the man and his attorney are calling for and what could happen next. we get a glimpse into the mind of a police officer. >> this individual police officer, attorney adante pointer is representing chaon green. green was shot by a now former san jose police officer in 2022 outside la victoria. taqueria green says he took a gun from someone who was part of a fight inside the restaurant. officer mark mcnamara shot green as he was backing out of the restaurant with the gun he took away. >> i went in there to help. i came out looking for help, seeking help from officers, people that are supposed to help me only to be shot and almost killed. >> now, text messages uncovered by a san jose police internal affairs investigation show what officer mcnamara wrote to fellow officers. the message is dated one day after the march 2022 shooting and said in wanted to carry a gun in the wild, wild

west. >> not on my watch. >> the text released by san jose police chief anthony motta friday go on to find mcnamara making even more racially charged statements, including one that says he hates black people. the city of san jose has faced a civil rights suit since the 2022 shooting. >> so much of a civil rights case depends on what the officer's state of mind was. >> legal analyst stephen clark says those messages could be used to paint a picture of the officer's state of mind. >> i think that creates a whole new view of this case on many levels, and you will see certainly for the civil rights case, that these will be the centerpiece of the case to show this officer acted differently because the person that was shot was african american. >> though officer mcnamara resigned and is no longer an lapd officer, green and pointer are calling on him to be decertified so he can never bring his racial animus to bear in the community again. as for green and pointers calls for mcnamara to face criminal charges, clark says it's not out

this case aside from paul pelosi being hurt while others have extensive knowledge of it, describing their in-depth understanding of qanon, giving attorneys a lot to discuss. and we know those discussions, ins are happening as we speak. 12 jurors and two alternates will be selected to decide the fate of david depape, the man charged with federal assault and attempted kidnaping after breaking into the home of former speaker nancy pelosi last october. and striking her husband, paul on the head with a steel hammer. today jurors were asked to answer questions on a wide range of topics, including whether they are represented by congresswoman. pelosi. if they had supported her campaigns or have ever expressed opinions about her on social media. >> this is the time for people to express their bias. this is the time for people to truthfully say how they feel, what we really fear is that people will hide those views and say they can be fair when they really can't. >> adam gassner, a 22 year veteran, federal criminal defense attorney, says this is

crucial to ensure a fair trial. but the reality is san francisco has has a wide variety of people that are for and against that family in general. several jurors admitted they could not remain impartial given the media exposure or other preconceived notions they had about the case and the former. speaker. one potential juror candidly responded to one of the questions, saying pelosi deserved harsh treatment while others said they could still remain impartial, despite expressing frustration over their stock trading, arguing the pelosis have privileges they use for financial gain. so if somebody is critical of the pelosi's, it shows a bias and they're perhaps not a good juror for this case. a public defender representing depape has argued that the extensive media attention, as well as pelosi's popularity in san francisco, will prohibit him from getting a fair trial in the city. this is why his defense team tried to move the trial to eureka. but the judge denied that request. gessner says it's too soon to tell if juror impartiality will be an issue.

>> really, san francisco is a big and diverse county. eureka, for example, where they wanted to transfer to is a small and not so diverse county. so the reality is there's a lot of san franciscans here for that i think will be fair. >> david depape pled not guilty to both federal charges of assault and attempted kidnaping. now the trial begins this thursday. we know paul pelosi himself is expected to testify next monday. and we've also learned that speaker emerita, nancy pelosi will be named as a possible witness. we'll, of course, be following this very closely. dan we're live in san francisco. stephanie sierra, abc7 news. >> yeah, stephanie obviously has has been well documented. there's an overwhelming amount of evidence against pap. what else are we expected to learn during the trial? >> well, dan, we do know a lot of evidence have been released in this trial, but the one thing we still do not know is target number one on depapes hit list.

this was revealed early on in the trial from sfpd. investigators it was when depape claimed that he had plenty of other targets on his hit list, including governor gavin newsom, actor tom hanks, as well as the president's son, hunter biden. so prosecutors have alleged that depape planned to use paul pelosi to lure to target one. and again, we don't know who that is. it's unclear if that person's identity will be revealed during this trial. >> well, we shall see. all right, stephanie sierra, thanks very much. >> well, let's get his mom was in court today to face new charges. they are connected to accusations that she organized drunken parties for her son and his friends during which some teens were sexually assaulted. and 49 year old shannon o'connor was arraigned on 20 felonies and 43 misdemeanor. they include child endangerment, sexual assault and providing alcohol to minors. the complaint says girls as young as 14 were sexually assaulted at the parties. the district attorney's office sent

look now outside and go to spencer christian to talk a little bit more about what we can expect as we start another week. spencer okay. >> dan and kristen well, you know, it was wet for some folks today and even wetter for others. let me give you a look at the rainfall totals. you can see many locations received only a few hundredths of an inch of rain from this system like oakland and san jose and redwood city. but 3000/600 of an inch of rain was measured in santa rosa and in fremont and danville. 4100. it's more than 4/10 of an inch of rain. so it has been wet in some spots and even now, as we look at live doppler seven, you can see a big gap there, a big break in the activity in the central part of the bay area. but there's a line of showers and even some thunder showers approaching the north bay coast right now. and another line of showers moving through the south bay. so here's what we can expect this evening as we look at the forecast animation. it looks like the activity in the south bay is going to wind down. but a few more isolated showers are likely to move through the north bay tonight. but by about 10:00 tonight, we expect the

young michael reading and the spectacular second birthday party. firefighters from vallejo and alameda county threw for him. michael suffered from a rare connective tissue disease and he loved fire engines, firefighters, everything that had to do with the fire department during the pandemic, michael made daily visits to his neighborhood firehouse in castro valley. sadly michael died a few months ago. today, his mom thanked the firefighters with hugs and a heartfelt gift. >> so today i am presenting them with the book. firefighter michael and the titans last spell that i'm so excited to give them. it was their love and their eulogy that they gave for michael that inspired this book. today an emotional reunion between emily and the firefighters from the alameda county fire department. >> point oh know that meant so much to them. and what a nice

engineers got together to tackle those problems using artificial intelligence. abc7 news reporter luz pena has the story. >> could i save san francisco? hundreds of engineers are hoping for that. >> they started working on this back in august. we decided to reach out to a number of organizations and shefs public sector to find problems that to find challenges that we can build tech solutions for. >> that's when accelerator sf was born, a project to identify problems in san francisco and build ai solutions over the weekend, more than 100 engineers and people with specific areas of expertise got together for a hackathon to help san francisco. >> so we really want to make sure that like this one has an impact on sf. >> during the two day hackathon, 22 projects were developed with three winners that could reshape how the city works. >> first place was 301 plus, which is an incredible tool where you can just take a photo of if your car had a break in. it takes metadata from the photo
