wave, we're starting the day a little bit cooler than yesterday. 55 degrees in san francisco right now. 56 oakland. we've got a low to mid 60s in hayward and san jose. 57 redwood city, 55 at half moon bay. a fairly clear view right now from sutro tower looking out over san francisco. we have low to mid 50s at this hour at santa rosa, petaluma and napa, low 60s at fairfield, concord and livermore. so it's beginning to warm up a little bit in our inland areas. it's going to warm up a lot in our inland areas by afternoon, we expect high temperatures ranging from 100 to 103. in places like antioch, livermore, concord, fairfield, mainly mid to upper 90s in the north bay. today mid 90s in the south bay and around the bay shoreline where we had numerous high temperatures yesterday in the 90s. it will be mainly mid to upper 80s today. still a very warm to hot day and we still have a heat advisory in effect until 8 p.m. tomorrow. the risk of heat related illness of course, elevated under these conditions, with high temperatures ranging from 95 to 105. good morning. gloria so, you know, if you're driving to work this morning like i did,

you might experience of fog. >> i know i experienced that right here. >> this is a live look at our golden gate bridge camera. and there is patchy fog in some areas. you can see right there the sun spots that will be careful driving today. >> all right. well, gloria, i'm going to take it over here this morning. we are seeing new video of the teenager accused in the shooting of forty-niners rookie wide receiver ricky pearsall. it appears to show him dropping a gun moments after the shooting and clutching his arm shortly after. pearsall was shot near union square in san francisco last saturday. >> now, the 17 year old appeared in court for his arraignment yesterday. his parents were also there. these are some sketches from the hearing. the judge decided the suspect will remain detained. he was charged with attempted murder, assault with a semiautomatic firearm, second degree attempted robbery and several gun charges. now, after yesterday's hearing, his attorney spoke with the media outside the courthouse. >> he's very sorry, genuinely, that this did happen, as is his

family. from what little i know that this is completely out of character for him. i do think there are extraneous circumstances that haven't really formed a part of the narrative yet, but i'm still piecing that together. >> thank you. san francisco mayor london breed, who spoke at chinatown night out last night, held a firm tone when we asked about the suspect's apology. >> but at the same time, accountability has to be a part of the equation because things could have been far worse. and fortunately, they weren't. but he needs to be held accountable. >> the san francisco district attorney told us it will be at least two weeks before she decides if she will try to prosecute the suspect as an adult, they're looking at past crimes, one of which happened in san joaquin county, and also they're going through surveillance video. he is scheduled to be back in court next tuesday. of course, you will find continuing coverage of this story by going to our website, abc7 news .com. we are constantly updating the story right on the home page.

>> this morning, a big win for x, formerly known as twitter. a federal appeals court has sided with elon musk's company to block a state law on content moderation. and gloria, this could mean less transparency for all of us online. >> that's right. kumasi the 2022 california law requires social media companies to submit reports on their policies for allowing banning, or flagging content. that content includes hate speech, harassment, disinformation and foreign political interference. the idea was to provide more transparency about how social media companies were moderating content. x sued over the law, saying it was too burdensome and also violated their first amendment rights. in december, a us district judge ruled against the company, but yesterday an appeals court reversed the ruling and ordered a lower court to issue a preliminary injunction against the law. in a post on x, the company wrote, quote, this is not just a victory for our platform, but also for free speech nationwide, whether in the united states or around the world, x will always fight for free speech and against

government efforts to restrict people's rights express themselves. the appeals court says the judge should now decide if other sections of the law should be reinstated, and that includes requiring to disclose terms of service. of course, we'll stay on top of the story for you. kumasi. >> thanks, gloria. in the south bay, the search is on for a man wanted for scamming people out of hundreds of thousands of dollars with fake intentions. he was supposed to be in court for sentencing back in august, but didn't show up. abc seven news south bay reporter laura martinez shows you who authorities are looking for. >> a man who santa clara county officials are calling a phony tech inventor is on the run. the district attorney's office said 67 year old dennis fountaine, once connected to the los gatos area, stole more than $350,000 from investors. >> he put outhe created a robot called homer h.a.m.m.e.r. that would help dispense medication to the elderly and disabled.

>> fountaine was convicted in may of three felony counts of grand theft by fraud. his sentencing was set for august 5th, but he never showed up. one of the four victims he defrauded is disabled, but he's not going after vcs or millions of dollars at a time. >> but he'll go after multiple people for tens of thousands or hundreds of thousands people. like i said, just like you and me, pulling at our heartstrings. what were some of his tactics that he used to do this? having fake websites up. one of them is 100 inventors.com. that appears to be a fake website saying that he was nominated. >> the da's office wants the public to know fountaine is a wanted fugitive, and they hope to prevent anyone else from getting victimized. >> we usually talk about the phrase grooming and sexual assault, but that happens very often in fraud related crimes. >> according to the fbi, there is an alarming increase of scams

podium position on screen. they will time two minutes to answer questions, two minutes for rebuttals and one extra minute for a clarification and follow ups. the presidential debate is less than one week away. it is scheduled for tuesday night right here on abc seven. our coverage begins at 5:00. >> your electric bill could increase another $6 a month by the end of the year. p-g-and-e's is proposing another rate hike because it's still recovering from the winter storms between 2022 and 2023. it spent nearly $950 million when those storms knocked out power for millions of californians. rates have jumped 110% in the last decade. the public utilities commission approved previous hikes to also help with wildfire response and prevention. the cpuc is expected to vote on september 12th. >> a fresno principal who resigned in response to a viral video is rejoining the same school staff in a different

position. now, the video in question shows the principal engaging in what is being described as a lap dance with the school mascot during a school rally. after the video went viral last month, the principal was placed on administrative leave. the merced union high school district said the decision was part of their, quote, commitment to maintaining a safe and respectful environment for all. this morning he's returning to school, but in a new position as an associate principal. the district says it will open the principal position next spring to secure a permanent principal moving forward. >> time now for a look at our weather. we'll start with the weather headlines today and tomorrow we'll have scorching heat inland once again. two more days left in this four day heat wave where it experiencing heat advisory is still in effect until 8 p.m. tomorrow. now, the weekend outlook calls for breezy and refreshingly cooler weather right now, looking across the embarcadero under mainly clear skies. mid 50s in san francisco and oakland, 60 in hayward, 64 san jose. mid to upper 50s at half moon bay and redwood city.

now we're hearing from the ceo of a top supermarket chain, and he's promising to lower prices if a controversial merger is approved. >> he is amanda kroger ceo rodney mcmullen testified in a hearing that could determine the fate of a proposed merger with his company's rival, albertsons. kroger owns multiple brands, including food for less, which has stores right here in the bay area. albertsons owns pleasanton based safeway. the ftc is trying to temporarily block the $24 billion merger, claiming that it would get rid of competition and also lead to higher food prices. mcmullen told the court that the merger would allow the combined company to lower prices, and also to compete better with walmart and costco. when asked why food prices are up 25% since 2019, he blamed rising supplier

costs, fuel prices and credit card fees. but mcmullen is making a promise. he is pledging to cut grocery prices by $1 billion. on day one, if the merger is approved during the same hearing last week, another kroger executive admitted to gouging prices on select items above inflation levels. he said the company raised the cost of milk and eggs beyond what inflation would require for the chain to turn a profit. kumasi. >> all right. thank you. gloria. discount stores across the country are seeing a drop in customers. dollar tree shares collapsed 20% yesterday. the company announced last week it dramatically cut its full year forecast. experts say a weaker job market and inflation are pushing low income customers away. retailers like target and walmart have also been lowering prices on key products, and that's bringing customers in. dollar tree owns family dollar that is struggling to as well as dollar general. >> this morning more job cuts in

silicon valley. intel just announced it's laying off 54 positions at its santa clara offices. this is part of intel's plan to reduce its global workforce by 15%. the company is planning to get rid of 15,000 positions around the world before the end of the year. intel had a disappointing second quarter earnings report last month that prompted the company to cut costs by $10 billion. >> san francisco leaders are proposing four more areas of the city that could be official entertainment zones. these proposed zones include the mid-market area between fifth and sixth street. you can see it there on the map, and then maiden lane between kearny and grant, mark lane and the harlem place in the financial district. and then, of course, thrive city, which is already an entertainment zone. but it will be official outside of chase center. the legislation would enable restaurants and bars to sell alcoholic beverages, to go for people to consume outdoors during events. now, earlier this week. look at this. the downtown

now. and that's typically the hottest region of our of the bay area when we have a heat wave, as we're having right now. so let's take a look at our forecast headlines today. and tomorrow. we expect more scorching heat in our inland area. so two more days left in this four day heat wave. heat advisory remains in effect until 8 p.m. tomorrow, but the weekend will bring breezy and refreshingly cooler weather. our way. can't wait for that. but for this afternoon, look for highs over in the inland east bay at 101 at concord and livermore, 100 at antioch. fairfield 103 up in the north bay 95 at napa 97. santa rosa right here in san francisco, a high of 76. and across the bay in oakland, a high of 83. down to the south bay. look for 93. in san jose and 100 in morgan hill. once again, we call your attention to this heat advisory, which remains in effect for all of the bay area except the immediate bay shoreline and the coast until 8 p.m. tomorrow, with an increased risk of heat related illnesses. so we should try to limit our exposure to this heat, especially avoid outdoor strenuous outdoor activity if possible. high temperatures during this time

of heat related illness. and here's a look at the accuweather seven day forecast. cooling will arrive over the weekend and continue into early next week. let's take a look at traffic with gloria. >> good morning. so we're going to start in emeryville today. and you can see starting to get a lot busier out there, especially on the west side of the freeway if you're driving from highway four to san francisco, right now, it will take you 38 minutes. and let's go to san jose right now. looking at the 101 8-80 camera, you can see in the south bay majority of cars are commuting northbound in the san francisco direction. no major delays there. and looking at our overall map of the roads here in the bay area, you can see mostly in the green, which means no major slowdowns except on the altamont pass. which of course is pretty common. so it will take you a little longer there at this time of the morning, guys. thank you. >> gloria, we are tracking breaking news in the south bay this morning. fire crews have knocked down a three alarm fire in a strip mall in san jose. it's on alum rock avenue near capitol avenue. not too far from

680. abc seven news reporter lena howland just got there. and, lena, what can you tell us at this point? >> yeah, kumasi, we just got here a few moments ago, and i can tell you we are seeing an incredibly heavy fire response. now, take a look right here behind me. you can see these firefighters still actively working on this fire. the good news is we are not seeing any active flames, but we are still seeing quite a bit of smoke coming from this shopping center. i want to go now to some video taken a little more than an hour ago from the scene, flames could be seen coming from the roof of this shopping center. specifically, it appeared to be happening at a business called botanical santa clara, though it appears as though five different units in this shopping center may have been damaged. firefighters are still working on scene to mop up any hot spots and lingering flames. we can see up until a few moments ago, we could see

firefighters working on the roof of this building. no word yet on what may have caused this fire, though. we are expecting an update from san jose fire officials hopefully here in the next few minutes. for now, reporting live in san jose. lena howland abc seven news. thank you lena. >> developing news on that deadly school shooting at a high school in georgia. we are learning about possible missed red flags around the alleged 14 year old suspect accused of killing four people. gloria is at the live desk with more on what the fbi is saying about this case. gloria. >> good morning. kumasi officials say the alleged shooter was on law enforcement's radar for more than a year. he is accused of killing four people, two teachers and two students at his high school yesterday. investigators say that agents received tips last may about threats to commit a school shooting. they found the threats came from then 13 year old colt gray. the fbi said, quote, the father stated he had hunting guns in the house, but that his son did not have unsupervised access to them.

they said there was no probable cause for agents to take any action against him. officials believe that he acted alone and used an ar style rifle. students scrambled for shelter in classrooms and eventually the football stadium. >> a lot of people were crying. it was like. like everybody was scared and people were screaming or calling their moms and everything. >> school resource officers engaged within minutes. authorities say the suspect surrendered immediately. nine victims were taken to the hospital with injuries. they are all expected to survive. the georgia bureau of investigation says that the 14 year old suspect is in custody, and will be tried as an adult. amanda. >> all right. gloria. thank you. >> now, this morning, a woman in alabama is suing a hospital after a surgeon removed the wrong organ during surgery. last month, william and beverly bryan were in destin, florida, when

william began experiencing pain in his shoulder, neck and left side. the two went to a local hospital, where they were told william would need his spleen removed immediately. beverly says william died on the operating table after the surgeon removed his liver instead of his spleen. >> i know i'm not the only wife that has lost her husband suddenly, but the loss of my bill was exceptionally unnecessary and brutal. >> this is just unbelievable. >> now, the bryan family attorney says this is the second time in two years the doctor has operated on the wrong site in a patient. the hospital apologized to the family and says it is investigating. the doctor's name has been removed from the hospital's website, but the hospital has not released any information about disciplinary action that it has taken. >> the federal program providing free covid vaccinations has come to an end, and now we're seeing

not all insurances are willing to cover the cost. those without insurance are being charged $200 for the latest vaccine at drugstores and at doctor's offices, and that could be a big deal, particularly for the workforce of the bay area, people who are working in the gig economy, people who are just making just enough to not qualify for the safety net and social service programs, but yet can't shell out $200 to get a shot. >> so, yes, it's a considerable proportion of our population. >> the cdc is allocated $62 million for vaccines for the uninsured. that means there's at least some money for every county health agency to help with the cost barrier. experts also recommend people reach out to pfizer and moderna directly to request discounts. >> a bill is headed to the governor's desk that would require insurance coverage for menopause symptoms. assembly bill 2467 seeks to establish menopause equity in california. many medications and therapies aren't currently covered, which

could benefit millions of women on every bill that affects our health insurance, we do a cost analysis, and it really was not huge on this one. >> and counterbalancing that is that we see a loss of $1.8 billion of productivity in the workplace as women go through menopause, we start to not be as effective. and that's so important. we're at the height of our careers when we go through menopause, so we have to look at the effect on our economy of making sure women are cared for in this period, as well. >> if passed, it would take effect in january, and we'd be the first state in the nation to require this coverage. >> the city of oakland says southwest airlines continues to violate employees rights to take paid sick leave, despite a 2020 settlement. so now the city is suing. the lawsuit claims southwest does not allow workers to use their sick time and retaliates against them if they try to use it. the suit seeks payment of withheld sick leave, fines for each violation, and an order for southwest to change its practices. southwest did not admit wrongdoing in 2020, but

did restore sick hours and paid the city $53,000. the airline denies violating the law or the settlement. >> well, it is pumpkin spice season, which means halloween is coming up. >> chipotle is offering burrito themed group costumes. now the collection is made of bodysuits that resemble a chipotle napkin. for a burrito and to go bag, you see them there. you can buy the costumes online. now, some spirit halloween stores will also have them, but not in the bay area. they go on sale on september 6th and will cost a little under $40. >> that's funny. >> now, nasa says the boeing starliner spacecraft will return to earth this weekend, about three months overdue. but the capsule's two astronauts have a different itinerary. news reporter karen caifa has the latest update from the space agency. >> nasa on wednesday detailing the plan to bring the beleaguered boeing starliner space capsule back to earth without its two person crew. >> today, the boeing team powered on starliner systems and

performed a variety of pre undock activities, both on the systems and crew activities to get the capsule ready to come home tomorrow. butch and sunny will review procedures as they will be the ones closing the hatches between starliner and the space station just after 6 p.m. eastern time on friday. >> starliner is scheduled to undock from the international space station, leaving astronauts butch wilmore and suni williams in space as the capsule tracks for an early saturday arrival. >> this will dip starliner's orbit into our atmosphere and will allow it to land at white sands, new mexico, just after midnight eastern. >> the starliner carried williams and wilmore to the international space station on june 5th. the plan was for the two astronauts to return home in about a week, but the starliner suffered setbacks with helium leaks, and five of its 28 thrusters stopped working. after extensive discussion, nasa ultimately decided to bring starliner back to earth without the crew on board. but expressed confidence wednesday that the capsule itself can land. >> we have requirements for

university recognizes that and is trying to make amends, basically, and make sure that we're also represented as filipino students. ariana locsin is the president of the university's associated students. she's also a proud filipino american film for short. locsin joins a coalition of students, alumni, community groups, and more, reigniting the push for representation. >> and that collaborative effort brings us here to the main entrance of the sjsu student union, a high visibility spot which is going to help amplify and preserve parts of the important and historic contributions of filipino americans. >> a permanent mural will be painted across these four panels. >> i think the possibilities are endless. we have the ability to uplift various parts of filipino american history on each panel. maybe we want to incorporate into one cohesive design. i think the dialog and the discourse of the committee that's stewarding this will still have that conversation, but we really want to make sure that whatever element we want to expand more than just the
