findings in what was this frightening and deadly crash. this wrong-way driver zipping down highway 85 in san jose for miles on monday. and there are new visuals and testimony from those who saw him driving by. good evening. i'm ama daetz tonight, the santa clara county medical examiner has identified the 47 year old woman killed in the crash. the teenage boy also killed in the same car has not been named. the suspect was seen driving in the wrong direction for several miles. he hasn't yet been charged. abc seven news reporter j.r. stone talked to witnesses about what happened and legal experts about what charges the driver may face. >> this is previously unseen cell phone video showing a toyota tacoma pickup truck going the wrong way on highway 85 in san jose. shortly before the driver slammed into a tesla, killing the two people inside. the video was recorded monday by norm juarez, who had just picked up her son from school. i'm driving at 65 or 70, but the

truck is very more faster. >> chp hasn't said how fast the driver was going, but you can see in this dash cam video, he whizzed right by other vehicles going the opposite way. >> the santa clara county medical examiner says 47 year old rebecca joann olson of san jose died in the wreck. a 14 year old boy was killed, too, but his name has not been released. both were inside. the tesla driver of the pickup was hospitalized with major injuries. we aren't naming him since he hasn't been charged. investigators say they are looking at felony manslaughter charges. >> second degree murder is not off the table at this point. a lot is going to come down to the toxicology results that we will receive later. were there any prescription drugs or alcohol or street drugs in his system at the time of this crash? >> that's legal analyst steven clark, who says they'll also look at this driver's criminal

history. initial online records show he has previously been convicted of dui in florida. >> what investigators are going to want to know is what was his mindset at the time of this driving. they're going to want to talk to people who were with him that day. was there something going on in his life that could suggest that perhaps this was intentional? >> as bad as this crash was, juarez says, it could have been worse. as other drivers dodged the pickup. so it nearly hit the cars. the three cars before the crash. >> yes, before. and scary. i say if i come a little minute before maybe me. >> officers also confirm that the pickup truck driver had been going the wrong way for more than ten minutes. many people online are very concerned about that. >> it's a legitimate question to ask whether there was some law

enforcement component that could have interceded more quickly. >> chp says that at last check, the suspect is still alive and in the hospital. j.r. stone abc seven news. >> the countdown is on at the capitol for the legislature to take action on several bills. they have fewer than four days to go. one of them deals with the story. we've been reporting a lot recently. cell phones being banned at schools. the bill that was passed today would require all public schools to come up with a plan by july of 2026 that either bans or limits the use of devices during the school day. this is something the governor has supported, calling for restrictions a couple months ago. now he has to sign the bill. some reparations for black californians are just a signature away from becoming reality in the state. state lawmakers approved two bills today that now head to the governor's desk. one would compensate people who had their land taken by the state in racially motivated instances of eminent domain. a second offers a formal apology from the state to black californians for human

rights violations. as a result of slavery and anti-black policies. the author of that bill says it will help start the healing process. >> to be able to get rid of all of that river of racism that's been going through the african american community, and it starts with the apology. >> it's been a four year process, and these are the first proposals from california's reparations task force to get full legislative approval. the abc seven originals documentary, california's case for reparations, dives into the groundbreaking work of the reparations task force and examines bills that came out of it. you can watch it any time. it's streaming now on demand on the abc seven bay area app. we are seeing new tactics in new places to try to slow down the ongoing fentanyl epidemic, an effort to build a better bay area. people skilled at making beverages and serving customers are now being taught how to treat overdoses. abc seven news reporter tara campbell has more on the local push to serve up safety. >> from mixing a drink to serving up potentially life

saving naloxone spray and fentanyl test strips firsthand, i've seen narcan at work on these streets, so it's important to have the legionnaires saloon in oakland is working to keep people safe as the drug overdose crisis continues. >> having the test strips and the narcan on hand is kind of vital, honestly, to the point that, like most of us, keep it on us, like in our purses, like in our backpacks, as we're walking down the street. >> the bar is teaming up with fence check, a nonprofit working with bars and nightclubs to help supply resources and education. >> a lot like the free condoms that you'd see during the aids crisis in bar bathrooms. we've been doing that with fentanyl test strips, allowing people to have anonymous and free access to fentanyl test strips allow people to check drugs like cocaine and heroin for the presence of the powerful opioid and resting beside the strips is naloxone nasal spray, best known as narcan. we also make sure that narcan, the life saving

drug, is out there in all of these bars and all of these nightlife, and we educate bartenders on how to reverse an overdose. >> and this saturday on international overdose awareness day, that training will be happening right here. how does it feel to know that you are equipped? >> i feel secure. i feel like there's not going to be someone dying on my hands and beforehand, that's quite literally a possibility these days. >> and she says it's about serving everyone, not just the people at their bar. >> even the people on the streets that need the help to. you know what i mean? it's community. it's not just the people that are patrons of this bar, it's the people outside, too. you know what i mean? >> tara campbell, abc seven news. >> new at 11. an in-n-out is opening in the bay area. there is no opening date, but the company's website says an in-n-out is coming soon to hayward. the location is hiring and offering a starting wage of $23 an hour, with the potential to earn up to 26.50 an hour. the

in-n-out will be at 709 harter avenue near cal state east bay's hayward campus. this new restaurant comes after in-n-out, for the first time in its history, closed a location. it was along the hagen burger corridor in oakland. that in-n-out cited crime as the reason it closed in march. all right, let's take a look outside because we felt that inland heat once again today. fortunately some late august relief is finally starting to come. our way. abc seven news meteorologist sandhya patel is tracking it all in our 24 hour accuweather forecast. sandhya. yeah, we had upper 90s and low one hundreds today. >> you can say goodbye to that because look what's showing up. yeah, the fog is here over san francisco from our exploratorium camera. and they're not the only ones dealing with that. temperatures have dropped. it's a double digit drop in hayward. napa down to ten degrees cooler than yesterday. at this time. 12 degrees cooler in san jose. so tomorrow morning, definitely layer up, give yourself a little extra time as fog and drizzle may slow down your commute. 50s and 60s on those temperatures, so a cooler start to the day, a

cooler afternoon. we will see sunshine bay and inland at noontime, and you will notice the breeze picks up mid 60s to mid 90s. eventually the fog spreading back out again in the evening hours. i'll be back with a look at your holiday weekend forecast coming right up. >> all right. we check the weather. let's check the roads. a live look tonight. it may be smooth sailing right now, but that's likely going to change tomorrow. triple a is expecting a record number of travelers for the labor day holiday. as we take a live look at the san mateo bridge. all the bay area airports expect to be bustling with travelers. bookings are up 9% this year nationwide compared to last year. the transportation security administration is anticipating its busiest labor day travel period on record, but one welcome source of relief lower prices. analysts say gas prices, airfare and overall travel costs are down compared to last year. we are following the story. take a look. this invasive, non-native mosquito known to carry diseases has been

found in north concord. the aedes aegypti mosquito hasn't been seen in contra costa county in two years. it can carry dengue fever and zika virus, among other diseases. nola woods, with vector control, says they found the mosquito in a routine west nile virus surveillance trap. you see a mosquito biting you and you swat it on your arm. >> this is not that mosquito. its common name is the yellow fever mosquito. so it's a really dangerous mosquito. it raises an alarm because where there's one, there's likely more. >> woods says these mosquitoes fly low and usually bite below the knee. the county is putting out additional traps and doing inspections in the area. new at 11. california's effort to save salmon is taking a big step forward near the oregon border by removing the last of four dams on the klamath river. the river meanders from upper klamath lake in oregon through the northern part of california, before ending at the pacific ocean. by removing the dams, more than 40 miles of the river will flow freely for the first

with a vehicle. these thefts occurred in at least 80 cities with a huge bust in southern california, where federal investigators say a rental car company supplied cars only to criminals and would tell them where to go to commit crimes. >> the criminals would fly in from south america, primarily chile, to pull off burglaries and other crimes. this investigation took six years and there were 120 cases nationwide. the indictment named 57 year old juan carlos duran as the ringleader. >> toll has been running, in essence, the hertz rental car business for thieves, furnishing them with cars that entered ventura county. and when they entered ventura county, they did so for one purpose to hit homes

and steal from businesses. >> in all, six people are under arrest. investigators say the thieves were directed to max out stolen credit cards at stores like target, best buy and home depot. the goods would then be either brought to the rental car dealership or shipped to other people involved in the scheme. the artwork of 24 san francisco public school students is now being featured on muni busses. the middle school students took part in the tasty roots art competition promoting california fruits and vegetables and healthy eating. it was opened to eight middle schools in the city, seven of which are low income schools. more than 5000 students were encouraged to create art pieces highlighting the state's specialty crops. the artwork will be featured on muni busses until the end of november, so check them out. all right, time to talk 40 niners. because fans can hardly wait for the week one kickoff as the team tries to get back to the super bowl and their road starts with monday night football on september 9th. right here on abc

seven. but before all that, members of the team found some time after practice for a very good cause. abc seven news south bay reporter lauren martinez has more on the seventh annual players for a purpose event, which we just learned raised more than a million dollars tonight. >> the 40 niners are welcoming fans back inside levi's stadium for a night of giving back 40 niners foundation's annual event, players for a purpose, benefits bay area youth on wednesday night, the faithful met and dined with the team on the field while raising money for local students in need. senior manager sophie navarro grew up in hayward. >> it is an amazing blessing to be able to give back in that way. i come from a family of educators, so this is very true to my passion and to my roots. the foundation says levi's, is

the first professional sports stadium with dedicated classrooms inside. >> students from around the bay can learn stem skills. >> we pay for the transportation to get them here. that has expanded our reach and our access. more than anything i've seen locally. >> one of the best parts of the event for fans of all ages. many of the 40 niners players attend. >> it's just great to see from the top, from our leaders on the team, our veteran guys showing our younger guys, our rookies and some of the guys who are new to the team. what this organization is all about during the off season, j.r. brown said he loves being a role model for kids here and from his hometown of trenton, new jersey. >> for me, you know, being that person that i wish i had when i was coming up, man, it's such a it's such a help. we love to, you know, play the game of football, but it's the it's the impact outside of football. you know, that really matters. >> the 40 niners will take the field here at levi's stadium on september 9th for monday night football against the jets.

>> this is my favorite part of the year. you know camp is over with. off season is over with. it's time to go at levi's stadium. >> lauren martinez, abc seven news. >> and again, less than two weeks until the niners open the season, you can watch them on monday night football against the new york jets september 9th. right here on abc seven. new at 11. it's still summer, but it's not too soon to get spooked for halloween. san jose's winchester mystery house released some ghoulish details about this year's halloween event. they've been holding their unhinged halloween interactive experiences for 100 years now. this season, it's unhinged hotel, a group of friends stranded due to car troubles enter a hotel they think is empty, but quickly learn they're not alone. unhinged hotel will run select nights starting in september on friday the 13th, so convenient. all right, we are not there yet. we are still in summer sandia and we are dealing with some heat. >> that's right. and today, those temperatures peaked in the

upper 90s to low 100. but it's going to start to feel like the seasons are changing. okay. if you didn't feel it today, i want to show you some live pictures over the next couple of days. the cooling is going to spread to our inland areas, and temperatures are going to drop closer to average, even below average in some spots by sunday. as we take a look at those live pictures, the one thing that is in common is that we have the marine layer. it has rapidly ramped up today, 1800 feet deep. considering how shallow it was yesterday evening, it's an indication when it's becoming deeper that it is going farther and the temperatures are going to drop. so today versus tomorrow, santa rosa, 93 degrees going down to 87. so six degrees cooler. you will certainly notice it livermore concord down for san jose. going from 90 to 86 degrees. and a couple of degree drop in san francisco from 68 to 66. so the marine layer will continue to deepen. this area of high pressure is going to move out of the

picture. it's this area of low pressure that is going to get closer to the coast over the next couple of days, and then get cut off. so it's going to meander there off the coastline and deepen the marine layer further. it is going to cool us off even more so as we hit the weekend. temperatures are going to drop off even more. we certainly saw the southerly surge developing a nice circulation look like a hurricane off our coast, but that's just a coastal eddy. tonight we've got the gray skies along the coast, around the bay and making their push. the marine layer is making its push towards some of the valleys. four mile visibility in half moon bay. watch out in the morning temperatures right now, anywhere from the 50s to the 70s. it is going to be a cooler start to the day, and from our bay bridge toll plaza, you can certainly see the gray skies tomorrow. cooling trend continues overnight fog and spotty drizzle. and for your holiday weekend, temperatures will drop near average and as i mentioned, by sunday, a couple spots may even be a little bit lower than average. so fog to sun on saturday for your holiday weekend, mid 60s to low 90s. a nice little variety. sunday is your coolest day. breezy

conditions, mid 80s inland and it is going to turn milder for labor day with a little bump up tomorrow morning. watch out for the fog. certainly will be a slow burn back to the coast, but at 8 a.m. you will notice still a lot of coverage around the bay and coast and then along the coastline. you're going to stay socked in most of the day going into the evening hours. your morning temperatures anywhere from the 50s to the 60s may need those wipers briefly tomorrow morning because of the drizzle tomorrow afternoon. it's breezy at the coast, 60s at the beaches, low 90s inland. we'll squeeze out maybe 1 or 294 degree readings. here's your accuweather seven day forecast. cooling trend will continue. the next few days. you get that relief from the heat and then we start out september 1st with 60s to 80, a little warmer on labor day. the heat spikes inland. so don't get too used to the idea of a break from the heat, because upper 90s to low 100 seconds, the sizzle is back. beaches will
