ago, we saw smoke billowing from this building earlier this morning. there were flames that were still being seen. and though some work is able to be done from afar, firefighter was still and investigators still can't do much more until this building is demolished. something like you said, can't happen for weeks to come. the worst in the christmas morning fire at this los altos strip mall is over. but more than 24 hours later, flames and smoke could still be seen inside the building. once home to at least ten businesses, i can't imagine what they're going through. >> it's just been a christmas and, um, they're all hard working and i feel terrible for them. >> larry chu and his family have owned chef chu's restaurant for 53 years. they got the call early christmas morning that there was a fire near where the restaurant was located. >> just jumped out just in our pajamas, ready to find out what's going on, chu was relieved to see that their restaurant was fine, but heartbroken to see that the neighboring businesses he knows personally lost everything. we're close. you know, we since the pandemic, you know, we've gone through a lot all these small businesses and we've been

really supportive of each other. >> one of those businesses is lady m cake boutique. we found manager juan delgado and some staff carrying out what they could from their building, though somewhat separated from the main strip mall, it does share a wall. they're like charred. >> the buildings next door. ours somehow is it's still white. everything in there is still completely fine, though there were no injuries in the fire. >> the main building now redtagged is a loss. >> we are going to go through the demolition process for the building. >> fire officials say the full investigation into the cause of the fire can't even start until the demolition. >> we need to demo, remove basically the second story and the first story. um, and then we can once that's removed, it'll be safe for us to go in, though relatively unscathed by the fire lady. >> um, cake boutiques attached to the building leaves its fate uncertain. >> they do have one wall that's shared and so our concern is we're not going to know if how damaged that wall is until we do the demo. our goal and the city's goal is to keep that intact act. um, but we won't

know until we go through the demo process. >> despite uncertainties, delgado says he's grateful that friends and business neighbors were not injured. >> i do know that some of the residents in los altos that have businesses here, they stay there too. overnight so, um, 14 nobody was here. >> so again, the demolition process might be 2 to 3 weeks away. in the meantime, the part of the road, el camino real, that's closest to the building is going to stay closed. that's about a block wide, and it's the eastbound lanes of the road that are going to stay closed until that demolition process can begin. while there are still concerns over the potential collapse of this building right now, live in los altos. zach fuentes abc seven news. >> all right, zach, thanks very much. contra costa county officials held a surprise inspection this afternoon at a martinez refinery that's had several flaring incidents this month that we've reported members of the contra costa health department went into the martinez refining company to look at maintenance records and review staff training and procedures. health department officials say they are concerned about the frequency of flaring incidents at the refinery, which

tomorrow. so it's a level one on our storm impact scale. scattered showers, some isolated downpours and gusty southerly winds. so it will be returned to some slick roadways and it will impact your morning commute for the north bay and your evening commute for the south bay. but this moves out of here. we have another advisory or coastal flood advisory to pass along to you for your wednesday. with that high surf and a high surf warning. so we're getting into a pretty strong system that's going to bring dangerous conditions along the coast. for your thursday. but this is the weaker system. we're going to talk about a stronger system in time for the weekend. but the big question is does it move out of here for new year's eve and new year's day? i'll be back with the answers coming up. dan okay, lisa. >> thanks. at the airports, the post-christmas travel rush is underway. although the busiest day isn't expected until later this week. here's a live look at san francisco international. there have been about 90 flights delayed there, but otherwise it's been fairly smooth. that is not the case in other parts of the country. here's abc news

reporter reena roy. >> heavy snow pummeling parts of america's heartland and authorities shutting down a portion of this highway near elizabeth, colorado. the area under a blizzard warning until wednesday morning and from denver to the kansas border, i-70 eastbound closed for a time, drivers being diverted off the interstate. people trying to navigate the slick, snow covered roads similar scenes in nebraska were drivers have been facing whiteout conditions. parts of i-80 closed after a big pile up the dangerous weather right in the middle of the holiday travel rush. the same system now heading east. many are already dealing with dense fog in new york and boston, haunting morning fog also delaying some passengers in manchester, new hampshire. >> and i got another text on the way to the airport. my flight on december 26th from manchester now departs at 1107, but now i think it's actually delayed even more. >> meanwhile, in atlanta, some passengers tell us they waited

over an hour and a half in the security line. >> i think we're in a way, probably twice as long as our flight. our flight is two hours, but we are already an hour and a half in. >> this is how long we've been standing in line. >> and we're still in the overflow area. yeah but overall, things have been pretty smooth so far. >> delays in cancellations, limited and this holiday travel season keeps breaking records. the tsa says on friday alone, it screened 2.7 million passengers. reena roy, abc news, new york. >> respiratory illnesses are on the rise in 23 states across the country, with many reporting high or very high infection rates. respiratory illnesses can be defined as really anything tied to respiratory disease. things like the flu, covid, rsv or the common cold. the cdc is reporting over a 200% increase in cases of the flu and a 50% increase in covid rates. data shows that only 18% of the population decided to get a covid shot this year. in the east bay, oakland police are

looking into a liquor store robbery that happened in the middle of the night, when a car came crashing through the front entrance. >> a group of guys came in and broke into. they slammed the door with their van. they got inside. obviously. they grabbed a lot of liquors, secrets. the money we have in the registers, this one is our third time in less than two months. >> third time in less than two months. the robbery took place about 3 a.m. at the intersection of college and taft avenues. the owner of the store says he suspects it's the same individuals who robbed the store in the past. oakland police arrived within ten minutes of the alarm, sounding. however, the owner added that the thieves were able to smash and grab everything in less than five minutes. >> anti-semitic incidents at two los altos schools this month are shining a light on an undercurrent of fear in jewish communities, prompting some to hide their heritage. but it's not just in that city as abc seven's dustin dorsey reports, a new survey shows how widespread that fear is across the bay area

. >> the hateful graffiti in san francisco, oakland's largest menorah, smashed anti-semitic incidents are on the rise, and members of the jewish community do not feel safe. but it's not just a big city problem in los altos. >> i have never been more proud to be jewish. i've never been more vulnerable to be jewish, though at the same time, this jewish resident of los altos who wished to remain anonymous, says this fear is sadly not something new for her community. >> she and her family are trying to maintain pride in their heritage, but she knows many others who are fearful. as israel continues its military campaign in gaza. in retribution for the october 7th attack by hamas militants. >> i know so many people who have taken great efforts to maybe not speak hebrew in public , taking down their mezuzah, which is a clear indication that that is a jewish household wearing jewish jewelry to identify themselves. >> similar messages have flooded los altos council member pete daley's office, including concern for the safety of children. after at least two anti-semitic incidents took place at local middle schools,

swastikas were drawn on lockers at one school and students yelled jews must die in another. according to daley, who we spoke with on the phone tuesday, you can just sense it when you're talking to them, how scared they are and how much they question society and leadership and values around them, and wonder whether they're in the right place, a safe place to raise their families. the struggles of the jewish community here in los altos represent a micro chasm of a bigger issue. anti-semitism is felt throughout the bay area and beyond. we're seeing a big spike in reports jewish community relations council of the bay area ceo tyler gregory says his organization is hearing about anti-semitism by community members daily. a recent report by the jcrc shows about 61% of bay area jewish residents feel less safe living daily lives since october 7th, and 36% say they have experienced anti-semitism personally, gregory says more needs to be done to educate americans and stop hate before it grows. >> we want to make sure that in the same way that acts of racism

and sexism and homophobia are addressed by institutions, so too should anti-jewish, you know, hate be addressed in the same way from different types of leaders, in the hopes that everyone can live peacefully without fear, in their community in the south bay, dustin dorsey, abc seven news. >> rabbi ye, formerly known as kanye west, posted a statement on instagram apologizing to the jewish community for his anti-semitic remarks. the post was written in hebrew, but ye wrote that he deeply regrets any pain it may have caused. ye also added that he is learning from his experience and hopes to engage with greater sensitivity and understanding. the apology comes more than a year after he posted that he would go death con three on jewish people. >> the village project hosted their 17th annual kwanzaa celebration today at san francisco city hall. today's free event kicked off at noon to celebrate day one of the seven day holiday. family and friends enjoyed a day of live blues and jazz performers, dance speakers

expert with the us geological survey. she found that the west napa fault actually stretches nine miles further north than previously known. that fault produced a 6.0 quake in 2014, killing one person and injuring 200 others. this new information finds that if the 37 mile fault ruptures in its entirety, it could produce a 7.0 magnitude quake. the west napa fault is not in active or as active as well-known san andreas or the

hayward faults. experts do believe that the impacts of a magnitude seven quake on the west napa fault would be similar to the loma prieta quake in the east bay today. >> it was opening day at golden gate fields, and while it's just the start of the racing season, it is also the last opening day for the racetrack. abc seven news reporter anser hassan talked with people about what today means ahead of the track's planned closure for good in june . >> it's opening day of the winter spring season at golden gate fields and likely the last doesn't make me feel good, you know, i've been there my first year in california. >> i started in washington and my first year in northern california was in 1977. >> ed mosher has raced at golden gate fields every year since. he recalls the first time he drove past the racetrack on highway 80. >> i saw it, i thought it was like a biggest place in the world, and i thought how it was the coolest thing in the world, and i was uh, you know, just sad

that they're not going to be there anymore. >> with the closure of bay meadows racetrack in 2008, golden gate fields has been the only major thoroughbred racetrack in northern california . it held its first meet in 1941. in july, the owners announced they were closing, tentatively set for june of 2024. >> i've been there maybe a handful, 4 or 5 times and had some good times there, you know, betting on horses and eating nachos and cheap hot dogs, apollo pastor ing says he never won big up the races. >> but as the racetrack has been an east bay landmark for decades , it will be odd to see it not there anymore. >> driving by so i've had i've had good times there though, and our friends have had some fun, fun times there on, you know, sunday activity. >> the current owners say they're moving races to santa anita to consolidate operations, but there have also been protests over animal cruelty, demanding that the racetrack be closed. 17 horses have died at golden gate fields this year, most adds the track is also losing money.

we have a lot of energy in the pacific. you see that system curling around? that is a very dynamic and energetic area of low pressure that will bring bringing in a high surf. warning for your thursday with 20 to 30 foot waves breaking along the coast here. so some very dangerous conditions. so it's going to bring the waves and it's going to bring some wind and rain to the bay area. kind of a murky looking view isn't it. for 57 the sunset san francisco 5655. in oakland you can see 61 in san jose. and another view from our sutro tower camera. lots of clouds stacked up. the winds are calm. it's been kind of a chilly day out there. 56 santa rosa. napa is at 56 with low 50s in livermore. so our highlights chilly overnight dry conditions. we will wake up to some morning rain in the north bay, spreading across the east bay of the peninsula and the south bay throughout the day. on wednesday , and then getting into that high surf warning on thursday.

the coastal flood advisory beach hazard statement. so dangerous conditions at the coast for the next couple of days in anticipation of that area of low pressure heading to the north of us 54 in oakland overnight. notice how mild the temperatures are. those southerly winds out ahead of the front, keeping temperatures up overnight for a change. so we are dry through the overnight hours, stopping this at 9:00 on wednesday. so pretty much escaping a rainy morning commute. but look what happens by about 230. we've got lightrillionain all across the bay area moves on out just in time for the evening commute in the south bay. unfortunately for wednesday, we're dry thursday and we'll look at some light rainfall totals for most of us throughout the day tomorrow. but the north bay picking up the most anywhere from about 2/10 to a half inch santa rosa, but look at the amounts less than a 10th of an inch of the peninsula, and you can see livermore just over a 10th of an inch. i wish i had better news for the sierra nevada snow. not likely. this is another warmer system with only about a couple of inches

expected in the mountains. it is going to bring the winds. so as we get into your wednesday overnight, tuesday into wednesday morning, the winds begin to pick up right along the coast and look how gusty they are accompanying the rain with 30 to 40 mile an hour winds along the coast. remember we have the high surf advisory, so a sloppy day for your wednesday with upper 50s to low 60s. it's a little bit on the milder side simply because we've got those south winds ahead of it. so it's not a cold system. an early look at our new year's weekend and new year's day forecast calls for a little bit of morning rain on saturday that will be ending a level one system. we're dry for new year's eve, and then we get into another dry day, new year's day, which is some good news. we're not talking bright sunshine. we're talking more cloud cover because it looks like more rain is going to arrive tuesday after the first day of 2024. so we are back into it. and boy do we need it still falling behind in our where we should be for this time of year.

factory in israel. the tech giant and the israeli government announced the plans to move forward with construction of this facility in kiryat gat, about 16 miles northeast of gaza. intel, which already employs more than 11,000 people in israel, has decided to move forward with this deal despite the conflict between israel and hamas. the factory is expected to begin operations in 2028. >> now to the latest about the violence in the area. last night, the u.s. military carried out three air strikes against hezbollah. in iraq. president biden ordered the attacks after three u.s. service members were injured in northern iraq by drones sent by the iranian backed military group us central command says the airstrikes likely killed a number of kata'ib hezbollah militants. but the iraqi government refutes that claim, saying there were also a number of civilian casualties. >> and this comes as we learn that a cease fire proposal from egypt has been rejected now by hamas and the islamic jihad. the

of people was leaked onto the dark web. the i-team was the first to report the city's oversight, exposing dozens of victims that were never notified that their sensitive financial information was exposed. >> it's really terrible. and tonight we're learning what's happened. since i-team reporter stephanie sierra has been tracking really every development of this story. she's here with new details on what's going on. stephanie. >> that's right. we've been following this for nearly a year now. the aftermath of this hack started with one oversight after another, and the city even admits they were not prepared and there was outdated it infrastructure for a lack of warning and notification and a lack of overall investment. tonight we want to introduce you to one of the victims. that's now paying for it. as dress a driver's license number, social security number. >> oakland native dedrick warmack is living through a financial nightmare on a credit report. there's credit cards that should have been closed. there are now open with balance is of like 17,000, um, 30 something thousand. and i don't

have them right now. yeah. i have no idea what's going on. >> months after the city's network was hacked, he says his credit score dropped more than 200 points, but little did he know, that was only the beginning. do you think your identity was stolen from the oakland hack? >> yes, yes. i mean, i'm getting the phone calls, the emails that i get stating, oh, you have this account, you have that account. i've been getting letters from chase and bank of america. i don't have a bank account here. after the hack, the i-team consulted cyber security professionals to download the leaked data. >> this was an attempt to get a better idea of the impacts facing victims. due to a limited response from the city. that's when we found warmack social security number published on the dark web. >> if you look at my email now, my entire list of emails, it all reads fraud. it looks like my junk mail. >> warmack is one of dozens of victims the i-team contacted who previously filed a claim with

the city, alleging injury, but instead ended up with their sensitive financial information leaked. now, he says fraudulent checks are being made in his name. >> so i don't know what this is. >> $2,000? >> yeah. to strange sewage and water bills being sent to him. the water and sewage wasn't from east bay. mud like, what is that? is that new england? so how can i have an open balance and then this there's things that are popping up on my phone. i'm getting notices about refinancing a home, and i'm like, i pay rent. >> warmack believes someone has even purchased a home in his name. >> somebody has something in my name somewhere. since october, i've been getting things from bestbuy about about kitchen installations. >> and to add to the stress, he says he didn't even know about it. until we contact him. now he's scrambling to get help. like many others. in april, we spoke to dozens of victims on the phone and in person, but not

one said they received any notice from the city that their personal and financial information was impacted. we kept some of their identities anonymous. >> my information was found on the dark web with an apartment in my name, without me even knowing. >> in march, the it masked mayor shengtao how far along her admin was informing the thousands of people impacted by the breach. but we did not get a straight answer. >> are you 50% done with that process? do you know if you're almost done with that process? where does that stand? that's going to be an ongoing process. >> we have notified the current employees and not just that, but we are now notifying employees that have left the city. the city's ignored, ignored and stonewalled its own employees. >> that was ten months ago. today, we're told the city's notification process has been completed for several months, but the i-team continues to receive complaints from residents affected. >> i never heard anything, no, no. >> in may, the mayor committed to spending an additional $10 million to upgrade and harden

the cybersecurity protections over the next two years, documents obtained by the i-team from the city administrator s office show only 30% of that goal has been spent since, including the restoration of opd's cctv server, which the mayor says is now fully operational. but other concerns still linger. >> we're not managing or directing properly on the heels of a multi-million dollar missed opportunity to fight retail theft following 1911 dispatcher application was overlooked, some city officials are concerned about another mistake, including cyber insurance. >> eight months ago, the i-team consulted cybersecurity experts to weigh in on oakland's current policy. do you think oakland's coverage is sufficient enough to protect against a ransomware attack? >> yeah, it's it seems like it's mostly covering, uh, comprehensive of electronic information and security liability coverage, shutting down systems. the downsream effect, not able to deliver services. this policy not necessarily designed to meet those needs.

the books in california and many of them are aiming to help you save more money. >> here are a few of those policies going into place. >> minimum wage is getting increased to $16 an hour for all employees. all employers, i should say fast food employers are required to pay workers a minimum of $20 an hour, starting april 1st. health care workers are seeing an increase in pay to $18 an hour. >> more sick time is coming to california. workers. workers will get at least five days or 40 hours of sick leave every year. that's up from the standard three day minimum, or 24 hours per year. the new law aims to standardize sick leave policies statewide, and a ban on junk fees goes into effect halfway through 2024. >> july 1st. the new law prohibits the act of deceptively advertising low prices, then tacking on additional required fees, either in print or toward the end of the transaction. state attorney general rob bonta says california now has the most effective piece of legislation in the nation to tackle this problem. >> also, in effect, starting

alone for the very first time. he was supposed to go from philadelphia to fort myers, florida to meet his grandmother, but instead he ended up in orlando more than 150 miles from fort myers. spirit has since reimbursed casper's grandmother for her three hour drive north to pick up the boy. i feel as though lisa gas money. that's it. yeah, i mean, she should own the airline at this point, i'd be furious. oh that's frightening. >> it's extremely frightening. yeah, i hope there's some other things that happen that we don't know about because as you see that a lot. you know, usually the flight attendants will walk the child to the airline. i just can't imagine. it's always a kind of a nervous thing. and they should take special care. hopefully they did, but they didn't this time. so like you said, yeah, they should own the airlines. i'm with you. >> yeah. and casey, i have so many questions about how this would have happened also because i'm sure you hold on to your kid. you know, for dear life. and then when you put them in the hands of someone with the airline, i don't know.

>> yeah, i have a six year old daughter and she's not going through security and checking herself in on her own. i can tell you that much. they have to be on the six year old child from the moment they get to the airport through security, through the check in, right onto the plane. i remember traveling as a kid. they would literally seat you. they would walk you in and seat you and make sure you were on the right flight. so i have no idea how they could have missed this bad. >> yeah. although personally, i would not put a six year old kid on a flight by themselves anyway. yeah, that's a whole other issue. >> yeah, maybe, you know, ten or something. >> you're getting that to that age. maybe. all right. if santa didn't bring you exactly what you wanted this holiday season, return your items to the retailer. might cost you more retailers are charging fees for holiday returns. that's according to the national retail federation. an estimated 17% of purchased items are returned by shoppers, costing companies more than $800 billion every year. i'm fortunate i'm not returning anything. i like everything that i received this year and it all fits. lisa, how about you? >> that's a win. yeah so far, maybe 1 or 2 things, but ouch. you know, i'm not surprised.

>> they've been working with monterey bay aquarium staff since july 2nd. these are photos taken wednesday. officials are responding because this five year old female otter is showing concerning and unusual behavior by approaching people. >> we don't have this issue that frequently to, you know, know exactly how to, um, to capture an animal with with this, uh, set of behaviors. so, um, you know, we're just trying to be as adaptable and creative as we can . >> otter has quite the history. tsay, a spokesperson for monterey bay aquarium, said the otters mom was rescued in santa cruz in 2016. the mom had reports of approaching people on kayaks and boats, but nothing to the extent of her daughter. otherwise known as otter. 841, which is her rescue number. >> although we haven't observed her being aggressive towards people, she's really focused on the boards. or if they're wearing fins, she's focused on the fins. um, you know, we don't want to have a person, um, accidentally bit.
