concerns of so many riders now from abc7 live breaking news and that breaking news is with bart. >> red, yellow, green, blue line service all being delayed in both directions at the embarcadero station because there is someone in the transbay tube police are trying to get the person out of there. so train service can resume. bart is advising commuters to seek another form of transportation to get across the bay. this is video taken at the embarcadere station in san francisco where you can see a large crowd of people all being delayed tonight because someone is walking in the transbay tube. we'll keep you updated on that. but in the meantime, good evening. thank you for joining us. i'm dan ashley. >> and i'm karina nova. now to our other top story tonight, there is a race to extend the cease fire in the middle east as more hostages were released today is technically the final day of the truce between israel and hamas. and negotiators are trying to extend it possibly by several days. one of the hostages released today is a woman who holds dual israeli

american citizenship and the fbi thinks nine us citizens are still being held. israel says it is going to resume its bombardment once the cease fire ends, saying it's troops have already been attacked. >> when hamas stops giving back hostages, we will resume military pressure in order to bring them all home. >> 16 hostages were released today, bringing the total to more than 100. now israeli officials believe more than 150 people are still being held hostage in gaza by various militant groups. >> and one local man is breathing a sigh of relief. that's after two of his relatives held hostage by hamas were released. >> abc seven news reporter tara campbell spoke with him today and she's here with the story. i can't imagine his relief. yeah >> well, dan and karina, i first met oren rubenstein a few weeks ago and have been following his story ever since. he's been advocating for the release of three of his family members held hostage by hamas. and last week, he actually traveled to israel.

today, i caught up with him from tel aviv as the world watches from afar, one bay area man is in israel and is bearing witness to the homecoming kings with two of his family members released by hamas. it's like getting finding out you win the lottery. >> i mean, it's just an amazing thought. >> we first met oren rubenstein a few weeks ago putting up posters of the then 200 plus hostages being held by hamas. the pacifica resident pleading for their return. >> three of my first cousins have been have been kidnaped. my cousin alan, his wife sherry, and their 18 year old daughter. >> and last saturday, he found out sherry and noga were set to be freed and they didn't even know they were going to be released. >> they were just taken out of this cave that they were in this tunnel. >> and the family is choosing not to share images of the reunion and only a few details of their captivity. >> and then, you know, we found out like, you know, sherry was by herself alone in the dark for two weeks, and they haven't even

had one shower. and they, you know, minimal all food on the ground. i mean, yeah, it's torture. >> the freed hostages just now learning of all that was lost on october seventh, including loved ones killed in the hamas attack. >> they've lost everything. every single thing. can you imagine their home is gone. all their possessions are gone. they're not even coming home with their own clothes. >> rubenstein is relieved. they're doing physically fine and will soon be moved from the hospital to temporary housing in tel aviv. in israel, prepared for 240 hostages to be released. >> and they have houses and, you know, facilities and doctors. >> and he says with each passing day, they're getting a bit better where they're surrounded by love. >> they're surrounded by people who are supporting them. they're surrounded by an entire country that's behind them. >> and as far as the third family member goes, reuben stein says they're not giving up. >> i think you have to hold out hope and really believe that

>> as alameda county district attorney pamela price closes out her first year in office, she's highlighting the work around victims and survivors. she says after taking office, she conducted a full audit of victim services and they conducted an audit by interviewing every member of that division personally, individually, she says, that uncovered a department that was understaffed, under-resourced, with unpaid bills and a backlog of services, which meant victims weren't getting help. >> we also clear the backlog, meaning that we processed 792 bills and. 408 applications. >> da price says she initiated programs to assist survivors of human trafficking, more advocacy around helping children in creating the first ever victims advisory commission to the da's office to provide a level of public accountability and think about how can we continue to build an even more robust and equitable service delivery structure for people harmed in the county.

get because it is all good for the bay area. let's take a look at a live picture right now from our pier 39 camera where it is just a pretty view as we look towards the ferris wheel there. we did have some rain come through here between last night and this morning. and there were some brief downpours as we had expected. now that all added up some of the wettest spots picking up 6/10 of an inch in kentfield, just under a half an inch in san francisco, oakland, about a quarter of an inch, six hundredths in san jose, 2000/200 in concord. and 2000/600 of an inch in half moon bay. so let's go hour by hour for tomorrow. there will be some spotty showers that pop up at noontime. it's around mendocino county and then you will notice just a couple of showers passing through here at 4:00 pm as a disturbance comes through. this trend continues into the evening hours. and there's another opportunity for seeing some stray showers. i'll be back with a look at that forecast. plus your weekend coming right up. karina all right, sandhya, thank you. and we learned today chevron is in trouble for the

flaring event on monday at its richmond refinery. three the bay area air quality district says it issued four violations and there could be more. chevron says a partial power outage caused the flaring. this generated numerous complaints and reports of flames and smoke coming from the refinery and in martinez, residents have filed a lawsuit against another refinery they claim the martinez refining company did not properly warn them about the flaring incident that happened last year or the coke dust release we reported this past summer. >> abc7 news reporter ryan curry spoke with one resident named in the suit martinez residents have had enough. >> they claim the martinez refining company is risking their safety. makes me feel like they might be hiding something and it's definitely not good for us, whatever it is. alina cruz spoke to me on the phone while in between doctor's appointments. she and another resident filed a lawsuit this week demanding the refinery be more transparent. >> and it seems like there's

these problems and these issues. they're not really telling us exactly what the problem is and why it's happening and what they're doing to correct it. >> the lawsuit highlights two recent incidents, a flaring on thanksgiving day last year were 20 tons of toxic powder were released. and in july, the refinery admitted coke dust so thick it blanketed cars nearby and they didn't let the people know immediately what was going on. >> they didn't take action to stop it. and you know, the people are sort of saying, what's going on? what can we do? the lawsuit claims pbf energy, which owns the refinery, was negligent, ignoring their duty to immediately alert regulators to keep the community safe. >> it says lab tests show the flaring released magnesium, sulfur, nickel and other harmful components. the suit claims the dust from this summer also landed in people's gardens. contaminate eating the soil before they even knew what had happened. >> you know, if there had been notice immediately as it was happening, maybe even just the day after that could have been

committed to building a better bay area that involves finding solutions to issues and answers to questions about the community. and today we're following up on a story that we've been tracking that new bike lane in san francisco's mission district. it was supposed to make things safer for cyclists, as you may recall, but many say it is literally killing businesses along valencia street. the bike lane runs from 15th to 23rd streets. and today those businesses got even more bad news. the city's official update on how it's been working has been postponed until next year. so we sent abc7 news reporter luz pena to do our own check in. >> a month ago we introduced you to iyad and rafiq, two business owners on valencia street who've been struggling to survive and they blame the center bike lane for the decline in business. we caught up with them today. we chatted a month ago. what's happening today? >> today as of today, i decided to close today. just today? not permanently. no reservations whatsoever for zero business. so

i'd rather close today than having to pay staff off at a loss. >> how are things going now? horrible >> feel really, really bad. business is keep going down and customers keep complaining about the bike lane. >> yard is falling behind on personal bills to be able to pay his staff. >> we're really struggling right now. we're paying our pockets. >> the valencia street bike lane was approved in april of this year as a 12 month pilot program leading to the removal of 70 parking spots that a lack of parking is what some say is killing their business. sfmta was expected to release an evaluation of the bike lane by the end of this year, but last week the director announced we'll continue to make small adjustments while we do our larger and more formal evaluation that will be coming to you with in early 2024 and said that is my director's report. >> we followed up with sfmta and

over email they said the data gathering started later than anticipated. >> so we'll have to start early 2024 in order to have three months of reliable data. it's been seven months and sustainable transportation advocate luke bornheimer says even cyclists at this point are reporting the need for a new design. >> when all the signs are very clear that this bikeway design is not working, it's bad for safety. >> i mean, people are sandwiched between driving cars and trucks. we see the condition of some of these plastic posts here. most of them have been hit, run over or destroyed. >> the latest survey by the valencia street merchants association found that almost 64% of people hate the bike lane and two said they loved it. >> i think i lost about 20% of revenue due to parking. >> in the meantime, these business owners are protesting the bike lane with these posters on their windows while keeping their doors open as long as they can. >> every week, a restaurant shut down, a business shuts down here it is. this week, ahmad osbahr

some live pictures tonight. it's nice to see quiet conditions from all of our tower cameras. no matter which direction you look, it's pretty views from all of them. now, we do have another disturbance heading our way. it's a northwesterly wind flow that is going to be picking up. right now, it is pretty light, as you will see from the current surface winds. i mean, we're talking eight miles an hour in san francisco out of the northeast, but that all changes come tomorrow. so as the winds really start to pick up and they will get gusty, especially near the coast where we are expecting wind gusts over 30 miles an hour, heading into the afternoon hours. so as we look at that hourly forecast, you know what you can expect if you have a windbreaker, it'll come in handy. might be a good day to fly a kite. let me show you what you can expect over the next couple of days. first on live doppler seven, mainly clear conditions as that will all be changing as we head towards tomorrow morning. 40s and 50s on your temperatures. it will get chilly overnight tonight from our east bay hills camera. a

lovely view as we look back towards san francisco. chilly overnight areas of morning fog, spotty showers the next few days and we are expecting a milder weather pattern next week in case it's too cold for you. so while you're sleeping, the clouds increase. tomorrow morning, we will have some patches of fog, but certainly a lot of cloud cover, a few sprinkles showing up as we head towards the afternoon. this is when we'll have our first opportunity for some north bay showers at 2 p.m, 4:00 pm. pretty much spotty across the central portion of our viewing area. and as we head towards 8 p.m, another round of a few showers trying to come through here friday. we have another opportunity at 3:00 in the afternoon. so you see what i'm where i'm going here. it's not going to be a wet day all day and it's not going to be raining everywhere. it's just going to be either isolated or spotty around the region. a better opportunity tomorrow than friday. now, rainfall totals through friday night about a 10th of an inch in the wettest spots, but some areas will not measure any rain at all. your morning temperatures will be in the 30s to 50s. we will see a

cruise. the company has faced turmoil ever since a self-driving car dragged a pedestrian who'd been hit by another car. this happened in san francisco. the dmv, in fact, pulled the company's operating permit after that incident, which was in october. earlier this month, cruise's ceo and his co-founder resigned. cruise employs about 3800 people. the majority of those work here in the bay area. >> artificial intelligence is already rapidly transforming companies, and now it's being incorporated more and more into the lesson plans of students.

at the top of the hour. the commute home on bart disrupted because of reports of a person on the tracks. transbay service was suspended just after 5 p.m. and passengers are being urged to find alternative ways to travel. train cars are running within san francisco in the east bay, but with signal delays. but the big impact, there is no service between the embarcadero and west oakland stations. sky seven captured the scene at west oakland where passengers were offloaded and the trains turned back around. ac transit transbay busses and the ferry are alternatives and we will bring you more as we learn of developments. just got on the car and just smashed the whole window in the back. >> now to a major story we're following here tonight in the south bay. a dog and driver are recovering after a road rage incident nearly blinded the

animal and it was all captured on camera. the attack has police issuing a warning now to all bay area drivers. each one of us, abc seven news south bay reporter zach fuentes has the story. >> this is bambi, a maltipoo who's more than a year old. he's recovering after being nearly blinded in a road rage incident. >> it's still like left him, like, very like disabled in a way. >> san jose police say it happened on november 11th in the area of capital expressway and tully road. a driver in the area shot this video. two people were already outside of the silver bmw. they were driving in confronting the driver of the car. bambi was in shortly after another driver jumped out of a different car, walked over and jumped on the back window, smashing it. >> the windows are shattered all over the back seat, all over the front seat. >> glass covered bambi's body and got into his eyes. james was with him and did not want to show his face on camera out of fear. he says he believes the drivers were mad at him for not driving past the speed limit. >> he started like waving like middle fingers and like hand signs, and i kind of just roll

down the window. i asked him like, hey, what's up? is there something wrong? did i do something wrong to you? and i guess he got really, like, agitated and mad with that. >> james tried driving away, but says that the car followed him. things got violent when they came to a stop. >> first person who was following me got out of his car with his friend, started punching me through the window. >> shortly after is when the person in the other car smashed the window. james says he didn't know any of the suspects prior to the incident. san jose police say the people in the two cars that approached james are all connected. the suspect who jumped on the back window was arrested and faces felony vandalism, battery and animal abuse really jeopardize not only the driver, the occupants and the dogs, but the people around them. san jose pd tells us they don't track road rage incidents, but our abc7 data team did analyze chp numbers of crashes involving some of the common factors leading to road rage incidents. factors like unsafe speed following too closely and unsafe lane changes were tracked , unsafe speed led, the factors trending up this year after a low in 2020. police say if you find yourself in a potential road rage incident, don't engage. >> i think it's important to

always take a step back. i'm not saying that road rage is justifiable, but you never know where someone is coming from with that said, everyone is responsible for following the rules of the road police say the suspect who was arrested, the one who jumped on the window and smashed it, is the primary suspect. >> but they are working to identify the other two who were in the second car in san jose, zach fuentes, abc seven news. >> authorities are saying little so far about a fatal accident near livermore. now today, alameda county sheriff's deputies discovered a pickup truck about 300ft down an embankment off tesla road. firefighters had to use ropes to make it to the truck. they found a person inside, but no word yet on their identity. >> a man is now charged in the crash that killed a cycling champion in san francisco's presidio. the suspect, arnol , faces a number of federal charges for the april collision, including driving under the influence of alcohol. it's not clear if he is in custody. ethan boys died after he was struck while riding on arguello boulevard. now, the reason this

is a federal case, not a state case, is because the park is owned by the federal government. >> the children of a man from oakland will get $7 million following his death at the santa rita jail. maurice monk was arrested in 2021 for refusing to get off a bus as he couldn't afford bail, so he spent over a month in jail. his family says monk struggled with mental health issues and may not have been given his medication. under the settlement, the alameda county sheriff's office is also required to change the way it monitors and respond to prisoners during observation checks. today san francisco supervisors are pointing fingers at each other over the future of a police staffing measure supervisors voted 6 to 5 yesterday to give voters the final say on whether or not the plan moves forward. the measure's original author supervisor matt dorsey, claims it was and is now a tax hike scheme. supervisor ahsha safai,

>> the chief medical examiner has recorded 692 accidental overdose deaths so far this year. the majority caused by fentanyl and to combat crisis. the city set aside nearly $600 million for behavioral health services in the past fiscal year. money going towards everything from more treatment beds to the street crisis team. the city is also working to get life saving naloxone spray or narcan, into more hands, doling out more than 70,000 doses so far this year. >> hey, we're going to give you some narcan. hello. hello >> hello. and just a block away from city hall, a sheriff's deputy reverses an overdose. >> can i give you this? >> and back in the tenderloin, another life is saved. it's exactly why a group of active ists set up this pop up safe consumption site earlier this year. what we're doing today is that we're showing how simple it can be to save lives. >> we're not putting anyone at risk, including ourselves. >> richards fighting addiction
