we all seen in the video. you know, it wasn't right. and that's what we want today. >> family and friends of an east bay teenager gathered to remember him, marking one month after he was shot and killed by a police sergeant in los angeles. good evening. thank you for joining us. i'm dan ashley and i'm ama daetz. >> today's remembrance comes one day after the lapd released video of the moments before the 18 year old richmond teen was killed. >> abc seven news reporter luz pena spoke with his family and joins us from the newsroom with their calls for justice. >> yes, dan. we spoke to the mom and sister of 18 year old ricardo or ricky ramirez. he had just graduated high school. his family said he went to los angeles to spend time with friends, and he never came back. today, they held a ceremony to remember him. >> give this family the strength that they need to persevere in their fight for justice. >> leaning on each other. family and friends of 18 year old ricky ramirez held hands and prayed as they remembered the high school

graduate, whose dream was to become a caregiver for those in need. following the footsteps of his mom and sister. >> knowing that i won't see him the next day is hard. take your time. but i'm trying to get through it. i try to be strong for my parents since i'm the oldest. >> ramirez's mom keeps playing back and forth. the last words her son said to her as she dropped him off at a friend's house before he went to l.a. for the weekend. >> he's saying, i love you, mama. mama, i love you. and that's definitely what i'm going to miss this week. >> a month after a los angeles police officer shot and killed ramirez. the police department released surveillance video of the moments leading up to the shooting on july 13th. ramirez and three others were in this silver cadillac that caught the attention of an officer in the area. >> the occupants of a silver cadillac wearing ski masks

involved in a possible dispute with the driver of another vehicle. >> after both vehicles took off, an officer asked for the cadillac to be followed. >> follow that car because they were all masked up. follow that car. follow that car. >> surveillance video shows the moment an unmarked vehicle followed the cadillac. the cadillac stopped and ramirez got out and approached the vehicle, following them. seconds later, police shot him. shot in the chest. the family's attorney said the officers should have identified themselves, and they followed protocol and waited for the marked vehicle. >> ricky would have known who he was approaching, and i think the video shows quite clearly ricky did not have a weapon in his hand. his arms were open on both sides near the window of the door, and he was right in front of the window, and the only one that we see with any kind of weapon is a gun come up and a shot go out, and ricky fall to the ground, not conscious, not breathing. >> a month after the shooting, ramirez's family released balloons in colma to celebrate

his life as they continue to seek justice for his death. >> i'm ricky's voice today. i'm his voice and i have to fight for him. >> the lapd said they are in the early stages of their investigation. the family's attorney said they want justice for what happened to the 18 year old. the family, seeking financial compensation. the attorney said they are hoping to reach a resolution without a lawsuit. luz pena, abc7 news. >> all right, luce, thank you. in the south bay today, there was some finality for the family of a mentally ill inmate who was killed in a santa clara county jail back in 2015. today former jail guards rafael rodriguez, gerald o'brien and matthew ferris pleaded guilty to voluntary manslaughter charges after beating michael tyree to death. abc seven news south bay reporter dustin dorsey was in court and has more on a resolution following the death of a santa clara county inmate with mental illness. >> nine years in the making. former jail guards matthew

ferris, rafael rodriguez and jared lubrin back in court tuesday, openly admitting their involvement in the deadly beating of michael tyree in his jail cell. >> they pled guilty to voluntary manslaughter to beating and killing michael tyree with conscious disregard for his life conscious disregard for human life. today was a victory for the vulnerable and the voiceless. >> the men agreed to a plea deal to serve a maximum sentence of 11 years for their involvement in the fatal beating. this comes after a state appellate court overturned their murder convictions in 2022, because it could not be fully proven which defendant actually killed tyree. instead of retrying the case, santa clara county district attorney jeff rosen's office accepted the deal with a major condition. >> it was important for us to have them admit in court that they beat michael tyree to death, or aided and abetted the beating of him to death, and that they did that with conscious disregard for michael

tyree's life and for human life. because if they're accepting responsibility for what they did, then we wanted them to accept responsibility. >> tyree's family attorney, paula canny, says this still doesn't take away the pain of tyree's death. santa clara county has since adopted reforms to make sure mentally ill inmates are better taken care of. so something like this never happens again. but canny says more still needs to be done to take care of the mentally ill. >> mental illness is not a criminal justice problem. it is a public health problem. and until we reconcile that and address it as such, we're going to continue to have tragedies like this. >> the three former guards will be in court next on october 22nd, to determine how much of their remaining sentence they will serve in santa clara county. dustin dorsey, abc seven news. >> in san francisco, a political activist facing rape and abuse charges is set to be released from custody. john jacobo's release follows a hearing this

morning. despite calls from the district attorney's office that he remain in jail, saying he poses a threat. the judge did order jacobo to be placed on home detention. his attorney says he will likely remain in custody for a couple of days, while the sheriff's office makes sure his home is secure and safe. i think the court did the right thing and released him. >> the court did put in place a lot of strict requirements, including home detention, electronic monitoring, a no alcohol condition. so i do think the judge was trying to balance both interests. >> jacobo also has to surrender his passport. he has pleaded not guilty to the charges. >> governor newsom is now calling for school officials to implement stricter rules on cell phone use in classrooms, sending a letter to school districts statewide here in the bay area. some districts have already banned phones. abc seven news reporter ryan curry has more. >> it's now been one week since students returned to school at mount diablo, and ignacio valley high school. one week with a

strict new rule, every student is required to put their phones in pouches that will be locked throughout the day. now, governor newsom wants other districts to follow suit. he sent a letter asking them to consider rules against smart phones, excessive use of smart phones has had not only a distraction in the classroom, but, you know, a really negative impact on students mental health. assembly member al muratsuchi is the chair of the assembly education committee. he authored a bill in 2019 that allowed districts to install rules against smart phones. that was before the pandemic. since then, he says, teen cell phone use has increased. >> over 70% of high school teachers are saying that, you know, smart phones are becoming a, you know, a serious distraction, distraction, undermining, you know, their ability to teach our kids. >> hence the reason why some districts have already taken action. it's a pilot program. and not only will school and district officials keep a close eye on it throughout the year, but also parents, they want to know if it's going to be

implemented throughout the district. >> i actually told them about this and they were like, oh, mom, what did you say? you know, we don't want that. >> campbell says the majority of the parents in the district want to see harder rules on cell phone use, because the problems are severe. >> that leads to other issues. you know, on campus with bullying. and, you know, or kids just, you know, sneaking off because they're used to playing games on their phones or being on their phones. >> in the governor's letter, he highlighted the surgeon general's warning, saying social media and cell phone use among teens increases anxiety and depression. he also said some districts with cell phone bans have seen higher test scores and grades, and parents hope it leads to better social lives. >> ultimately, i think that the kids will, you know, probably see that they, you know, enjoy their peers more. they, you know, have better interactions. and yeah, i think it's going to be a good thing. >> a classroom where taking away a screen means removing a barrier in the east bay. ryan curry, abc seven news. >> there are new details in that destructive fire that gutted a

beloved bookstore in oakland. fire investigators say the fire that burned down east bay booksellers on college avenue two weeks ago was an accident, but they don't yet know the exact cause. oakland fire says the building is too close to collapsing for investigators to get a really good look at the spot where the fire started. the longtime rockridge bookstore is a complete loss, as you can see. the owners of other local bookstores created a gofundme, which has raised more than $213,000. >> the clock is ticking for people living in rvs near the san francisco zoo. the city is giving people until midnight to leave zoo road or be towed. when we drove by this morning, most of the street was clear, though there were still a line of rvs parked on one side. many of the residents moved here after the city forced them off. winston drive weeks ago. the city says it's offering help, including financial assistance for vouchers for housing, but the residents tell us they need to find landlords who will accept the vouchers.

>> a plan to raise $20 million for affordable housing in the bay area could be cut from the november ballot. the agency behind this massive housing bond is holding a special meeting tomorrow to discuss dwindling support for this expensive plan. documents from the bay area housing finance authority show polls have only 55% of voters in support of the idea. bonds need two thirds of the vote to pass. tomorrow is the last day for ballot measures to be changed or removed before the election. >> coming up, it was valued at $855 million. but now a san francisco tech company is shutting down and laying off its employees. we're going to tell you why. >> plus concerned about a covid spike as students head back to school, what health experts are predicting. when abc seven news at five continues. >> coming up tonight here. tropical storm ernesto taking aim now set to become a hurricane. ginger has the new track. the urgent manhunt at this hour for an escaped killer who broke free from the guards. and the largest nuclear power plant in the u.s, issuing

a verizon, another respiratory virus. the cdc says it's watching an increase of parvovirus b19, also known as fifth disease. it's pretty common virus, especially for kids with symptoms of fever, muscle aches, rash and joint pain. cases went way down during the pandemic, of course, when people were taking more precautions, but the cdc says it's seeing signs of an unusual rise in infections and complications. >> and meanwhile, coronavirus levels in the wastewater remain very high. and that, coupled with students heading back to school, is creating concerns about a spike in cases that may be coming. abc seven news reporter leslie brinkley talked with health health experts about how long this covid wave that we're experiencing is expected to last, and has a look at what

schools are doing to prepare for it. >> we're all excited about the start of the new school year here at lafayette elementary school. >> today marked the kickoff to being back in the classroom. like many school districts around the bay area, new teachers have been hired. food services are ready to go, and the spread of viruses is likely inevitable, including covid. >> in california, interestingly, and unfortunately, is really a hotbed for covid. >> experts say while the rise in covid cases appears to be plateauing, the start of school could continue fueling this summer's surge. >> but with kids from preschool to school to grammar school to junior high, high school and college all going back, now that's going to exacerbate the problem somewhat. so it's impossible to predict what's going to happen, but i expect we're going to see continued respiratory activity throughout the rest of this month and september. >> we feel like we're back to normal this year. it is an option for families to have

their children mask at school, but it's nothing that we require. >> and schools are recommended to allow a student to mask if they want to mask, and there shouldn't be any stigma posed on a student who wants to mask. >> some experts say kids should stay home if they're sick. >> if it turns out to be covid, follow the cdc guidelines. keep them home for five days, and then if they're better and no fever for 24 hours, they can come back to school. but wear a mask for the next five days. >> in the east bay, i'm leslie brinkley, abc seven news three hard working moms are celebrating the gift of reliable transportation today. >> they each picked up newly refurbished vehicles in fairfield, courtesy of the national auto body council. recycled rides program. the program takes donated cars, fully restores the vehicles, then gives them to people in need of transportation help. >> i'm going through a rough time right now with my daughter. she was diagnosed with a cancer, so this will help me to take her to the doctor. appointments and

anything that we need to do. >> places you wouldn't go before because you didn't think your car would make it. you could go now. we can make it now. >> look at those smiles. today's third new car recipient, jason mcgee, is an army veteran and single mom with four children who attend three different schools. she says her new suv will make getting her kids to and from school a lot easier. the recycled rides program has been around for more than a decade, and in that time, caliber collision and its partners have repaired nearly 600 vehicles for individuals and families. that is fantastic. >> life changing. all right. well, after years of speculation, we finally know details about the plans for the 40,000 square foot building at emeryville's bay street mall, what shoppers can expect, and when the store will open next

tokyo central will carry groceries made to order food and more imported products. it will also include an upscale japanese restaurant. the bay street mall lost a dozen big name stores during the pandemic, and new owners have focused a lot of the recovery efforts on food and restaurants. >> a financial tech company based in san francisco is shutting down after running out of money. the founder of tally shared the news on linkedin, saying they couldn't secure enough funding to keep going. we saw for lease signs on their headquarters in potrero hill today. the company launched nearly nine years ago, pitching financial tools to help people manage credit card debt. >> right now to the park fire burning north of chico. cal fire is cautiously optimistic its crews are finally starting to get the upper hand on it. a containment is at 39% now, and the fire has charred nearly 430,000 acres, making it the fourth largest wildfire in california history. crews are taking advantage of favorable conditions, but there are a couple of trouble spots. >> our firefighters continue to make amazing progress in all

areas of the incident despite the continued progress, we still have a few areas of concern, specifically in mill creek and surrounding areas that is within the fire footprint, where hotspots and hazards trees still pose a significant safety hazard. >> the fire started nearly three weeks ago and has destroyed hundreds of buildings. a chico man was arrested and charged with arson. >> and of course, we always worry about the air quality with fires. >> so much smoke for the last few weeks from this fire. a couple of weeks. meteorologist sandhya patel is tracking the air quality for us. >> yeah, and the good news here is because of this windy pattern that we're in, we're seeing that the air quality near that fire. take a look. is actually okay. it's a good surrounding that park fire. good to moderate. other parts of the state and we are on the same boat. we do have a nice breeze blowing through. so it is fine here locally as well. right now 30 mile an hour winds in san francisco. those onshore winds uh- 21 at sfo. so

we take a look at the hourly wind forecast and you'll you'll notice that it's still going to remain gusty over 30 mile an hour winds along the coastline this evening lighter inland as we head into tomorrow morning the winds drop off and then they pick back up again tomorrow afternoon and evening. so that will actually keep our atmosphere well mixed as we look at a live picture from our pier 39 camera. well, somebody is enjoying the sunshine, the sea lions soaking it up, lots of blue sky right now. temperatures responding. it is three degrees warmer in san francisco and oakland, up five in san jose, six degrees warmer in santa rosa, and also out towards concord. so this trough that was to our north that brought temperatures down a little bit. the last couple of days has actually started to move on out of here. high pressure has come in a little bit and brought us the warmth, but we are in that breezy pattern looking at a live picture from our mount tam cam, you can see how clean the air is right now. 64 in the city, low 70s oakland, hayward 82, san jose and it is currently 63. in

half moon bay, the sun is shining in walnut creek and many of our inland spots are in the 80s right now. but we did get to the low 90s this afternoon for places like fairfield. santa rosa is at 88 right now, 89 in fairfield, 84, in livermore from our san jose camera. you are seeing plenty of blue skies tonight. breezy to gusty. the next few days are mild to warm weather will continue and the weekend forecast will feature breezy and cooler than average conditions once again. so we go hour by hour. the marine layer is going to reestablish. we didn't have a whole lot this morning. but tonight by 10 p.m. it's established near the coast. it is advancing across the bay, and tomorrow morning we will wake up to more gray sky than we did this morning. so the coast isn't going to see much warming. they may actually see their temperatures come down a little bit, but bay and inland, you'll be nice. 50s and 60s tomorrow morning. tomorrow afternoon in the south bay. 88 in gilroy, 84, san jose, 78, in sunnyvale on the peninsula, 73, in san mateo. low 60s coast side with some fog lingering. 68. in downtown san

francisco, north bay numbers up into the low 90s. santa rosa, calistoga 83, in san rafael. really a pleasant pattern in the east bay. mid 70s berkeley, oakland, fremont, 7690 inland in concord and 87 in livermore. your accuweather seven day forecast. we'll feature low 90s. the next couple of days. low 60s coast side and then those temperatures will come down. breeze will pick up over the weekend and then bouncing back early next week. no extremes. that's the bottom line dan. yeah, thanks. >> well, the oakland zoo has good news to share about brier. a mountain lion cub found abandoned in el dorado county. the zoo says the kitten is gaining weight, sleeping well and starting to transition from milk to solid food. wildlife officials found brier all alone at the start of the month. they looked for his mom for days with no luck. at just 4 or 5 weeks old, the kitten was too young to survive on his own. the oakland zoo took him in and now he is doing well. >> look at that face. yes. all
