>> cheers to more than a beer. to a big deal. california's first ever entertainment zone, which is right here in the bay area. good evening. >> i'm ama daetz, and i'm dan ashley. thanks for joining us. this idea of an entertainment zone has been years in the making, and now it's a reality in the bay area. >> we're talking about the block of front street between sacramento and california in downtown san francisco. right now, it's hosting the city's oktoberfest, which means the bars there can sell beer on the street. >> abc seven news reporter luz pena is live on front street, where thousands of people literally are expected as this event continues tonight, loose. >> cannon. emma. this is a monumental day for bars and restaurants here in san francisco. they were expecting about 4000 people, but as you can see, they have absolutely surpassed that number. many people coming here for the first ever entertainment zone. it's a victory for bars and restaurants throughout san francisco. this is the first entertainment zone in the state is a really big

deal. >> so but some people don't know is this is years and years in the making. >> ben bleiman is the owner of harrington's bar and grill and also the founder of california nightlife association. there were key supporters of senate bill 76, which made entertainment zones possible. we're full, fully staffed. >> i had to hire ringers to come in from my old businesses and people, friends of friends, to come in because we don't even have enough staff to cover what we're expecting today. >> before sb 76 took effect this year, people had to consume alcoholic beverages in the bar or restaurant where they bought them. this bill makes it possible for people to carry those drinks onto the sidewalk or in the street of a designated entertainment zone. the one behind this bill, senator scott wiener. >> this new law that we passed gives cities the ability to decide uh- whether they establish one of these entertainment zones and thus allow local bars and restaurants to participate. >> friday's entertainment zone activation celebrates

oktoberfest, a one day block party. the city hopes will attract more people to the area. >> we're really looking to view downtown in a different light. it's not just a place for folks to come work anymore, it's actually a place to come and enjoy and have a good time. >> this entertainment zone is set to be one of many to come. >> there will be more. there have been other parts of the city, including ones that already have street festivals that want to turn it into an entertainment zone because it will be more flexible. >> and this definitely feels like pre-pandemic times. and this is obviously one of san francisco's strategies to bring people back to downtown. and he, it's working. this is one of another event that's also taking place here in san francisco tonight at 7 p.m, people can go to civic center plaza for a free concert live here in san francisco. luz pena abc seven news. >> what about beyond this one? is san francisco planning more of these? >> yes, actually, there are four

other entertainment zones set to happen in san francisco in the coming months. obviously, this one proves to be a success, so i'm sure that we're expected to see many more. back to you, emma. >> sounds good. thank you so much. loose the entertainment zone is an effort to revitalize downtown san francisco. but what about other neighborhoods like mid-market x, formerly known as twitter, has officially moved out. abc seven news building a better bay area reporter leon melendez takes a look. coming up at 638, firefighters are recovering from yesterday's crash when a fire truck overturned in southern california. >> they were returning from a 12 hour shift battling the airport fire, which has spread now to more than 23,000 acres. >> i had an opportunity to meet with them last night very late last night, and it was absolutely heartbreaking, as we stand here today, i think we're all still a bit of shock. we've got a tough road ahead. many of the injured are going to be hospitalized for quite a while.

>> two firefighters have been released from the hospital. six others were taken to trauma centers. two of them are in critical condition in the intensive care unit. shock and disbelief over today's arrest of a cal fire firefighter. the 38 year old man from healdsburg is suspected of setting a string of arson fires over the last six weeks. abc seven news reporter cornell bernard spoke with local firefighters and the suspect's estranged wife about the arrest. >> i'm still processing this, but, yeah, he's not here. he doesn't live here. nor has he. >> the estranged wife of a 38 year old cal fire apparatus engineer wants to stay anonymous, but says she's speechless about her husband's arrest for felony arson. abc seven news is not identifying the firefighter until he's been officially charged. here's a facebook post of him wearing cal fire gear. >> i don't think anyone will have any idea that this had been happening. >> you sound like you're in shock about this. >> i'm 100% in shock. >> cal fire officers arrested the suspect friday morning at

the howard forest fire station in willits. the department suspects him of causing five brush fires in sonoma county. this summer while he was off duty, including the alexander fire on august 15th. the windsor river road fire on september 8th. the geysers fire on september 12th, and the geyser and kindle fires on september 14th. cal fire says all five brush fires burned less than an acre of wildland. due to the quick action of residents and firefighters, cal fire's director says, i am appalled to learn one of our employees would violate the public's trust and attempt to tarnish the tireless work of the 12,000 women and men of cal fire. tyler says information from the public helped make the arrest. >> it's a tough pill to swallow for all of us local firefighters, some who responded to the fires over the summer are saddened by the news. when you read that press release and you know, understand that that's someone that's supposed to be out in the community protecting us, and they're actually putting us all in harm's way. it's hard,

hard to read. >> the suspect will be booked into the sonoma county jail on suspicion of arson to forest land. he's scheduled to be arraigned next week in sonoma county. cornell, bernard. abc seven news. >> a judge is delaying his decision on whether to dismiss charges against three alameda police officers in the 2021 death of mario gonzalez. the judge says he will issue a written ruling next month on whether to dismiss manslaughter charges against the officers. gonzalez died three years ago while being taken into custody. he was 26. the officer's attorneys argued this morning the da's office didn't file all the necessary paperwork in time to meet the three year statute of limitations. prosecutors say they did meet the necessary requirements outside of court. gonzalez's family and other community members gathered to protest bogus a sham investigation cleared these cops. >> it's only because the people demanded that a new da be elected, that we even have a shot at justice reviews by the previous da. >> the sheriff's office and the city of alameda all found the

officers were not criminally liable. the alameda county coroner's office later ruled gonzalez's death a homicide caused in part by the stress of the altercation in the south bay. a santa clara man has been accused of the murder of someone he may have known. almost 40 years after the crime occurred. joseph anthony abeyta faces 25 to life if convicted of killing jesus ibarra of san jose. abc seven news south bay reporter justin dorsey explains how detectives linked abeyta to the case after all these years. >> a cold case in the south bay dating back to 1987. now back in the spotlight. the murder of then 46 year old jesus ibarra went unsolved until now. >> that's one of the challenges in a cold case. but we're we're happy and eager to overcome those challenges and obtain justice for the victim's family. they were present here in court today, and they just want justice. >> 37 years have passed since the time of ibarra's death. police did not identify a

suspect then, but dna evidence tested this year just linked santa clara native joseph anthony abeyta to the crime. abeyta is already in jail for gun possession and identity theft, but is now charged with murder and faces 25 years to life in prison. >> his dna was collected as a part of his arrest in that existing case, and we had the codis hit. so the codis is the database for dna. and then we went ahead and did a confirmation to confirm the dna that was collected upon his arrest for the other case. and confirmed it was a match. >> the investigation into ibarra's death began in april 1987 here on nordale avenue in san jose. san jose police say he was strangled with a power cord inside his apartment. evidence obtained by the santa clara county district attorney's office suggests the two men knew each other. ybarra's car was located a day before he was found dead, burned from the inside out on peach court, just three miles away from ybarra's home. this is less than a block from where county records showed abeyta was living. one month after the murder. abeyta is newly tested dna matched dna

the public and journalists. >> abc seven news i-team reporter melanie woodrow questioned attorneys and court staff about the issue, and the next day there was an unscheduled hearing. >> and she's here now with the latest on this. melanie. >> dan and ama. these documents have since been filed after the judge ordered the defense to do so. an attorney i spoke to said this is a first amendment rights violation for journalists and for the public. prosecutors and defense attorneys met wednesday at san francisco superior court for a hearing to make arguments about what evidence they say should be allowed or excluded in the bob lee murder trial. he is accused of stabbing and killing the tech executive in april of last year. several of those motions were heard in private. the judge cleared the courtroom after both sides agreed the discussion could taint a potential jury pool. prosecutors had filed their motions with the clerk's office, but defense attorneys did not. instead saying they had emailed them to the judge and prosecutors. yeah, we emailed everything to the parties and the judge in a timely fashion. david schneider is executive director of the first amendment coalition. it's

a violation of the first amendment to exclude the public and the press. how about the filings? why aren't your filings at the clerk's office? i talked to the clerk. we filed them. did you file with the clerk's office? can you tell were they filed today? no. what? do you know the date offhand? i don't. i'm sorry. schneider says there are reasons records can be filed under seal, but that didn't happen here. what? >> it appears to have happened here is the lawyers just did an end run around all of that and simply didn't file the papers in a public place and if that's what happened, it's deeply troubling. >> in addition to asking his defense attorneys about the missing filings on wednesday, i asked the court public information officer, the clerk's office supervisor, and the courtroom manager. the following day, an unscheduled hearing was held where the judge blasted his defense attorneys for not following court rules and filing their documents on the public docket. the i-team obtained the court transcript, in which the judge ordered the defense to file by noon that day. i was going to ask you what happened,

but to be perfectly honest, i'm not interested in the answers, said the judge. she later said, this won't happen again. follow the rules if you don't. that puts us into a universe that i don't want to be in, and i'm sure you don't want to be in. so just do things the right way. attorney tony brass told the judge he was responsible. florida based defense attorney sam zanganeh told the judge we were under the impression these were fillled. i apologize, this is unacceptable. this is not how we practice. >> this is a federal constitutional issue. it's a first amendment issue. and depriving the public of access to records that are filed in court is a violation. whether you're in florida or in california. >> the documents ultimately filed publicly thursday include the defense's trial, brief motions in limine and response to the people's motions in limine. >> delayed access is denied access. they assert he acted in self defense. >> we also learned what evidence his attorneys want excluded from the trial. this includes surveillance video of momeni speaking with a private investigator, in which

prosecutors allege he made three distinct stabbing gestures and an overhead throwing gesture. video and pictures from the execution of a search warrant at his home, allegations he engaged in activities involving sex workers, allegations of drug use, evidence that he didn't turn himself in to authorities after lee's death. statements that the knife used came from his sister's apartment and text message evidence from jiménez's family regarding his state of mind or character. in open court wednesday, the judge denied the defense's motion to exclude circumstantial evidence about where the knife came from. it's not clear how or if the judge ruled on the motions that were discussed in private. i reached out to jiménez's defense attorneys by email and phone today for their response. i have not yet heard back. according to this transcript from the hearing, defense attorney sam zanganeh asked the court to seal a portion of the transcript. the judge told him he could file a written motion explaining why he meets the legal criteria. it doesn't appear that was filed before i obtained the transcript. balwani is back in court on monday. all right. >> we're following it all. thank

eight points to end at 42,063. the nasdaq fell 65. the s&p slipped 11 points. nonalcoholic drinks may be fostering unhealthy habits in kids. that's according to some doctors, who are now calling for age restrictions on alcohol free drinks and mocktails. the experts cite studies in japan, taiwan and australia that show an increase in nonalcoholic drinking among youth. one of those studies also showed teens who tried zero alcohol drinks were 2.5 times more likely to switch to alcohol later on. manufacturers say their products are for adults 21 years and

twitter block, reddit, uber and dolby had headquarters there today. only dolby remains the lobby, which was once bustling with twitter employees, is now filled with a quiet desolation. now known as x, the company was once the second largest tenant in the mid market area, with more than 450,000ft■s of space. nobody misses their business more than ferit uyar, owner of market street gyro. >> of course, when they left, they hurt us as this street is always get worse. >> x's move adds to a neighborhood in crisis. many small businesses here have been forced to close because of rampant drug use and ongoing criminal activity. >> last two months, they broke my window. three times. they stolen my stuff inside. it's the sceneries go bad every day. go bad, you know. >> there is a lack of foot traffic in the area. offices that used to be full of workers

are now empty as remote work continues. this is hitting this particular neighborhood hard. >> solution. we need more people coming to work. office. this empty office. fill up. you know it's all empty. >> the mid market area has struggled for decades. when tech companies started filling the neighborhood, things improved. but when work from home became a new norm, many companies seemed hesitant to bring employees back in person. full time for fear of losing them. sales force recently announced that as of october first, its employees must be working on site 4 to 5 times a week. the hope is that other companies will follow their lead. >> i hope that it does. we know this new generation loves the work life balance. after the pandemic, so what we want to do is make sure that companies are doing their part for whatever days a week. we're hoping it's at least four. >> when it moved here in 2012,

twitter was seen by many in the city as the fortress that would economically strengthen the area for six years, the city gave them a tax break. $70 million in tax revenue were lost, and the revitalization plans never really took off as intended. last year, ikea opened in the area and this year saleh hall, a large food court, followed. still, the vacant spaces are proof that the neighborhood has yet to turn a corner. some mayoral candidates have proposed reopening market street to cars in order to help businesses. in early 2020, the downtown area became a car free corridor only public transportation and bicycles are currently allowed, but the san francisco municipal transportation agency reports that the number of bicycles in the city has dropped. in 2021, 4.7 million bicycles were counted throughout the city from a high of 10.8 million in 2019.

by using sensors embedded in the pavement, the agency can track bicycles. for example, there is one in front of the building that once housed x by 2:45 p.m, only 1005 bicycles and electric scooters on that day had gone through the mid market area. another plan that may help to revitalize the area is a recent law to convert empty office spaces into housing. the idea is to attract developers by offering tax incentives. >> that law was just signed and will have, we think, an impact at least adjacent to mid market in the downtown core in san francisco. >> but for many of the businesses who are trying to survive here, help can't come soon enough. is there a point where you just say, i can't do this anymore? >> i can't, of course i can't do anymore. that's why i say it's hard to survive. >> really hard. so the idea of bringing back cars on market street is a hotly contested issue. but we have to point out

that businesses on major streets and avenues in other cities, like fifth avenue in new york, michigan avenue in chicago, are thriving now. what do they have in common? they have bicycles. they have busses, and they have cars. now, i love market street. i love walking down market street. it has wide side sidewalks. i just see so much potential. i just don't understand why it hasn't really worked for years. for years before we even got here. >> yeah, i know, i mean really, but it does have great potential. yeah, it really does. >> thank you. liane. yeah >> early in-person voting opened today in three states minnesota, south dakota and virginia. we're about six weeks away from election day, according to the pew research center. in 2020, about a quarter of voters cast ballots in person before election day. in california, county election offices will start mailing out ballots on october 7th, a little more than just two weeks away. so be on

the lookout for that. early in-person voting begins october 26th. of course, election day is november 5th. >> vice president kamala harris is expected back in the bay area next week for a fundraiser. today the democrat's campaign trail included stops in georgia and wisconsin. she spoke in support of abortion rights in atlanta. if she chooses, she will talk with her pastor, her priest, her rabbi, her imam. >> but it should not be the government or donald trump telling her what to do with her body. >> there were no campaign events today for donald trump's team. he is scheduled to hold a rally in north carolina tomorrow. the secret service's acting director today admitted failure at the july trump rally, the first of two apparent assassination attempts against the former president. this comes as lawmakers are one step closer to securing more resources to bolster the security of presidents, vice presidents and candidates for those positions. reporter maribel gonzalez has more. >> as i've said, this was a failure on the part of the

millions of asthma patients, but a new study from stanford health suggests that some asthma inhalers are also taking a startling toll on the environment. doctor jose tirumalasetti says research is zeroing in on propellants known as hfcs or hydrofluorocarbons. they push the medicine out of the inhaler in measured doses, but can also escape into the atmosphere at alarming rates, which now we know. >> trap heat in the atmosphere thousands of times more powerfully than carbon dioxide and increase, you know, worsen global warming. >> she says some inhalers can emit as much greenhouse gas as the average car driven for 60 miles. to better understand those levels, doctor tirumalasetti and her colleagues used safety data and prescription records for inhalers in the u.s. they found traditional devices known as metered dose inhalers released the most hfcs, about 98% of the total, but also vary widely from
