larry beil is here to kick off our coverage. larry, what a big night for the 40 niners. a chance to start again and fix some things from last time. >> absolutely. trying to get back to the super bowl after losing to the chiefs. big problem though right off the bat. here is we just learned seconds ago that christian mccaffrey is not playing tonight for the 40 niners. we talked about this at 3:00 because of the calf injury. calf slash achilles. will he go. will he not go. he's been saying all along he's going to play. except he was ruled out of the game. they don't want to take a chance. so that's already a setback for the 40 niners. now we all remember the disappointment in vegas. they lost in overtime to the chiefs. only one team this century has lost the super bowl then won the lombardi trophy the following year. that was the patriots in 2018, then in 19. so history not on the niners side here. now the off season as you know was filled with contract issues. brandon aiyuk was just minutes away from actually being traded to pittsburgh before ultimately deciding to sign his new deal. trent williams took even longer. the man regarded as the best left tackle in football got his contract issues resolved last

week. but how rusty are these guys? they've had no preseason to get in sync. that being said, the niners roster is loaded. i talked with the man who's going to call tonight's game here on abc seven, joe buck, about the niners off season and those super bowl or bust expectations. >> i mean it's been chaotic. but they kind of got in under the finish line with at least the deals that they had to get done obviously. and they're so well coached and they've got such a great game plan each and every week. i mean, i work with a guy in troy aikman that has said if he took over a team, he would give however many draft picks it would cost to get kyle shanahan to be his head coach, he's that good at putting a game plan together. so it's been enough of the tease for the 40 niners. in my mind, they're still the team to beat, especially in the nfc. and, they just got to get that one more play, that one more score to get a lombardi trophy. and i think they'll be there at the end when the super bowl is in new orleans.

>> let's hope so because we'll be there as well. let's get down to levi's stadium now. nbc seven's chris alvarez joins us. a little bit of a shock here with this mccaffrey news. >> yeah, yeah larry you referenced it at 3:00 and we didn't know if he was going to go. he said he was going to go. but tonight you know what. why risk it? it's a very long season trying to get to new orleans. so christian mccaffrey is out with a calf. we'll wait and see what that means for the next week and the weeks forward. but he is out tonight. a big blow for the niners. but they have plenty of weapons. you got brandon aiyuk back in the fold. trent williams deebo samuel the list goes on and on for brock purdy. now another special moment today. frank gore, the longtime 40 niner. he was inducted in the team hall of fame. we had a chance to speak with him one on one before his big honor. he's wearing a nice red jacket. >> first team took a chance on me and i gave them everything i had for all ten years i was here, so i'm blessed. i'm so happy to be a part of the san francisco 40 niners hall of fame, especially with some of the guys who came through this

organization. a lot of great top guys like jerry rice, ronnie lott, patrick willis, brian young. and now you add frank gore in the same. so it's a it's a great, great, great feeling and blessed. >> run me through when you got the call that you were going to the 40 niners on draft when you got drafted, >> i was with my family just waiting and but i talked to scott mcclellan during the process, and he told me he couldn't take me with the first round pick. he couldn't take me with the second round pick because my injuries, and he was like, he told me the fifth pick. trust me. i'll be calling you. but, you know, i heard that from, you know, other teams that they'll call me in the second round and when the second round came, they didn't get the call. i didn't get the call. so i was, you know, just waiting. and when the 65th pick came, you know, he was right. he was, you know, he stuck to his word. he drafted me with that pick. and once i got that call, i told myself this man was real with me. so i'm going to give this organization

everything i got. >> last one for you on the way out, when you look back at your career, what are you most proud of, >> just how doable i was. how doable i was. because man, people thought i wanted to be able to be in this league no more than two years. and i proved them wrong, i was able to play 16 years and i had a blessed, great career. >> great to catch up with frank gore as he gets honored tonight. now, a really cool moment here. ricky pearsall, we all know, is surviving from that gunshot wound. the officer saved his life right there joel harrell is here. the 49 ers invited him or her excuse me and her husband to the game. i had a great interview with her moments ago. she says all of her training kicked in and she kept ricky calm. his training of being an athlete and listening helped him get through the moment. and she's a huge 40 niners fan. she's here for the first time and she's waiting to meet ricky. he i saw him walking around the field. it's his birthday. he looks good. he dabbed up some of

his teammates, but so good to talk to her. a true life hero ahead of this game. it puts a lot of things into perspective. larry, as we send it back to you, ricky pearsall is good. hey, christian mccaffrey's hurt. he's going to be okay eventually, but that's the real stuff that changes lives. and she did a great job, helping ricky out. we can't thank her enough for what she did in her service. >> you're right, chris, i mean, it was bad enough the shooting. but when you hear that only two out of 100 people typically survive a gunshot wound to the chest, i mean that as you pointed out, is life saving work by that officer, from tailback to tailback. with christian mccaffrey out, we're going to see jordan mason, who was the backup and got a lot of work in the preseason. he's big, strong, rugged guy. but again, you know you're losing the nfl offensive player of the year last season in christian mccaffrey. and hopefully it's only a one week thing. but you know they're going to be cautious. it's a long long season. and you don't want to risk. you don't want to risk your you know your best

weapon. let's say in the first game when you think look we've got to be they hope to be playing until february. that's a long time from now. >> and they got a lot of talent on the field. yeah. >> it's not it's not like there's only one guy who couldn't do a thing. you know they got a lot of people who can score. so we'll have to watch that. >> it'll be fun to watch us against aaron rodgers, that's for sure. >> absolutely yes yes. all right. >> well the 40 niners faithful are certainly ready and fired up. and prepped for the game. >> they are fired up. abc seven news south bay reporter dustin dorsey is live in the levi's stadium parking lot, says tailgating is in full swing. dustin, how's it going out there? >> you know dan and kristen, it is going fantastic. it's monday night football, of course, we're all fired up and ready to kick off this 2024 season for the 40 niners. and who else is as excited these fans that are strolling in right here behind me? the 40 niners faithful. there's been a lot of talk this week about what's happening before the game, the tailgating policy from our vantage point, things to seem to go pretty smooth. overall, not a lot of enforcement actually happened on

some of those rules that fans were so concerned about. but bottom line was, once they got into these parking lots, that all went out the door and they were just ready for some football. the levi's stadium parking lots were empty at 11 monday morning, but the 40 niners party had already starte. hey, let's go niners. >> i've been here since 4:00 in line, so 4:00 this morning. >> yeah. my goodness, i'm the first. >> i'm the first one here. why? because that's important to get here. absolutely. yeah. it is never too early to start cooking right. >> oh never too early. >> we started at 830 this morning. we're going to go hard to 515. >> the kickoff concerns over new tailgating policies didn't stop the fun in the south bay, but some fans were still unhappy. >> the whole part of having early tailgating is to get in, get your spot, set your stuff up, get the food going, get everything ready now that's a waste. >> we're done. exactly. >> because a lot of our fans

friends don't have their own tailgating, and they'll be directed away. >> the 40 niners say directed parking rules are not new simply being enforced. this year. also starting this year, loud music taking up multiple spaces with tents and choosing where to park won't be allowed. it's angered many, but some understand. >> some groups come in and they take up, you know, they have one parking pass and they take up ten tents. they put ten tents up so that loses the well, loses revenue for them, but for the niners. but also somebody paid, somebody else paid for those parking spots. >> the 40 niners announced parking lots opened at 145, but we were there when cars filed in at 1 p.m. despite the changes, complaints and confusion, the feeling of football still took precedent. hey, go niners! a new year and a new hope for the faithful. the road to the super bowl starts now, and it begins here at levi's stadium. >> for me, it's my first monday night football game, so prime time i mean, you can't say much more than that. i mean, we're

as firefighters work to control the boyles fire. it's burned 76 acres, more than 30 buildings and at least 40 vehicles across the southern end of town since it started yesterday afternoon. right now, the fire is 40% contained, so that's better news. abc seven news reporter cornell bernard is in clear lake. he spoke with neighbors who escaped the fire but sadly lost everything in less than an hour. >> it was a life changing moment, like my home. just like fell apart and like an hour. >> esperanza hagy is thankful her family is safe after the boyles fire roared through their clear lake neighborhood sunday afternoon, the family was heading home from church when they spotted the flames shooting hundreds of feet in the air. >> but like, the fire was too close. so i was. i was like panicking. >> 4000 residents told to leave their homes as the fire grew larger, too dangerous for the gaze to return home, and hours later they learned their home was gone. >> for the past 25 years, my parents have lived there and

just lost everything. they just have the clothes that they left with, but you know, everything else is gone. >> the family sharing this photo of their home before the fire, firefighters say 30 homes were lost here, about 40 to 60 vehicles destroyed, lots of property is substantial, especially for a 76 acre fire. the fire started several hundred feet in that direction and then raced up this hillside, carried by strong winds and into the neighborhood. and one hour around fast. >> we try to stay to fight it with hoses and stuff, but it was too much, so we had to leave and get out of there and then come to find out, we come back. it's just all burnt to the ground. so sad. >> building inspectors are going door to door assessing damage and redtagged homes. >> it's pretty dramatic in a small area. it's kind of heartbreaking because some of these folks are limited income and elderly, and it's going to be tough again. >> investigators are now looking

for a cause to the fire, but say the danger is not over. >> we're still under a fire weather watch from today to wednesday, so there's going to be low rh in the afternoon and winds, which has the potential for areas that aren't 100% mopped up to flare up. we coined that time the witching hour. >> we're just figuring out insurance now. >> the horror guys are trying to move forward, but remembering the home they loved. >> i grew up in that home. yeah, i don't remember. i don't know any other home except that one in lake county. >> cornell. bernard abc seven news. >> weather conditions in clear lake could affect the fire fight against the boyles fire. so let's check in with abc seven news meteorologist sandhya patel for a look at what things are looking like there right now. sandhya. kristen. >> not favorable at this hour. let me show you the temperature near the fire 92 degrees. so it is definitely hot. relative humidity is low 19% and the winds are gusty southwesterly to 16 miles an hour. when we go hour by hour. in just a moment, i'll show you the winds. but first let's talk about the

temperatures. so tomorrow it is going to cool, which will help the firefighters. then as we head towards the next few hours, the winds remain gusty. tonight at 5:00 they will start to taper as we look at the air quality in the area, it is obviously impacting it to the north, but here locally we don't have any impacts. we have good to moderate air quality. i'll be back with a look at a changing forecast for the bay area. coming right up. dan okay sandhya, thanks very much. >> an elk grove woman is under arrest and charged in a wild terrorism investigation that includes a hit list as well as calls for bombings and soliciting attacks on politicians and government officials. >> the defendants disseminated a list of, quote, high value targets for assassination. the list included targets, names, their addresses, and photographs. >> federal agents revealed the stunning details of this indictment. this morning. they say 34 year old dallas humber is one of the leaders of what they call the terror. graham

collective, a transnational group that solicited hate crimes and the murder of government officials online. humber and 37 year old idaho man were arrested on friday. authorities say humber and her organization also encouraged mass casualty attacks and attacks on infrastructure. >> the defendants were motivated by their ideology of white supremacy and accelerationism, an ideology centered on the belief that the white race is superior and that violence and terrorism are necessary to ignite a race war and accelerate the collapse of the government. >> prosecutors say humber and her partner provided instructions for making and detonating bombs, and shared an instructional video that explained how to find federal buildings that would be suitable targets. >> a show of support today for an unhoused san francisco woman who is fighting a very serious illness and also fighting the city. the group faith in action bay area, held a rally this morning outside zuckerberg general hospital in support of

carmen marquez. the group claims marquez contracted meningitis while in a city operated homeless shelter earlier this year. she had to have one of her legs and multiple fingers amputated. members of faith in action say the city rejected carmen's request for appropriate support for her medical condition, asking for dignified housing, permanent housing, state to comfortable housing that meets carmen's necessity needs. by phone from her hospital room. we reached out to the city for a response to the claims. they said, quote, privacy laws prohibit us from commenting on the particulars of any client's case. that said, we have not had any reports of an outbreak at any of our city funded shelters, and we cannot substantiate the claim. >> listen to this. seniors in their 80s, 90s even 100 who were displaced after a fire in san francisco's japantown are not backing down. they're refusing to leave their temporary shelter

until their demands are met. >> abc7 news anchor dion lim went in search of answers for the elders from the jones senior home. >> i almost fell into depression because i didn't know what was happening. >> 91 year old yong lim remembers the fire that ripped through her senior housing facility along fillmore street. like it was yesterday. >> some firemen came and lifted me and took me downstairs. >> the blaze on may 10th forced more than 50 seniors at the jones senior homes to find new housing. many relocated temporarily to this extended stay building in alameda, but on september 4th, residents who lived on the second floor of the jones were given this letter saying restoration work was done and they needed to move back by september 6th. >> in two days, like it's impossible for them to move back, i feel worried and concerned. >> we need time. >> panicked and confused due partially to the language barrier. men and women in their 80s 90s and even as old as 103

grabbed their belongings and walkers and attempted to move back. this 92 year old, with an ailing back reduced to tears. >> even if they move in, it's really hard to live under these conditions, under that management. >> nonprofit groups such as asians are strong and the korean community center of the east bay, who have been aiding seniors with food and transportation since the fire, are now helping, along with the asian law caucus, to foster more communication between the seniors and the alton management group that oversees the jones i reached out to billy hutton of alton management. he acknowledged things could have gone smoother and apologized, promising more communication going forward in different languages. >> this is what we want. we want them to speak their mind and actually be able to express their opinions and have a voice. >> as the rest of the residents wait to hear back on what's next, lim knows what she wants. >> she can. >> my number one thing is just to be nice to us. they're very rude, and i think the number one thing is i want the managers to

away. there's our clock right there. so 39 minutes and 11 seconds from kicking off our coverage of monday night football. and of course, the 40 niners are starting their season. so fans packing levi's stadium right now, everybody in their red and gold. so at 5:00 you can watch it right here. >> join us for that. but let's move on to some other news. the protests that led to some tense clashes with police on the uc santa cruz campus have now led to a lawsuit. the aclu and other civil rights groups are suing uc santa cruz for banning more than 100 students and faculty members from the campus. those students were arrested at a pro-palestinian protest back in

may. the lawsuit claims the arrests and the ban were, quote, punitive, profoundly unfair and unconstitutional. >> the sfmta says the redesign of the center bike lane that's caused a lot of problems and controversy along a stretch of valencia street in san francisco is now in its final stages. we've been following this story for months now. the transit agency has been coordinating with business owners on valencia about moving the bike lane closer to the sidewalk to make that happen. each business owner with a parklet will have to choose to keep their parklet next to the sidewalk with a bike lane or closer to cars, or push the parklet out and allow the bike lane to run next to the curb. option two would mean the parklet will take up space that could be for parking. >> that has been one of the big question marks that we needed to get answered. so currently there are 26 parklets on this eight block stretch on valencia and 20 that 21 of them would like to stay against the curb so they would not be moved at all.

going to drive those temperatures down, kick up the winds right now you will notice that the marine layer is still hanging around parts of the coastline. most areas have noticed their temperatures coming down. the winds are picking up, gusting to 30 at oakland. here's a look at what you can expect. the next few hours. so 5:00 tonight it will be breezy across the coastal areas out towards the delta going into 7 p.m. now we take you into tomorrow morning. winds start to drop off only to pick back up again tomorrow afternoon and evening. and even stronger winds are coming. beyond that, a live view from pier 39. it is a beautiful one. a lot of sun. it looks like visitors are enjoying 63 in the city, 69 in oakland you're in the 70s. hayward, san jose, redwood city and half moon bay, 63 degrees. here's the fog from our emeryville camera as we look towards the golden gate bridge 70. from santa rosa to petaluma. napa our warm spot. fairfield at 92 degrees 88, in livermore. santa cruz camera showing you a lot of sun right now that is going to change

tonight. the fog spreads inland. we're certainly going to see some more cloud cover as well. fall like weather with below average temperatures for tomorrow and the next few days. we are looking at breezy to gusty winds. so tonight if you are stepping outside the fog along the coastline inland areas at 520, still in the 80s, dropping off to the 70s by 8 p.m. you will certainly notice the fog advancing pretty quickly tomorrow morning, starting out with some spotty drizzle, a lot of fog and cloud cover even into the valleys. and then as we head towards the afternoon, not exactly what you would expect around this time of year. so those temperatures will be running below average. morning numbers will be in the 40s and 50s for most of you. definitely bundle up before you head out the door because you will need that extra layer in the morning tomorrow afternoon, 62 degrees in half moon bay where the clouds will linger. breezy conditions there along the coastline and inland areas will be, in the 80s, really pleasant, but certainly not going to feel like summer around here. here's a look at the accuweather seven day forecast. gusty and much cooler, especially inland. tomorrow a minor rebound on

palace of fine arts. >> they'll also feature things like a customizable action button that will replace the mute button, letting phone owners do things like translate a phrase or turn on a flashlight. they'll be equipped with a physical button that opens the camera. >> the camera control elegantly blends hardware and software. when you click, it launches the camera. >> some of the features shown at monday's event were previewed at apple's worldwide developers conference in june, and the stakes for apple have been high, with the company coming into the ai game later than others. many have looked to apple's jump into ai as an opportunity for it to improve iphone sales. many of the apple ai functions announced will be part of the newest update to ios 18. the new smartphones will be in stores september 20th. tech expert mark venus said monday's announcements could take some time to really motivate the average person to go out and buy the latest model. i think it's going to be it's going to require some type of killer application that may not be may not even be available yet, or something that, hey, i have this phone, i have this capability,

711. late last night. >> now we're learning more about what led up to this incident. we were in touch with police about it just a short time ago. abc seven news reporter lena howland is in san jose. >> reports of an active shooter in the area of 711. the call is at 4278 center road. >> a sidewalk covered in glass. after san jose police shot a man they say had been shooting into the air randomly, both inside and outside of a restaurant sunday night, injuring one man and blowing out a nearby 711 front windows. >> i got scared myself because when he was shooting, it was so you know, so strong that we had to cover our years. >> by the time police arrived on scene, acting san jose police chief paul joseph says he still had a gun in his hand. >> the suspect was still armed with his stolen 45 caliber semiautomatic handgun that he

was raising above his head. officers attempted to deescalate the situation, giving the suspect commands to drop his weapon, but the suspect did not comply. >> joseph says the suspect then pointed his gun at officers, causing four officers to shoot him. each of those officers has at least three years of experience. the suspect was taken to the hospital where he later died. jose rodriguez was helping out at the restaurant when the shooting happened. i heard when they asked him to drop the gun and that's it, because i was back there in the restaurant with the girls, the waiters and the cook to try to make them calm down. he says while he didn't personally know the suspect, the man was a regular at the shopping center. chief joseph says he had been drinking at the restaurant earlier that day. >> we are learning that the suspect had estranged himself from his family. he was drinking heavily and had made comments regarding suicidal ideations. by all accounts, we believe the suspect was determined to have

an armed confrontation with police and unfortunately shot a bystander during his self-created melee. >> san jose mayor matt mehan saying he's grateful for the swift actions of officers that may have saved lives. >> i believe that the reason that this was not a much worse tragedy than it already is because our officers responded quickly and courageously and did what they needed to do to ensure the safety of others who were there. >> lena howland abc seven news. >> we continue to follow the investigation underway after the shooting of san francisco 40 niners wide receiver ricky pearsall. abc seven news has learned the teenage suspect in this case brought a gun to school the week prior to the attack. a report from the tracy police department shows details about an incident on august 21st at stein high school. that's an alternative school for troubled students. the student's name and personal information are redacted or obscured from the

report because he's a teenager. that same teenager is accused of shooting pearsall in the chest during a robbery attempt on september 1st in union square. pearsall is recovering from the attack and doing very well. the 17 year old suspect is facing attempted murder charges. the district attorney's office is deciding whether to ask for a hearing to determine if he should be tried as an adult, and this update comes as ricky pearsall is celebrating his 24th birthday. the forty-niners instagram account posted this message wishing pearsall a happy birthday. he's not playing tonight as he remains on the 40 niners non-football related injury list, as we reported here earlier. but the niners posted this instagram video of as pearsall walked into levi's stadium this afternoon. he was dressed in denim and looked to be in very good spirits. it's his birthday after all. the pearsall shooting will obviously be on the minds of niners fans tonight, as the season kicks off. here's another live look at levi's stadium. the countdown clock shows 22 minutes,

seconds on my mark until monday night football kicks off right here at 5 p.m. on abc seven. all right. >> we're going to shift gears here. fairfield police have arrested a man they believe stabbed a stranger on an amtrak train last night. a 21 year old victim suffered stab wounds to his chest and was hospitalized in critical condition. police are commending another passenger who bravely took the knife away from the suspect and detained him until police got there. the 23 year old suspect is from sacramento and faces charges, including attempted murder. the motive is unclear. police say neither the victim nor that brave passenger knew the suspect. on the peninsula today, the san mateo county sheriff's office held a ribbon cutting ceremony for its new headquarters in redwood city. this building was once the old mcguire jail, where sheriff christina corpus says she started her career as a young correctional officer. she says the new headquarters is going to be good for the sheriff's office and the public forward facing to the public an opportunity for all of our services to be under

countdown clock on the screen and major, major news we got only minutes ago. tailback christian mccaffrey not playing for the 49 ers tonight. mccaffrey is nursing a calf slash achilles injury throughout training camp now he insisted just last week that he was fine and he was going to play. but it's a long season. the 49 ers do not want to risk losing last year's nfl offensive player of the year by making a hasty decision before game one, a torn achilles that would end the season before it starts. so they're going to be cautious with this. jordan mason will get the start at tailback. he's big, strong runs hard, played a bunch in the preseason, but not as dynamic as mccaffrey and doesn't catch the ball as well out of the backfield. so look for that and i'm sure they'll be talking about all night long on the broadcast. all right. let's check in with abc7 news reporter j.r. stone who's live outside
