now abc seven mornings live now at six. >> a new look at the teen accused of shooting a 40 niners receiver. video appears to show the 17 year old dropping a gun after the attack. the mayor now weighing in. >> and a win in court for elon musk. and x, the decision that could mean less transparency for all of us on the internet. >> then pay up just when you think your electric bill can't get any higher, the price could go up a few more dollars. again >> well good morning, it is thursday, september 5th. >> yes, we're going to get to that and keep you updated of course we have to start our forecast with spencer. yeah. >> you know, i've enjoyed filling in for drew this week and i found that later into the week. i'm getting less sleep but feeling more energetic. >> that's how it works. >> is that right? let's take a look at what's going on with the

weather. we start the day under calm conditions. the wind speeds are like up to about five miles per hour. and less, but it's a little bit cooler in most locations right now by 2 or 4 degrees or two, 3 or 4 degrees than at this time yesterday. so a cooler start is encouraging, although we know it's going to be hot in the afternoon right now, 54 degrees here in san francisco, 56 across the bay in oakland, inland east bay areas low to mid 60s. right now that's generally the first area to start warming up, although down in san jose it's in the mid 60s as well. so the south bay is getting warm. also, here's a look at what we are projecting our high temperatures will be this afternoon. we're talking about 101 at concord and livermore, 100 at antioch, 103 at fairfield, down in the south bay, 93 san jose 100 at morgan hill, and around the bay shoreline. we'll see highs in the 80s. and once again, i'll call your attention to the heat advisory, which remains in effect for virtually all of the bay area until tomorrow evening at 8:00. and now over to gloria with a look at traffic. >> all right, spencer, thank you so much. well, we've been telling you about the stalled big rig over in san lorenzo that's been causing some delays

this morning. this has now turned into a sig alert. this is on southbound 880 before eighth street. right now, the speeds are down to about nine miles per hour. and if you're driving in this area, keep in mind there are going to be some major delays there. two lanes are still blocked on southbound 880. again, that's before eighth street. we don't know when those lanes are going to reopen, so just keep that in mind. also, the metering lights are now on over at the bay bridge toll plaza. you can see that it is still getting pretty busy out there this morning from highway four to san francisco, it will take you 50 minutes. so a little bit of a slowdown there. kumasi. thanks, gloria. >> we are tracking breaking news in the south bay this morning. fire crews have knocked down a three alarm fire at a strip mall in san jose. here's the maps. you can see where it is. it's on alum rock avenue near capitol avenue, not too far from 680. now, the fire was reported just before four this morning, and more than 60 firefighters are on the scene right now as they work to knock down any hotspots that are left over from the blaze.

officials tell us this type of fire is harder to fight. >> yeah, this incident proved pretty difficult and complex due to the overhang, what we call a mansard on the alpha side or the front of the structure. so we can't see what's happening behind that mansard or overhang, and it poses a significant risk to our first responders. >> crews are currently working on the roof of the building, preventing any spread to nearby units. >> and this morning we're seeing new video of the teenager accused in the shooting of 40 niners. rookie wide receiver ricky pearsall. it appears to show him dropping the gun moments after the shooting and clutching his arm. shortly after, pearsall was shot near union square in san francisco last saturday. now, the 17 year old appeared in court for his arraignment yesterday. his parents were also there. these are some sketches from the hearing. the judge decided the suspect will remain detained. he was charged with attempted

murder, assault with a semiautomatic firearm, second degree attempted robbery and several gun charges. after yesterday's hearing, his attorney spoke with the media outside the courthouse. >> he's very sorry, genuinely, that this did happen, as is his family. from what little i know, that this is completely out of character for him. i do think there are extraneous circumstances that haven't really formed a part of the narrative yet, but i'm still piecing that together. >> san francisco mayor london breed, who spoke at chinatown night out last night, held a firm tone when we asked about the suspect's apology. >> but at the same time, accountability has to be a part of the equation because things could have been far worse. and fortunately, they weren't. but he needs to be held accountable. >> the san francisco district attorney told us it will be at least two weeks before she decides if she will try to prosecute this suspect as an adult, they are looking at past crimes. one of which happened in san joaquin county and also

going through surveillance video. he is scheduled to be back in court next tuesday. you will find continuing coverage of this story by going to our website, abc seven news.com. we are constantly updating this story right on the home page. >> this morning a big win for x, formerly known as twitter. a formerly a federal appeals appeals court has sided with elon musk's company to block a state law on content moderation. and gloria, this could mean less transparency for all of us. >> it could kumasi. the 2022 california law requires social media companies to submit reports on their policies for allowing, banning or flagging content, and that content includes hate speech, harassmen, disinformation and foreign political interference. the idea was to provide more transparency about how social media companies were moderating content. x sued over the law, saying it was too burdensome and also violated their first amendment rights. in december, a u.s. district judge ruled against the company, but

yesterday an appeals court reversed the ruling and ordered a lower court to issue a preliminary injunction against the law. in a post on x, the company wrote, quote, this is not just a victory for our platform, but also for free speech nationwide, whether in the united states or around the world, x will always fight for free speech and against government efforts to restrict people's right to express themselves. the appeals court says that the judge should now decide if other sections of the law should be reinstated, and that includes requiring to disclose terms of service. amanda. >> all right. thanks so much, gloria. now in the south bay, authorities are looking for a man wanted for scamming people out of hundreds of thousands of dollars with fake inventions. he was supposed to be in court for sentencing in august, but he never showed. now, the da's office says 67 year old dennis fountaine, once connected to the los gatos area, stole more than $350,000 from investors. he claimed he created a robot that would help dispense medication

to people who are elderly and disabled. fountaine was convicted in may of three felony counts of grand theft by fraud. his sentencing was set for august 5th, but he no showed. >> he'll go after multiple people for tens of thousands or hundreds of thousands people, like i said, just like you and me, pulling at our heartstrings. >> if you have any information about fountaine, you're asked to contact the santa clara county da's office. >> abc laid out its rules for the next presidential debate. there are a few key things to keep in mind. the microphones are only live for the candidate whose turn it is to speak, and they'll be muted any other time. former president donald trump won the coin toss to determine the order of closing statements. he chose to go last. vice president kamala harris chose to be in the right podium position on screen. they will they will time two minutes to answer questions, two minutes for rebuttals, one extra minute for clarifications and follow ups.

>> the presidential debate is less than one week away. it's scheduled for tuesday night right here on abc seven. our coverage begins at 5:00. now, the justice department is warning about online attempts to spread misinformation and cause division ahead of the november election. federal officials claim the russian government has spent millions of dollars to influence the election. in one criminal case, two employees of the kremlin media arm are t were indicted. they were reportedly part of a $10 million scheme to set up a tennessee based company to produce divisive content online. the company is called tenet media. white house national security adviser john kirby spoke on the issue. >> they're using rt and they're using social media influencers and artificial intelligence to sow disinformation and to push their own policies and programs. >> the justice department is also cracking down on russia's use of fake profiles and fake news websites. >> your electric bill could

increase another $6 a month by the end of the year. p-g-and-e's is proposing another rate hike because it's still recovering from the winter storms between 2022 and 2023. it spent nearly $950 million when the storms knocked out power for millions of californians. rates have jumped 110% in the last decade. the public utilities commission approved previous hikes to also help with wildfire response and prevention. the cpuc is expected to vote on september 12th. >> okay, let's take a look at our weather. starting the day with calm conditions and clear skies. looking across the embarcadero from our rooftop camera. current temperature readings are popping in there any second now. 54 degrees in san francisco. oakland 55. hayward 5964 san jose and mid 50s at redwood city and half moon bay. also a clear view mainly from sutro tower looking down onto the city. we see a few little patches of thin fog moving out over the city. 52 degrees in petaluma right now. mid 50s at napa and santa rosa.

62 at concord. 6862 at fairfield. concord at 60. livermore 61. the inland east bay areas are beginning to get a little warmer ahead of most of the remainder of the bay area. these are our forecast headlines today and tomorrow. we expect more scorching inland heat. heat advisory remains in effect until 8:00 tomorrow evening, and the weekend outlook calls for breezy and refreshingly cooler weather this afternoon. look for highs in the south bay 93 at san jose, 100 at morgan hill, up on the peninsula upper 80s to about 90. low 70s on the coast. downtown san francisco, a high of 76 degrees up in the north bay. we'll see. mid to upper 90s. east bay. highs generally in the mid 80s. and the inland east bay, of course, will be our warmest region with numerous triple digit high temperature readings. kumasi. >> thanks, spencer. still ahead. food and wine's restaurant of the year right here in the bay area and the ceo of one of the nation's largest grocery chains, says he'll lower prices if a merger is approved. then the embattled boeing starliner space capsule finally coming back to

the improvements opd has made, and he cited crime statistics trending down fewer race based traffic stops and improved data collection and analysis. but he said the problem lies within leadership. the chair of the oakland police commission said opd presented a list of action items that do not work. >> i'm so happy that the judge was very clear that the philosophy that the chief chief, floyd mitchell, was pushing out was something that has failed in the past. what are the city and the police department going to do differently? >> judge orrick set a january date for the next hearing. you probably noticed you are paying more for groceries, and now we're hearing from the ceo of a top supermarket chain in gloria. he's promising to lower prices if a controversial measure is approved. >> he is kumasi. kroger ceo rodney mcmullen testified in a hearing that could determine the fate of a proposed merger with his company's rival, albertsons. kroger owns multiple brands,

including food for less, which has stores right here in the bay area. albertsons owns pleasanton based safeway and the ftc is trying to temporarily block the $24 billion merger, claiming it would get rid of competition and also lead to higher food prices. mcmullen told the court that the merger would allow the combined company to lower prices and to compete better with walmart and costco. when asked why food prices are up 25% since 2019, he blamed rising supplier costs, fuel prices and credit card fees. but mcmullen is making a promise. he is pledging to cut grocery prices by $1 billion. on day one, if that merger is approved during the last hearing, that was last week. another kroger executive admitted to gouging prices on select items above inflation levels. he said the company raised the cost of milk and eggs beyond what inflation would require for the chain to turn a profit. kumasi.

>> thanks, gloria. discount stores across the country are seeing a drop in customers. dollar tree shares collapsed 20% yesterday. the company announced last week it dramatically cut its full year forecast. experts say a weaker job market and inflation are pushing low income customers away, and retailers like target and walmart have been lowering prices on key products. and that's bringing more customers in. dollar tree owns family dollar is struggling as well. so is dollar general. >> the boeing starliner spacecraft is set to return this weekend. nearly three months overdue and without its crew. friday evening, the starliner capsule will undock from the international space station. astronauts butch wilmore and suni williams will be left on the station. the capsule had been stuck since june due to helium leaks and thruster failures. >> today, the boeing team powered on starliner systems and performed a variety of pre undock activities, both on the systems and crew activities to

get the capsule ready to come home tomorrow. butch and sunny will review procedures as they will be the ones closing the hatches between starliner and the space station. >> nasa expressed confidence in the capsules ability to land itself. the crew will fly home with a separate spacex crew early next year. >> an east bay restaurant has a lot to celebrate this morning. it was just named the 2024 food and wine restaurant of the year. can you guess what we're talking about? yep. burdell in oakland. chef jeff davis specializes in soul food with a modern twist. the magazine calls this food brain meltingly delicious. that is a quote they mentioned the okra stew, smothered pork chops, and barbecue shrimp. and get this burdell only opened last year and has already gotten recognition from michelin guide. and earlier this year, chef davis was a james beard finalist for best chef in california. how

bay right now at mid 50s at redwood city. and half moon bay, and from sutro tower where we had a totally clear view earlier, we see some little areas of shallow fog pushing out over parts of the city. right now we have low 50s up north, petaluma and santa rosa, 55 at napa, 5062 at fairfield, 61 livermore, concord 60 degrees. so it's getting a little milder over in the inland east bay right now. these are our forecast headlines today and tomorrow we'll have more scorching inland heat. heat advisory remains in effect until 8:00 tomorrow evening. but the weekend will bring breezy and refreshingly cooler weather. yay for that! but for today, we're looking at more triple digit temperature readings in our inland east bay locations 101 at livermore and concord, 100 at antioch. fairfield will top out at 103 degrees down in the south bay. look for 100 at morgan hill, 93 san jose locations around the bay shoreline will still be pretty warm today, with mainly mid to upper 80s where we had low 90s yesterday and up in the north bay. mid to upper 90s will be the highs once again, i call your attention to the heat

to a viral video is rejoining the same school staff in a different position. now the video in question shows the principal engaging in what is being described as a lap dance with the school mascot. during a school rally. after the video went viral last month, the principal was placed on administrative leave. the merced union high school district said the decision was part of their, quote, commitment to maintaining a safe and respectful environment for all. this

morning, he's returning to the school, but in a new position as an associate principal. the district says it will open the principal position next spring to secure a permanent principal moving forward in an effort to curb textile waste, california has proposed a bill that would require fashion industries to fund a statewide clothing recycling program. annually, the state throws out nearly 1 million tons of clothing or textiles. the fast fashion industry has bolstered the issue, creating more clothes than are being purchased and using cheap materials. the bill would force clothing companies to fund recycling efforts. riders of the bill hope it will force companies to think more about their production habits. now a singaporean food pop up with national recognition is opening up at san francisco's metreon. dabao singapore is known for street food dishes like laksa and black pepper crab. owner and chef emily lim was a semifinalist for the james

astronomers and scientists says was streaking overhead. explain. oh my goodness. >> good morning everybody. it is thursday, september 5th. >> well, start. we'll get to that. but we want to start with the weather. >> yeah i know people excuse me are tired of hearing about the heat advisory, but it's important to point out that when the heat is this extreme, we need to be cautious about our outdoor activity. stay hydrated. of course. so we'll start with a live view from our rooftop camera. looking across the embarcadero. current temperature readings mid 50s san francisco and oakland and down at half moon bay 58. redwood city, 64 at san jose and 5859 degrees at hayward. looking out over the city from sutro tower, we see some, some thin fog, some shallow fog pushing out right now. it's not very widespread, and it's not very deep up in the north bay. low 50s right now at petaluma and santa rosa. 55 at napa. and we have low 60s in our locations over in the east bay, like 62 at fairfield, 60 at concord, 61 at livermore. this afternoon it's going to be another hot one, much like the

saying about this case. >> good morning. kumasi officials say the alleged shooter was on law enforcement's radar. for more than a year. he is accused of killing four people, two students and two teachers at his high school yesterday. investigators say that agents received tips last may about threats to commit a school shooting, and they found the threats came from then 13 year old colt gray. the fbi said, quote, the father stated he had hunting guns in the hous, but that his son did not have unsupervised access to them. they said there was no probable cause for agents to take any action against him. officials believe he acted alone and used an ar style rifle. students scrambled for shelter in classrooms and eventually the football stadium. >> a lot of people were crying. it was like. like everybody was scared and people were screaming or calling their moms and everything. >> school resource officers engaged within minutes. authorities say the suspect surrendered immediately. nine

victims were taken to the hospital with injuries. they are all expected to survive. the georgia bureau of investigations says the 14 year old suspect is in custody and will be tried as an adult. amanda. all right. >> thank you so much, gloria. now, san francisco leaders are proposing four more areas of the city that could become official entertainment zones. the proposed zones include the mid-market area between fifth and sixth streets on maiden lane, between kearny and grant at mark lane and harlan place in the financial district. and thrive city, the area outside chase center. the legislation would enable restaurants and bars to sell alcoholic beverages to go for outdoor consumption during these events. and earlier this week, the downtown san francisco partnership shared a rendering of the first entertainment zone. a portion of front street between california and sacramento will be transformed into an outdoor area for drinks, food and music. it will be the first entertainment zone in the state.

>> the city of oakland says southwest airlines continues to violate employees rights to take paid sick leave, despite a 2020 settlement, and now the city is suing. the lawsuit claims southwest doesn't allow workers to use their sick time and retaliates against them if they try to use it. the suit seeks payment of withheld sick leave fines for each violation, and in order for southwest to change its practices. now, southwest did not admit wrongdoing in 2020, but did restore sick hours and paid the city $53,000. the airline denies violating the law or the settlement. >> the federal program providing for free covid vaccinations has come to an end, and now we're seeing not all insurances are willing to cover the cost. those without insurance are being charged $200 for the latest vaccine at drugstores and doctor's offices. that could be a particularly big deal for the workforce of the bay area. >> people who are working in the gig economy, people who are just

making just enough to not qualify for the safety net and social service programs, but yet can't shell out $200 to get a shot. so yes, it's a considerable proportion of our population. >> the cdc has allocated $62 million for vaccines for the uninsured. that means there's at least some money for every county health agency to help with that cost barrier. experts also recommend people reach out to pfizer and moderna directly to request discounts. >> a bill is headed to the governor's desk that would require insurance coverage for menopause symptoms. assembly bill 2467 seeks to establish menopause equity in california. many medications and therapies aren't currently covered, which could benefit millions of women. >> on every bill that affects our health insurance, we do a cost analysis, and it really was not huge on this one. and counterbalancing that is that we see a loss of $1.8 billion of productivity in the workplace as women go through menopause, we

change with breezy and cooler weather. now this afternoon, look for highs in the low to mid 70s along the coastline. 76 here in san francisco. a little bit milder across the bay at oakland. a high of 83. mainly upper 80s around the remainder of the bay shoreline inland east bay will once again be our hottest region with highs there at or above 100 degrees down in the south bay 93 at san jose, 100 at morgan hill, up in the north bay. we'll see mid to upper 90s. and once again, the heat advisory that's been with us the last couple of days remains in effect until tomorrow evening, 8 p.m. at risk of heat related illness comes with this kind of increase in heat. so try to stay hydrated and limit your outdoor exposure to this heat. high temperatures ranging from 95 to 105 during the period covered by that advisory. going into the weekend, we can expect some significant cooling, high temperatures, that temperatures that will have been in the triple digits on friday will reach only about 90 or 92 on saturday and sunday. there will be further cooling going into early next week, with breezy conditions and a few clouds gathering. and just a hint of
