[ cheers and applause ] oh, jimmy. the one thing i know. i saw the word scrabble and i was like, "oh, my god!" a normally quiet east bay neighborhood is rocked by a rare, deadly shooting. witnesses are giving us a clearer picture of how this all unfolded. good evening. i'm ama daetz and i'm dan ashley. >> thanks for joining us tonight. an apparent case of road rage turns deadly in orinda. one person is dead and another has been detained. it happened at the intersection of las vegas road and la esperanza road just before 1 p.m. >> abc seven news reporter j.r stone is following this developing story and spoke to

neighbors about what they heard. >> detectives looking for clues after a deadly shooting in the orinda hills. witnesses who were on scene when officers first arrived described a situation similar to what was heard from police dispatch. keep in mind p here stands for reporting party. the one who also fired the shot. >> we have a murphy advising. he defended himself and he's in a dark gray vehicle. one party is bleeding profusely. okay, now males on the ground or p advising the subject, pulled a gun out and started punching him. and then the rp shot him. >> i work from home. i was at my computer and i just heard a loud bang that honestly sounded like a gunshot. but i'm thinking no, that seems strange. then my dog starts barking. >> neighbors in the area tell us it appeared the man who was shot and killed was driving the forerunner, while the older man who fired the shot was driving the tesla. >> and i came out and saw the police, and i looked down here and saw the cars and the police

trying to resuscitate somebody. >> those life saving measures proved unsuccessful. this intersection was then closed off for much of the afternoon. >> it's scary. it was shocking. also, it was shocking because, you know, this area is so quiet after so many years. nothing has happened like this in this area. so people were really shocked. >> the man who fired the shot has been detained by deputies. i did reach out to the contra costa county sheriff's office to see if he has been officially arrested, if he faces any charges, or if this was a case of pure self-defense. i'm still waiting to hear back from the department in orinda. j.r stone abc seven news. >> a fremont man is under arrest accused of assaulting a flight attendants on a frontier airlines flight bound for sfo monday. according to court paperwork, the 30 year old man tried to choke. one flight attendant pushed another and kicked one about six times in the leg, leaving bruises. the justice department says this all

happened after he pulled down an oxygen mask from the overhead compartment and started yelling obscenities. the flight was en route from john wayne airport in santa to ana sfo had to be diverted to ontario international airport in san bernardino county. the suspect faces federal charges of interfering with flight crew members and attendants. >> we continue to follow the law enforcement crackdown on retail theft across the state. the first numbers are out on arrests since the state put millions of dollars toward combating these crimes. thursday, governor newsom signed the final bill to complete a legislative package to combat retail theft. that was today. last october, 55 cities and counties across california received more than $260 million in grants. as part of this crackdown. since then, nearly 7000 arrests have been made in cities and counties that received the money. that includes nine suspects charged with stealing nearly half $1 million of goods in santa clara county. >> we also then figured out who

the fences are, who the people that were reselling these goods. and when you arrest and prosecute the resellers, you really dry up the market for organized retail thieves. >> the da says that in the last year, california businesses lost about $8.5 billion to retail theft. new at 11, a winery in the south bay finds itself locked in a dispute with santa clara county. the issue here is housing. the vineyard is allowed to manage and its family to live in on the property in an rv, but the county says that is actually breaking the law. abc seven news south bay reporter lauren martinez with legal action that's now being taken. >> michael ballard has owned savannah chanel vineyards in saratoga since 1996. >> one of the things that i just always felt from the beginning was that we were doing the right thing. >> in 2013, ballard let his vineyard manager, marcelino martinez, move his family into an rv on the 60 acre property. after an inspection in 2017,

ballard said santa clara county sent a letter that it was illegal to let someone live in a recreational vehicle on the winery property. >> they have no home, so we're going to we're going to make a family homeless so that you can enforce an ordinance that says you can't live in a recreational vehicle when there are hundreds, if not thousands of people living in recreational vehicles all over the county. and you aren't enforcing that. >> martinez has worked for ballard for more than 20 years. >> trabajando aqui este me ha gustado mucho trabajar aqui. >> martinez says he really likes working here. he started when he was young and has raised his family here. his children go to schools nearby. ballard said the county eventually started issuing them fines that have accumulated to more than $120,000 in. >> vamos a yo creo, vamos a dejar todo ya y yo me voy a ir para qué se acabe esto? >> martinez told mike they'll leave so this can be over. but ballard told him no and they will fight for them to stay. in

this weekend as we take a look at a live picture right now. the waxing gibbous, the newly renovated transamerica pyramid in san francisco. looking good as visibility is terrific. right now. here's a look at your day planner. patchy fog in the morning. temperatures mainly 50s. there will be a few 60s. the sun's out at noontime. it's going to be summer warmth for us at 4:00, mid 60s to low 90s. and breezy and still mild later on in the evening. so here's a sampling of your high temperatures. it's going to be 71 degrees in the city. the best time of year. 78 in oakland 89 summer warmth for walnut creek and you will notice 86 degrees in san jose where the sun is going to come out. we have some big changes ahead. it's not just the cooler, fall like feeling. we're going to get this weekend. we have chances of showers. i'll be back with that in just a few minutes. >> dan okay, sandhya, thanks very much. now to your voice, your vote. we have a lot of news from the campaign trail tonight, with the candidates crisscrossing the country following tuesday's debate. we'll start with former president donald trump. he is

returning tomorrow to the bay area for another fundraiser. abc seven news has learned he's going to woodside and the event is apparently being hosted by billionaire tom siebel. to get in will cost people anywhere from $3,300 to half $1 million. the former president made a rare visit to san francisco in june for a fundraiser hosted by david sacks. that one brought in $12 million for his campaign. meanwhile, don't expect another debate between the former president and vice president kamala harris at the end of a lengthy social media post today, he said, quote, there will be no third debate. he also said it at a campaign appearance. trump debated kamala harris, as you know, on tuesday, and joe biden back in june. the harris campaign is calling for a rematch almost immediately after tuesday night's debate wrapped up, but trump said he is simply not interested in that. during a campaign event today in arizona, trump claimed he won the debate. vice president harris spent her day campaigning in north

carolina. she had two events, starting in charlotte and then later in greensboro. both drew larger audiences, which could be a good sign for harris. the last time a democrat won north carolina was barack obama, by the way. back in 2008. she was one has one campaign stop scheduled for tomorrow night. that one will take place in pennsylvania. >> new developments with the collapse of baltimore's francis scott key bridge. investigators found a loose cable on the cargo ship that crashed into the bridge in march. why is that significant man still seeing that video again? it's hard to hard to watch. that cable could have caused the electrical issues that led to the ship losing power, then veering off course. the details come from new documents released by the national transportation safety board, but they do not include any conclusions. those will be revealed when the ntsb releases its final report. p-g-and-e's rates are going up again. it's the fourth time this year state regulators approved the hike, which amounts to about $6 a month. p-g-and-e's says the increase is needed to recoup

was called and the new special, oprah takes a deep dive into ai where the technology is going and the risk it poses. she talks with a wide variety of guests, from gates to fbi director christopher wray and openai ceo sam altman. >> do you think it's moving too fast? >> my current belief is no, but i could imagine things that would change that quickly. and i would say, okay, this is moving too fast. >> like what? what would change that if we made an ai system that was better at doing ai research than all of openai, and you could push a button and just say, improve, really fast. >> that's an example of something i think would be moving too fast. >> very intriguing. the special ai and the future of us will be available on hulu starting tomorrow. >> the largest wildfire burning in california has now burned more than 51,000 acres and is 0% contained, according to cal fire. >> the bridge fire is also threatening more than 5000 structures. nearly three dozen

homes have been destroyed by the fire burning in los angeles and san bernardino. san bernardino counties. that's according to local media. one resident spoke out after losing their home in the fire. >> how are you feeling right now? >> uh- mixed feelings. very overwhelmed. maybe i can start doing some facials and massages again. and. but we have to do it one day at a time. >> parts of eastern los angeles county and western san bernardino county are under evacuation orders. the fire has been burning since sunday, and we are monitoring other fires throughout the region as well. the airport fire in orange and riverside counties. that one is about 5% contained as of thursday night. tonight, that's according to cal fire. parts of those counties remain under evacuation orders. cal fire says that fire has burned more than 23,000 acres, threatening nearly 22,000 structures. two structures have been destroyed ten firefighters and two civilians have been injured. and outside reno tonight, the davis fire is about 56% contained,

according to the u.s. forest service. that's up from 37% contained wednesday night. fires burned nearly 6000 acres. the forest service says the fire has stayed in its footprint throughout the day today. temperatures in the area expected to drop into the 40s tonight as crews continue to work. meanwhile evacuation orders are being lifted in some areas and several schools in reno are expected to reopen on friday after a year of work and a $1 billion investment. >> the transformation is complete at san francisco's transamerica pyramid. it's cause for celebration tonight. the iconic building is all lit up as part of a grand reopening, creating quite a buzz on the street tonight. tonight's laser show on the east side of the pyramid follows an edm concert earlier this evening, and all of it to celebrate an extravagant renovation and several new attractions on the property. the celebration started earlier today with a ribbon cutting and a reception. the building is now part of the transamerica pyramid center, and a historic block

that includes the pyramid plus two adjacent buildings. there's the transamerica redwood park, a renovated grand lobby, conference spaces, and on the 27th floor, the new sky lounge. >> today is the day that we open this place to the public for the people to come to enjoy the art shows, the restaurants, the activities, or just come and have lunch at the redwood park. >> it's pretty exciting stuff. the ground floor of the pyramid will feature cafes, a bookstore, and a flower shop. >> building a better bay area can take many forms, and tonight it's turning a pop-up museum into a permanent fixture. a $2 million grant is giving black culture and history a new place to call home on the peninsula. the dominique hoskins black history museum and learning center began as a pop up museum. executive director carolyn hoskins tells me that the idea began 25 years ago as a school project for her grandson, dominique. >> he says to me, granny, i am doing another report on doctor

king because i know everything there is to know about him. so his question was, why aren't there any other famous black people that did anything? >> that got her inspired? over the years? it's been a family affair to create more than 200 categories of black history for people of all ages to enjoy. they traveled to different schools teaching children about the history. >> we wanted to focus on the fact that african americans do more than just entertain and sports our main focus is education because there is so much of our history, which is so rich, so great that people have no clue about it. so that's the important part. >> now, with the help of a grant, the pop up museum finally has a home on jefferson in redwood city, and the nonprofit

can't wait to host more visitor. and carolyn's goal is that when you leave, you've had such a good time that you want to come back. she knows when people hear museum, they think boring, but that is not the case. i mean, did you see her purple hair and her cool earrings? you know, it's not going to be boring, interesting, fascinating and important stuff. >> yeah, absolutely. all right, nice job. all right, let's talk about the weather forecast. >> yes. important as well. especially as we inch closer to the weekend. meteorologist sandhya patel is here. sandhya. >> yeah. that is very important i agree. and that was pretty cool though. let's take a look at some live pictures right now from our towercameras. visibility is fantastic. as you can see, visibility is good because we don't have a lot of fog around. it's very patchy near the coast. i do want to tell you about the drought monitor. it just came out today. unfortunately, 61% of the state is now in the d0 or abnormally dry category. it's the lowest category and the bay area is now

part of it. so we are in one of our drier months and it is definitely taking a toll, as we've had month after month of very little precip. but that is going to be changing possibly as we look here, pretty strong trough is coming in on sunday. it's going to drop those temperatures, kick up the winds and there's a possibility between sunday night and monday that we could see some showers here in the bay area. certainly possibility of sierra snowfall. as you can see on monday, that's not the only system. there's another one coming through here on wednesday. and that could bring us another round of this now september. typically we don't see a lot of rain. i'll show you that in just a moment. here is a deep low that is developing and that's what's going to be the driving factor for the first system. rainfall averages for september. oakland gets about a 10th of an inch. same thing for san francisco 1310 hundredths of an inch in santa rosa, less in san jose, livermore and gilroy. so it's not out of the question that we could see some moisture, but not

tomorrow. you can enjoy the sunshine. high pressure controlling our weather brought us the warm up today that is going to continue tomorrow. as we look at live doppler seven, all is clear. other than a few patches of fog, your temperatures right now, anywhere from the 50s to the 70s well inland, and a live view from sutro tower. another gorgeous view there. tomorrow sunny, mild to warm day. this weekend we're looking at cooler, gusty below average. it's going to feel like fall. and then monday comes around and there's that chance of showers and drizzle. so we start your morning off with just a few areas of fog. temperatures will begin first thing in the morning in the comfortable zone. 60s coast side, 80s inland by noontime, and by the afternoon we pop you up into the upper 80s to low 90s for the warmest spots. so yes, it's going to feel like summer morning temperatures in the 50s and 60s tomorrow afternoon. a mild to warm one. south bay 86, san jose, 88, in gilroy on the peninsula 77 san mateo, mid 60s. coast side a nice day in downtown san francisco, 71 degrees north bay, upper seconds
