our support and love behind ricky. >> 40 niners general manager john lynch sharing relief and gratitude tonight at the survival of rookie wide receiver ricky pearsall recovering after being shot during an attempted robbery in union square. good evening. thank you for joining us. i'm dan ashley and i'm ama daetz. >> the team is speaking for the first time since this weekend's shooting, as we learn new details about the next steps in the case against the teenage suspect. >> san francisco's district attorney has said charges could come as soon as today. for the 17 year old accused of shooting pearsall in union square. investigators believe the teenager followed pearsall from his parked tesla, and they were both shot in the scuffle. >> now, sources briefed on the investigation tell abc news they believe pearsall was targeted for the high end watch he was wearing. da brooke jenkins has indicated she wants to try the suspect in adult court, though legal analyst stephen clark tells us a judge will make that decision. >> clark says the judge would look at any criminal history. the suspect would face harsher

sentencing if he were tried in an adult court, of course, rather than as a juvenile. we are in place at the da's office in case she speaks about this. this is a live picture of the microphones on the podium set up outside the da's office. we'll bring that to you live when it happens. >> today we're hearing from the forty-niners for the first time since the shooting, players got to visit with pearsall in person at their practice. there seemed to be an overall sense of relief, and the incident appears to be bringing the team closer together. abc seven news south bay reporter zach fuentes joins us live from levi's stadium with that part of the story, zach. >> yeah, ama the team is practicing extremely hard today ahead of their big game on monday. and they're in a good head space now too. after having seen ricky pearsall in person. now, general manager john lynch says given what happened to him, he's doing incredibly well. i have an immense feeling of relief and excitement among the 40 niners. tuesday both on the

practice field and in the locker room. >> bunch of energy in the building. >> it all comes after they got to see their teammate, ricky pearsall, for the first time since he was shot, and just hugged him and just hugged him and just just let him know, man. >> just take it at his own pace. >> and right now that's what 40 niners general manager john lynch said. they're allowing him to do for now, putting pearsall on the non-football injury list. >> we had to we had to act quickly with that decision. i wish, i wish we had some more time to make it, but ultimately we felt the number one thing we had to be concerned with was ricky's well-being. >> but according to lynch's update, pearsall may not be on that list for too long. >> it's nothing short of miraculous that he came out of this as good as he did. >> lynch, who visited pearsall at the hospital, confirmed that pearsall did not suffer any nerve or organ damage during tuesday's press conference, lynch also sent a big shout out to the sfpd sergeant, joel harrell, who was on hand to help pearsall until paramedics arrived. >> she was there for him in a real rough time, and i know how

appreciative ricky is of that. we're appreciative to the entire police department. >> pearsall first got to talk with his teammate saturday via facetime at a training camp party. >> we had a team party that was scheduled when i got to the hospital and visited with ricky as one of the first things, he said, mr. lynch, what's going on? you know, i would really like everyone to go to that party. and i'd also like to talk to some of my teammates. i said, ricky, you take care of yourself. but you know, kind of a cool moment. we were able to pipe ricky into the party and he facetimed the entire group. >> still, the team tells us nothing beats seeing him in person. >> as soon as i saw him, i smiled like i just. i smiled, went and wrapped him up, hugged him. >> the shooting that injured pearsall comes just as the team is overcoming some turbulent times. late last week, it was reported that wide receiver brandon aiyuk finally reached a deal with the team after high stakes contract negotiations. now, tuesday, it was announced that star left tackle trent williams is finalizing a new deal after a prolonged holdout with aiyuk and williams on board

and pearsall recovery, the team says they're ready for their first game of the season monday against the new york jets. >> this is a great way to open the season, against a great defense, against a great offense as well, i think it'll be a good showdown. >> now, again, while pearsall is doing well, all things considered, they are giving him at least four weeks to recover physically, mentally and emotionally after everything that happened. but general manager lynch said that he's confident that pearsall will be able to make a contribution and get back on the field this season. live at levi's stadium zach fuentes, abc seven news. >> all right, zach, thank you so much. all right. >> sports director larry beil is here. the team obviously is rattled but relieved. how does his absence as they start the season really affect the wide receiver lineup? >> you know, if they don't suffer any injuries, i think they'll be fine because he's a rookie. there's other players ahead, especially with with brandon aiyuk in camp because he was out for a while. you didn't know what the situation was

going to be. but they still have deebo. they have george kittle. i mean, the story on ricky pearsall, some of this stuff is just amazing. i don't know if he's made of titanium or what, but tim ryan, who does radio for the 40 niners, said he saw pearsall in the gym already in the gym like, i mean, he gets shot through and through and he can't. i got to go work out. so you know, that kind of leads you to believe that. it clearly is not as serious as it could have been. but in terms of ricky, he's going to be out the month if the niners don't suffer any serious injuries. now he's had a couple of injuries in training camp, so he's missed a bunch of time. this is going to be a setback for him just to get out there. but the 40 niners have a full complement of receiving options. >> yeah i mean it could have been a lot worse. thankfully you know, just thankful he's okay. but more news coming out of the 40 niners camp today. >> yes, this is big news because trent williams is a very big man. that's big number 71. so he was holding out. he didn't

report to a day of training camp until they offered this new deal. he had three years left on his contract but no guaranteed money. players don't like that because if you get hurt, then you're done. potentially. so he gets an extension for $82 million, 48 million of that is guaranteed. and the bottom line is the 40 niners without trent williams, you have no hope of reaching the super bowl. with trent williams. you might win the super bowl. so everybody knew what his value was. i have a feeling part of this was the money, and part of it was also him not being real anxious to you know, put the pads on and hit people in the heat. but here's what trent said about why it took so long to sign a guy. >> my stature, my age. you know, i thought security was important, and that was all. honestly, i hadn't did a full camp, and i don't know how long. ever since i got here, kyle has done a great job taking care of

me, you know, keeping a close watch on my reps, my workload. i definitely wasn't trying to dodge camp. you know, i'm not trying to sound like a teacher's pet, but i like camp. you know? >> well, and they like seeing him back with the 40 niners. brandon aiyuk last week. he actually admitted today. he said, you know, i probably made this a little bit more difficult than it needed to be at the end in terms of the contract extension, you think? anyway, so he's back and he's smiling and happy. and also christian mccaffrey, who has been out for several weeks in terms of missing training camp with a calf injury. he was back on the practice field again today. so the bottom line is the 40 niners, the whole the band is back together again. everybody is back. they got their money, they're ready to play. and you know pearsall will be okay. he'll be he'll be fine. he'll be fine. okay. thanks, larry. >> all right. >> well, again, the niners kick off their new season against the new york jets monday at levi's

stadium. and of course, you can watch it right here on abc seven. coverage begins at 5:00. >> all right. let's turn now to our weather and the heat. let's take a live look outside. yeah, these are the conditions right now. i mean, it looks gorgeous, but right now, a spare the air advisory is in effect, as well as some heat advisories. so for the details, let's get to abc seven news meteorologist sandhya patel. hey, sandhya. hi, there. >> yeah. ama and dan. we're going to take a look at the highs. so far, and then we'll talk about those advisories. san francisco has managed to get up to 85 degrees. oakland, you're at 89 triple digits. concord. santa rosa airport, livermore, 99, san jose 95 degrees. you can see there's a lot of sun from our golden gate bridge camera. and at this hour, temperatures are still in the 90s inland. 97 in san ramon, 93, san jose, 82 in oakland. looking at the north bay, we've gotten up to 97. in santa rosa right now. still at that hour. at this hour is what i should say. the heat advisory for san francisco until 7 p.m. tomorrow. risk of heat related

illnesses. and that advisory covers virtually all of our inland valleys and hills. tomorrow morning until thursday night. so the heat risk is going to be in the moderate to major category for our inland areas. and we also have a spare the air alert up today. up tomorrow. poor air quality for the inland east bay, the santa clara valley. and as you take a look at a live picture, you can already see there is some haze in the air. i'll be back to let you know how long the sizzle is going to stick around. coming right up, dan. all right. >> sandhya, thanks very much. in the east bay today, the city of antioch announced its plan to begin cracking down on homeless camps. this comes in the wake of governor newsom's executive order to clear out these encampments across the state. abc seven news reporter anser hassan has the details and explains why. antioch city officials feel a sense of urgency. >> i want to be very, very clear that antioch is not going to be a dump site for the bay area's problems. >> antioch mayor lamar hernandez thorpe says as san francisco and oakland crack down on their homeless encampments, he

believes many are coming to antioch. but now antioch is cracking down as well. >> i'm proposing a change to our camping ordinance that specifically includes trails like these waterways and other city assets like plazas. >> the city passed a no camping ordinance in 1996, but the mayor says it wasn't strictly enforced. in july, governor gavin newsom issued an executive order that allows state agencies to clear homeless camps. cities like antioch can lose out on funding if they don't comply. >> we have applied for close to $6 million from the state. we don't want that funding compromised. >> that money is to fund more transitional housing. currently, the city has the executive inn, which houses more than 40 people, with another 200 on the wait list. the mayor says the city is trying to provide resources for those who live on the streets, but can't neglect the concerns of residents eithe. >> we shouldn't have encampments at our trails and in our waterways because that poses a public public threat. that's not right. >> mary barnes is assistant

manager at bella rosa apartments. she says rocks have been installed along the nearby creek and trail to form a barrier, but adds the problem is getting so bad tenants are leaving. they are starting fires and, you know, at nighttime, the tenants can't sleep. >> just a lot of things are going on with the homeless. >> it's a sad day for me, for antioch. i'm really disappointed. >> nicole gardner is with the advocacy group facing homelessness in antioch. she says antioch has made some progress, but that the latest evacuation orders don't help since there isn't enough temporary housing available to offer. >> so if it's this apartment over here, they go down the street, it's going to be somebody else that's complaining, and i think it criminalizes homelessness. >> the mayor says the new ordinance will likely be introduced at next week's city council meeting in antioch. anser hassan abc seven news. >> now to breaking news. we are tracking news in san francisco with a bad crash with two cars over a cliff. you can see one of the cars right in the center of your screen. there appears to be possibly a white tesla. sky

seven is over the scene now. this is near sutro baths by the cliff house. there is the other crash car where you see all those firefighters by the building there. firefighters say the cars crashed through the wall on point lobos avenue, then went over the cliff. firefighters say they are evaluating injuries in the crash. again, this is a live look at that crash scene with firefighters responding. all the first responders trying to make sure everyone is okay right now. point lobos is closed. we will continue to monitor this and bring you any updates as we learn more. that's a bad moment coming up here. >> raising awareness about the dangers of fentanyl. a bay area mother is now calling in the heavy hitters. we'll explain how the san francisco giants are getting involved and why it's such a personal issue to the team's star pitcher. abc seven news at

and as abc seven news reporter tara campbell explains, she's teaming up with the big leagues to help get that done. >> a face larger than life and a message helping to save lives. >> one quarter pill can kill. because that's the truth. >> that's kerry luther. her son, tosh, died of a fentanyl poisoning in 2015 after taking a counterfeit xanax pill. >> you know, it will be nine years this october, but that doesn't change the trauma of having lost him that way. >> she's since been sharing his story, speaking at bay area schools and beyond, and now she wants to put up more of these billboards. >> we're trying to expand. so the billboard right now is just located in a small community in the watsonville area, which is near to where my son grew up. >> and in her efforts to go big, she's calling on some heavy hitters. the san francisco giants. >> tosh was my second born, and he was a, i'll say, rabid giants fan. >> still recalling the first

season without her son and fellow fan. so many moments where i felt like i needed to pick up the phone to call him and talk about what was happening preseason. >> and that was really hard. you know, to have that moment where it's like, i can't do that anymore. >> and now the team is helping her raise funds as part of its first fentanyl awareness day. >> we knew that we had to figure out a way to be a connector for resources for people who have shared experiences. >> star pitcher logan webb, leading the charge. an advocate himself after losing his cousin cade to the fentanyl crisis. webb talked about his cousin's death in an espn outside the lines documentary. he had been the best dad and just it's heartbreaking. >> it's something that impacted logan deeply and something that he's been really passionate about, raising awareness for and becoming an advocate for. as for kerry, she says she's grateful for the giants support and that her work will continue. >> that brings me very deep joy knowing that that other families

are being saved from this tragedy. tara campbell, abc seven news. >> still ahead here, a five year old boy attacked by a mountain lion during a labor day picnic.

now been euthanized. that's according to state department of fish and wildlife officials. the attack happened sunday afternoon while a family was picnicking at malibu creek state park. as soon as a mountain lion attacked, the boy's father charged the and fought it off with his bare hands. the boy was airlifted to the hospital with significant injuries, but was released yesterday. wildlife officials were able to locate that mountain lion in a nearby tree and euthanized it. scary. >> well, hundreds of homes are under evacuation orders north of lake tahoe tonight because of the bear fire. it's threatening the community of sierra brooks in sierra county. the fire scorched hundreds of acres and

hour yesterday, but growth did slow down today. it's burned more than 1500 acres with no containment. firefighters are focusing their efforts on protecting homes. all right, well, let's get a check on our weather because we are dealing with some heat here. we are in the triple digit heat. meteorologist sandhya patel is here. sandhya? >> yeah, it's already started. and that triple digit streak is going to continue for several days. take a look at the 24 hour temperature change. 22 degrees warmer in nevada right now. up 20 in livermore, 15 degrees warmer in san jose. as those temperatures are rising, our air quality is starting to decline. moderate pockets in yellow for parts of the bay area, and there will be poor air quality as we head into not just today, but tomorrow as well. high pressure building in. we don't have really strong winds to mix out our atmosphere, but that is why the air quality will decline. with that ridge of high pressure comes moderate to major heat risk for bayside and inland communities, shaded in oranges and reds. you will notice that parts of solano county is in

that major category. as we look at the humidity. it has really plunged 9% in fairfield, 10% in brentwood. so our fire danger is elevated as we head into the next couple of days. a live view from golden gate bridge camera. 74 in the city. it is in the 80s. oakland. hayward 93. san jose and 94. in redwood city. blue skies from our exploratorium camera are hot spots in the 90s and 100. 97 in santa rosa. triple digits. fairfield 99, concord and livermore. right now. and here's a view from san jose, where you see the sun is shining next three days. triple digit heat. inland, our coastal areas will be warmer than average as well. and fire danger elevated the next few days, particularly in the hills where it's even drier and it's still hot with a little bit of wind. so tonight, 620 you're going to notice it's still hot inland in the 90s. by 8:00 we're looking at 60s to 90s. temperatures slowly dropping off tomorrow morning, some fog at the coast, but quickly those numbers will come up by lunch. we're talking 90s

inland. and you really feel it? by the early to mid afternoon, 100 showing up in our inland valleys, 70 at our beaches. your morning temperatures with limited fog will be in the 50s to the 70s tomorrow afternoon. it is warm to hot, well above average in the south bay. 97 in san jose, 100 in gilroy. on the peninsula, you're looking at 94. in redwood city, 74 in half moon bay. downtown san francisco, 85 degrees. a 77 in the sunset district. north bay temperatures. it will be sizzling. san rafael, santa ros, calistoga. triple digits 76. in sausalito, in the east bay. upper 80s, berkeley. oakland. 94, in castro valley. head inland and it will be triple digits across the board. 102 in concord, 104 in brentwood, 103 degrees in livermore. if you're looking for relief from the heat, you'll have to wait a few days. dangerous heat tomorrow. sizzle and heat risk continues on thursday. temperatures do moderate friday, but you really don't notice it inland. relief finally arrives over the weekend

with 60s to low 90s, and by early next week we're talking 80s. so it will be a nice change of pace. ama and dan. but until then, definitely going to be hot. >> okay. thank you sandhya. >> we want to go back now to san francisco district attorney brooke jenkins on today's decision regarding charges in the shooting of 49 year ricky pearsall. >> by what happened, i also know that the san francisco community has been traumatized and now it's my job and my office's job to make sure that we have accountability in this case and that we move forward with ensuring that san francisco has a level of public safety that doesn't contribute to these types of events happening in the future. we have now filed the following charges against the minor who committed the offense on august 31st, in addition to other charges, we have filed attempted murder, including allegations of personal discharge of a firearm and

personal and intentional discharge of that firearm. we have also charged assault with a semiotic firearm, semiautomatic firearm, as well as an attempted second degree robbery charge. we expect him to be arraigned tomorrow afternoon at 1:30 p.m. at the youth guidance center here in san francisco. and again at this time, because we are dealing with a minor, there is very little that i can share beyond what i have just said. with respect to the charges and with respect to how things will move forward. i'm happy to answer it charged as an adult then? >> at this time, the charges will be filed in the juvenile court, no longer under california law. can a district attorney choose to file those charges against a minor in adult court? the only mechanism for that is to request a transfer

hearing, which requires that a judge rule on the minor's fitness to be transferred to adult court, which essentially means that the juvenile system would not be equipped to rehabilitate that minor. so going forward, my office will review the case more closely to determine whether or not we will seek that fitness hearing. >> how long until you make that decision to seek that petition? >> the amount of time that we have to decide whether to seek that petition depends on the speed at which the defendant proceeds with the case. so tomorrow, the defense will be able to make a determination of whether they want to move forward on a speedy trial basis, meaning they can invoke his right to a speedy trial, which entitles him to a trial within 30 days. if they proceed in that fashion, then we will have to make a decision within that 30 day period. if they decide to waive time, essentially waive that right to a 30 day trial, then we will have additional

time to have that consideration. what sort of penalties might a minor in this case be looking at? juvenile jurisdiction ends at age 25. so the juvenile system has to essentially lose its jurisdiction over the individual at age 25, meaning they are released back into the public, with no supervision. after that point. is jail time an option for a minor? no will go through the juvenile system and remain in juvenile custody. should the judge order that or should that be the resolution? but only in juvenile in the juvenile system, they will not be transferred over to the county jail. only if we proceed and are granted the opportunity to move this case to adult court. would he be facing adult custody time? >> i know we have to go through that process, but do you personally believe he should be tried as an adult at this time? >> this is still a very fresh investigation. we were able. we've got enough obviously, to be able to file these charges,

but it is premature for me to opine on that right now. we have a lot to review as far as not only this case, but the background of the minor, the facts. we again, sfpd is still gathering information about this crime and we will make the appropriate decision at that time when we have all of the facts. >> does he have a previous history of criminal activity? >> i cannot discuss anything about whether he does or he does not. >> can you tell us what this process looks like going forward, now that he will be referred for charges in juvenile court? what's the timeline? what's the time frame? when will your office get a chance to weigh in and ask for him to possibly be tried again? >> so whether or not we pursue a fitness hearing

where there was only one pediatrician to serve more than 10,000 children. daniel lurie said, i'm going to help. we opened a clinic for our most vulnerable children. i have worked shoulder to shoulder with him as we have brought solutions where people thought the problem was unsolvable. daniel doesn't take excuses. he holds himself accountable. and i know that he can do it for the city of san francisco.
