in the shooting of 40 niners wide receiver ricky pearsall appears in court. tonight we're hearing from the mayor about the charges and the police chief on the surveillance video. good evening. i'm ama daetz. we are continuing to follow the story of the shooting of 40 niners wide receiver ricky pearsall. the 17 year old accused in the

shooting and attempted robbery made his first court appearance today. these are some sketches. and the judge decided the suspect will remain detained after today's hearing. his attorney spoke to the media outside the courthouse. >> from what little i know that this is completely out of character for him. i do think there are extraneous circumstances that haven't really formed a part of the narrative yet, but i'm still piecing that together. >> it remains to be seen whether the case gets moved and the teen is tried as an adult in 2022. district attorney brooke jenkins said she would only seek to move cases out of juvenile court if there were heinous crimes. the attorney for the 17 year old doesn't think that's necessary, even though this case is garnering national attention. >> you know, we're the only reason you're here talking to me is because mr. pearsall is a 40 niner. i mean, let's be honest about that. >> the suspect's parents were there today as well. he is scheduled to be back in court next tuesday. this evening, san francisco mayor london breed spoke for the first time since charges were filed yesterday, as did the police chief. abc seven

news reporter j.r stone is following the story and joins us with their reaction. j.r. >> i talked with the mayor and police chief earlier tonight. i asked the chief if there is a belief that this young man was part of a group. he said it's definitely something they are investigating. as for the mayor, she told me the suspect needs to be held accountable for his actions. >> he's very sorry, genuinely, that this did happen, as is his family. >> an apology from the teen suspect who was arrested in the forty-niners. wide receiver ricky pearsall attempted robbery and shooting case. that suspect, who was in court wednesday seen in this all new surveillance video from saturday dropping a gun and clutching his arm shortly after pearsall was shot. also shortly after that suspect was struck by a bullet during a scuffle. earlier this week, the san francisco district attorney said she hasn't yet decided if she will try to prosecute the 17 year old as an adult. mayor london breed, who spoke at chinatown night out wednesday

evening at san francisco, says she stands by the da's course of action, whatever that may be going forward. >> i think that's the da's decision. and look, the court systems are complicated. juvenile court is a little bit different than adult court, but ultimately, whatever happens, it needs to be an aggressive action, mostly because this kid had a gun and things could have been a lot worse. >> san francisco police chief bill scott gave a recap of what happened saturday to police commissioners. wednesday night, we asked him before that meeting if the teen suspect surrendered after dropping the gun. >> i can't go to what was on his mind, but the video kind of says it all. he dropped the gun. i don't know if it was a voluntary voluntarily surrendered or not, but what i do know is officers were right there and they identified him as being a part of that incident. >> as to the teen suspects, quote, very sorry apology that came from the public defender.

sweating it out on thursday. sandhya. yeah. >> if you live inland you'll be sweating it out that's for sure. let me show you some live pictures right now from our tower. cameras don't have to worry about sweating tonight because the fog is in. and you will notice from all of our tower cameras that it is thick out there. it's certainly helped to drive our temperatures down today, but inland areas were still hot. 102 in fairfield, 100 in livermore, 96 degrees in concord. it got up into the 60s right near the coast, where the fog set around most of the day. that is going to change tomorrow once again, as a heat advisory remains in effect until 11 p.m. tomorrow. risk of heat related illnesses for those areas shaded in orange. so be prepared. here's a sampling of what you can expect. fog to start in san francisco and oakland. and then it's going to warm up. it's going to be a nice day. 77 in the city, 85 in oakland. our hot spots will be places like san jose at 96. and how about a sizzling summer day in walnut creek? 101 degrees? i'm going to be back to let you know some good news, especially if you

don't like the hot weather to let you know when you will get some relief. you better come back. we want that. okay. sounds good. >> all right. thank you. sandhya. in the south bay, the search is on for a man wanted for scamming people out of hundreds of thousands of dollars with fake inventions. he was supposed to be in court for sentencing in august, but no showed. abc seven news reporter lauren martinez shows you who authorities are looking for tonight. >> a man who santa clara county officials are calling a phony tech inventor is on the run. the district attorney's office said 67 year old dennis fountaine, once connected to the los gatos area, stole more than $350,000 from investors. >> he put out there that he created a robot called homer h.a.m.m.e.r. that would help dispense medication to the elderly and disabled. >> fountaine was convicted in may of three felony counts of grand theft by fraud. his sentencing was set for august 5th, but he never showed up. one of the four victims he defrauded

is disabled, but he's not going after vcs or millions of dolla at a time. >> but he'll go after multiple people for tens of thousands or hundreds of thousands people, like i said, just like you and me, pulling at our heartstrings. what are some of his tactics that he used to do this? having fake websites up. one of them is 100 inventors.com. that appears to be a fake website saying that he was nominated. >> the da's office wants the public to know fountaine is a wanted fugitive, and they hope to prevent anyone else from getting victimized. >> we usually talk about the phrase grooming and sexual assault, but that happens very often in fraud related crimes. >> according to the fbi, there is an alarming increase of scams nationwide. americans lost 1.6 billion from january to may of 2024, which is nearly 300

million more than the same time last year. wednesday, james barnicle with the fbi went on. good morning america to address ways to protect yourself. >> relax. don't be emotional when you're talking to people. the fraudsters want you to be emotional and make a quick decision and give money. so you should look at things with a healthy dose of skepticism. >> anyone with information on fountaine is asked to call the santa clara county da's office in the south bay. lauren martinez, abc seven news. >> now to developing news. we are getting a better picture of what happened today at a georgia high school. two students and two teachers are dead. and the suspected gunman is 14 years old. at least nine other people were taken to hospitals with injuries. the county's sheriff's office says that teen suspect was questioned last year by law enforcement over online threats to commit a school shooting. at the time, his father said the boy did not have unsupervised access to guns at home, and the boy denied making threats. there was no probable cause for further action, we're told. i

never imagined that i would be speaking to the media in my career over something that happened today, the pure evil that happened today. law enforcement says the gun used was an ar 15 style rifle. they don't yet know how he obtained it. the suspect was arrested after a brief confrontation. abc laid out its rules for the next presidential debate. there are a few key things to keep in mind. the microphones are only live for the candidate whose turn it is to speak, and they will be muted any other time. former president donald trump won the coin toss to determine the order of closing statements, and he chose to go last. vice president kamala harris chose to be in the right podium position on screen. they will time two minutes. that's how much time they will have to answer questions, two minutes for rebuttals and one extra minute for clarifications and follow ups. the presidential debate is less than a week away. it's scheduled for tuesday night right here on abc seven. our coverage begins at 5:00. it may

vaccinations has come to an end, and now we're seeing not all insurances are willing to cover the cost. those without insurance are being charged $200 for the latest vaccine at drugstores and doctor's offices. that could be a particularly big deal for the workforce of the bay area. >> people who are working in the gig economy, people who are just making just enough to not qualify for the safety net and social service programs, but yet can't shell out $200 to get a shot. so yes, it's a considerable proportion of our population. >> the cdc has allocated $62 million for vaccines for the uninsured. that means there's at least some money for every county health agency to help with that cost barrier. experts also recommend people reach out to pfizer and moderna directly to request discounts. a bill is headed to the governor's desk that would require insurance coverage for menopause symptoms. assembly bill 2467 seeks to establish menopause equity in california. many medications and therapies aren't currently covered, which could benefit millions of women.

>> on every bill that affects our health insurance, we do a cost analysis, and it really was not huge on this one. and counterbalancing that is that we see a loss of $1.8 billion of productivity in the workplace as women go through menopause, we start to not be as effective. and that's so important. we're at the height of our careers when we go through menopause, so we have to look at the effect on our economy of making sure women are cared for in this period. as well. >> if passed, it would take effect in january, and we would be the first state in the nation to require this coverage. filipino-american students and alumni at san jose state university, along with community groups across the region, are looking to build a better bay area. they're leading an effort to memorialize the legacy of filipino american farm workers. abc seven news anchor amanda delcastillo has more on the process, partnership and future. mural project. >> monumental moments in time memorialized at san jose state university. the olympic black power statue depicting tommie smith and john carlos brave protest at the 1968 olympics

stands tall. the arch of dignity, equality and justice, commemorating the united farm workers movement. hard to miss, but what is missing from the arch? according to many, the contributions of filipino american farm workers. >> right now, our part of history is left out, and i'm just grateful that our university recognizes that and is trying to make amends, basically, and make sure that we're also represented as filipino students. >> ariana locsin is the president of the university's associated students. she's also a proud filipino american fil-am for short. locsin joins a coalition of students, alumni, community groups, and more, reigniting the push for representation. and that collaborative effort brings us here to the main entrance of the sjsu student union. a high visibility spot, which is going to help amplify and preserve parts of the important and historic contributions of filipino americans. a permanent mural will be painted across these four panels. >> i think the possibilities are

endless. we have the ability to uplift various parts of filipino american history on each panel. maybe we want to incorporate into one cohesive design. i think the dialog and the discourse of the committee that's stewarding this will still have that conversation, but we really want to make sure that whatever element we want to expand more than just the filipino contribution in the united farm workers movement and just see how we can highlight all of those elements. >> alan gerwig with sjsu's filipino alumni network, says the new partnership and mural project with the university will be the focus of the september 7th inaugural alumni legacy gala, with the goal of completing installation by october 2025. filipino american history month there is an enormous responsibility, a tremendous responsibility to honor this legacy of not just community organizing. >> the united farm workers movement, and folks like laura young and vera cruz, but also the legacy of collaboration, of coalition building. >> that's asian american studies assistant professor doctor wayne

>> i take it you're done with this, ama? yeah. i mean, it could be worse. yeah. that's true. okay, we'll get through friday. that's when our hottest couple of days. and then the weekend is looking good. all right. just in time for your plans. i do want to show you our cooling influence that got underway today from our sutro tower camera. you probably notice the fog came in last night. it was dense. and then it sat around this afternoon along the coastline, taking those temperatures down along with the sea breeze. but that was a temporary respite as you look at live doppler seven, we are seeing the fog right near the coastline. it has pushed in over parts of the bay already. visibility is down to three miles and half moon bay. the fog layer is about 1000ft. it's compressing and so it's heavier down around monterey. just over a mile. two miles in salinas, san jose, reporting ten mile visibility. watch out. tomorrow morning as you may encounter some low visibility temperatures. certainly running lower just about everywhere. six degrees in san jose, concord

down seven in santa rosa and four degrees cooler in san francisco. good sleeping weather tonight, 50s to 70s on your temperatures. high pressure is going to regain control and with this downsloping wind tomorrow, i think those temperatures are going to go back up a little bit over today's high temperatures. so moderate to major heat risk for the bay and inland. tomorrow you can see the shading in orange and red. there that's the area where you have the greatest risk. so watch out for that right now from our sutro tower camera fog is just kind of hovering over downtown san francisco. here's a look at what you can expect through friday. summer scorcher inland overnight tonight. fog near the coast and bay and your weekend outlook is cooler. i'm happy to report with near average temperatures until then, staying above average for a few more days. so here's a look at your planner for tomorrow. inland areas starting out in the 60s at 8:00. quickly heating up 90 to 100. and then as we look at the bayside communities fog in the morning, you're going from the 60s at 8:00 to the 80s by 5 p.m. and

along the coastline, fog will be dense, upper 50s eventually to the low 70s. so first thing in the morning, 50s to 70s to start the day once again. watch out for the fog tomorrow afternoon in the south bay. triple digits morgan hill, gilroy, 96, san jose. on the peninsula. you're looking at 88, in palo alto, 93 in redwood city, low 70s, right near the coast. downtown san francisco, 77 degrees in the north bay 101 degrees in lakeport 99. santa rosa mid 90s around san rafael in the east bay. it's going to be warm. 85, oakland 91. in fremont. inland areas getting steamy 104 degrees in fairfield 103. in livermore 102 in concord. your accuweather seven day forecast. triple digit heat for two more days inland then those temperatures drop. you will notice that inland areas really notice it this weekend with low 90s. and we'll keep the cooling going because we don't want to hear the complaints. right. >> i knew i was just thinking drop them like it's hot because it is hot.
