suspect who shot and killed a man in the east bay. residents shocked. it happened in what they believe is a safe neighborhood, and the abrupt resignation at sf usd one week into the new school year. plus, the effort to make a popular bay area road safer for bikers. good morning everybody. it's saturday, august 24th. i'm stephanie sierra. great to be back with you. >> yeah. welcome back. we missed you. i know i missed you all. >> i certainly didn't miss this gloomy weather. >> i know. yes, this is tempoorary. we have an area of low pressure that's pretty strong for this time of year. that has brought some showers. maybe you missed them. perhaps while you're sleeping, you can see the ground has certainly gotten wet in many neighborhoods. some lightning up towards eureka. the area of low pressure crescent city, the tail end of it bringing a few showers across the north bay, the east bay, and now into the sierra nevada. a closer look from petaluma to point reyes. there still some shower activity, so the next few hours and then it will be winding down. but look at all that from south lake all the way down through the central

sierra. so some sun trying to come out there at sfo. it is muggy and mostly cloudy, 67 san jose, 62 san francisco and the exploratorium. camera a little sun glint there on the bay 64. in concord we are much milder, muggy and low 80s arriving inland by this afternoon. sunny skies as we get into the mid morning hours and we'll talk about a big warm up for sunday. coming up stephanie. >> lisa, thank you. developing news now. police are looking for a suspect who shot and killed a man in dublin. an area that rarely sees violent crime. it happened yesterday afternoon at the emerald park apartment complex off hacienda drive and central parkway. a nearby school was put on lockdown. abc seven news reporter lauren martinez talks to residents in this normally quiet neighborhood. dublin police are looking for the person who shot and killed a man friday afternoon. police say it happened at the emerald park apartment complex just after two. sandra cardenas has lived

at the complex for three years. >> i was just shocked because we are normally a quiet community and living close to an elementary school. i never really thought we would have that kind of incident happen here. >> james doherty elementary school was briefly put on a lockdown. as far as the shooting, police say an adult man was found with a gunshot wound to his head. he was pronounced dead at the scene. during the investigation, some residents were blocked from getting in. >> i'd say everybody is getting home from work right now and not expecting to see police first thing as you come in through the complex and definitely getting the message from the apartment complex that, you know, a fatality happened here during the day is definitely just kind of mind blowing. >> several residents talked to us off camera and said, as far as crime, maybe their mailboxes will be tampered with or their cars will be broken into, but nothing to this scale. according to city data, there's been less than a handful of murders reported since 2014. 2 in 2020

and 2 in 2022. police say they were still searching for the suspect, but there is no threat to the public. >> i feel okay and safe knowing that at least they don't suspect that there's like an active shooter around. so yes, i think we're all just really on our toes and alert right now. >> in dublin, lauren martinez, abc seven news. and developing overnight, bart will operate as scheduled in the east bay. it comes after a major delay affected stations around downtown oakland last night. service was stopped between ashby west oakland, rockridge and lake merritt because of an equipment problem on the track right near the macarthur station. bart says repairs have been made. also, new overnight sideshows happening across the bay area. take a look in vallej. this sideshow happened just after midnight. video shows people lighting a ring of fire. as you can see here in the middle of the intersection. witnesses say it took an hour

before police dispersed this crowd. this video is from crockett at around 1 a.m. at san pablo avenue and merchant street. one off road vehicle took part in this sideshow, and a witness says that dozens of people blocked intersections and the interstate 80 off ramp. police broke up the crowd about 25 minutes later. public safety is one of the top concerns for the city of oakland. it's also one of the reasons why mayor shang tao is facing a recall election in november. last night, the mayor and police chief held a public forum. abc seven news reporter tara campbell was there. >> a packed church friday in oakland. concerned community members gathered to hear from the mayor and police chief. what do you think it's going to take to reduce crime? money. money. >> more police officers. more of a real concerted effort. more from the community. get the community involved. >> and that's exactly what this series of town halls is all about. the city's public safety

leaders taking questions. one card at a time. up first questions about the police staffing shortage. >> one of the key pillars in regards to how we move forward with our budget, even though we had a huge deficit, was to ensure that we continue to have those police academies. >> what do you think can help reduce crime and make change in the city? >> reducing crime might be prosecuting more people. the people that run into stores and grab things and run are know that they're not going to be prosecuted. >> the police chief speaking specifically to prosecution, saying working with prosecutors at all levels is key. >> we're going to continue to work with our state prosecutors, our attorney general and our federal prosecutors when the crimes rise to that level and from prosecuting to the pandemi, questions about how to get young people the support they need when schools got shut down, that really threw a wrench in clockwork for a lot of, you know, these adolescents here in oakland. >> and i just want to hear

something that's going to help, that's going to help offset what they've been going through. >> the police chief calling on community leaders to help keep kids from turning to violence. >> they're the elders of our communities and the mothers of our community that know that can help us pull these kids aside and say, hey, there's a better way. >> and from the youth to the youngest among us, the next generation, top of mind. >> it just turns into having enough resources for children to go to. there has to be things like after school, there have to be programs. this oakland native says she'll believe the change when she sees it. the hope is there. it's small, but it's there. >> tara campbell, abc seven news. >> the chp recovered $450,000 worth of stolen merchandise and a bust on a fencing operation. investigators looking into a string of retail thefts. tracked stolen items to a home in oakland. that search led them to a storage facility in the city,

where they found more stolen items. the chp says many of the items are from drug stores. one person is in jail, and they're accused of organized retail crime, conspiracy and more. california college of the arts is facing a $20 million budget deficit. this as the school finishes an expansion project to consolidate its san francisco and oakland campuses. according to the chronicle, a's president announced possible layoffs in a recent staff meeting. he also suggested a merger with another institution could help. a follow up memo says core student enrollment has declined by a third. now to this, a big shakeup for the san francisco unified school board. the school board president unexpectedly resigned, citing personal reasons. >> due to my personal circumstances, my immediate priority needs to be my health and my family. and while i believe this to be a temporary setback, i truly am unable to give this role the attention it deserves.

>> usher, mayor london breed moved to replace her immediately. this is all happening during a very challenging time for the district, which faces budget cuts and school closures. board vice president matt alexander will step in as president. fill kim was also sworn in to fill a vacancy. he will be on the board for the remainder of the term. in the north bay, now, a chinese immersion preschool is fighting to stay open despite being served an eviction notice. mill valley unified school district owns the building. it claims tara marin preschool owes rent for june, july and august. the prequel. the preschool director says she made the payment for the space. tara marin is currently using, and hoped the district would consider that payment as rent. she says the check was cashed. she believes the district is breaking the lease early because it needs the space for administrative offices. >> i really want things to work out. i would love if i could talk to the school district. i

here's a live look from our exploratorium camera looking at the bay bridge. it's 812. the san francisco police officers association has endorsed mayor london breed in the november election. according to our media partners at the san francisco standard, this has come with some disagreement in the ranks on this decision. their sources say that the choice was made by the poa president, tracy mcrae, and that she did not take the recommendations of an endorsement committee, nor did her board cast a vote. the san francisco deputy sheriffs association and the firefighters local 798 endorsed mark farrell in the mayoral race. health officials say covid 19 cases are still high in california, and now the cdc is looking to see whether our summer surge returns as a winter wave. the biden administration is making covid tests available for free again next month. you can get four per household. new covid vaccines

that target variants are also rolling out. the cdc recommends scheduling vaccinations for september or october. ucsf doctor peter chin-hong told us the later end of that time frame may be better. >> right after october comes a bunch of events. this thanksgiving. there's the holidays. there's holiday parties, there's holiday travels. so if i wanted to kind of get the biggest bang for the buck, it's going to be that period because antibodies are going to peak for that period. >> doctor chin-hong says if you've had covid recently, wait at least two months before you get a booster. the cdc recommends everyone six months and older get an updated covid shot, as well as a flu shot. a new study shows one of the world's most popular weight loss drugs has an added health benefit. researchers say the long term use of wegovy can reduce the risk of heart attack and stroke by 44%. in march, the fda approved the drug for use by obese or overweight people with heart disease. wegovy is also approved for weight loss.

in to help him when the boy didn't come back up from the water. >> he started going towards him and then he was about to go underwater. yeah, i was kind of scared. are you a good swimmer? well, not that much. >> i've heard both stories like these, but were both ended up drowned. it can happen to even the best swimmer. i thank god that he could save that boy's life. i told him congratulations. you did it. i felt grateful for what i did. >> thankfully, park rangers say that boy is going to be okay. lazaro will be recognized at an upcoming monterey county board of supervisors meeting for his heroic effort in the east bay. now, the push for safer roads for cyclists, apparently is paying off today. those who ride up mount diablo will celebrate the addition of new bicycle turnouts on the road, and officials now say it's already reduced collisions. here's abc seven news reporter ryan curry. >> these signs are everywhere. when you drive up to the mount

diablo summit. why? this road is narrow, windy and full of these blind curves. >> very fun going up. coming down. a little scary for me. >> sherry taylor and alex sagastume are out on an afternoon ride. it's sheri's first time, but alex has been riding this hill for years. recently, he's felt a lot safer. >> they built up a few new ones on the side also, which are really nice, and it's a lot safer for everybody going up and down the hill. >> he's referring to these bicycle turnouts at the blind curves. they were first installed eight years ago after an abc seven news i-team report in 2015 identifying something that needs to be fixed, an important safety issue in this case, and pushing public officials to get it done. abc seven's dan noyes found there were 116 collisions involving cyclists on mount diablo over a four year span. 70% of them were around blind curves. >> it's actually, over 300 blind curves as you go up the mountain. anybody who's driven up the mountain or ridden up the

mountain knows that not only is it arduous, but there are a lot of turns. >> randy madera, with the california state park foundation, says cyclists started raising money for these turnouts years ago. >> the rest was, donated by the general public, which was it was a process. it's exciting. and it was only like two years from fundraising to construction, which was pretty quick for the state parks and state process. so we're excited about that. >> this saturday, officials are gathering with cyclists to celebrate the recent addition of 22 turnouts, bringing the total on mount diablo to 67. and according to park officials, the ones already in place have led to an 80% decrease in collisions. >> the cars are coming over and these guys are coming down, you know, just having a good time. and there have been some accidents coming down here. so it's been it was very dangerous beforehand. now it's made it a lot safer making sure the ride up and down the bay area's tallest peak can be done safely in the east bay. >> ryan curry abc seven news. >> investigators say a wildfire

that destroyed more than a dozen homes is a case of arson, and they've arrested a suspect. the thompson fire burned 3700 acres on the eastern side of oroville in butte county last month. cal fire arrested a 26 year old from oroville this week, and he's now being held without bail. cal fire is not saying why he's been accused of sparking this fire, but we do know there is a press conference on the matter that will be held on monday. turning to weather now, you may have woken up to the rain this morning thinking, wait a second, this is august. >> yes, and you're absolutely right. our second driest month throughout the year. and yet we picked up 4/100 or actually a 10th at sfo. wow. which puts us at about 250% of average. that 10th of an inch of rain at sfo. so we are looking at this system still bringing some showers. it has been raining on and off from the north bay even into concord. some showers, oakland and still another batch that is going to

move on through san ramon, danville. the list goes on. so as we look at the area of low pressure, which is to the north of us, crescent city, eureka, you see the lightning bolts, but the bulk of the activity northern and central sacramento valley. while the bay area saw a few showers early on three 4:00 in the morning. a bit of a lull. and now look at this as we get into your 8:00 hour, we've got a area of showers from bolinas mill valley. this will all be sliding off to the east and then up in the north bay, just some spotty light showers from yountville. saint helena, and there could be more underneath the radar beam. but looping this, you'll notice that from bear valley to mammoth, winds of 55 miles an hour and a dusting of snow for the sierra nevada back home, exploratorium camera. what a dramatic view, right? we're looking at the clouds, some sun, possible rainbows out there. 63 san francisco. it is 65, in hayward, with san jose. a muggy 67. fog clouds. mount tam,

stranded in space since june. nasa administrator bill nelson met with officials from the agency and boeing to discuss some options. they're deciding whether the starliner they arrived on is able to safely bring astronauts butch wilmore and suni williams back to earth. if not, they may have to wait until early next year to get a ride on spacex dragon. that would turn a planned eight day trip into a potentially eight month long stay. the press conference is scheduled for 10 a.m. we'll keep you posted on that. california's attorney general and the department of justice are suing real estate software company realpage. they accused the company of price fixing, which can lead to skyrocketing rent. it claims this enables landlords to avoid competition and raise prices. landlords sign up by sharing

rent data. then the software algorithm compares it with other landlords and tells them the maximum amount they can charge. realpage says prosecutors are scapegoating its software. last month, the san francisco board of supervisors moved toward banning this kind of software. the ban heads to a final vote next month. new this morning, microsoft says it will hold a cybersecurity conference. microsoft executives plan to meet with crowdstrike and other security companies at its washington state headquarters next month. it comes after a crowdstrike software update caused outages for millions of windows computers worldwide in july. delta airlines says the outage cost the company more than half $1 billion. delta is now seeking damages from both crowdstrike and microsoft. fudge sold at tj maxx and marshalls, is now being recalled for possible mold growth. ew, the canadian company authentic fudge

good morning everybody. we're starting this half hour with a look at the weather. pretty gloomy. gloomy in those cameras. i'm looking over. yes. >> and you know, we're not done with the rain yet. there's still some showers out there as the system continues to the north of us to sink south and eventually slide to the east. it's well to the north, but the remnants and the tail end of it is pushing through the bay area. and from a 10th of an inch of rain from sfo, there is more right there along the coast from point reyes, down through southern marin county in tiburon, crossing pretty soon over the richmond-san rafael bridge and into the sunset in the next. maybe 30 minutes. as we look at the north bay, a few scattered light showers and the east bay

run health ministry says at least 69 palestinians died, with more than 200 others wounded in just the past 48 hours. obstacles remain as new signs of hope for a gaza ceasefire deal. senior negotiators are expected to continue talks over the weekend in cairo following reports of progress made on friday. here in the bay area. today marks ten years since a 6.0 magnitude earthquake shook the city of napa. one person was killed and nearly 200 others were injured. the quake happened at 320 in the morning on august 24th, 2014, damaging businesses and homes and some of the city's most iconic buildings. nearly 100 buildings were deemed unsafe. napa is 140 year old historic courthouse reopened about five years later in 2019. the quake caused over $1 billion in damages. it was the bay area's most powerful earthquake

since loma prieta in 1989. new developments now a person expected to be a key witness in the 2023 murder case of cashapp founder bob lee, will not take the stand. the government does not plan to call the sister of accused killer nima momeni as a witness. according to charging documents, the sister sent a text message to lee the night he was murdered in her message, she said her brother had, quote, come down way, come way down hard on him. quote when the three were talking at the time, it was considered a key piece of evidence during the preliminary hearing. since prosecutors allege she may have been the reason for a dispute between the two men. the defense now says it's not sure why she's not testifying. >> so we're under the assumption that the government was going to call her. i think that she's a necessary element for the people to explain certain things. doesn't look like they're going to do that. so we'll go ahead and consider whether or not we need to fill that void. >> yesterday was his 40th

birthday. you see, his mom bringing balloons and signs to court here. his trial is expected to start next month. now to the case of a former bay area pilot accused of trying to crash an alaska airlines passenger jet. joseph emerson, from pleasant hill, is now sharing details about what happened that day. here's abc news reporter gio benitez. >> former alaska airlines pilot joseph emerson is telling his side of the story after he was pulled off a flight in cuffs for allegedly trying to crash a passenger jet. >> its 30s of my life. i wish i could change, and i can't. >> last october, he was hitching a ride in the cockpit jump seat on a flight from everett, washington, to san francisco when he says he began to hallucinate. >> there was a feeling of being trapped, like, am i trapped in this, in this airplane? this is not real. i need to wake up. >> he stood up in the cockpit and pulled these red handles that are meant to shut off the engines in the case of a fire. thankfully, it didn't work. did

you know what the levers were at the time? >> what i thought is this is going to wake me up. i know what those levers do in a real airplane, right? and i need to wake up from this. >> two days before the flight, emerson says he took psychedelic mushrooms, hoping that it would help with depression. he blames that and a lack of sleep for the episode. >> coming into this, i hadn't really been sleeping a lot. the night that i took the magic mushrooms, and i did not sleep that that night, and so this cumulative sleep deficit, i believe, may have also impacted, just my perception of what was going on. >> emerson says he'd been suffering from depression ever since his friend scott died suddenly but never sought psychiatric treatment. worrying that a formal diagnosis could end his career, he instead turned to alcohol and eventually those psychedelic mushrooms. >> right now, there's a perception out there that if you raise your hand and say something's not right, there's a very real possibility that you don't fly again. >> emerson now speaking about it all in the new documentary, the

the beatles invaded here in san francisco. now, curators at the deyoung museum are getting ready to capture the excitement of beatlemania all over again. here's abc seven news anchor dan ashley. >> well, it certainly is nice to be here in san francisco. >> it was 60 years ago, almost to the day the beatles arriving in the bay area to kick off their first u.s. concert tour, and the images of the fab four performing before a packed crowd at san francisco's cow palace in august of 1964, are still the stuff that dreams and screams are made of. twist and shout, shout. >> come on, come on, come on, come on baby. >> and while it's a bit of a hop from the cow palace stage to the bandshell next to san francisco's deyoung museum, curator sally martin katz is hoping that same excitement will still echo through in an upcoming photo exhibit. and she met us on stage to highlight its unique point of view. beatlemania through the eyes of

sir paul mccartney. >> so this exhibition covers the period the three month intense period from december 1963 to february 1964, and so we have a rare opportunity now to see it through mccartney's eyes, to see it from their experience. >> the exhibit is called eyes of the storm candid photographs taken by mccartney himself with his 35 millimeter pentax camera and newly retrieved from his personal collection. the photos document that mad rush in the year leading up to the san francisco concert. >> i love that the title of the exhibition is called eyes of the storm, which really gets at this idea. i mean, the storm that was beatlemania arriving here in the u.s, how it took the country by storm, but also this notion of looking, of being eyes and who's looking at who and the direction of gazes. we're used to being the ones looking at them. and here he's returning the gaze. >> and mccartney turns his lens on both journalists and his

fellow beatles, giving audiences an unfiltered look at the innocent joy and unrelenting pressure of their sudden fame. >> the photographs are on the go. they're blurry. we see a sense of movement. and so, you know, they're not carefully posed images where he's thinking about composition from a very deliberate perspective, but they do, i think, have a lot of value as works of art in and of themselves. >> the photos have been on exhibit in new york and will arrive at the deyoung this spring. perhaps reigniting the excitement that swept the bay area for so many decades ago. yeah such a beautiful >> and now i have twist and shout in my head. that was our dan ashley reporting the paul mccartney eyes of the storm exhibit will be at the deyoung museum from march through early july next year. well, people are making the trek to burning man in the nevada desert. officials don't expect heavy rain like

great weekend everybody. i'm larry beil. >> thank you larry. well happening right now a tropical storm is approaching hawaii. the storm is threatening the big island this weekend. it's expected to bring heavy rain and strong winds. and officials say the breezy conditions will raise fire concerns, too. back here at home, we're certainly getting the rain to at least the tail end of it. lisa, what's the latest? >> that's right. you know, we have picked up over a 10th of an inch at sfo average for this late date in august would be about 4 or 5 one hundredths. so we are 250% of average for not only san francisco, but concord picked up rain still a little bit more to come in san francisco and in the north bay, so we're not done with it yet. you can see the lightning here. the strong area of low pressure is to the north of us. it will pivot into the mountains throughout the day today. and there's a look at the line of showers that keeps coming as we get in closer to tiburon. moving into richmond, the next 15 to 20

minutes, you can see berkeley is in its path and even emeryville getting a brief shower. powell street, look at balboa street here, downtown san francisco, the sunset. so this continues to press off to the east. and as we check out the north bay, just a smattering of light showers. the south bay hasn't seen much, but over into the east bay you saw a few showers early 4:00 this morning. so not out of the question to see this linger. perhaps in the north bay in napa throughout the afternoon. but look at the activity from the central sierra, the northern sierra. it is 31 degrees at palisades and freezing as you get up higher in height there. so really some dynamic weather for late august. there's a look at the cloud cover from mount tam. sunshine on the way for everyone the next few hours. 63. in the city. it is muggy out there from oakland to san jose with all that moisture in the air. you can see how gray it is out towards emeryville. low 60s santa rosa to 64 by the delta.

so as we go through the afternoon, things brighten up. we're already getting peeks of sun in the south bay, but drizzle spotty showers this morning. it's much warmer for your sunday, 8 to 10 degrees warmer than today, but by the pretty warm into the east bay and then into next week. the warming trend continues monday, peaking on tuesday. things get cooler. the temperatures do on wednesday. there's a look at the cloud cover. it lifts the activity into the mountains and we're left with a dry afternoon. but the fog sets up along the coast for your sunday. it will be much warmer, even the coast warming into the 70s for your monday and tuesday. what's left of this system is a couple one hundredths as we go through the early afternoon, but there will still be a few showers out there. this is the tropical storm that continues to impact the big island briefly. a hurricane into early monday and the most rain will be on the big island anywhere from about 6 to 12in. even maui, picking up a lot of rain. but on its heels is
