old boy who was struck and killed tragically yesterday in san jose. good evening. thank you for joining us. i'm dan ashley, and i'm ama daetz. >> the collision happened on camden avenue near the cambrian park neighborhood. abc seven news south bay reporter zach fuentes spoke with a friend of the 12 year old and has more details from police on what happened. >> a small memorial is growing at the corner of camden and lee avenues in san jose. just after 420 tuesday afternoon. a 12 year old boy was hit and killed while crossing the street. >> 12 year old was riding a non-electric or non-motorized scooter northbound across camden when they were struck by a truck that was driving westbound san jose, police say that the driver of the truck stopped and is cooperating with the investigation. the person that was driving the truck did have a green light and was just proceeding through the intersection when they unfortunately collided with the child, police say they don't believe speed or alcohol were factors.

>> this 13 year old jack said he was with the 12 year old when it happened. jack and his mother came back to pay their respects and add to the vigil, though they didn't want to give an interview, they said that the 12 year old, who was still not been identified by authorities, was a nice, funny boy who loved basketball. jack tells me that his 12 year old friend was halfway through the intersection when he was hit. this is tragic. >> as a parent, when you send your children out, you want to believe that they're going to come back safe. >> san jose city councilmember pam foley is chair of the city's vision zero task force, which aims to eliminate crashes. she said they're focused on improving infrastructure, education and enforcement, increasing our traffic traffic enforcement unit, installing our speed cameras that will be going up to the automatic speed cameras that we had legislation approved, and we will be implementing those in 2025. this is the 11th pedestrian death in the city this year, and the 30th traffic fatality. >> we had a record an awful record in 2022 when 65 people

died on our streets. >> last year saw 49 deaths. the department attributes the high number in part to the city's infrastructure. >> i believe seven expressways in san jose and an equal number of freeways running through the city. and so now what our charge is as traffic safety professionals is to re-engineer those streets. >> still, the call is also for drivers and pedestrians to follow traffic safety rules. it's really about making sure we talk to our loved ones about roadway safety being everybody's responsibility. in san jose, zach fuentes, abc seven news. >> newark police went undercover today to slow down drivers and alert them to pedestrians. this awareness campaign was set up like a sting operation. really? non-uniformed members of the department crossed a few pedestrian crosswalks while officers watched for compliance. all the more important because school starts there tomorrow. >> we're looking to basically have awareness not only for pedestrians who are crossing at this location and other locations in newark, but also to remind our motorists that they

need to slow down, be less distracted, giving themselves more time to get to their destinations so that they can watch out for all of our our young ones going to school and put other pedestrians that are in our crosswalks. >> we're told that the tickets given out today were very expensive. >> alameda county district attorney pamela price says she will consult with the family of a murder victim before deciding whether to retry a case after the state attorney general found misconduct during the trial. the case dates back to 1986, when curtis lee ervin was convicted in the murder for hire. death of carlene mcdonald. price says the prosecutor illegally excluded prospective jurors who were black and jewish, which the attorney general confirmed there was evidence of the prosecutor's disparate questioning and investigation of black and white prospective jurors on the case that, in fact, the prosecutor misrepresented to the court. price has 60 days to decide whether to retry the case or free ervin, who has served 38

years in prison. abc seven news spoke with former alameda county district attorney tom orloff, who was a high ranking prosecutor in the office at the time. he says, quote, there was no policy in the office to discriminate against jury selection. >> as we look to build a better bay area, we focused a lot recently on san francisco's effort to find solutions to the homeless crisis. we have seen a directive, aggressive sweeps and rules to deal with arv's that take over city streets. rv owners were recently asked to move from over to stonestown shopping center and ended up at a community center parking lot, creating a new set of problems there. abc seven news reporter louis pena is following the story and is here with the update. louis. >> yes, dan, the rv residents that are parked outside the community center were previously on winston drive. here's the back story. last week, sfmta began implementing a four hour parking restriction on winston, which meant that anyone living in those rvs had to find another place to park to avoid getting a parking ticket. many of these rv

residents are now parked on zoo road, where the center is located, inside san francisco's largest recreational and rehab center for developmentally disabled children and adults, creating a safe space is what staff members here strive for, but lately, they're growing concerned by the number of unhoused people in rvs parked outside. >> access to the sidewalk, you know, and they're blocking the ramp a little bit. we have two accessible ramps on that side, and it's just been a little bit more difficult to access them and parking spots for our staff. i think we've lost about 25. >> gillian flannery is with the center and showed us one of their main accessible entrances. >> we had a fire drill on tuesday, so we tested to make sure we could all get out. >> last thursday, sfmta began implementing a four hour parking limit on winston drive, forcing multiple rv residents to look for other locations to park long term. many moved to zoo road, where the center is located, and

the only parking rule is to move during street cleaning. one of them is yamilet lira. cuanto estas aqui? how long have you been here? >> como otro dia? mas o menos? >> eight days or so. yamilet has lived in this rv for three years with her two adult sons. they moved from winston drive to zoo road and like it here. we would like for them to let us stay here. she said. the city did offer her shelter, but she refused. she said after an accident she needs her family close to her. cannot live on my own. the center says they have compassion for these families and even offered them to be part of their thursday food pantry. but they want the city to find a solution. compassionate plan that both will benefit uh- the pomeroy center and the rv residents. in a statement, the mayor's office said the rvs should not remain along zoo road and added in part the mayor's office is actively working with city departments, including sfmta and hsh. a next steps for this site. we're not pursuing

any proposed permitting system for vehicles to remain on site in the public right of way on zoo road or anywhere else. in the meantime, people who frequent the center want a solution soon. it's very disruptive to the people that have to come here. and according to san francisco's homelessness and supportive housing department, all the rv residents have been offered shelter. and as of june 27th, 23 households, including children and families, have been moved out of their vehicles and are now successfully housed. but there are still many who are waiting on housing news. >> all right, luce, thanks very much. >> just last week, san francisco mayor london breed directed city officials to offer bus tickets out of town to the unhoused who

have support elsewhere before offering them other city services. the journey home program is not new. this order just prioritizes it. our partners at the san francisco standard looked into where people were being sent. they looked at data going back to september of 2023, and when it comes to states where people are going after california, is oregon, nevada and texas tied for third with. in california, the top three destinations are los angeles, sacramento and humboldt counties. >> well, believe it or not, muni's light rail system is still run by floppy disks. it may finally be getting an update. the san francisco chronicle reports that transportation officials took a big step yesterday in modernizing the system by awarding a contract. it's estimated the project to modernize the train control system will cost around $700 million. construction could start in 2027. the floppy disk system has been around since 1998. >> happening now. evacuation orders tonight in the sierra foothills because of a wildfire. the crosier fire started early this morning northeast of placerville in el dorado county. it's burned 245 acres so far, and is 5% contained. firefighters are worried about the weather conditions because

the humidity in the area is expected to drop while the winds pick up, not a great combination. farther north, the park fire just keeps on growing, burning through about 7000 acres overnight, it is now scorched about 423,000 acres and is 3 contained. firefighters are dealing with searing heat, with temperatures expected to top 100 degrees on the fire lines. a relief could be on the way a little later this week. cal fire says the flames have destroyed more than 600 buildings, including several homes. a chico man was arrested and accused of starting the fire. >> a san jose city council member is accusing a hospital operator of prioritizing health care for wealthier residents. council member peter ortiz is critical of a plan by hca health care to downgrade trauma level services at regional medical center in east san jose while it expands services at good samaritan hospital, located in a more affluent part of the city. >> hca health care is seeking support from the city of san

jose to expand emergency medical services for wealthier communities here in west san jose while it pulls emergency support away from the communities that need that need them the most. our working class families on the east side. >> hca healthcare says it's building two new hospital wings at good sam as part of a seismic retrofit at the hospital san jose state is getting ready to house several hundred students in a new residential high rise. signs just went up calling it the spartan village on the paseo. the tower had been transformed for student housing. he was formerly part of the signia by hilton hotel. sdsu says there will be a gaming lounge, fitness room, film center and study areas in the building. students will begin to move in starting next week. >> we've been following the fallout from the san francisco taco festival that left people hungry and furious. tonight. what we've learned about another festival being planned by the same organizer. >> have you seen this bird? if you have, consider yourself

facing a class action lawsuit from passengers who are claiming the impact of the flight cancellations was just disastrous. they also claim delta refused or ignored requests for refunds. delta, crowdstrike and microsoft are now locked in a public battle over who is responsible and who, of course, should foot the bill for this widespread computer outage. >> we've been following this story about a taco festival in san francisco that left many attendees wanting more. now, seven on your side has learned the west coast taco and beer festival, scheduled for labor day weekend in san jose has been put on hold. that news comes as many who attended last week's events say they are struggling to get their money back. but as

abc seven news reporter lena howland uncovered, festival goers are facing more problems while trying to get a refund. >> people are jokingly comparing it to the fyre festival. >> seven on your side has learned that organizers of the west coast taco and beer festival have postponed an event. labor day weekend at history san jose. this comes after our reporting on the same event in san francisco last weekend. the event promised unlimited taco samples and bottomless beer tastings, but attendees say that isn't what they got. susie normally paid 96 bucks for one vip ticket. >> i would like to know what where the money from the ticket, from the tickets. where did it go? >> and catalina reyes says even the vendors had no idea samples were even part of the deal. >> he said, you know, they told us when we got here this morning that we were supposed to provide, free taco samples, and we don't have enough. and we did

not. we didn't, you know, we didn't prepare for that. >> so many complaints have been pouring in about the san francisco event. yelp disabled the comments while they investigate the event organizer told us he is accepting refund requests. but when reyes reached out in the facebook comments on the event page, she got asked for information she wasn't comfortable giving. >> they said, you know, send us, you know, your your registration information and your cash app and then they said, okay, well, to get your money back, we need $30 to verify the payment. >> i have firsthand seen fake customer service accounts pop up on social media. >> melanie mcgovern with the better business bureau says these kind of events happen nationwide, and consumers should be wary. >> it's really important to do those checks. if the account has maybe three followers or it looks brand new, there's not a lot of activity. they're

station in los angeles, spoke with some people near the epicenter. >> yeah, we're just south of the epicenter of that 5.2 magnitude earthquake. people across southern california were reporting that they felt something, either a jolt or a rolling motion for 4 to 5 seconds. and that earthquake caused some major issues. >> you heard something fall, and

i was like, was it something that fall? and then it just started shaking and i was like, what? so i got up, i was ready to grab my daughter. >> people across socal got this alert before that jolt at 909 last night. a woman who lives two blocks from the epicenter showed us her damaged tv and toppled starbucks cup collectio. this video, taken at verdugo market and liquor store in mettler. people running from the store and items falling from the shelves after a 5.2 magnitude earthquake hit just south of bakersfield. >> i thought some huge person was running across my roof, and then all of a sudden it felt like a tractor was pulling my house, like on a railroad track going dunk, dunk, dunk, dunk. >> the quake caused a boulder to fall into lanes of the five south in the grapevine, bringing traffic to a slow crawl. chp now cautioning drivers through the mountainous areas with aftershocks. >> there can be loose rocks. there could be loose debris up on the hillside, so that may yet to fall. we're hoping it

from our mount tam cam. you can see the marine layer is beginning to expand. it has certainly deepened and it's rolling in. so definitely plan on changes for tomorrow. right now as we look at live doppler seven, we have been seeing some leftover tropical moisture in the form of mid and high level clouds coming through here today. but we're also seeing that marine layer establishing right near the coastline. and as we head into the overnight hours, you're going to notice more of it. heat advisory continues for parts of the south bay until 9 p.m. tonight. so the risk of heat related illnesses remains for those who are sensitive, the sea breeze is picking up, gusting to 36 at oakland. and you know what that means. temperatures are going down already cooling in oakland and napa down ten degrees 14 degrees cooler in santa rosa. you can see the breeze here along the embarcadero from our kgo roof camera. it is already 61. in the city. you are in the low 70s earlier today, so cooling quickly. oakland 66, san jose 86 and it is 59. and half moon bay. there is the fog from

sfo 79, in santa rosa, right now in the 70s from petaluma to napa, our hot spots in the 90s so far, vacaville managed to get up into the low one hundreds places like concord, livermore in the upper 90s. overnight tonight, fog, clouds and drizzle. tomorrow it's going to be a cooler afternoon and your weekend weather will feature breezy conditions below average by the second half of your weekend, which is sunday. so 6:00 tonight you see those wispy clouds coming through? certainly the fog layer establishing and tomorrow morning we're going to start you off with some drizzle around the coastal areas. so don't be surprised if you have to use your wipers briefly in the afternoon. the high clouds will move out, but we'll still have some fog near the coast. your morning temperatures will be in the 50s and 60s once again, watch out for some damp roadways tomorrow afternoon looking at 90s inland, so not quite as hot as today. coastal areas in the 60s and partly to mostly cloudy skies. taking a quick look at debbie, as you will notice, bands of rain continue to push across the

carolinas. it is just off the south carolina coast. a second landfall is expected tomorrow morning. there are tornado watch boxes posted for parts of the carolinas, and as we look at the forecast projection tomorrow, you will notice early in the morning that second landfall. but it is going to it's already strengthened. it is going to weaken as it makes that landfall and then quickly weaken as it races up the eastern seaboard. but this storm will interact with a front. and as the two merge, they're looking at quite a bit of rain across the new england area as well. the carolinas already have seen over a almost a foot and a half of rain and more in some spots, and they're looking at an additional half a foot of rain or more up around the new england area. looking at 3 to 6in of rain. so flooding will be considerable and remain that threat that they've already been seeing. the accuweather seven day forecast. it's a cooler afternoon tomorrow, mild to warm on friday, and then you will notice that the temperatures really come down by sunday. only in the

birdwatchers are flocking to a san francisco park, hoping to catch a glimpse or take a photo of a bird that's never before been seen in california. >> pretty wild a birders and photographers are getting up early in the morning looking for a slate throated redstart at pine lake park, near stern grove. the rare bird is found in primarily mexico and central america. we talked with a couple of lucky birders who got photos. >> i'm so sorry to say this, but we were here for like five minutes. we were really lucky. i don't know, i just had this
