football right here on abc seven. >> always live. abc seven news starts right now. the was struggling to get hold of the gun out for because he was like out of his pocket and he was in the air and we were like, there's a gun. >> and then within seconds he was shot. >> she saw ricky pearsall get shot at union square. and tonight we are getting a new look at the suspect. moments after those shots were fired. good evening. i'm ama daetz and i'm kristen sze. >> today, the suspect made his first court appearance in the case. he is 17 years old. so in juvenile court, we'll begin our team coverage live with abc seven news reporter tim johns, who was in court today and has the latest. >> tim. >> yeah. kristen. this afternoon, the suspect went through what the juvenile equivalent of an arraignment is. he's charged with several different counts. remember some of those, including attempted murder, assault with a semiautomatic firearm, and attempted second degree burglar. the 17 year old accused of shooting san francisco forty-niners player ricky

pearsall, appearing in front of a judge for the first time wednesday afternoon. the suspect, who was joined in court by his parents, will continue to be detained in san francisco, according to judge's orders. his attorney, deputy public defender bob dunlap, speaking to the media outside the courthouse following wednesday's proceedings. >> from what little i know that this is completely out of character for him. i do think there are extraneous circumstances that haven't really formed a part of the narrative yet, but i'm still piecing that together. >> dunlap, also confirming the teen has another outstanding matter in san joaquin county, although he did not elaborate. he says his client is remorseful following saturday's incident. >> he's very sorry, genuinely, that this did happen, as is his family and i can say on their behalf as well as on my own behalf that, our thoughts go out to the pearsall family and mr. pearsall himself. >> the case has garnered significant attention across the country and once again put a spotlight on san francisco's public safety over the past few days, questions have emerged over whether the city's district attorney, brooke jenkins, would

seek to move the case from juvenile to adult court. in a 2022 press release, jenkins said she would only try to move cases that involved certain heinous crimes. while the charges her office has filed against the suspect would seem to meet that criteria, jenkins said tuesday her office has not yet made a decision over whether to file that petition. >> i don't walk into cases trying to use them as an example, so i want that to be clear, but it is my job to make sure that people understand that the culture in san francisco is very different than it was two and a half years ago. >> legal experts say getting the case moved would not be an easy task to accomplish, and the ultimate decision would rest with the judge. a potential move dunlap thinks is unnecessary. despite the high profile nature of the case. >> the only reason you're here talking to me is because mr. pearsall is a 40 niner. i mean, let's be honest about that. >> the suspect is expected to next appear in court on september 10th for a pretrial conference. but for now, live in the newsroom. tim johns, abc seven news. okay tim, thank you for that update. >> this case has unfolded

quickly. the suspect's first court appearance today came just a day after charges were announced. the forty-niners practiced yesterday for the first time since the shooting. the team put pearsall on the non-football injury list on monday. he left the hospital on sunday, the day after the shooting. and today we're getting a new perspective on the shooting from a surveillance camera in union square. >> abc seven news anchor dion lim continues our team coverage. she walks you through the video, which you'll see only on abc seven news. >> we just shot the gun three times, so we just ran an exclusive video, time stamped 3:33 p.m. saturday, august 31st. >> watch as a group of people make a mad dash down geary, running from gunshots that wounded 40 niners wide receiver ricky pearsall. >> you could see like he was, like, shot right into the chest. >> i just obtained this police report, which outlines the details of where pearsall was shot and where the suspect was apprehended. combine that with witness accounts and new surveillance, and the details are dramatic. 15 seconds after

the group runs by surveillance shows a figure dressed in all black running to. he drops a gun identified by officers as an unregistered glock, and is clutching his left arm. he walks across the street where he encounters sfpd. according to the report, an officer noticed the young man's arm was bleeding. he then asked, who shot you? do you know who did this? what's your name? the young man didn't respond. he's then taken into custody just at the corner on grant. police were tending to pearsall, who had been shot in the chest. i spoke to a number of witnesses, including a woman named shan, vacationing from manchester, england. she and her friend were just feet away from pearsall when he was shot, and we walked out of macy's and we both noticed the guy next to us because he had two big shopping bags. >> one was like a ramona and one was a big orange louis vuitton bag. >> according to the report, pearsall says the suspect told him, give me everything you got. documents show pearsall was wearing a white gold chain valued at $30,000 and a rolex

valued at $9,000 on his wrist. he wore them during an autograph signing earlier in the day. >> we walked just a few meters in front of him and could hear like commotion, and we turned around and there's this, like young, boy with black all in black, trying to grab his bags. >> as shan tells it, that's where she saw the suspect pulling the gun and the ensuing struggle for both pearsall's bags and the weapon. >> he was not giving up without a fight. he's brave. >> in san francisco, dion lim, abc seven news. when the san francisco 49 ers spoke yesterday for the first time publicly after the shooting of ricky pearsall, you could sense a different energy than has been there all offseason. fans say they noticed it too. abc seven news south bay reporter dustin dorsey spoke with a faithful about their excitement for the season, kicking off. >> it seems like there's been a dark cloud hanging over levi's stadium in the san francisco 40 niners all offseason from a close super bowl loss to two

here on abc seven. coverage starts at 5 p.m. monday. >> now to developing news. a high school shooting in georgia that left two students and two teachers dead and nine others wounded. we learned late today that the suspect, who is under arrest, came to the fbi's attention more than a year ago. about an hour ago, the agency posted on x that they've received anonymous tips about the threats of a school shooting. back in may 2023, they tracked down the suspect, who was 13 years old at the time, and spoke with both him and his father. the fbi says, quote, the father stated he had hunting guns in the house, but the subject did not have unsupervised access to them. the agency says there was no probable cause for arrest last year. now that subject is a suspect under arrest for today's deadly mass shooting. abc news reporter reena roy shows you what it was like on campus. >> they're telling us to run. cell phone video shows the chaotic moments after police say a gunman opened fire at apalachee high school in winder, georgia, an hour north of atlanta.

others appearing to circle together in prayer. >> i was scared, i had so much fear. like i'm still shaking. >> i might not get to see my family again. i mean my brother again. i was scared that he might not make it out. >> authorities identifying the alleged shooter as a student just 14 years old. >> his name is colt gray. again, he has been taken into custody. uh. he will be charged with murder and he will be tried as an adult. >> president biden has been briefed on this tragedy by his homeland security advisor. he released a statement calling for new gun laws, including a ban on assault weapons and high capacity magazines, adding, quote, we cannot continue to accept this as normal. reena roy, abc news, new york. >> and here is the live update on the shooting going on right now in georgia. investigators have said there's no evidence on additional shooters or anything, but they are looking for associates of the boy they arrested. we are listening in for you to what these investigators have to say. and of course, if there's anything important, we'll give you updates later in this newscast.

of the pandemic to provide quickly subsidized vaccines at no cost for all members of our society. arnab mukherjee is an associate professor of public health at csu east bay. >> he says now, those without health insurance will be charged $200 for the vaccine at drugstores and doctors offices. >> people who are working in the gig economy, people who are just making just enough to not qualify for the safety net and social service programs, but yet can't shell out $200 to get a shot. so yes, it's a considerable proportion of our population. >> those on medicare and medicaid still qualify for free vaccines, but mukherjee says with only 22% of the u.s. public up to date on their vaccines, he worries the end of this program could lead to more covid cases later this year. >> i do fear that it will lead to a peak that is comparable, if not higher, than previous. >> in the meantime, the cdc has

allocated $62 million for state and local programs to provide vaccines to uninsured and underinsured adults. >> each county has been allocated not a lot of money, but there is funding through the centers for disease control and prevention that is being filtered down to the county level. so if anybody is having trouble getting a low cost or no cost vaccine to contact your county health agency to indicate that the cost is a barrier as an alternative. >> he says folks can also contact the vaccine manufacturers directly, like pfizer or moderna, requesting free or reduced price vaccines through their patient assistance programs in san francisco. lena howland abc seven news. >> at the end of this month, you'll be able to get covid tests for free from the federal government. you can get four per household from covidtests.gov. so we checked today. they're not yet available, but we'll let you know when they are. >> we are following the story of a deadly collision at a san francisco landmark. this is the

damage left behind at the cliff house after two cars crashed through the wall yesterday, landing on the cliff. investigators are trying to figure out the cause of the crash. one driver died. the other driver survived. firefighters tell us that person has minor injuries. the crash happened yesterday afternoon. >> all right. we're going to turn our attention to the weather and this heat wave that we're still in the middle of. >> yes, definitely a bit of a stretch, sandhya. yeah, absolutely. we have two more days to go. >> and, kristen, let's take a look at the highs for today. got up to 102 in fairfield. that was one of our hot spots. 105 in ukiah, 100 in livermore. but it was definitely a noticeable change in places like san francisco 68, oakland 75. san jose was up to 9091. in santa rosa, 90 in san rafael and 68 in half moon bay. from our pier 39 camera, you can certainly see the fog. it is back, the sky is dimming a bit and here's a look at the temperature change. yes, a temporary drop in temperatures

today following its worst day in the history of the stock market. it lost 9.5% yesterday, which wiped out $279 billion from its market cap. nvidia is a santa clara based company and a leader in artificial intelligence chips. in mid-june, nvidia was the world's most valuable company, with a value of $3.3 trillion, but it has been on the decline since then. that's because investors have become skeptical of nvidia and other ai stocks. high sky, high valuations as the economy shows signs of stress. legal woes are also behind the company's sharp decline, according to a report from bloomberg. the u.s. justice department recently subpoenaed nvidia as part of an antitrust investigation. >> lyft will lay off workers and sell some of its bike and scooter rental business to try to cut costs. the san francisco based company is cutting about 1% of its nearly 3000 employees, according to lyft's annual report. that means just under 30 employees could be affected. lyft says the restructuring plan is expected to boost the company's income by about $20

the asteroid was about three feet in diameter, too small to pose a threat, and burned up when it hit the atmosphere. the catalina sky survey discovered the object this morning. spotting an asteroid before it strikes earth is rare. this is only the ninth to be spotted before impact. >> nasa says the boeing's starliner spacecraft will return to earth this weekend, about three months overdue. but the capsule's two astronauts have a different itinerary. reporter karin caifa is in washington with today's update from the space agency nasa on wednesday, detailing the plan to bring the beleaguered boeing starliner

space capsule back to earth without its two person crew. >> today, the boeing team powered on starliner systems and performed a variety of pre undock activities, both on the systems and crew activities to get the capsule ready to come home tomorrow. butch and sunny will review procedures as they will be the ones closing the hatches between starliner and the space station just after 6 p.m. eastern time on friday. >> starliner is scheduled to undock from the international space station, leaving astronauts butch wilmore and suni williams in space as the capsule tracks for an early saturday arrival. >> this will dip starliner's orbit into our atmosphere and will allow it to land at white sands, new mexico, just after midnight eastern. >> the starliner carried williams and wilmore to the international space station on june 5th. the plan was for the two astronauts to return home in about a week, but the starliner suffered setbacks with helium leaks, and five of its 28 thrusters stopped working. after extensive discussion, nasa ultimately decided to bring

starliner back to earth without the crew on board, but expressed confidence wednesday that the capsule itself can land. >> we have requirements for protecting the public as well. and so, you know, we have confidence in the thrusters. we went and looked at the thruster performance. the astronauts will fly home with the crew of a spacex crew dragon capsule that was already slated to make an es routine mission. >> their return expected early next year. in washington, i'm karin caifa. >> restored and reimagined. a three year long project to redesign a tropical garden at uc berkeley is now complete. the gardens will be open to the public starting saturday. today, our abc seven news team got a preview of the new indoor space. it features a large pond, rare and exotic plants, and a living plant wall. everything on display is also available for research, so even the water here in the house is heated to accommodate tropical water lilies. >> the blue lotus of the of the nile is behind us. and that's actually a research project for

court in san francisco to discuss how much longer it might last. >> abc seven news reporter anser hassan attended that hearing and has the latest. >> good evening. the hearing ended about an hour ago. federal judge william orrick says he will keep the oakland police department under federal oversight. he says he will issue an order later this week outlining what the city and the police department have to do next. cameras were not allowed in court, but oakland police chief floyd mitchell was the first to go before the judge. he laid it out in very simple terms, saying many issues could have been avoided if officers just followed procedures already in place. but judge orrick says over the years, the problem at the oakland police department is a problem in leadership. the judge praised improvements opd has made, citing crime statistics are trending downward. fewer race based traffic stops, improved data collection and analysis. but marcia carpenter peterson, chair of the oakland police commission, says opd presented more of the same a list of action items that don't work. >> i am so happy that the judge was very clear that the

philosophy that the chief. chief floyd mitchell, was pushing out was something that has failed in the past. what are the city and the police department going to do differently? >> judge orrick says along with the failure of leadership, there has been a failure to be honest and transparent, which he called, quote, inexcusable and intolerable. he believes opd leadership just wanted to sweep recent problems under the rug, either because they, like the officers involved or because they wanted to hide issues from the public and the federal monitor. the judge suggested having the internal affairs division report directly to police chief mitchell. but jim shannon, one of the plaintiff attorneys, doesn't think that will be enough. >> that's already happened. that's already been tried. the problem is not who reports to who. the problem is the integrity of the people. >> the judge set a january date for the next hearing in san francisco, anser hassan abc
