suspected shooter, a student at that school and the teenager accused of shooting a 40 niners player, makes his first court appearance today. >> the details just in from the courtroom as that youngster faces attempted murder charges. good afternoon. thanks for joining us. i'm larry beil and i'm kristen sze. >> developing news in georgia. now, at least four people are dead and at least nine others injured after a gunman opened fire at a high school in barrow county about an hour outside of atlanta. >> a suspect is in custody. multiple law enforcement sources tell abc news that the shooter is a 14 year old, a student at apalachee high school. >> abc news reporter reena roy has the latest. >> they're telling us to run. >> cell phone video shows the chaotic moments after police say a gunman opened fire at apalachee high school in winder, georgia, an hour north of atlanta. >> we were in class and i heard, like the shots. i heard it was like 5 or 6 shots. >> the teachers came in and they were like, everybody get on the

floor. cover yourselves. like, we were all like, hugging each other. >> family members showing up to the school in a panic, trying to get in touch with students. >> i'm so sorry. please tell me you're joking. he said, no, mom, i'm not joking. he said, they're shooting and they're shooting in the school. and the shooter is right across the hall from me. >> first responders racing to the scene this morning. >> there are four individuals who are deceased from this incident. two were students and two were teachers. >> hurry up now. come on, let's go. >> sophomore alexandra romero capturing the moments. law enforcement evacuated her classroom, telling abc news she saw who she believes was a math teacher injured in the hallway. >> my friend was in that class when he had math period, she said. like as soon as he opened the door, he got shot. >> you can see students gathered on the football field moments after gunfire rang out, some reuniting with their loved ones, others appearing to circle together in prayer. >> i was scared, i had so much fear. like i'm still shaking. >> i might not get to see my

family again. i mean my brother again. i was scared that he might not make it out. >> authorities identifying the alleged shooter as a student just 14 years old. >> his name is colt gray. again, he has been taken into custody. he will be charged with murder. and he will be tried as an adult. >> president biden has been briefed on this tragedy by his homeland security adviser. he released a statement calling for new gun laws, including a ban on assault weapons and high capacity magazines, adding, quote, we cannot continue to accept this as normal. reena roy, abc news, new york. >> the 17 year old accused of shooting forty-niners rookie receiver ricky pearsall, made his first court appearance since being charged with attempted murder and attempted robbery. now we have a sketch from this afternoon's court appearance by vicki behringer and the teen reportedly did not have any kind of reaction in the courtroom. just kind of stared straight ahead, the judge decided. the juvenile will remain detained. his next court appearance is scheduled for september 10th. the public defender says his client is sorry for what

happened during the incident. the teen was shot in the left arm. that was also, like pearsall, a through and through wound. abc seven news has received new surveillance video from the moments after pearsall was shot. you can see the suspect running and dropping a gun on the street. seconds later, police arrive and detain him right in the middle of the street. abc seven news anchor dion limb and abc seven news reporter tim johns will have much more on this case. coming up tonight at five. and when the 40 niners spoke yesterday for the first time publicly after pearsall got shot, you could sense a different energy that's been there all off season. and the fans noticed it as well. >> yeah. abc seven news south bay reporter dustin dorsey spoke with the faithful about their excitement for the season, kicking off. >> it seems like there's been a dark cloud hanging over levi's stadium in the san francisco 40 niners all offseason, from a closed super bowl loss to two major contract disputes. and now mix in a shooting of a young star. it's been a lot to take in for the faithful. >> well, it certainly has been

the off season of off seasons, for sure, but everyone is ready to turn the page right now. >> it's time to play. and i think that, you know, all those close calls, you know, thankfully everybody is okay. we signed trent. we got you know brandon in in in camp right now. so we're ready to go. >> the start of the nfl season is always exciting, but there's definitely a different buzz this year. a lot of that feeling from the incredible news that not only did rookie wide receiver ricky pearsall survive an attempted robbery that left him with a bullet wound to the chest, but the fact that he's already back with a team and even expected to play this year, the sort of good news that's felt in the locker room as well as in the stands. >> i'm so happy for him. first of all, and grateful that it wasn't anything more serious as a fan gives us one more piece of evidence that this is a guy that wants to be on the field, and that's where we should be happy that that's where his mindset is. >> pearsall will likely be standing on the sidelines monday night, when the 40 niners kick off the 2024 season at levi's

sideline. >> literally within uh- almost seeing distance if you will, of brock purdy, fred warner and nick bosa, you name it. on the sidelines, which is really exciting and certainly only a few days from now, this place will be rocking as we kick off the season with monday night football. >> also, as part of the partnership, the 40 niners and cash creek casino will celebrate native american heritage month in november. that will be a month long tribute highlighting native americans cultural heritage and contributions. and one more reminder the niners kicking off the new season against aaron rodgers and the jets monday at levi's. and you can watch it right here on abc seven. our coverage begins at 5 p.m. >> right. turning now to the weather as our stretch of hot days inland especially continues. a live look outside at our south beach camera, looking at the bay bridge, a sunny and hot afternoon. a heat advisory and spare the air alert are still in effect. let's get right to abc seven news meteorologist sandhya patel for a first look at your forecast. sandhya. >> yeah, kristen, it is definitely hot inland, no doubt

about it. but don't tell that to people near the coast and around the bay because temperatures have come down. let me show you some live pictures right now. you can see what's driving the numbers in this direction. it's the fog on the golden gate bridge, but we are seeing plenty of sun from our other towercameras 101 right now in brentwood and fairfield 99, in livermore, san francisco. you're at 66 degrees. the heat advisory was dropped for san francisco, but for the rest of the region shaded in orange. it is continuing until 11 p.m. tomorrow. risk of heat related illnesses is still there, so take it easy out there and stay hydrated. looking at our air quality, it is good to moderate right now that spare the air alert in effect today as we are expecting moderate to poor air quality. but tomorrow you will notice all areas go to moderate. so no spare the air up for tomorrow. but we are still going to have to deal with the heat. i'll be back with a full look at the temperatures for tomorrow. coming right up, larry. >> all right, sandy, we'll see you in a few minutes with the

seven day forecast. investigators are trying to determine the cause of a deadly crash that sent two cars smashing through a wall over a cliff in san francisco. that wreck happened yesterday afternoon at the cliff house on point lobos avenue. both cars have since been removed from that accident site, but you can still see some of the damage that was left behind. one driver died in that crash. firefighters tell us the driver who survived has minor injuries. it's not clear if speed played a factor in the crash. >> san jose police have made two arrests in a shooting that injured two people at a car show. the shooting happened on july 20th in the area of monterey road and south side drive. investigators say shots were fired after a scuffle between two large groups and during a fight, an adult male suspect unrelated to the fight approached. >> the group produced a handgun and began shooting into the air. he then proceeded to shoot at one of the adult male victims. >> a 26 year old suspect from union city is charged with attempted murder for the shooting. a second man from fremont is charged as an accomplice. >> a federal program that helped

people get covid 19 vaccines for free has ended, and now it could cost you to get the updated shot this fall, and it's going to be especially pricey for those who are uninsured. abc seven news reporter lena howland has the story. >> kids are back in school. fall is around the corner and public health agencies are urging people to get the newly released covid vaccine now available ahead of the cold and flu season. but a federal program that provided free covid vaccines ended last month. >> the bridge access program really was meant during the time of the pandemic to provide quickly subsidized vaccines at no cost for all members of our society. >> arnab mukherjee is an associate professor of public health at csu east bay. he says now, those without health insurance will be charged $200 for the vaccine at drugstores and doctors offices. >> people who are working in the gig economy, people who are just making just enough to not qualify for the safety net and social service programs, but yet can't shell out $200 to get a

shot. so yes, it's a considerable proportion of our population. >> those on medicare and medicaid still qualify for free vaccines, but mukherjee says with only 22% of the u.s. public up to date on their vaccines, he worries the end of this program could lead to more covid cases later this year. >> i do fear that it will lead to a peak that is comparable, if not higher, than previous. >> in the meantime, the cdc has allocated $62 million for state and local programs to provide vaccines to uninsured and underinsured adults. >> each county has been allocated not a lot of money, but there is funding through the centers for disease control and prevention that is being filtered down to the county level. so if anybody is having trouble getting a low cost or no cost vaccine to contact your county health agency to indicate that cost is a barrier as an alternative. >> he says folks can also contact the vaccine

manufacturers directly, like pfizer or moderna, requesting free or reduced price vaccines through their patient assistance programs in san francisco. lena howland, abc seven news. >> regulating artificial intelligence the bill just passed here in california, aimed at helping famous figures keep control of their name and likeness. >> amending california's constitution, the ballot measure that's up for your vote this november. that could end forced labor in state prisons and more entertainment zones. >> the new areas of san francisco being eyed as the city looks to bring the

the developer of a housing project for people at risk of homelessness, has reached a deal to build 66 apartment units. but elk grove city council pulled the plug on that project, saying it did not meet the city's zoning rules. the developer and the state then filed separate lawsuits last year, arguing the denial violated california law governor newsom and attorney general rob bonta say they'll hold or continue to hold cities accountable for providing housing opportunities for all. >> it was for people with disabilities, and it was denied 6667 unit development. at the same time, the city was approving similar sized developments, but not for people

with disabilities. >> so the project was moved to another location in elk grove and will now offer 81 bedroom apartments for lower income households. >> artificial intelligence is growing fast and laws to regulate it have been slow to come. now the state senate has passed a bill many are calling a win. it would require consent before using ai to recreate a dead performer's likeness. abc seven news south bay reporter zach fuentes has more from experts on what the bill does and how it could affect people, famous or not. >> artificial intelligence can make it easy to impersonate famous figures, type whatever you want her to say and type whatever you want her to say. >> and voila! >> the rapidly developingg technology is leading to new concerns. public figures and performers are worried deepfakes and other fabricated videos could negatively impact their legacy after they're gone. >> something we're going to probably have to start putting in our wills because we have to remember our likeness belongs to our own estate, alive or not.

>> the use of ai to recreate performers has long been an issue in hollywood. that's been the basis of strikes and much outcry. sag-aftra has had a collective bargaining agreement in place, but a bill just passed by the california senate over the weekend takes things a step further. >> ab 1836 is specifically aimed at providing postmortem right of publicity protection when it comes to digital replicas. >> joseph lawlor, a trademark attorney at haynes boone, said only around half of the states provide protections for performers likeness after they die. even so, he said, growing technology needs to be updated and existing right of publicity laws. >> digital replicas of the term is used in ab 1836 aren't discussed in any of these historical right of publicity law. it's not something that people were envisioning. >> the bill passed the senate and is now waiting on a signature from governor gavin newsom as his bill, 2602, which works to protect performers who are living from having an employer use an ai version of them without permission. sag-aftra has praised the

passing of both bills, but lawlor said these bills can have wider impact. >> even these laws can apply to individuals that aren't looking to put out a hit record or star in a film, simply because a lot of people's lives are out there on social media. >> robert chestnut is the vice president of the san francisco norcal sag-aftra union, though he couldn't comment on the union's behalf as a performer, he says the bills are a step in the right direction. >> it's just a wonderful start, but we have so much, so much more to do in the south bay. >> zach fuentes, abc seven news. >> the three year long project of restoring the uc berkeley tropical gardens is now complete. the gardens will open to the public saturday. today, our abc seven team got a preview to the redesigned indoor space featuring a larger pond, more rare plants and better visitor flow. it's a very warm, humid place, so even the water here in the house is heated to accommodate tropical water. >> lulu's. the blue lotus of the

picture. last night we had some fog and it was dense and we warned you about it. but the fog has overstayed and the sea breeze has picked up 23 miles an hour, which has helped to take those temperatures down. a live view from our san jose camera. and we have plenty of sun right now. 89 degrees. it is warm there. san francisco 66. a far cry from the 80s of yesterday. 77 in oakland. it is currently 61. in half moon bay. and from our golden gate bridge camera, you see the breeze there. you see the top of the tower is obscured by the fog. santa rosa is at 89 degrees. you're at 101. in fairfield though, so it is hot inland concord, livermore in the 90s, and napa is at 83 degrees from our o k camera. as we look back towards the city, you can certainly see the fog there and a lot of blue sky up above through friday. the summer scorcher continues inland overnight tonight. fog near the coast and the bay and your weekend outlook will feature cooler weather and near average temperatures. the heat risk for tomorrow will be moderate to major once again for our bay

side and inland communities, so be prepared for it. if you're sensitive to the heat, definitely everyone should stay hydrated and find a way to keep cool tonight. the marine layer makes its push as we head towards late tonight into the bay, and not everyone is going to see gray skies, but we certainly will have some fog around tomorrow morning hanging around into the afternoon hours. temperatures tomorrow morning, starting out in the 50s to the 70s clear inland fog along the coast tomorrow afternoon in the south bay. we're talking triple digits. morgan hill, gilroy, 96, san jose, 99, in los gatos on the peninsula, 88, in palo alto, 93. redwood city, low 70s near the coast. so maybe a little bounce back. downtown san francisco, 77 degrees 73. in the sunset district, north bay. temperatures 102 in calistoga, 99 in santa rosa, 96 in san rafael. heading into the east bay. mid 80s from berkeley to oakland. but you'll see 90s around castro valley, fremont temperatures inland will definitely reflect late summer

prisons. reporter ashley mackey, from our sister station in los angeles, has the story. yes. so six. >> yes. >> on six. supporters of proposition six gathered tuesday morning outside the century regional detention facility in lynwood to launch their campaig. if passed into law. prop six would amend the california constitution to prohibit the state from punishing inmates with involuntary work and from disciplining those who refuse to work, something this group calls a form of slavery. >> they're exploiting our labor for $0.08, $0.10, $0.12, $0.50 an hour, and we return to our communities with nothing. if we don't work, we're punished. if we do work, we're exploited. >> the prop calls for state prisons to set up volunteer work assignment programs that would take time off sentences in the form of credits, and would have the county or city establish a pay scale for inmates in local jails. chastity says she was formerly incarcerated and forced to work in the kitchen for $0.08 an hour, and because of that,

she missed out on rehabilitative programs. >> it means a lot for, people that are still in there to get rehabilitated, to get the skills that they need to come out and be, productive citizens. >> we have classes that we want to take to rehabilitate that could help us, resources that we could get in prisons that they offer. but we cannot take them because we have to work. >> according to cal matters, of about 90,000 inmates, the state prison system employs nearly 40,000 with various jobs and most earn less than $0.74 an hour. what's unclear is if the state would be required to pay the minimum wage to inmates, which could cost about $1.5 billion annually based off a similar measure that didn't pass in 2022. so we're not in charge of the budget, right? >> so we can't speak to that. what we what we can speak to is we're going to vote yes on prop six to end slavery. >> and that was ashley mackey reporting. so far, there are no organized campaigns against prop six. >> california lawmakers are making a plea to the governor to

the suit alleges four companies violated laws intended to protect youth by selling flavored nicotine pouches like zins. city attorney david chu says these products are dangerously addictive and come in sweet flavors meant to appeal to young people. nicotine pouches have recently become more popular among young people and teens. the ftc says it's reached a nearly $3 million settlement with san mateo based security company verkada. a lawsuit accused verkada of having poor security practices that led to a hacker breaking into customers devices. officials say the company's security failures exposed sensitive data to unauthorized access. ricardo was also accused of spamming potential clients with more than 30 million email ads over a three year span, and not giving them a way to opt out of receiving the messages. >> san francisco leaders are proposing four more areas of the city that could become official entertainment zones. they want zones in the mid market area

the new trend is emerging in the work world. it's called micro retirement. it's all about spreading your retirement throughout your career. yes, the wall street journal reports some workers in their 20s and 30s are taking time off now to enjoy some of their retirement savings while they're still young. that means they'll have a smaller 401 k down the line, of course. in a recent survey, nearly 80% of recent college grads expressed interest in taking time off from work to volunteer or do personal projects. and then, you know, get back in later. leanne and larry, you two kind of have kids in that age group. is that a thing? >> no. impossible okay. i have suffered from financial anxiety. had i done that? i mean, i know
