dense fog through about 9 a.m. it'll burn off for sunshine and temperatures again very much like yesterday were maxing out in the mid 60s so we'll have morning fog to sunshine 66 in oakland, 65 in the city 68. in san jose up to 66. in napa. let's get a check of traffic with jobina. good morning. >> good morning, drew. thank you. hi, everyone. so we are starting back here at the richmond, san rafael bridge where we are in week five of this sigalert where we have three westbound lanes closed. and you want to make sure that you do not bring any wide load vehicles onto this roadway because that is not allowed. right now. and again, the chp, no updates as to when that will all reopen. and emeryville showing you a live picture now of 8-80 headlights in the westbound direction right now beginning to pick up. it's a very different commute this morning because we are not dealing with that wet pavement. tracy, to dublin should be around 39 minutes for that ride. >> thanks for being in the south bay. san jose police are investigating a deadly crash that killed a pedestrian mian. it happened just after 930 at the intersection of chesbro avenue and blossom hill road. a

car hit the woman she was taken to the hospital with life threatening injuries and later died. police say the driver did stay on the scene and is cooperating with this investigation. this is the 45th traffic death this year in san jose in the east bay. >> oakland police are investigating after a driver crash into two parked cars and then went into a home overnight. oh this is a mess. video shows the car flipped upside down on worth street. one homeowner says she and her husband were watching tv in their living room when they heard a loud explosion outside. >> we felt something just came down really hard and i knew right. i knew right away it was our car because our car was so loud. the alarm came off and it just went on and on and on. we were looking for our car keys. we were afraid to come out. and then we saw so many people outside trying to get somebody out of this car. >> the homeowner says their house has been yellow tagged. they will still be able to stay

there, but utilities have been shut off. one person was seen in the back of an ambulance. we don't know their condition. and the cause of the crash is still under investigation. >> an if you think bridge toll prices are already too high across the bay area, listen to this. there's a plan being considered right now that would bring tolls to most bay area freeways. you do still have a chance to weigh in on this proposal though. abc7 news reporter laura martinez is looking ahead to today's next steps on what could be a big change for how we all get around driving on the freeway could cost you more than it already does. >> the metropolitan transportation commission started a two year study in 2022. it includes three proposals for charging drivers, one of which would add tolls to all lanes of many. bay area freeways. on tuesday and wednesday. the mtc is asking for public input on pricing freeway travel. >> no, i don't think so, no. >> an mtc spokesperson wants to

emphasize this is a planning exercise, not a policy proposal. all they say since the state has serious low emission targets, californians should be serious about driving less every day. >> i spent at least two hours and 20 minutes to go to work. you know, come, go to work and come back home. >> con nguyen purchased an electric vehicle, specifically for his commute from san jose to foster city. he said if the freeway tolls plan does come to fruition, hopefully drivers with evs can get a discount. >> hopefully they will be more lean in, you know, on the freeway. it'll be great for us and, you know, less, less travel, the less better, mtc says freeway congestion is jumping back to pre-covid levels. >> they're freeway pricing study aims to reduce travel times, encourage transit use and generate money for road safety improvements in 2022. mtc spokesperson john goodwin said the study will address how new fees would impact low income drivers.

>> how do you make sure that the burdens are not borne disproportionately by low income people? mtc will be holding two workshops virtually. >> bay area residents can weigh in on the trade offs between driving and taking transit. >> we're already paying so much to live here, mtc says. >> any changes wouldn't happen before 2035. in the south bay, lauren martinez, abc seven news >> today marks one month since the war between israel and hamas began and this morning we're hearing from him. we're hearing from prime minister benjamin netanyahu as he talked to abc news. >> president biden has said that it would be a mistake for israel to occupy gaza. who should govern gaza when this is over? >> those who don't want to continue the way of hamas, it certainly is not. i think israel will for an indefinite period, will have the overall security responsibility because we've seen what happens when we don't

have it. >> netanyahu also described under which conditions there would be a cease fire. >> well, there will be no cease fire. general cease fire in gaza without the release of our hostages. as far as tactical, little pauses and our here and our there, we've had them before. i suppose we'll check the circumstances in order to enable goods, humanitarian goods to come in or our hostages, individual hostages to leave. >> in the past month, at least thousand hundred people in israel have been killed in the fighting in gaza. the hamas run health ministry says at least 10,000 palestinians have died. >> should people accused of domestic violence be barred from owning a gun? that is the question going before the supreme court today and jobina this decision in could have consequences across the country. >> yes, kumasi. good morning. if the supreme court overturns the federal law that bans americans with domestic abuse, restraining orders from owning a gun, similar laws in most states

would also be invalidated. every year, judges issue thousands of those restraining orders, limiting contact between an aggressor and victim, and also blocking roughly 77,000 gun purchases through the federal background check system. but the supreme court has a decision to make after a lower court ruled the law violates the second amendment. this statute actually ends up disarming a bunch of law abiding or otherwise good people, judges often issue mutual restraining orders, which disarms both the victim and the abuser at the same time. >> we know that it's not just intimate partners murdering their their partners. >> we know that they're doing it with firearms and that these laws are preventing them from doing that. >> hundreds of gun safety and domestic violence prevention advocates are expected to rally at the supreme court today. gun rights advocates say they will be there, too, as oral arguments begin. reggie jobina, thank you. >> yesterday, california attorney general rob bonta released a report that found

death is 12 times more likely to occur in a domestic violence case if a gun is involved. bonta says people with a history of violence should not have firearms. >> violence is not an accident. it's also not inevit able. it's not something that is unpreventable. it can be prevented. >> bonta says the law barring people with domestic violence restraining orders from gun possession works since it was enacted in 1994. california saw a 61% drop in domestic violence deaths involving firearms. san francisco is gearing up for the asia pacific economic cooperation, or apec summit. it will be one of the city's biggest tests on the global stage in decades, and the security plans may test your patience. why do spread? traffic delays are expected in and out of san francisco and anywhere near moscone center all next week. so here's a sample. so you know what to prepare for. one lane will be closed in each direction on the bay bridge. and

that's for the whole conference. the fourth and fifth street off ramps will be closed until the end of the summit on the seventh. keith, you can always check this info on our website. abc seven news.com and all. there are 21 member economies participating at apec. they represent about half of all world trade in 2021. president biden and vice president kamala harris some in the us cabinet and ambassadors are all set to attend. there will also be other world leaders and we are especially highlighting chinese president xi jinping. he'll meet directly with president biden during the summit, just in time for apec. >> the giant ferris wheel from golden gate park will reopen at fisherman's wharf just one day before the official start of the conference. the parts weighing nearly half 1 million pounds were moved over the weekend. so let's take a live look right now over pier 39. our camera here, you can see the ferris wheel. it looks like it's half way up right now. city crews said it's going to be up and ready for residents and for visitors in town for apec to enjoy. the

plan. is for the wheel to stay there until 2025. that's pretty cool. wow >> i didn't realize going to be there that long. all right. 510 this morning. let's go to live doppler seven along with satellite. what we are seeing is that we have this trough that is set up across the west coast. it was responsible for the showers yesterday. you do see some action off the coast. this is going to stay away from us. it'll sink south. and what it will do today bring cooler temperatures this afternoon and it is bringing us a cooler morning as well. had some snow showers above about 7000ft over the past 24 hours around tahoe. those are dwindled as we speak this morning. look at the 24 hour temperature change. it is a lot colder compared to this time yesterday by about 10 to 18 degrees, depending on where you are this morning. the coldest areas right now, certainly the north bay where santa rosa is, 18 degrees cooler compared to this time yesterday morning outside from sutro tower, just a little bit of fog. but again, we do have dense fog across much of the north bay valleys and along

thousands to get new providers. according to the chronicle, non-renewal notices have been going out to customers of farmer's direct property and casualty insurance company, which is owned by farmers insurance group. the company attributes inflation severe weather and high reconstruction costs. most customers will be offered coverage by another company owned by farmers insurance. >> governor gavin newsom is speeding up the approval process for a major water conservation initiative. it's because of a new state law that allows the governor to cut legal red tape for certain infrastructure projects, including projects that boost the state's water supply. the site's reservoir would be built about 70 miles north of sacramento. when complete, it would hold enough water for about 3 million households per year. the total cost of the project nearly $4 billion. if approved, construction wouldn't start until at least 2025. today national irish folk music on the plane, passengers on board a delayed flight got a spur of the

that'll all be underway until about 6 a.m. >> number seven, the bay area will be hosting the 2025 nba all star weekend. nba officials and san francisco mayor london breed made that announcement yesterday. the all star game will be played at chase center and other events will be held at the oakland arena. >> it's official co-working company weewerk has filed for chapter 11 bankruptcy protection. the company saw a rapid boom after its founding in 2010. at one point, it was valued at 47 billion. it has struggled more recently, ever since the home from the work from home era took hold, the ap reports. we work now has around 777 locations in 39 countries. in september, the company announced plans to renegotiate most of its leases. >> the company behind chatgpt is joining major corporations like google or microsoft, offering to pay legal fees for some users who may face copyright infringement claims. the ceos of san francisco based openai made that announcement yesterday

during the company's first ever dev day conference. ceo sam altman says copyright shield will be available to its business tier customers, not to regular people, though the new offering comes at a time when openai is facing several lawsuits claiming it used copyrighted material to train its ai models. the company denies that. >> speaking of ai, elon musk is taking on chatgpt the social media platform has rolled out an artificial intelligence chat bot. it's called grok. musk says it loves sarcasm and will answer, quote, spicy questions rejected by other ai platforms. grok is only available to premium plus subscribers or through the x.ai website. over the weekend, hundreds of engineers in san francisco gathered to tackle problems like crime and homelessness using ai. abc7 news reporter luz pena has that could i save san francisco? >> hundreds of engineers are hoping for that. >> we started working on this

back in august. we decided to reach out to a number of organizations and public sector to find problems that to find challenges that we can build tech solutions for. >> that's when accelerator sf was born, a project to identify problems in san francisco and build ai solutions. over the weekend, more than 100 engineers and people with specific areas of expertise got together for a hackathon to help san francisco. we really want to make sure that, like this one, has an impact on us. during the two day hackathon, 22 projects were developed with three winners that could reshape how the city works. >> first place was 301 plus, which is an incredible tool where you can just take a photo of if your car had a break in. it takes metadata from the photo to say where and when automatically fills out the form for you. >> a key tool considering that there have been more than 17,000 car break-in incidents this year so far in san francisco and many go unreported. second place allowed homeowners and developers to enter an address

to check for the expansion potential or adu eligibility. third place, an ai tool to make reporting property crimes easier and more accessible. city attorney david chu was one of the judges at the hackathon. >> you had a bunch of folks who literally thought overnight of what to do and by sunday afternoon had demos that were almost ready for prime time. >> supervisor matt dorsey spoke to the group about the importance of data to accomplish real change. >> i really wanted to emphasize anything that i can do to make sure that people are connected to their government. >> the winners received a cash prize, but also connection to make these ideas a reality. >> my thought is that we should pilot some of the things that we saw that were working. hopefully on the city side, people will agree and the more we're able to innovate in different corners of city government, i think that can help. >> in san francisco. luz pena abc7 news.

give us a live report as soon as she gets there. >> oakland police are asking for your help after an outrage. s attempted robbery at a convenience store. and we have the video that shows vandals breaking into the store using a backhoe trying to claw the atm out of the building. abc7 news reporter gloria rodriguez is in the newsroom with more about the vandals unsuccessful attempt. >> a good morning, reggie. the owner of the store says this caused at least $70,000 worth of damage and the vandals still have not been caught. check out this surveillance video. so. shows a backhoe crashing through the bulletproof glass of an atm store on west grand avenue in west oakland on monday morning. the backhoe is used to eventually tear apart the atm machine out for surveillance. video shows a mass individuals first breaking into the store with a backhoe and then backing a white pickup truck to the entrance. soon they can be seen

pulling out a chain, which they then tried to connect to the damaged atm. but it appears a chain was not long enough to connect to the atm. so when they heard sirens, at least one jumped into the back of the pickup truck and then drove off without taking anything. ali abdullah, the owner of the store, talked to our j.r. stone. he chose not to show his face because of safety concerns, was born and raised in oakland. >> i'm 51 years old. i've never seen nothing like this. i think the only way you can run a business in oakland is you maybe have to. as soon as you close, you sleep in your store and stay locked and loaded with an ak 47 and just be ready because the police is not coming on time. and i'm not blaming the police. it's just not enough of them out there. >> abdullah says a clerk who was working is doing okay. when officers arrived, they could see the heavily damaged store and the backhoe was still there. but there were no signs of the vandals. abdullah says he is frustrated by the thousands of dollars worth of damage to his

store and also upset over what has happened to other businesses in oakland. he wants to know where his tax dollars are going when it comes to public safety. and of course, if you recognize guys, those vandals, you should contact police. kumasi >> thank you, gloria. more information this morning on a story that we first told you about yesterday here on abc7 morning's police in berkeley are investigating a shooting involving at least one of its officers. it happened yesterday morning at seventh and grayson streets. not too far from berkeley bowl west. an officer shot a car burglary suspect who was later taken to highland hospital. and that person later died. it's not known how many officers shot the person. now, this is the second shooting by a police officer in berkeley since september. >> i worry about theft and i worry about. anything happening >> well, no officers were injured. it's not clear if the suspect who died was armed at

the time of the shooting. >> new developments in the debate over public safety in san francisco. mayor london breed along with some city supervisor leaders, have pulled their support for a plan that would increase police staffing. in a letter, mayor breed says that she's alarmed by an amendment added earlier this month that would require a tax increase to pay for additional officers. breed says basic services like police staffing should be within the city's budget supervisors. joel engardio and rafael mandelman, along with the original writer of this legislation, supervisor matt dorsey, have all pulled their support for this bill. the measure with the amendment was approved by the rules committee yesterday. it now goes to the full board. new information in a disturbing crime in the north bay. investigators in sonoma county say they have found the head of a woman after her body was discovered decapitated last week. the victim's victim identified as 64 year old santa rosa resident elvia lopez arroyo

, the grandmother of the suspect at her head, was found in the santa rosa creek near a park walkway and brought to the coroner for examination. 23 year old luis gustavo arroyo lopez has been charged with murder and police recovered several weapons from his home. we now have breaking news in the east bay. it's happening in oakland near city hall. there's a heavy police presence on san pablo avenue near 16th street. abc7 news reporter lena howland is there. lena, what do we know so far? >> reggie right now we don't have very many very many details about what happened, but i can tell you here at san pablo and 16th street, we are seeing a very large police presence. as you can see right here behind me, we're seeing multiple oakland police cars and we are also seeing another car with all of its doors open just behind me here. let's go now to some video that was taken earlier this morning where we can see one of one of the cars with its doors

president, donald trump's daughter, ivanka, will testify tomorrow and her father's fraud trial. >> trump took the stand and attacked the judge and the attorney general of new york. jobina has more on that testimony. and the judge's response. >> reggie, former president trump's five hours of testimony was full of emotions. many of his insults and aggravation were directed at judge arthur and goran. trump said the judge, quote, always rules against me. this is a very unfair trial, end quote. the judge threatened to throw trump out of court and yelled at his attorneys to control their client. judge goran has already determined trump defrauded banks by overvaluing his assets and inflating his net worth to get better rates on bank loans and insurance. trump also claimed that when factoring in the trump brand, his net worth is more than what's on paper now, because it's a scam. >> and this is a case that should have never been brought. and it's a case that now should be dismissed, he rambled.

suspect, david depape, tried to move the trial to eureka, but the judge denied that request. depape has pleaded not guilty to federally attempted kidnap and assault charges. the trial starts thursday. paul pelosi is set to testify on monday. >> a los gatos mom faces new charges connected to accusations she organized drunken parties for her son and his friends, during which some teens were sexually assaulted. 49 year old shannon o'connor was arraigned yesterday on 20 felonies and 43 misdemeanors. they include child endangerment, sexual assault and providing alcohol to minors. the complaint says girls as young as 14 were sexually assaulted at the parties. the da's office sent the case to a grand jury to avoid preliminary hearings that they say would retraumatize the victim, raise their anxiety, understandably ramps up as they get prepared to testify and relive what the defendant did to them. o'connor could face more than 30 years in prison if

and we are dry. but now now we have another issue. it is fog. we've been ebbing and flowing when it comes to our visibility. now, half moon bay down to zero miles. that's as bad as it gets. that is thick fog this morning. the valleys of the north bay also seeing some low visibility anywhere from about a quarter to a half a mile. that's as low as it is right now in novato, napa, santa rosa and petaluma. this will linger here until about 9 a.m. this morning. then we'll start to see that sunshine burn it off and we'll have a nice afternoon on the way. temperatures mainly in the 60. so morning fog to sun. that's the call for your tuesday. we're dry today. 65 in the city, 66 in napa, the same in oakland, up to 68. in san jose, 67 in concord. fog right now in half moon bay. but we will get sunshine even along the coast this afternoon hitting about 60 for a daytime high there. now overnight tonight we'll have clear skies gets even colder tonight. 30s and our coldest spots lots of 40s on the board as we head into wednesday. but wednesday is a nice looking day. thursday's drive up by friday, we'll reintroduce a chance of some wet weather. the reason why future
