on friday, the 10th. paul pelosi is

scheduled to testify in court on the 13th. at last check, nancy pelosi is also expected to be named as a witness. and the federal judge in this case expects the trial to last one week. all eyes will be on former president donald trump tomorrow when he takes the stand in his new york fraud trial. trump is expected to testify under oath in the case that could severely impact his real estate business empire. new york attorney general letitia james accuses the organization of falsely inflating and deflating the value of the company for better taxes and loans, as trump has continually lashed out and ridiculed the prosecutor and judge overseeing the case, calling his legal opponents racist and deranged. still ahead, help for those involved in the fight of their lives. the local agency working to make sure no one battles cancer alone. also, this is, what, 5 p.m. in the bay area will look

all is set to reopen tomorrow. caltrans expects the work to be done in time for the monday morning commute. the three mile stretch of deterior rating roadway is being repaved and crews laid new concrete just last night. and once dry,

they'll clean up and paint on the stripes. they've condensed 40 nights of work into just a weekend. this construction is just one phase of a three year project of fixing roads and adding lanes. a key part to building a better bay area is highlighting the efforts to make it happen. that includes a local center that ensures no one battles cancer alone on the latinas contra cancer center in santa clara county provides crucial bilingual and bicultural support to people facing cancer, especially in the latino community. since 2003, the center has educated more than 7500 individuals about cancer, leading to hundreds of preventative screenings and many early detections. the organization has trained more than 200 community health educators throughout california, texas and florida. abc7 news anchor stephanie sierra spoke with the organization's executive director, darcy green,

it's about five 15in the evening and it's already getting dark outside daylight saving time has ended for now and as usual, not everyone is happy about it. abc's will gantz explains why it's not curiously unpopular. >> both on the small screen daylight saving ing, not plural time has never saved us from anything and in real life, a recent poll finding 62% of americans want to eliminate changing our clocks entirely. tiktok are shining a light on how annoyingly dark our afternoons become when daylight saving time goes away. this time of the year, how much daylight could we possibly need to save? >> it's 5:16 p.m. it's pitch black outside. what the. >> are you serious? right now? >> daylight saving time was implemented 105 years ago as a way to save on energy consumption during world war one. but decades of clock clashing followed congress repealing it. president wilson vetoing the repeal because he

liked to golf. and at one point in may of 1965, the twin cities were keeping two totally different time. then in 1966, president johnson signed the uniform time act. the american medical association says all that changing of the clocks comes with potential risks. any change that affects your sleep cumulative over time can with it bring all the detrimental effects of sleep loss so that can include mood disorders, loss of focus, loss of judgment and even some long term issues such as changes in your blood pressure, your blood sugar. last year the us senate unanimously passed the sunshine protection act, which would make daylight saving time permanent, meaning more daylight in the evening hours all year long. but the act didn't pass in the house and never made it to president biden's desk. now that bill is still in congress, final limbo. >> that was abc's will ganss reporting. let's focus on the positive of the sleep was great. it was. darkness is upon us. spencer christian it certainly is.

>> the sun officially set at 507 this afternoon in case you want to know. yeah. and the days are getting shorter. here's a look at what's going on with the weather right now on live doppler seven. we've got some light rain pushing into the bay area a little bit earlier in the afternoon, santa rosa was reporting some very light showers. and you can see there widely scattered. a lot of this isn't even hitting the ground yet, but the moisture in the atmosphere is increasing. here's a view from sutro tower looking out over cloudy san francisco where right now it's 66 degrees, 67 across the bay in oakland mountain view, 68, 71. san jose 69. palo alto, 59 at half moon bay and then the post-sunset sky . as we look westward from emeryville, a nice view. it's 63 right now in santa rosa, mid 60s at novato and napa, 70 at fairfield, concord and livermore. and here is our view from the rooftop at abc7. looking across the embarcadero and check out the forecast headlines. cloudy overnight spotty showers and light rain. there'll be more rain tomorrow, more widespread. they'll produce slippery roadways for commuters in the morning and in the evening and we expect drier days

midweek and chilly mornings. the system that that's approaching us right now on the exclusive live abc7 storm impact scale is a level one storm. so for tonight and tomorrow there'll be periods of showers and light rain. less than a quarter of an inch of rainfall. most areas and of course slippery roadways. the overnight forecast animation looks like this. we'll see a little bit of a break in the shower activity just after midnight. but then later in the morning hours, by mid-morning, we'll see more widespread and even heavier rain moving through the north bay and then shifting southward late in the afternoon and evening. but winding down late tomorrow night and leaving rainfall totals generally under a quarter of an inch, but over a third of an inch in novato and yountville expected on we go to the sierra where light snow will fall from this storm system but i mean very light. maybe 1 to 2in of accumulation above 7000ft. overnight lows here in the bay area, mainly mid to upper 50s. highs tomorrow, low 60s at the coast only mid to upper 60s everywhere else and here's a look at the accuweather seven day forecast. there's a slight chance of a lingering
